국내에서 만든 드라마, 음악, 예능 콘텐츠를 전 세계 소비자들에게 거의 실시간으로 제공하고 또 전 세계 방송사들이 방송한 콘텐츠를 손쉽게 구매할 수 있는 플랫폼을 기대하는 것은 어쩌면 모든 인터넷 사용자들에게는 당연한 요구일 만큼 디지털 콘텐츠 전송기술, 퍼스널 디바이스 그리고 소비자 콘텐츠 이용행태가 성숙되었다. 그러나 개인들 손에 HD급 디코더가 장착된 모바일 디바이스가 들려있어도 국경을 넘어 디지털 콘텐츠를 정상적으로 구매할 수 있는 플랫폼을 찾는 것은 현실적으로 쉽지 않다. 도대체 어떤 요소가 국경이 없는 창조기반 경제를 견인하는 디지털 콘텐츠 유통산업을 가로 막는 것일까 ?이러한 단순한 질문에서 본 연구의 대상이 되는 글로벌 콘텐츠 유통 플랫폼 설계와 구축과제는 출발 하였고 점점 더 많은 사람들과 조직이 이 질문에 답을 구하고자 함께 고민하게 되었다. 답을 찾는 첫 번째 시도는 콘텐츠를 생산하는 아시아 방송 산업 중심에서 글로벌 유통 플랫폼의 필요성에 동의해준 행위이며 이어서 뉴스콘텐츠 교환 시범사업을 통해 글로벌 전송네트워크의 성능과 사업적 활용에 대한 이해를 넓히는 것이 무엇보다 중요하였다. 본 연구는 이러한 몇몇 사전 시도와 글로벌 콘텐츠 사용제공 협력이라는 주어진 조건을 바탕으로 어떻게 플랫폼 구조를 설계하고 구축된 플랫폼을 활용 실제 성공적인 상용서비스를 만들어 낼 것인가에 그 목적이 있다. 본 논고에 담긴 소비자들의 미디어 이용행태 변화, 방송 메타데이터를 토대로 유통 메타 데이터 체계를 사업자간 공유하는 것, 글로벌 전송네트워크 경쟁력 제고방안, 글로벌 콘텐츠 유통사업 가치 사슬 내 사업자간 유기적인 에코 시스템을 구성하는 것 등등이 비교적 학술적 참고 사례가 적어 상당부분 필자가 주장한 주관적 가설들은 향후 단계별 사업추진과정을 통해 보다 객관적으로 검증해 나갈 수 있을 것 이다.

영국법상 정기용선계약에서의 반선과 잔존유 반환채권에 관한 고찰 -대법원 2019.12.27. 선고 2019다218462 판결 평석-

This case is one of several types of legal claims that occurred due to the bankruptcy of H Shipping, which had a major impact on the shipping industry in South Korea. Among them, there are various issues such as the determination of the governing law for the claim for damages in relation to the termination of the contract due to the commencement of the rehabilitation procedure in time charters, the issue of the claim for the return of residual oil at the time of redemption in time charters, and the issue of the application of off-set under English law. Among the main issues related to this, we will look at the problem of the residual oil return bond according to the time charters’ forms. In the case where the governing law is designated as the English law of a foreign law, it is expected that the issue of off-set will be reviewed. First of all, there are many differences between the use of the NYPE 1946 and 1993 forms and the use of the NYPE 2015 forms. When using the former forms, it is necessary to supplement the ‘rider clause’. Especially, it is necessary to recognize that the residual oil return bond due to the termination of the time charter contract, which is the core of this case, is excluded from the NYPE 1946 form, but is included in the NYPE 2015 form. Next, there is the issue of off-set the termination of the contract under English law. The position of the English and Korean Courts are that set-off under common law and set-off under common law have a substantive nature in the application of set-off under the equitable law. Under English law, the problem of set-off for premature termination lies in the application of set-off under common law and set-off under equitable law. The judgment of the English court and the Korean court is that set-off under the common law is applied because it has a substantive law nature. Although it is a reasonable judgment, when the English law is applied as the governing law, there are cases where the position on the permissible off-set by the cause of the voyage charter party and the time charter party is different in carriage of goods by sea, so additional review is necessary. Based on these results, it is hoped that they will serve as practical references in the future. 이 사건은 우리나라 해운산업에 큰 영향을 미친 H해운 파산으로 인하여 발생한 여러 유형의 법적분쟁 중 한 가지이다. 그 중 정기용선계약에 있어 회생절차의 개시에 따른 계약 해지에 관한 손해배상채권의 준거법 결정과 정기용선계약에 있어 반선시 잔존유 반환채권의 문제 및 영국법상 상계의 적용 문제 등 다양한 쟁점이 존재한다. 이와 관련한 주요 쟁점 중 정기용선계약의 반선시 계약서식에 따른 잔존유 반환채권의 문제에 대해 살펴보고, 준거법이 외국법인 영국법으로 지정된 경우에 있어 상계의 문제에 대해 검토하였다. 우선 NYPE 1946과 1993 서식을 사용하는 경우와 NYPE 2015 서식의 사용에는 많은 차이가 있으므로 앞의 서식을 사용할 때는 추가약관을 보완할 필요가 있다. 특히 이 사건의 핵심인 정기용선계약의 중도해지에 따른 잔존유 반환채권의 경우 NYPE 1946 서식에서는 제외되지만, NYPE 2015 서식에서는 포함시키고 있음을 인식할 필요가 있다. 그 다음으로 영국법상 중도해지에 대한 상계의 문제는 보통법상 상계와 형평법상 상계의 적용에 있다. 영국 법원과 한국 법원의 판단은 실체법적인 성격을 포함하고 있으므로 보통법상 상계가 적용된다는 것이다. 타당한 판단이지만 준거법으로 영국법이 적용되는 경우 운송계약에 있어 항해용선계약과 정기용선계약의 청구원인별 상계 허용에 대한 입장은 다른 경우도 있으므로 추가 검토가 필요해 보인다. 이러한 결과를 토대로 향후 실무적으로 참조가 되기를 기대한다.

Pityriasis lichenoides chronica is considered to be a benign disease. Erythematous yelIowieh scaly maeulea appear insidiously, chiefly on the sides of trunk, thighs and upper arms. Acanthosis nigricans is a rare cutaneous disorder with peak incidence in puberty characterized by hyperkeratosis and, dark pigmentation. We report a case of pityriasis lichenoides chronica associated with pseudoacanthosis nigricans in a 14 year-old obeae male patient who has bean sized erythematoua scaly papules on the trunk and extremities, velvety black brownish colored patchea on the neck and both axillary regions.

해사국제사법상 편의치적에 관한 고찰

Private international law or Conflict of laws can be defined as inconsistency or difference between the laws of different countries, arising in the case of persons who have acquired rights, incurred obligations, injuries or damages, or made contracts, within the territory of two or more jurisdictions. Specially the law of the ship`s nationality or the law of the flag is commonly used to apply the articles concerned in maritime field of private international law. Despite the vessel`s flag or nationality plays an important part in the choice of law problems, the theory of the law of the flag suffers from serious difficulties. For example, what law applies in cases of vessels wearing flags of convenience, or in cases of double flagging, or to collisions on the high seas between vessels of different flags? Specially I concentrated my attention on the flags of convenience, which is not the vessel`s bona fide nationality. In this case, the question of whether there exists a genuine link between a state and its flag vessels may be addressed indirectly. And the article 8 of Korean Private International Law stipulates the Exception of Choice of Law Clause, where the law of the country with which it is most closely connected is obviously existed, the legal relationship concerned is governed by the law of the country. Thus, it is essential for me to study on the constructive method of the relationship between a state and its flag vessels because the article 8 of Korean Private International Law can be applied to the flags of convenience. Therefore the writer try to describe both the flags of convenience and a genuine link between a state and its flag vessels in maritime private international law. These articles are followed by analyses concerning the lifting of the corporate veil and the piercing of the corporate veil for the purpose of grasping of the substantial incorporated entity. After considering all the factors, the use of flags of convenience can be applied to the Exception of Choice of Law Clause of Korean Private International Law. In this case, the law of the flag should be only one indicator or contact among many. It should rarely, if ever, be the sole consideration in determining the proper law of the maritime field. Thus, it is essential to think over many contacts which can be used in determining the applicable law through most significant relationship theory.

Impact of Digital Transformation on Business Performance: Moderating Role of Innovation Resistance and Organizational Characteristics

Purpose: This study aims to identify the relationship between SMEs' digital transformation capabilities, smart factory utilization, and management performance. It also aims to suggest how companies strategically utilize smart factories to achieve a competitive advantage and sustainable growth through empirical analysis of differences in innovation resistance and organizational characteristics. Research design, data, and methodology: This study Implement for SME's building smart factories did. The survey was conducted for 90days from October 1st, 2023 to December 31th, 2023. Total of 210 surveys were collected, and 186 surveys, excluding ones with missing value and outliers (64 surveys), were used. Results: The results of the empirical analysis based on previous research are as follows. First, digital transformation capabilities such as digital technology, digital leadership, and digital strategy affect smart factory utilization. Second, smart factory use affects operational performance. Third, innovation resistance has a moderating effect in the relationship with digital transformation capabilities, smart factory utilization, and management performance. Fourth, organizational characteristics have a moderating effect in the relationship with digital transformation capabilities, smart factory utilization, and management performance. Conclusions: Explore strategic ways to improve your organization's digital transformation capabilities. It is necessary to establish a strategy to make organizational members aware of the necessity and importance of introducing a new system through centralization of the organization.

전향 스윕 프로펠러 홴의 성능 및 유동특성

Performance and flow characteristics of a small forward swept propeller fan for home refrigerators are studied experimentally. An unusual discontinuity is observed in the performance curve of the fan. Mean flow fields measured with as-hole Pitot probe reveal that the flow is axial at the high flow rate and radial at the low flow rate. The flow structure changes abruptly across the discontinuity. Unsteady flow measurements with a set of hot-wire probes indicate that near the discontinuity a single-cell stall rotates at 40% speed of the fan speed, while away from the discontinuity the flow shows periodic variation corresponding to the blade passage frequency. Phase-lock averaged flow fields measured with a triple-sensor hot-wire probe show that there appears radially inward flow over the pressure side of the blade and the outward passage flow over the tip.

가압소결로 제조된 YSZ-30 vol.% WC 복합체 세라믹스의 상형성 거동과 기계적 특성

YSZ (Y2O3-stabilized zirconia)-based ceramics have excellent mechanical properties, such as high strength and wear resistance. In the application, YSZ is utilized in the bead mill, a fine-grinding process. YSZ-based parts, such as the rotor and pin, can be easily damaged by continuous application with high rpm in the bead mill process. In that case, adding WC particles improves the tribological and mechanical properties. YSZ-30 vol.% WC composite ceramics are manufactured via hot pressing under different pressures (10/30/60 MPa). The hot-pressed composite ceramics measure the physical properties, such as porosity and bulk density values. In addition, the phase formation of these composite ceramics is analyzed and discussed with those of physical properties. For the increased applied pressure of hot pressing, the tetragonality of YSZ and the crystallinity of WC are enhanced. The mechanical properties indicate an improved tendency with the increase in the applied pressure of hot pressing.

모바일 소셜커머스에서 휴리스틱 유형이 구매의도에 미치는 영향 : 쇼핑가치의 매개효과를 중심으로

Purpose - The purpose of this study was to examine the effect of the heuristic type of consumers affecting purchase decision making and the intention of shopping value in their relationship to derive mobile social commerce purchase promotion plans. Research design, data, and methodology - A research model was constructed to relate the mediating effect of shopping value between heuristic types and purchase intentions. A total of 233 valid questionnaires were used for analysis for users using mobile social commerce. The statistical program used SPSS 24.0 and AMOS 24.0, and correlation analysis, regression analysis, and 3-step parametric regression analysis were used for the analysis. Results - The results of the analysis showed that representativeness heuristics, availability heuristics, adjustment heuristics, and affect heuristics had a statistically significant effect on the utilitarian value and the hedonic value. On the other hand, affect heuristics among the heuristic types were found to have the greatest influence not only on the utilitarian value but also on the hedonic value. The two types of shopping value were found to be partially mediated between representativeness heuristics and purchase intentions, between adjustment heuristics and purchase intentions, and fully mediated between availability heuristics and purchase intentions, affect heuristics and purchase intentions. Conclusions - These findings suggest that mobile social commerce companies should check in advance how consumer heuristic types affect purchase intentions. In particular, affect heuristics are caused by consumers' emotional mood such as mood or external stimulus being more important to decision making than rational decision making. Therefore, the result of this study suggests that it can be an important factor to secure the competitiveness that the potential customers who access to use mobile social commerce can feel enough fun and enjoyment in the platform provided by the company. It is also worth paying attention to the utilitarian and hedonic values perceived by consumers. This is because the judgment regarding the economic, convenience and important information provided by the mobile social commerce users affects the purchase intention through the trust of the information, past use, and shopping experience displayed on the mobile social commerce platform.
