장래의 퇴직급여채권의 재산분할

Besides real estates, deposits and stocks, pension rights are employee's one of the most valuable property. As life span increases, the significance of pension rights in marital property becomes even more valuable. For this reason the need of division of pension rights in the divorce practice is increasing. The Supreme Court has ruled that a pension right is not divisible if an employee is still working at divorce, because of many contingencies and difficulty of the determination of present value of pension right. However, considering the purpose of property division, equal division of all marital properties those built up by the cooperation of couples, pension right should be regarded as one of the most valuable property to be divided, despite its contingencies, difficulty in the determination of its exact value and the statutes providing that pension right cannot be assigned or attached. The Supreme Court decision (2013mu2250) has changed its opinion and ruled that future pension right is divisible at divorce. It is significant decision that moves a step forward to equal property division. However, since the Supreme Court leaves what portion of pension right is divisible and how it should be divided to lower court trials' discretion, many law suitcases about this issue need to be made. Furthermore, to solve this problem ultimately, legislation of division of pension rights should be considered. 근로자에게 중요한 재산은 부동산, 예금, 증권 등을 제외하면 퇴직급여채권일 것이다. 특히 인간의 수명이 연장되면서 퇴직급여가 부부 재산의 중요한 부분을 차지하게 되었다. 이에 따라 부부가 이혼하는 경우 퇴직급여채권이 재산분할의 대상에 포함되어야 하는 당위성은 점점 커져가고 있다. 이전까지 대법원은 변동가능성, 가치평가의 어려움 등의 이유로 퇴직일과 수령할 퇴직금이 확정되었다는 등의 특별한 사정이 없다면, 장래 퇴직급여채권에 대한 재산분할 대상성을 명시적으로 인정하지 아니하고, 장래 퇴직금을 받을 개연성이 있다는 사정은 분할의 액수와 방법을 정하는 데 필요한 "기타 사정"으로 참작되면 족하다고 일관되게 판시하여 왔다. “혼인 중 취득한 재산의 공평한 청산”이라는 재산분할의 취지에 비추어 볼 때, 장래 퇴직급여채권을 분할하는 것은 가능할 뿐 아니라, 필요하다. 불확정성 및 변동가능성, 양도금지 조항과의 저촉 등 여러 문제점은 장래 퇴직급여채권을 재산분할 대상에서 제외할 사유가 되지 못하고, 재산분할 방법의 문제가 될 뿐이다. 결국, 퇴직급여채권의 재산분할에 관한 문제는 합리적인 재산분할의 액수와 방법 및 재산분할비율을 산출해 내는 문제로 귀결된다고 할 것이다. 대상 판결은 기존의 견해를 변경하여 장래 퇴직급여채권도 재산분할 대상이 될 수 있음을 명시적으로 인정함으로써 공평한 재산분할에 한 걸음 더 나아간 판결이라고 평가할 수 있다. 그러나 대상 판결은 퇴직급여채권에 있어서 재산분할의 방법과 재산분할 비율 등에 있어서 구체적인 판단기준은 사실심 법원의 재량에 맡기고 있어 이에 대한 앞으로 판례의 집적과 논의가 필요할 것으로 보인다. 또한, 퇴직급여채권의 재산분할 문제는 법원의 해석으로 해결하기에는 여러 한계점이 있으므로 결국, 궁극적으로는 퇴직급여채권의 분할에 관한 입법을 제정함으로써 해결되어야 할 것이다.

배달음식에 대한 지각된 위험, 혜택이 구매의도에 미치는 영향

Along with the rapid growth of the food service delivery market, the food delivery market has been further developed with the emergence of delivery apps that can be accessed easily and quickly by technology development of the smartphone. The purpose of this study was to analyze the effects of perceived risk and perceived benefits on purchase intention of delivery food on customers of the Seoul and Gyeonggi-do area. Through this, the purpose of this study is to establish a suitable marketing strategy for delivery food companies in the highly competitive food delivery market, and to draw up a plan for further development. The results of this study are summarized as follows: First, hypothesis 1 shows that 'economic risk' and 'product risk' among 'perceived risk' factor of delivery food have a negative effect (-) on 'purchase intention' and social risk and delivery risk did not affect 'purchase intention'. Hypothesis 2 shows that 'economic benefit' and 'delivery benefit' among 'perceived benefit' factor of delivery food have a positive effect (+) on 'purchase intention', and time saving benefits did not affect the 'purchase intention'. In order to increase the satisfaction and loyalty of the customers of the delivery food companies that are positioned as a new power in the food service market, besides the advantages of convenience of delivery orders, it is also necessary to provide confidence in hygiene and cleanliness of delivery food and delivery restaurants, and it should be differentiated from homologous delivery food. Therefore, this study intends to present the direction that should be pursued in the highly competitive food delivery industry in the future. 외식 배달시장의 급성장과 더불어 스마트폰의 기술 개발로 쉽고 빠르게 접근할 수 있는 배달앱이등장하면서 음식 배달시장은 더욱 발전하게 되었다. 본 연구는 배달음식에 대한 지각된 위험, 지각된혜택이 구매의도에 어떠한 영향을 미치는지 분석하기 위해 서울・경기지역 고객들을 대상으로 조사되었다. 이를 통하여 경쟁이 심화된 배달음식시장에서 배달음식 업체의 적합한 마케팅 전략을 수립하고 향 후 더 발전되기 위한 방안을 마련하는데 그 목적이 있다. 본 연구의 결과를 요약하면 첫째, 가설 1에서 배달음식의 ‘지각된 위험’ 요인 중 ‘경제적 위험’과 ‘제품위험’은 ‘구매의도’에 부(-)의 영향을 미치는 것으로 나타났으며, 사회적 위험, 배달위험은 ‘구매의도’에 영향을 미치지 않는 것으로 나타났다. 가설 2에서 배달음식의 ‘지각된 혜택’ 요인 중 ‘경제적 혜택’과 ‘배달혜택’은 ‘구매의도’에 정(+)의 영향을 미치는 것으로 나타났으며, 시간절약혜택은 ‘구매의도’에 영향을 미치지 않는 것으로 나타났다. 따라서 본 연구를 통해 외식시장의 새로운 강자로 자리매김하고 있는 배달음식 업체의 소비자의 만족도 및 충성도를 높이기 위해서는 배달주문의 편리함이라는 장점 외에도 배달음식 및 배달음식점의 위생과 청결에 대한 신뢰감을 줄 수 있어야하며 동종 배달음식과의 차별성이 있어야 할 것으로 사료되어, 향후 배달음식업의 치열한 경쟁 속에서 나아가야할 방향을 제시하고자 한다.

ESG 경영의 환경요소 사례 분석을 통해 도출된 실효적 정책

현대 사회의 급격한 발전에 따라 인류는 이전에 경험해 보지 못한 환경오염과 기후변화에 직면하게 되었다. 이에 대응하여 현대 자본주의 사회의 핵심적인 조직인 기업에 대한 사회적 책임이 높아지고 있다. ESG는 환경, 사회, 지배구조를 뜻하며, 현대 경영에 있어 기업을 평가하는 새로운 요소이다. ESG 경영은 이 세 가지 비재무적 요소를 중시하는 기업 경영이며, 최근 기업 경영 뿐 만 아니라 투자 유치에 있어서도 ESG 가 매우 중시되고 있다. 기업들은 이에 대비하기 위해 내부 제도의 개선과 시스템 구축을 도모하기 위한 지속가능경영보고서를 지속적으로 공개하고 있다. ESG경영에 대한 사회적인 관심이 증가하면서 실질적인 경영 실천 사례가 늘어나고 있는 것이다. 하지만 이러한 관심과 비례하게 친환경적이지 않은 제품을 친환경 제품이라 하거나, 자사의 탄소 배출량 감소 폭을 과장하여 홍보하는 등 가짜 친환경 마케팅이라 할 수 있는 그린워싱 사례도 발견되고 있다. 이에 본 총설에서는 ESG경영과 관련 기준을 제공하는 국외의 평가기관에 대해 알아보고 ESG 경영에 있어 환경적 요소의 사례를 조사하였다. 나아가 기업의 지속가능한 경영을 구축하기 위한 국내의 통합된 평가지표 활용방안에 대해 제시하였다. The modern society is developing rapidly, and humanity is facing unprecedented environmental pollution, global warming, climate change and various environmental problems. As a result, companies, a key social organization in modern capitalist society, are increasingly taking environmental and social responsibility. ESG management is an enterprise management that emphasizes non-financial factors (environment, society and corporate government). Recently, ESG considerations have become increasingly important in corporate management and investment. In preparation for this situation, companies are continuously releasing sustainability report to improve internal systems and build systems. As society is paying keen attention to ESG management, the number of actual management cases is increasing. However, in proportion to this interest, cases of greenwashing, which can be called fake eco-friendly marketing, have also been discovered, such as eco-friendly products or exaggerated carbon emission reductions. Accordingly, the comprehensive review examined cases of environmental factors in ESG management for overseas evaluation agencies that provide ESG management and related standards. In addition, a plan was proposed to establish sustainable corporate management using comprehensive domestic evaluation criteria.

인터넷 방송 플랫폼에서의 다크패턴 사례에 대한 사용자 연구 -라이브 방송 중심으로-

The recent advancement of the Internet accelerated the ‘Independent media’ industry and the internet broadcasting platform market is growing steadily over the world. In response, companies are widely using ‘dark pattern design’, which intentionally induces participation and immersion by transforming services in various ways to secure more viewers and make them invest more money and time than they expected. However, the research on dark pattern design is at an initial stage with insufficient research. Therefore, this study aims to find out the user’s perception according to different types of dark patterns in the Internet broadcasting platform. Cases were analyzed mainly on ‘YouTube’, ‘Twitch’, and ‘Afreeca TV’, the most representative commercialized Internet broadcasting platforms and selected 8 different types of dark patterns seen in live broadcasting through prior literature. In order to measure the degree of dependent variable on how people feel on each type, the 10 different types of video scenario prototypes were made for experiment. Then, one-way ANOVA was used to verify the research problem. This study focuses on the user perception according to different types of dark patterns shown in internet broadcasting platforms which are not dealt with much in current domestic research. In addition, the statistical differences in user perception and emotion on different types of dark patterns are found through the experiment and derived significant insights through additional interviews. It is hoped that this study will contribute to the establishment of a healthier internet broadcasting platform service, and it is expected to be used as foundation for future dark pattern design research.

Detection of Bartonella species from cattle ticks in South Korea

During 2010~2011, 877 ticks (Hemaphysalis longicornis and Ixodes spp.) were collected from cattle in South Korea. According to 16S RNA PCR assay for Bartonella species, 9 of them showed specific 356-bp band products. A phylogenetic analysis based on the 16S RNA showed two clusters of Bartonella strains. One cluster included four isolates that were quite similar to those previously registered on Genbank from various sources, whereas the other was highly related to the reference strain from human. It suggested that cattle ticks harbouring various Bartonella spp. might circulate among human, animals,and farm surroundings. Therefore, as ticks are main vectors that transfer pathogens affecting human beings and domestic cattle, further studies are required for bartonellosis in cattle.
