창작자와 AI운영자 간의 긴장 영역의 법적 규율에서의 투명성

디지털 전환 시대에서 정보는 그 영역 고유의 성질이 희석되는 현상을 겪게 된다. 정보는 국가의 자산으로 이를 배분하는 것은 입법자의 결단에 따른다. 특히 저작물을 학습하여 새로운 표현물을 생성하는 인공지능에 있어서는 입력단계와 출력단계에서 저작권 침해가 있다. 정보는 성격에 따라서 개별 영역으로 고유한 법리를 가지고 있으며, 이러한 정보를 이용하기 위해서는 권리소유자의 동의가 필요하다. 그러나 빅데이터를 기반으로 한 인공지능 기술은 개별 동의를 구하는 제도와 정합적이지 않다. 특히 나의 정보가 이용되고 있는지, 어떻게 활용하는가에 대한 불투명성은 권리구제를 불가능하게 만든다. 그러므로 본 논문은 이러한 현상을 극복하기 위한 규율의 핵심원리로서 투명성 원칙을 그 대상으로 삼았다. 사적 영역의 권리간의 기본권 최적화의 실현과 획일적인 인공지능의 특성으로 인한 수단으로서 적법절차의 원리를 투명성 원칙을 통하여 구현할 수 있을 것으로 기대한다.

This paper examines the 'legitimate interests' of the opt-out method as a legitimacy requirement of the Personal Information Protection Act from the perspective of expanding the use of personal information. With the development of ICT technology, consent as a legitimacy requirement has certain limitations, and processing personal information with consent within the scope of a specific purpose in the processing of big data by artificial intelligence is equivalent to giving up the de facto benefits. After obtaining the legitimacy requirements of consent and legitimate interest, and summarizing the rights of each data subject, it can be seen that 'legitimate interest' is superior as a requirement of legitimacy from the perspective of the data processor, and the scope of personal information processing is wider by not limiting the scope of purpose compared to consent, and as an accompanying requirement, the EU stipulates that the data processing can be reasonably expected based on the relationship between the data processor and the customer. It also recognizes technical safeguards as an important sentencing factor by allowing additional safeguards to be taken into account in the sentencing assessment to balance the potential interests of the data controller and data subject. 'Legitimate interest' has equal status with other legitimacy requirements and is relatively flexible, but requires a balancing of the interests of the data controller and data subject. Clarifying the penal component of the penalty test by specifying the penalty that is being requested can help ensure that it is a preferred option for data controllers over consent. This would serve to crystallize an unstructured 'legitimate interest' that is not limited to the flexibility of the sentencing regulation, which also allows the relationship between the parties to be fluid.
외국인 부동산 보유 관련 법적 쟁점 -규제할 권리와 간접수용을 중심으로-

This paper examined the payment waiver or indirect expropriation requirements of the land transaction license regime as a rule for foreign real estate investors. The next step was to examine the differentiation of rights relief from nationals when indirect expropriation is recognized. Although indirect expropriation is a necessary system to protect foreign investors, it is in tension with sovereign regulation due to its unclear scope of application. It is necessary to analyze the requirements for payment exemption through the lens of non-discriminatory regulation for public interest purposes to provide guidance for the implementation of legitimate administrative regulations. In addition, the discussion on the differentiation between nationals and foreigners in terms of remedies pointed out the problem of expropriation-like infringement and sought alternatives to it. Ultimately, the protection of foreign investors' rights through the recognition of indirect expropriation, which has an unclear scope of protection, exceeds the scope of property rights guaranteed by the Korean Constitution, and it is necessary to reconcile the problem of legal conflicts in advance by stipulating in the annexes that the scope of indirect expropriation is not different from the level of protection under domestic law when concluding treaties such as FTAs in the first place, and this should be applied to future treaties between countries.

A 63-year-old man was scheduled for T12-S1 posterolateral spinal fusion surgery. The patient's vital signs were stable and there were no specific laboratory findings except for high triglycerides. In addition, echocardiography showed mild left ventricular hypertrophy, but normal left ventricular function, no regional wall abnormal contractility and normal ejection fraction. During the operation, a warming blanket and fluid warmer were applied. Near the end of the operation, the blood pressure waveform from the radial artery and pulse oxymeter became flat. Cardiotonics were administered and an infusion of intraoperative salvage of blood was administered using the cell-saver. However, the hemodynamic status of the patient deteriorated to severe hypotension, with ventricular fibrillation. The patient's vital signs with temperature became stabilized after warming for 4 hours using active warming methods, including a forced air warming blanket and warming of the fluids and blood components with a rapid infusion system.
Technical Aspects of Combined Heart-Lung Transplantation

Although organ transplants have become quite common, combined heart-lung transplantation (CHLTx) is unfamiliar at most institutions. While the remarkable rate of development in treatment options, such as drugs and mechanical circulatory support, have reduced the need for CHLTx, it remains the sole treatment option for a subset of patients with end-stage cardiopulmonary failure. For many cardiothoracic surgeons, CHLTx is not technically new or difficult, but it does pose challenges due to its low frequency and relative complexity. Thus, this review aims to describe the CHLTx technique in technical detail using the existing literature.
Surgical Outcomes in Small Cell Lung Cancer

Background: The experience of a single-institution regarding surgery for small cell lung cancer (SCLC) was reviewed to evaluate the surgical outcomes and prognoses. Materials and Methods: From July 1990 to December 2009, thirty-four patients (28 male) underwent major pulmonary resection and lymph node dissection for SCLC. Lobectomy was performed in 24 patients, pneumonectomy in eight, bilobectomy in one, and segmentectomy in one. Surgical complications, mortality, the disease-free survival (DFS) rate, and the overall survival rate were analyzed retrospectively. Results: The median follow-up period was 26 months (range, 4 to 241 months), and there was one surgical mortality (2.9%). Six patients (17.6%) experienced recurrence, all of which were systemic. Eight patients died during follow-up; four died of disease progression and the other four died of pneumonia or of another non-cancerous cause. The three-year DFS rate was 79.2±2.6% and the overall survival rate was 66.4±10.5%. Recurrence or death was significantly prevalent in the patients with lymph node metastasis (p=0.001) as well as in those who did not undergo adjuvant chemotherapy (p=0.008). The three-year survival rate was significantly greater in the patients with pathologic stage I/II cancer than in those with stage III cancer (84% vs. 13%, p=0.001). Conclusion: Major pulmonary resection for small cell lung cancer is feasible in selected patients. Patients with pathologic stage I or II disease showed an excellent survival rate after surgery and adjuvant treatment. Prospective randomized studies will be needed to define the role of surgery in early-stage small cell lung cancer.
Extracorporeal Membrane Oxygenation Support in a Patient with Status Asthmaticus

Status asthmaticus is a rare, fatal condition, especially in children. Sometimes respiratory support is insufficient with a mechanical ventilator or medical therapy for patients with status asthmaticus. In such situations, early extracorporeal membrane oxygenation application is a useful method for treating refractory respiratory failure. We report on a case of a six-year-old, male child who underwent venovenous extracorporeal membrane oxygenation support for refractory status asthmaticus.
유치권이 도시개발사업 지연에 영향을 미치는 문제점 유형화 연구: 판례분석을 중심으로

The study conducted a study on the need for systematic improvements in urban and real estate sectors, focusing on the need for urban development projects to be stalled and neglected in the context of urban development. Based on the analysis methods of the Supreme Court, the analysis analyzed how the lien is problematic, and based on the analysis results of the expert case, the expert analyzed the systematic improvement of the urban spatial environment by presenting the major problems that lead to delays in urban development projects. Seven factors were cited as the main problems of determining the validity of false issues, the problems of the status quo, the status of the assessment, the question of the status of a lien, the issue of the rights of the lien, the question of inadequacy of the lien, the effectiveness of the lien on lien, the resolution of the lien and the establishment of a lien on lien, and the establishment of a lien on the lien. According to the research findings, the amendment to the Real Estate Registration Act and the establishment of a specialized court were suggested. 본 연구는 유치권제도로 인해 도시개발 사업이 중단되고 방치되는 상황에 초점을 두고 도시 및 부동산 분야에서 해결해야 할 큰 과제로 제도적 개선이 필요하다는 측면에서 연구를 진행하였다. 연구방법으로 대법원 판례분석을 통해 어떠한 형태로 유치권이 문제가 되고 있는지 분석하였으며, 판례분석결과를 기반으로 전문가 FGI를 거쳐 유치권이 도시개발사업 지연을 유발하는 주요 문제점을 유형화하여 제시함으로서 도시공간의 효율적 이용을 위한 제도적 개선방안을 모색해 보았다. 연구결과 허위, 과장 유치권 문제, 현황조사와 유치목적물평가 문제, 유치권공시와 점유의 불완전성 문제, 유치권의 인수주의 문제, 유치권에 기한 경매청구권의 실효성 문제, 유치권자의 대항력 문제, 유치권의 성립요건인 견련성 문제 등 7가지 요인을 주요 문제점으로 제시하였다. 연구결과에 따른 시사점으로는 부동산 등기법 개정과 전문법원 신설을 제안하였다.
부동산 개발사업 지연에 영향을 미치는 유치권 관련 문제점들의 인과구조 분석

This study intends to improve the problem of conflict between owners who have not participated in the study and the reconstruction promotion committee in the consent form to meet the requirement of the member 's consent of the divisional owners in the maintenance area necessary for approval of the reconstruction union establishment for the housing reconstruction maintenance project. The Urban and Residential Environment Improvement Act provides an exception to the scope of the housing reconstruction project in Article 41 of the same Act for the improvement of this problem, but the conflict between the classification owners and the reconstruction promotion committee is deepening. In this study, the theoretical foundation of land division related system is constituted through theoretical review and reference literature, and case analysis shows problems in land division request. The causes of the conflicts are classified into six types of conflicts as the basic data of the reconstruction business districts in Seoul, Gyeonggi - do and Incheon, and analyzed the problems in negotiations for conflict resolution. In the case of unconfirmed land acquisition, if the union is authorized to establish a union, the conflicts between the two parties are producing another conflict. If the beginning of the conflict is a disagreement between the two parties before the union is established, the unilateral land division lawsuit is causing new conflicts. The best of conflict resolution was the amicable agreement of both sides. 본 연구는 유치권으로 발생되는 여러 문제점 중 유치권으로 인해 부동산 개발사업의 지연과 도시공간의 효율적 이용을 저해된다는 점에 초점을 두고 여러 문제점들 간 상호 인과관계를 DEMATEL 분석을 활용해 어느 문제점이 원인적 요인이 되는지 또 원인적 요인에 영향을 받아 결과적 성격을 갖는지를 살펴보았다. DEMATEL 분석과정을 통해 직접인과행렬, 표준화된 직접인과행렬, 종합인과행렬 등을 각각 구한 뒤 종합인과행렬 인과점수에 기반해 영향도(D), 피영향도(R), D+R(중심도), D-R(원인자)를 도출하였다. 분석결과 유치권으로 발생되는 문제점으로 중요도는 유치권공시와 점유의 불완전성(D3), 허위‧과장 유치권 문제(D1), 유치권에 기한 경매청구권의 실효성 문제(D5), 유치권의 성립요건인 견련성 문제(D7), 현황조사와 유치목적물 평가 문제(D2), 유치권의 인수주의 문제(D4), 유치권자의 대항력 문제(D6) 순으로 인과점수가 나타났다. 이 중 부동산 개발사업의 지연 및 도시공간의 효율적 이용에 가장 원인이 되는 유치권 관련 문제점 요인은 유치권공시와 점유의 불완전성(D3)으로 나타났으며, 허위‧과장 유치권 문제(D1)가 다른 요인들에게 영향을 받는 결과적 성격이 강한 지연요인으로 분석되었다.
