제주자치경찰의 성과검토와 자치경찰제의 정착방안 연구

우리나라의 자치경찰의 도입은 역대 정부마다 주요 중앙정부의 권한과 기능 재 분배의 분권과제로 논의되어 실현이 될 수 있겠다는 희망을 가지기에 충분하였다. 이와 같은 자치경찰제도 도입이라는 주요 분권과제는 노무현정부 시기인 2006년 7월 제주특별자치도에서 자치경찰단의 창설로 전국 확대시행이 곧 시작 되는듯 하였다. 그러나 2016년 현재까지 지방자치발전위원회에서 지방자치발전 종합계획 과제로 주민중심 생활자치 및 근린자치 실현을 위해 자치경찰제 도입을 논의하고 있으나 그 성과는 과거 정부와 같이 한 발짝도 더 나아가지 못하고 있다. 자치경찰제 시행은 중앙정부의 집중되어 있는 경찰권력의 남용을 피하고 권력 구조의 수평적 실현을 통해 주민의 복리증진을 의의로 하고 있다. 이는 분권화 추 진으로 지방자치의 완성을 의미하는 것이다. 그럼에도 불구하고 우리의 자치경찰 제는 전국 확대시행에 대한 개략적인 윤곽도 제시하지 못하고 있는 실정을 본 연 구에서 고찰하면서 자치경찰제 시행 지연이 지방자치에 미치는 영향과 전국 유일 하게 자치단체에서 운영중인 제주자치경찰의 실태를 파악하여 향후 자치경찰제도 시행을 위한 합리적 정착방안을 제시하고자 한다. Due to discussion over major central government’s authority and decentralization of function redistribution by former governments, realization of introduction of autonomous police to Republic of Korea has always seemed hopeful. With the foundation of autonomous police agency in Jeju Island in 2006 July by No-Muhyun Government, nationwide enforcement of autonomous police system seemed highly likely. However, until the present times, there have only been discussions of introduction of autonomous police system for resident-centralized autonomous living and autonomous neighborhood realization as a part of overall provincial self-government development plan in provincial self-government development committee with no visible outcome. Enforcement of autonomous police system proposes to extend resident’s welfare by lessening the abuse of police authority which has been centralized on central government and realizing horizontal power structure. This means completion of provincial self-government through decentralization. Considering the research which observed the current situation of government’s inability to suggest the outline of nationwide enforcement of autonomous police system, this research would focus on the effect the postponement of autonomous policy system has on the provincial self-government and suggest the reasonable settlement scheme of autonomous police system enforcement henceforth by comprehending the reality of Jeju autonomous police agency, the only police force ran by autonomous body.

대한민국 자치경찰제의 현재 그리고 미래

자치경찰제는 주민의 안전과 질서유지 등 경찰 본래의 기능을 지방자치단체차 원에서 해결하게 함으로써, 치안행정의 지방분권화를 통해 지방자치를 실현할 수 있다는 점에서 그 의의가 크다. 이러한 관점에서 국민의 정부와 참여정부에서는 지방분권과 민주성에 충실하면서 실현가능한 자치경찰제 실시를 위해 자치경찰제 방안을 마련하는 등 자치경찰제 도입을 위하여 지속적으로 노력하여왔다. 이러한 노력의 결실로 지난 2006년 제주특별자치도에 자치경찰제가 도입되었으나 현재까 지 전면적인 자치경찰의 실시는 답보상태에 머물러 있다. 이러한 배경에는 무엇보 다 자치경찰의 사무, 조직, 인사, 재정 등 다양한 쟁점사항에 대한 합의에 이르지 못하고 있기 때문이다. 이중에서 특히 자치경찰의 사무는 국가경찰과의 합리적인 배분을 전제로 하고 있어 자치경찰제의 도입을 위해 해결해야할 우선적인 과제라 고 할 수 있다. 이에 본 연구에서는 문헌고찰을 통해 자치경찰제도의 의의를 살펴보고 제주자치경찰제의 현황과 한계를 고찰한 다음 지방자치발전을 위한 자치경 찰제의 과제를 살펴보았으며, 그 결과 첫째, 시·도 경찰위원회를 합의제 행정기관 으로 신설하여 시·도 경찰청장을 지휘·감독하며, 자치경찰에 대한 인사권, 재정권, 지역치안종합계획 수립, 주요 자치경찰 정책결정 등을 할 수 있도록 하여야 한다. 둘째, 시·도 경찰위원회 위원장을 지역주민이 직접 선거를 통해 선출하여 자치경 찰에 대한 민주적 정당성을 확고히 하고, 주민참여가 실질적으로 보장되어 자치경 찰의 민주성과 정치적 중립성, 책임성이 확보되도록 하여야 한다. 셋째, 주민복리 사무로서 치안복지 개념을 명확히 하고, 자치경찰사무와 국가경찰사무를 명확히 규정하여 자치경찰의 책임성을 보장하여야 하고, 자치경찰에게 지역민생치안에 대 한 범죄수사권은 국가경찰의 간섭 없이 스스로 할 수 있도록 하여야 하며, 자치경 찰제 도입에 따른 재원을 자치경찰 교부세 신설, 국세와 지방세 세수의 합리적 배 분이 되도록 세법 개정, 국가보조금등을 통하여 확보되도록 자치경찰과 지방자치 가 상생 하여야 한다는 결론을 얻었다. The autonomous police system is meaningful in that it can achieve local autonomy through decentralization of security administration by allowing local governments to solve their original functions, such as the safety of residents and maintaining order. From this point of view, the people's government and participatory governments have continuously made efforts to introduce the local police system, including preparing measures to implement the autonomous police system, which is feasible while adhering to decentralization and democracy.As a result of these efforts, the local police system was introduced in the Jeju Special Self-governing Province in 2006, but the overall practice of the local police has remained stalled so far. Against this backdrop, the government has failed to reach an agreement on various issues, including the office, organization, personnel and finance of the local police. Among them, the duty of local police in particular is based on a reasonable allocation with the national police, which is a priority to be solved in order to introduce the local police system.In this study, we looked at the significance of the local police system and the current situation and limitations of the Jeju autonomous police system, and as a result, the city and provincial police committee should be established as a consensual administrative institution to direct and supervise the head of the municipal police agency, establish a comprehensive plan for personnel management, financial rights, and local police decisions.Second, the heads of the municipal and provincial police committees should be elected by the local residents through direct elections to ensure democratic legitimacy and ensure the residents' participation in the police force to ensure democracy, political neutrality and accountability. Third, as a community welfare office, the concept of security welfare should be clarified, the local police office and the national police service should be clearly defined to ensure the responsibility of the local police, and the police should be able to investigate the local residents' livelihood without interference from the national police, the establishment of a local police department tax, and rational distribution of national and local tax revenue through the revision of the National Tax Service.

효율적인 자치경찰제 운영을 위한 제언

2018년 검·경수사권 조정안에 관하여 정부의 입장이 발표되면서 수사권과 관련하여 검찰과 경찰의 변화에 대한 논의가 활기를 띠고 있다. 정부는 수사권조정안에 자치경찰제 운영에 관한 내용을 함께 수록하고 있다. 우리나라 경찰체제의 역사적인 흐름을 살펴보면, 대체로 대륙법체제의 영향을 받아 국가경찰제가 실시되었다. 그러나 2006년 제주도를 중심으로 자치도의 특성을 고려하여 자치경찰제를 운영하고 있다. 역대 정부들에서 지방분권화와 함께 자치경찰제에 대한 논의는 계속되었으나, 제도의 도입은 쉽지 않았다. 현재까지 중앙정부에 집중되었던 경찰행정의 권한과 권력을 지방자치단체에 분산시킴으로서 지방자치단체와 지역주민의 입장을 최대한 반영하고 지역사회에 실정에 맞는 치안서비스와 대민서비스를 제공하고자 자치경찰제 운영을 예고하고 있다. 이에 경찰권과 시민권의 대립관계가 아닌 영미법계 경찰제의 장점으로 경찰권과 시민권은 동반자 관계로서 시민과 밀접한 관계를 유지하므로 명령과 강제가 아닌 치안·대민서비스의 역할을 강조하고 있다. 2019년 현재 이미 시행중인 제주도를 비롯하여 서울시와 세종시를 중심으로 몇 개의 도시에서 자치경찰제의 운영을 시작하였고 2020년에는 전국적으로 시행하기 위한 준비를 하고 있다. 문제는 자치경찰제 운영에 대한 몇 가지 해결해야 할 과제를 안고 있다. 효율적인 자치경찰제 운영을 위해서는 자치경찰제의 특성에 맞는 신임경찰교육체제 구성에 관한 문제, 자치경찰제 도입단위의 기준, 국가경찰과 자치경찰의 사무분배의 범위, 자치경찰제 운영을 위한 재정부담 문제, 수사권 부여와 관련되어 국가경찰과 자치경찰의 혼재되어 있는 사건에 대한 책임소재, 지역토착세력에 의한 정치적 중립성의 문제점 등을 해결하여야 할 것이다. With the announcement of the government 's position on the mediation plan for the investigation authority of the prosecution and police in 2018, with regard to investigation authority, discussions about changes in the prosecution and the police are lively. The government has included a report on the operation of the autonomous police system in the mediation plan for the investigation authority. When looking for the historical flow of the police system in Korea, the National Police System was implemented under the influence of the Continental Law System. However, in 2006, the autonomous police system was operated in Jeju island with consideration of its regional characteristics. In previous governments, with the decentralization system, the discussion on the autonomous police system continued, but the introduction of the system was not easy. By distributing the authority and power of the police administration, which has been concentrated in the central government so far, to reflect the position of local governments and local residents as much as possible, and to provide community service and public service appropriate to the local community, the operation of autonomous police system is predicted. Therefore, it is not the opposition between police rights and citizenship, but the advantage of the Anglo-American law police system. The police rights and citizenship are partnership and maintains close relationship with citizens, emphasizing the role of security and public service rather than command and enforcement. As of 2019, the autonomous police system has been in operation in several cities, mainly in Seoul and Sejong City, including Jeju Island, which is already in operation. In 2020, it is preparing to be implemented nationwide. The problem is that there are some issues to be addressed regarding the operation of the autonomous police system. In order to operate an efficient autonomous police system, below issues will be solved. such as the issue of the construction of the new police education system that matches the characteristics of the autonomous police system, standard of autonomous police system introduction unit, scope of office work distribution of national police and autonomous police, financial burden for the administration of autonomous police system, in connection with the granting of investigation authority, the responsibility of the national police and the autonomous police, and the problem of political neutrality by local indigenous forces

문재인 정부의 자치경찰제 도입 방향과 시범실시

문재인 정부는 2017년 5월 10일 출범하면서 100대 국정과제를 실현하겠다고 밝혔 다. 문재인 정부가 밝힌 100대 국정과제 중 자치경찰제 도입을 13번째로 과제로 제시 하였다. 이에 따라 대통령 소속 자치분권위원회 자치경찰특별위원회는 각계전문가들 로 위원을 구성하고 오랜 동안 연구를 통해 문재인 정부의 바람직한 자치경찰제 모델 안을 제시하였다. 이는 많은 전문가들로부터 기존의 모델들보다 더 한층 개선된 모델 이라는 평가를 받기도 했다. 더불어 민주당의 홍익표 의원으로부터 전국적인 자치경 찰제를 도입하기 위한 법적 토대로 경찰법 전부개정안이 국회에 의원입법으로 제시 되었다. 하지만 이 법은 검경간의 수사권 조정안과 맞물러 있고 여야 간의 합의를 이 루지 못해 2019년 말까지 통과되지 못했다. 특히 문재인 정부에서 도입하게 될 자치 경찰제는 검검 간 수사권 조정과 밀접하게 연계되어 있기 때문에 첫째, 법이 통과되 어야 하고, 둘째, 시범지역이 선정된 후 시범실시가 있어야 한다. 그리고 셋째, 법에 따라 17개 광역시도에 자치경찰조직이 만들어져야 하며 국가경찰로부터 3차례에 걸 쳐 43,000여명의 인력이 이관되는 절차들이 남아 있다. 본 연구에서는 문재인 정부에서 심혈을 기울이고 있는 자치경찰제 도입 모델, 법적 토대 마련, 조직과 인력 이관, 선험적 자치경찰제 경험을 가지고 있는 제주자치경찰제 등을 중심으로 준비해 나가 야 하는 과제들에 대해 살펴보았다. The Moon Jae-in administration announced on May 10, 2017 that it will realize the top 100 national agendas. Introducing the autonomous police system as the 13th task among the 100 national agendas identified by the Moon Jae-in government. Accordingly, the Presidential Committee on Autonomous Police in the Delegation of Autonomous Delegation composed of members from all walks of life, and through a long study, proposed a desirable model of the autonomous police system of the Moon Jae-in government. It has been evaluated by many experts as a more advanced model than the existing models. In addition, the Law on Amendment of the National Police Law was proposed to the National Assembly as a legislative basis for the introduction of a national autonomous police system from Democratic Party lawmaker Hong, Ik-Pyo. However, the law was not passed until the end of 2019 because it was coupled with a prosecution coordination proposal and failed to reach an agreement between the ruling and opposition parties. In particular, the autonomous police system, which will be introduced by the Moon Jae-in government, must be passed because it is closely linked to the coordination of investigation rights between prosecutors. In addition, priority areas should be selected. According to the law, autonomous police organizations must be established in 17 metropolitan cities, and there are procedures for transferring 43,000 manpower from the national police three times. This study examined the tasks that should be prepared centering on the autonomous police system introduced by the Moon Jae-in government, preparation of legal foundation, transfer of organization and manpower, and Jeju autonomous police system with a priori autonomous police system.

자치경찰제에 대한 일선 국가경찰관들의 인식 : 서울지역 경찰관을 중심으로

이 연구는 자치경찰제에 대한 논의와 조속한 도입의 필요성을 재차 강조함으로써 관련 연구자들의 지속적인 논의를 유도하고자 하였다. 또한 이를 토대로 경찰활동의 직접적 당사자이자 치안활동의 최일선에 자리 잡고 있는 현직 경찰관들의 인식태도를 분석하여 정책적 대안을 제시하고자 하였다. 조사결과, 일선경찰관들은 자치경찰제의 도입에 대하여 전반적으로 긍정적인 인식태도를 보이는 것으로 평가되었다. 세부 도입방안과 관련해서는 광역자치단체를 도입단위로 하여 독립기관 형태로 설치하는 것이 다수의 의견을 차지하여 정부안과는 배치되는 결과를 보였다. 또한 인사관리 방안으로 자치경찰의 신분은 계급에 관계 없이 국가공무원으로 임용해야 하며, 신규임용은 국가경찰에서 먼저 선발한 후 자치경찰로 전직시키고, 교육훈련 역시 국가경찰 기관에서 담당하는 것이 타당하다는 견해가 가장 큰 비중을 차지하였다. 한편, 자치경찰제의 기대효과로는 범죄 대응능력의 강화, 경찰의 민주성과 법치주의 향상 등으로 제시되고 있다. 반면에 자치경찰제 시행시의 문제점으로는 국가경찰과 자치경찰간의 협력 및 공조수사의 부재로 나타날 수 있는 광역수사의 어려움, 정치적 중립성 훼손, 막대한 운용비용의 부담 문제가 심각할 것으로 인식하고 있었다. 그러므로 향후 자치경찰제의 시행에 있어서는 도입범위 및 세부 도입방안과 관련된 법률안의 수정이 필요할 것으로 보이며, 현재 예측되고 있는 다양한 문제점들에 대한 보완책이 제시되어야 할 것이다. 특히, 현재까지 이루어지고 있는 자치경찰제에 관한 논의는 일반 시민과 현직 경찰관 등 제도의 시행에 따라 가장 직접적 영향을 받게 되는 중요 당사자가 배제된 채 소수 정책결정권자의 정치적 논리나 소수의 연구자들에 이루어지고 있다. 따라서 향후 자치경찰제의 논의에 있어서는 보다 다양한 주체들에 의한 정책참여가 이루어져야 할 것이며, 이들의 의사를 충분히 고려한 법률안 마련과 정책결정이 이루어져야 할 것이다.

신임 자치경찰의 효율적 교육훈련에 관한 연구 : 중앙경찰학교 신임자치경찰 교육분석을 중심으로

2006년 7월 1일 제주도에 자치경찰이 도입 된지도 벌써 5년이 도래한다. 날 로 급증하는 광역 치안수요에 효율적으로 대처할 수 있는 경찰체제 확립의 일 환으로 정부의 자치경찰제 논의가 있는 후 제주도 자치경찰 실행은 경찰체제 에 또 다른 체제의 실험적 실행이었다. 무엇보다도 제주도민의 기대에 부흥하는 자치경찰로서 역할을 할 수 있으리라는 기대감 안 고 있었기 때문이다. 따라서 본 연구는 자치경찰제를 도입이 곧 바로 주민보호가 이루어지는 것이 어렵기 때문에도 교육제도측면, 조직구조측 면,현장 중심적 측면의 분석하고,바람직한 자치경찰의 방향을 제시해본다. 문 제점으로는 경찰자치교육과 특별사법경찰관리의 법령 등 교육한 제주인재개발 원교육의 이중적 교육문제와 자치경찰제도상의 문제점으로 자치경찰과 국가경 찰간의 업무구조문제와 인원 장비문제점, 자치경찰의 조직 계급 구조상의 문제 점, 자치경찰업무의 행정화 현상 우려의 문제점 등이 있으며 이에 따른 효율적 인 자치경찰의 개선방안을 제시하였는데. 정진한 지방분권을 이룬다는 차원에 서 대다수 국민들이 공감하는 제대로 된 자치경찰제가 개선되어 나간다면 더욱 대한민국의 자치경찰 정착의 시기를 앞당겨 질것이라 기대해 본다.

자치경찰제의 성공적인 시행을 위한초기 운영의 쟁점 분석- 시・도자치경찰위원회의 인식조사를 토대로 -

With the introduction of the autonomous police system by the Moon Jae-in government, local governments are expected to provide local-specific public security services that reflect the needs of residents and comprehensive public security services through linking local administration and public security administration. The purpose of this study was to analyze the issues of the initial operation of the autonomous police system and to suggest improvement plans for the local police committee, which is a key organization for the successful implementation of the autonomous police system. To this end, a survey was conducted from July 1st to July 15th, 2021 on the organization and operation of the local police committee, personnel rights, budgetary rights, scope and linkage of the affairs targeting 18 local police committees. Based on the survey results, policy recommendations for the successful implementation of the autonomous police system were presented. First, it may be considered to allocate the recommended number of committee members to each recommendation institution in order to secure diversity of the local police committees. Second, the National Police Agency should cooperatively share personnel and budget information with the local police committees. Third, the independent personnel rights management system within the local police committee should be prospectively reviewed. Fourth, it is necessary to come up with various financial support measures that allow local governments to independently operate them. Fifth, it is necessary to continuously discuss improvement plans for local police affairs by reflecting the opinions and experiences of national police officers who perform local police affairs in the field. Sixth, for the personnel and budgetary authority of the local police committee to be effectively exercised, the facilities・manpower・budget of the national police must be completely transferred to the local governments. 문재인 정부의 자치경찰제 도입으로 지방자치단체가 국가와 함께 경찰사무의 공동책무자로서 주민들의 요구를 반영한 지역 맞춤형 치안 서비스와 지방행정과 치안행정의 연계를 통한 종합적 치안 서비스의 제공이 가능해질 것으로 기대가 된다. 본 연구는 자치경찰제가 성공적으로 시행되기 위한 핵심적인 기구인 시・도자치경찰위원회를 대상으로 자치경찰제 초기 운영의 쟁점을 분석하고 제도의 개선안을 제시하는 것을 목적으로 하였다. 이를 위해 18개 시・도자치경찰위원회를 대상으로 자치경찰위원회의 조직 구성 및 운영, 인사권, 예산권, 사무 범위 및 연계성에 관하여 2021년 7월 1일부터 7월 15일까지 설문조사를 실시하였다. 설문조사 결과에 근거하여 성공적인 자치경찰제 시행을 위한 정책적 제언을 제시하였다. 첫째, 시・도자치경찰위원회의 다양성을 확보할수 있도록 위원회 위원의 추천 인원을 추천기관별로 할당하는 것을 고려해 볼 수 있다. 둘째, 경찰청은 시・도자치경찰위원회와 인사 및 예산 정보를 협력적으로 공유해야 한다. 셋째, 시・도자치경찰위원회 내 승진심사위원회를 구성하는 독립적인 인사권 운용시스템을 전향적으로 검토하여야 한다. 넷째, 지자체 스스로 독립적인 운영이 가능한 다양한 재정지원 방안 마련이 필요하다. 다섯째, 현장에서 자치경찰 사무를 수행하는 국가직 경찰공무원의 의견과 경험을 반영하여 법정 사무의 개선안을 지속적으로 논의하여야 한다. 여섯째, 시・도자치경찰위원회의 인사 및 예산 권한이 실질적으로 행사되기 위해서는 국가경찰의 시설・인력・예산이 지자체로 완전하게 이양되어야 한다.

한국의 자치경찰제 도입방안에 관한 연구

한국에서 자치경찰제를 전국적으로 시행하고자 함에 있어 자치경찰의 역할을 최협의 경찰개념 즉, 협의의 행정경찰활동으로 파악하여 현재 시행 중인 제주자치경찰제도 및 특별사법경찰제도를 중심으로 그 과도기적 도입방안을 제시하고자 하였다. 즉, 자치경찰활동을 최협의의 경찰개념인 행정경찰활동으로 국한하여 규정하고, 자치경찰제를 정착시키기 위한 현실적인 방안으로서 현재시행 중인 제주자치경찰제의 문제점을 개선하고 특별사법경찰제도를 대폭 보완하며, 경범죄처벌법을 개정하는 자치경찰제 도입방안을 제시하였다. 이러한 도입방안은 대규모 인력을 충원하지 않아도 되고 현재의 인력을 활용할 수 있으며, 예산도 도비로만 충당할 수 있고 장비의 지원에 있어서도 부담을 크게 경감할 수 있다. 경범죄 처벌법상의 권한 부여는 지역의 기초질서 유지를 위한 좋은 방안이 될 수 있을 것이다. 다만, 이러한 도입방안은 대규모 예산이 필요로 하지 않는다는 점에서 도입의 실현가능성은 매우 높으나 자치경찰제도의 역할을 어느 정도로 파악해야 하는가에 대한 보다 지속적이고 근본적인 논의가 필요하다.

한국에서 자치경찰제를 부분적으로 도입한지도 13년이 지났다. 한국에서의 자치경찰제는 대한민국 헌법의 지방자치 이념에 다가서는 의미가 있고, 지방행정과 치안행정의 연계성을 강화하고, 자치분권과 지역특성에 적합한 치안서비스 제공으로 주민의 삶의 질을 높이는 종합행정의 완성이라는 법적・제도적 의의가 있다. 이 연구에서는 자치경찰제의 본격적인 도입에 앞서 자치경찰제 수용을 위한 지방정부의 여건을 살펴보고, 자치분권과 지방자치를 위한 제 법률 및 자치경찰제를 위한 법률안을 검토하고자 한다. 그리하여 동 법률안의 심의과정에서 반드시 논의될 필요가 있다고 판단되는 몇 가지 법적 쟁점을 도출한 후, 우리나라의 여건에 보다 적합한 자치경찰제 도입에 필요한 발전적 제언과 정책적 시사점을 모색하고자 하였다. 정부안은 자치경찰의 사무범위와 관련하여 제주자치경찰의 사무 분배 외에 생활안전, 여성청소년, 교통, 지역경비, 일정부분의 수사 등이 포함되어 있다는 점에서 제주자치경찰보다는 다양한 사무를 자치경찰이 담당하도록 하고 있다. 하지만 일부에서 지적하는 바와 같이 실효적 자치경찰제를 실시하여야 실질적인 자치행정과 자치치안이 가능할 것이라는 측면에서 국회의 논의과정에서는 반드시 고려되어야 할 몇 가지 사항을 쟁점별로 논의하였다. 이 연구는 지방분권법상의 사무배분의 원칙에 의거하여 국가경찰 사무와 자치경찰 사무의 배분 기준 등이 적절한지, 본질적인 자치경찰을 구현할 수 있도록 충분한 경찰업무가 이관되는지, 기타 조직과 인사 등 국가경찰과 자치경찰의 사무 배분의 전제가 되는 사항을 중심으로 자치경찰제 도입의 법적 쟁점과 과제를 검토하고 합리적 대안을 제시하였다. It has been 13 years since Korea partially introduced the autonomous police system. The autonomous police system in Korea is meaningful in approaching the local autonomy ideology of the Republic of Korea's Constitution, and the legal and institutional significance of completing a comprehensive administration that strengthens the link between local administration and policing administration, and improves the quality of life of residents by providing security services suitable for autonomy and regional characteristics. In this study, we will examine the conditions of local governments to accept the autonomous police system before the full-fledged introduction of the autonomous police system, and review the laws for the autonomous and local autonomy system. Thus, after drawing up some legal issues that are deemed necessary to be discussed during the deliberation process of the bill, the government sought to find the necessary development suggestions and policy implications for the introduction of a autonomous police system more suitable to the conditions of the country. Regarding the scope of the police's office, the government autonomous police system plan calls for the police to take charge of a variety of affairs rather than Jeju police, given that they include living safety, women and youth, transportation, regional security and a certain amount of investigation, in addition to the division of the office by the Jeju Provincial Police Agency. However, as some pointed out, several points that must be considered in the process of the National Assembly were discussed on a case-by- case basis, in the sense that effective self-governing and self-governing measures would be possible only when an effective autonomous police system is implemented. Based on the principle of division of office under the Local Autonomy Act, this study examined the legal issues and problems of introducing the autonomous police system were reviewed and rational alternatives were proposed, focusing on whether the criteria for allocation of national police offices and autonomous police offices are appropriate, whether sufficient police work is transferred to implement essential autonomous police, and other matters that are the premise of the division of the national police and autonomous police departments, such as organizations and personnel.

자치경찰제 정부안의 중립성 확보 방안 - 조직구조와 임명방식을 중심으로 -
