공범은 정범의 위법한 행위에만 관여하는 것이 아니라 경우에 따라서는 정범의 적법행위에 관여하여 자기가 원하는 범죄를 실현하는 것도 가능하다. 이러한 경우에는 처벌되지 않는 자를 이용한다고 하여 주로 간접정범으로 논하는 것이 일반적이다. 그렇지만 이러한 경우를 항상 정범으로 취급하는 것은 정범의 범위를 확장하는 것이 되며, 이는 제한적 정범개념을 취하고 있는 현재의 입장과도 어울리지 않을 뿐만 아니라, 또한 공범으로 처벌할 수 없다는 이유로 정범으로 취급하게 된다는 것도 정범개념의 우위성이라는 측면에서 볼 때도 타당하지 않다고 할 것이다. 이러한 문제의 원인은 다름 아닌 위법의 연대성을 철저히 관철하려고 하는 점에 있다. 통설적 지위에 있는 제한종속성설에 따르면 정범의 위법성은 예외 없이 공범에게 영향을 미치고, 정범이 위법한 이상 공범은 적법하게 될 수 없다는 결론을 내리게 된다. 하지만 이러한 이해가 과연 타당한 것인가라는 점에 의문을 가지게 된다. 그렇다면 위법은 상대적으로 작용할 수 없는가의 문제, 즉 이것은 정범행위의 성질이 공범성립에 어떠한 영향을 미치는가의 문제라 볼 수 있으며, 또한 그러한 관점에서 볼 때 공범종속성을 어떻게 파악할 것인가의 문제로도 이해할 수 있을 것이다. 요컨대 공범종속성은 공범이 성립하기 위해서 정범이 어떠한 범죄성립요소를 구비해야 하는지라는 ‘공범성립의 필요조건’의 문제와 그러한 요건을 갖추었을 때 정범의 어떠한 요소가 공범에 연대되어야 하는지라는 ‘정범요소의 연대성’의 문제로 나누어 살펴볼 필요가 있고, 결국 이것은 다수의 관여자가 있는 경우에서의 법적 판단, 즉 위법은 상대적으로도 평가될 수 있는 문제로 취급될 수 있다는 것을 의미한다 할 것이다.

This study examined the special features and domestic status of the shared-house from the increasing number of single-person households, and also studied demand characteristics of the shared-house targeting young single-person household. Moreover, it found affecting factors of residential inclination on the shared-house with the binary logic model. Some of field research and interviews for the survey were conducted, and the analyzed result from this study as follows: Firstly, the domestic shared-house, introduced between the end of 2012 and early 2013, has been rapidly increased and has some features such as decreasing in housing expenses and increasing in social interaction. Secondly, the demand for shared-house by residential experience of single-person household differs according to the demographic characteristics. Thirdly, the factors that affect residential inclination of shared-house are character types, community life experience, awareness, and need for shared house.

在韩中国留学生领悟社会支持对主观幸福感的影响 - 大学生活满意度的中介作用

As the most important part of foreign students in South Korea, they also have to bear a higher risk of psychological distress owing to they break away from the original support system and growth environment, and enter an unfamiliar cultural environment and start a new life mode. Although there are more and more studies on how to effectively support the well-being of foreign students, there is a lack of a more positive and proactive perspective. Based on the questionnaire survey of 425 Chinese students in Korea, this study hopes to explore the relationship between social support, subjective well-being and life satisfaction, and reveal the important role of family, friends, school and even the whole society in the construction of foreign students' subjective well-being. that understanding social support can effectively improve the subjective well-being and university life satisfaction of Chinese students in Korea. While college life satisfaction can effectively improve the subjective well-being of Chinese students in South Korea, it also plays a partial intermediary role between the understanding of social support and the subjective well-being of Chinese students in South Korea. This study not only helps to enrich and improve the theoretical research on the subjective well-being of foreign students, but also provides practical guidance for improving the subjective well-being of Chinese students in Korea.

글로벌 문화산업 환경에서 중국애니메이션의 민족서사 이념구축

글로벌 문화산업 환경은 중국애니메이션을 경제적, 기술적, 문화적 차원에서 크게 변화시키고 있다. 글로벌 다국적 자본의 수용, 첨단 CG기술의 도입, 포스트모더니즘 문화현상으로 중국애니메이션의 민족서사 표현방식과 이념구축은 당면한 현실적 과제가 되었다. 본 논문은 글로벌 문화산업 환경하에서 중국의민족서사 표현을 시도한 대표적인 중국애니메이션<Monkey King : Hero Is Back>과 <Little Door Gods> 를 민족서사의 표현방식 차원에서 비교 분석하였다. 두 작품은 감독 및 제작구성원의 민족 정체성 문제, 중국의 전통문화 소재 사용과 중화민족 민족정신(애국주의, 집단주의, 사회주의)의 내포 측면에서 뚜렷한 차이를 보였다. 이것은 중국애니메이션의 글로벌화는 중국관객이 수용할 수 있는 민족정신과 정서를 차별화된 서사구조와 문법으로 혁신할 필요가있음을 시사한다. 따라서 본 논문은 중국애니메이션에 대한 기존의표면적인 민족서사 연구를 보다 심층적이며 현실적으로 접근하고 있어 발전적 의미가 있다고 사료된다.

In the chinese animation, the national narrative form is a unique lifestyle, culture and psychological state in the long history of the nation, so that it can express the national spirit, language and customs. In this paper, we try to find out the national narrative strategy of chinese animation by examining the changes of national narrative style and the inclusion of national culture based on the division of chinese culture. The animation environment of the early days, prosperity period, and new period shows a remarkable difference in the psychology to the audience. This led to changes in the national narrative style of the chinese animation on the subject, story, and expression, and influenced the narrative elements and visual effects of the animation. Therefore, in order to explore the animation narrative strategy and expressing unique national characteristics that emphasize the cultural development needs of the global era and national competitiveness, firstly it is necessary to understand the new interpretive approach of the national spirit that incorporates socialist core values, Secondly, to discover unique characters with aesthetic qualities that can be used worldwide while meeting ethnic sentiment, Thirdly, it is necessary to consider creative adaptation of traditional culture. 중국 애니메이션에서 민족서사는 민족의 유구한 역사 속에서 독특한 생활 방식, 문화와 심리상태를 형성해 민족정신, 언어와 풍습을 표현할 수 있도록 한다. 본 논문은 중국문화의 시대적 구분을 바탕으로 중국 애니메이션에서의 민족문화의 내포, 민족서사 방식의 변화를 고찰하여 중국 애니메이션의 민족서사 전략을 모색하고자 한다. 초창기, 번영기, 신시기의 애니메이션 창작환경과 관객의 심리는 현저한 차이를 보이고 있다. 이것은 주제, 스토리, 표현방식 측면에서 중국 애니메이션의 민족서사 방식의 변화를 가져왔고 애니메이션의 서사요소와 연출영상미에 영향을 주었다. 따라서 글로벌 시대의 문화발전 요구와 국가 경쟁력을 부각시키는 특유의 민족적 특색을 표현하는 애니메이션 서사전략을 모색하기 위해서는 첫째, 사회주의 핵심 가치관을 접목한 민족정신의 새로운 해석적 접근, 둘째, 민족정서에 부합하면서도 세계적으로 통용될 수 있는 심미성을 갖춘 고유한 캐릭터 발굴, 셋째, 고전적 전통문화의 창의적 각색을 고려할 필요가 있다.
