        공감적 듣기 전략에 따른 자기노출의 긍정적 과정 연구 -영화 <굿윌헌팅> 분석을 중심으로-

        This article suggests that self-disclosure should be understood from an interactive point of view. It also suggests that self-disclosure should be a strategy of speech communication. On examining the revised curriculum in 2015, it was found that the contents of education related to self-disclosure were mainly dealt with from the viewpoint of the speaker. Therefore, this study focused on an audience-oriented strategy, since dialogue is an interaction between the speaker and the listener. In the self-disclosure method, the principle of ‘empathy’ is most important because the audience sincerely takes into account the speaker’s self-disclosure information and goes along with his feelings. Reflecting on this point, in this study, we tried to find out the main factors that led to the positive process of self-disclosure in ‘empathic listening’ of the listener. The film, < Good Will Hunting >, was selected to confirm the development of the aspects of empathic listening strategies and the way in which self-disclosure are developed. As the self-disclosure progresses in < Good Will Hunting >, the focus and topic of the conversation is transferred from Sean and circumstance itself to Will himself. Moreover, in the process of self-disclosure, Will establishes the correspondence between his inner thoughts, feelings, and desires. In other words, the person who showed self-defensive and distorted self-disclosure changed into a person who could truly look into his inner self and express it with authenticity. Through the positive process of Will’s self-healing and growth, he was able to see the importance of proper self-disclosure. Through this discussion, it can be seen that in the process of self-disclosure, the role of the listener is as important as the speaker’s. When the listener sincerely intends to empathize with the speaker, the process of self-disclosure can be positive.

        자기 노출 요구에 대한 반응 양상

        <Abstract> Self-disclosure is a verbal and nonverbal behavior through which individuals truthfully, sincerely and intentionally communicate novel, traditionally private information including thoughts and feelings about themselves to one or more individuals. People have personal and relationship-based motives for engaging in or refraining from self-disclosure. This study explores how people react when they are required to self-disclose but are unwilling to do so. The drama “Gaetmaeul Chachacha” was analyzed as a source. Scenes for analysis were self-disclosure situations including follow-up questions and reactions, considering both verbal and nonverbal cues of hesitation. Consequently, instances of self-disclosure were classified into five categories: accepting provided information, providing information (providing minimized information, providing reduced information, telling a white lie, and providing factual information), not providing information (closing the conversation, pretending to be indifferent, claiming incompetence, denying directly and indirectly), jointly searching for information, and delaying providing information. Since self-disclosure relies strongly on relationships and mutual relationship perceptions may differ, interest in active self-disclosure should be constructively expanded to manage various self-disclosure aspects through self-disclosure decision-making. .

        자기공지예외제도가 적용되어 등록된 특허에 대한 권리범위확인심판 또는 침해소송에서의 공지기술의 항변 또는 자유실시기술의 항변의 허용 여부

        Article 30 of the Korean Patent Act prescribes that a patent right may also be acquired in a situation of right owner’s self-disclosure or disclosure against the owner’s will (hereinafter collectively referred to as “self-disclosure”). ‘The issue whether prior art defense or free-to-work art defense is allowed in a patent scope confirmation trial or a patent infringement suit against a patent, registered applying the self-disclosure exception system has become a hot one in 2022. To resolve this issue, this paper has comprehensively analyzed the jurisprudence of major countries and the legislative history of Article 30 of the Korean Patent Act and has arrived at the following conclusions. Firstly, essence of the self-disclosure exception system is a system that disregard self-disclosure from the prior art against owner himself. Therefore, the prior art defense or the free-to-work art defense based on the self-disclosure should not be allowed. This self-disclosure exception system is designed to compensate for the shortcomings of the first-to-file system and to prevents owner himself from being harmed by the self-disclosure. Secondly, due to the amendment of Art. 30 of the Patent Act in 2001, its literary language only applies to the situation of judging novelty and inventive step of self-disclosure exception system. However, the 2001 amendment to the Patent Act was not intended to narrow the applicable scope of the system, but to expand it. According to this legislative intent, the provision should be interpreted that self-disclosure is not applied as prior art against owner himself. In Japan, where the content of the corresponding provision is the same as that of Korea Patent Act, we have failed to find any case where the prior art defense is recognized based on self-disclosure. In major countries, we have not found any case where the prior art defense is recognized based on self-disclosure. Moreover, in China, the courts have made it clear through guidelines and judgments, that for rights created through the self-disclosure exception system, the prior art defense cannot be claimed based on the self-disclosure. And some Chinese scholars have also explained that such an interpretation is consistent with the legislative intent. In Korea, we have found the 2016-Gahap-502475 judgment of the Seoul Central District Court, the 2021-Heo-4591 judgment of the Patent Court, and the 2014-Hu-341 judgment of the Supreme Court, which rejected the literary interpretation of Article 30 of the Korean Patent Act. Thirdly, the patent policy does not recognize the prior art or free-to-work art defense on the following grounds. (1) For the self-disclosure exception system to promote early disclosure of inventions to achieve the purpose of patent law, which is to promote technological development, the target patent court decisions must be revoked or changed. (2) As of 2022, there exist at least 30,000 patents registered using Article 30(1)(1) of the Patent Act in Korea. The strict literary interpretation can fool many innocent right holders. (3) In Korea, the prior user’s right has been recognized in the Patent Act and the Design Protection Act, so the interest of right holders and third parties associated with the self-disclosure exception system has been balanced to a certain extent. (4) The patentee who has obtained a patent by taking advantage of Article 30 of the Patent Act must be able to exercise the patent right. The patent right must be protected by remedies provided by the Patent Act. Seeking relief in other laws has nothing to do with “patent” right. A right without a remedy is no right at all. 특허법 제30조는 자기에 의한 공지(disclosure) 또는 자기의 의사에 반한 공지(이하 합쳐서, ‘자기공지’)의 경우에도 특허권을 획득할 수 있게 한다. 그 소위 ‘자기공지예외제도(self-disclosure exception system)’가 활용되어 등록된 특허를 근거로 권리범위확인심판이 청구되거나 침해소송이 제기되는 경우, 그 자기공지를 근거로 공지기술의 항변 또는자유실시기술의 항변이 가능한지 여부가 2022년 현재 뜨거운 쟁점이 되고 있다. 그 쟁점을 해결하기 위해 이 글은 주요국의 법리, 특허법 제30조의 입법이력 등을 전반적으로 분석하였고, 그 분석의 결과 다음과 같은 결론을 도출하였다. 첫째, 자기공지예외제도의본질은 그 자기공지를 자기의 출원 및 특허에 대하여는 선행기술에서 제외하는 제도이다. 그러므로, 그 자기공지를 근거로 하는 해당 특허에 대한 공지기술의 항변 또는 자유실시기술의 항변은 인정되지 않아야 한다. 동 제도는 선출원제도의 단점을 보완하기 위한 것이며, 그 자기공지로 인해 자기가 피해를 받지 않게 하는 제도이다. 둘째, 2001년특허법 개정으로 인해 제30조의 문언이 자기공지예외제도가 신규성 및 진보성 판단의국면에서만 적용되는 것으로 보여지게 되었다. 그러나, 2001년 특허법 개정은 동 제도의적용범위를 좁히기 위한 것이 아니라 오히려 넓히기 위한 것이었다. 그러한 입법의도에따라, 자기공지가 자기에게는 선행기술이 되지 않는 것으로 해석되어야 한다. 우리 규정과 동일한 내용의 규정을 가진 일본에서도 자기공지를 근거로 공지기술의 항변을 인정한 사례가 전혀 발견되지 않았다. 다른 주요국에서도 자기공지를 근거로 공지기술의 항변을 인정한 사례가 전혀 발견되지 않았다. 더욱이, 중국에서는 법원이 지침 및 판결을통해 자기공지예외제도를 통해 형성된 권리에 대해 그 자기공지를 근거로 공지기술의항변을 주장할 수 없다고 명시적으로 밝힌 바 있고, 학자들도 그러한 제도가 입법의도에부합한다고 설명한다. 우리나라에서도 특허법 제30조의 문언해석을 거부한 서울중앙지방법원 2016가합502475 판결, 특허법원 2021허4591 판결 및 대법원 2014후1341 판결이 발견된다. 셋째, 특허정책적인 다음의 이유에 의해서도 자기공지를 근거로 하는 공지기술의 항변 또는 자유실시기술의 항변은 인정되지 않아야 한다. ① 자기공지예외제도가 발명의 조기공개를 조장할 수 있게 하여 기술발전의 촉진이라는 특허법의 목적을 달성할수 있도록, 대상 특허법원 판결들이 변경 또는 파기되어야 한다. ② 2022년 현재 우리나라에 특허법 제30조 제1항 제1호를 활용하여 등록된 특허가 적어도 3만건이 존재할 것이다. 엄격한 문언해석은 그 수많은 특허의 선량한 권리자를 우롱하는 것이다. ③ 우리나라에서는 선사용권이 특허법 및 디자인보호법에서 이미 인정되고 있으므로, 자기공지예외제도와 관련하여 권리자의 이익과 제3자의 이익이 어느 정도 균형이 맞춰져 있다고 보아야 한다. ④ 특허법 제30조를 활용하여 특허를 획득한 특허권자가 특허권을 행사할 수있어야 한다. 그 특허권은 특허법이 제공하는 구제를 통하여 그 권리가 보호되어야 한다. 다른 법이 제공하는 구제는 특허권과 관련이 없는 것이다. 구제 없는 권리는 권리가 아니다.

        연인 간 의사소통에서 자기 노출 양상 연구 - 20대 대학생 연인을 중심으로

        The purpose of this study is to analyze a perception of self-disclosure and to consider an aspect of self-disclosure in couples communication. In this survey, a total of 5 questionnaire survey papers in 4 different types, with 69 questions were used. Based on this survey, we compared the phenomenon of self-disclosure between male and female and between couples. The study of perception of self-disclosure between male and female was already presented by Yi Yumi(2009), therefore this paper will be considered an aspect of self-disclosure in couples communication. If we sum up aspects of self-disclosure in couples, those are as following. First, men thought that listening personal story is an effective way to enhance in couple’s relationship. Secondly, male showed more strong tendency than female in that who is more listener-centered person in couples communication. Thirdly, women showed low satisfaction with the way the partner listen to their self-disclosure. Fourthly, women also showed low satisfaction with the quantity of the partner’s self-disclosure. Last but not least, both gender answered that the speaker should be express their self-disclosure to satisfy by themselves in the question about enough self-disclosure, but men put emphasis on the quantity of self-disclosure, while women put emphasis on the quality of self-disclosure in second largest answer.

        모바일 인스턴트 메신저 상황에서 소속감, 외로움이 자기노출 행동에 미치는 영향: 시스템 품질의 조절효과를 중심으로

        Purpose - Recently, Mobile technologies and devices including smart phones and tablets have increased the possibility of communicating with other people and sharing personal information without time and space restriction. In order to realize the market potential related to mobile technologies, a large number of internet services have been incorporated into mobile platforms. Especially, The number of MIM(Mobile Instant Messenger) users has been increasing dramatically and services using MIM platform also have diversified. In spite of drastic growth in markets related to MIM, there is little empirical research on MIM and users' behaviors. This study designed to examine the structural relationships among belongingness, loneliness, self-disclosure intention, system quality, and self-disclosure behavior in context of MIM. Research design, data, and methodology – Three hypotheses were about the relationship among belongingness, loneliness and self-disclosure intention. The other two hypotheses were about the moderating effect of system quality in the causal relationship between self-disclosure intention and self-disclosure behavior. The data was analyzed by structural equation modeling. Research data were obtained from 330 undergraduate students who were KakaoTalk users and total 314 valid questionnaires were used in the final analysis. Results – The results from this study are as follow. First, the belongingness and the loneliness had a significant impact on self-disclosure intention in MIM. Second, the self-disclosure intention in MIM also had a positive impact on the self-disclosure behavior. Lastly, there is a moderating effect of the system quality in the relationship between the self-disclosure intention and self-disclosure behavior in MIM. Specifically, the higher system quality level was perceived, the positive effect of the self-disclosure intention in MIM on the self-disclosure behavior was greater. Conclusions - Based on the results from this study, academic and practical implications can be drawn. First, the study extends the scope of research about SNS through focusing on MIM to be classified by closed type SNS and identifies the relationship between emotion, behavioral intention and behaviors in MIM. Second, this study provides strategic guidelines to increase the efficiency for promotion activity. Limitations for the study also should be discussed.

        인스타그램 이용자의 나르시시즘이 자기 노출을 거쳐 주관적 안녕감에 미치는 영향과 긍정적 피드백의 조절효과: 기록적, 과시적 자기노출의 차이를 중심으로

        본 연구는 왜 사람들이 타인의 존재가 전제된 공간인 SNS에 자신에 대한 게시물을 올리는지, 이런 자기노출 행위가 개인의 행복에 어떤 영향을 미치는지를 살펴보았다. 우선, SNS에 게시물을 올리는 행위를 기록적 자기노출과 과시적 자기노출로 나누어 개념화하고, 개인의 나르시시즘 경향이 두 종류의 자기노출과 어떤 관련을 맺는지, 두 가지 자기 노출 행위가 각각 개인의 주관적 안녕감과 어떤 관계를 맺고 있는지 알아보았다. 이와 함께, 타인의 긍정적 피드백에 의해 자기노출이 주관적 안녕감에 미치는 영향이 조절되는지도 살펴보았다. 20-30대 인스타그램 이용자 434명을 상대로 실시한 온라인 설문조사 자료를 분석한 결과, 나르시시즘은 기록적, 과시적 자기노출 모두와 정적인 관련을 맺고 있었으나, 과시적 자기노출과 더 강한 관계를 보였다. 기록적인 자기노출은 주관적 안녕감과 정적인 관계를 가지고 있었다. 반면 과시적 자기노출은 주관적 안녕감과 부적인 관계를 가지고 있었다. 타인의 긍정적 피드백은 두 가지 형식의 자기노출 행위와 주관적 안녕감 사이에서 조절작용을 하지 않았다. 하지만, 나르시시즘이 강한 개인의 경우, 과시적 자기노출과 주관적 안녕감 간 사이의 관계는 긍정적 피드백에 영향을 받는 것으로 나타났다. The present study divided self-disclosure behaviors on Instagram into ‘archiving self-disclosure’ and ‘conspicuous self-disclosure’, and examined whether or not narcissism affects the two forms of self-disclosure. This study also examines how these forms of self-disclosure influence individual’s subjective well-being and whether this relationships are moderated by the amount of positive feedbacks. Online survey data of 434 Instagram users in their 20s and 30s were analyzed to answer these questions. The results showed that narcissism had a positive effect on both archiving self-disclosure and conspicuous self-disclosure, but narcissism had a stronger effect on conspicuous self-disclosure than archiving self-disclosure. Moreover, archiving self-disclosure positively influenced subjective well-being whereas conspicuous self-disclosure had a negative effect on subjective well-being. Positive feedbacks from others did not moderate the relationship between the two categories of self-disclosure behaviors and subjective well-being. However, there was a three way interaction effect of self-disclosure, narcissism and positive feedback on subjective well-being.

        20대 남ㆍ녀 대학생의 자기 노출 인식 양상 비교 연구

        이 연구는 20대 대학생 연인을 대상으로 자기 노출에 대한 설문 조사를 실시하고 남ㆍ녀 간, 연인 간 인식비교를 실시한 결과 가운데 남ㆍ녀 간의 차이를 분석한 것이다. 분석 결과를 살펴보면 남ㆍ녀 간의 자기 노출에 대하여 남자는 자기노출을 많이 하지 않고, 여자는 남자보다 자기 노출을 많이 하며, 남자는 자기노출과 친밀도에 대하여 유의하게 생각하지 않는 반면에 여자는 이의 관련성을 인정하는 경향이 있다. 또한 상대의 친밀도에 따라 자기 노출을 받아들이는 정도가 친한 친구가 아닌 그냥 아는 이웃 정도의 사이에서 여성이 상대의 자기노출을 더 긍정적으로 인식했고, 남성이 여성보다 상대의 비노출에 대해 더 관대하게 받아들였다. 그리고 자기 노출의 경향성은 남자는 화자 만족형이고 여자는 청자 만족형으로 나타났다. 여성은 자기 노출이 자기만족적이며, 상대의 노출에 대하여 보상해 줘야 한다는 부담감이 큰 반면에 남자는 자신의 노출에 대해서는 상대가 보상해 주기를 바라지만 상대의 노출에 대한 보상의 부담을 갖지 않았다. 또한 남,녀의 의사소통 자신감에 대한 조사 결과 남성은 여성에 비해 의사소통이 친밀함의 절대 요건이 아님을 보였고 여성은 의사소통에 있어서 자기 노출이 관계를 발전시키고자 하거나 친해지고 싶은 표징으로 나타났다. 전체적으로 자기 노출은 대상에 따라 긍, 부정성이 있으나 상대의 자기 노출에 대해서는 대부분 긍정적인 결과를 보였다. 그러나 상대가 자기 노출을 꺼리는 것에 대해서는 공히 부정적인 결과를 나타내었다. The purpose of this study is to analyze a self-disclosure of college couples between ages 20-29 through conducting a survey. Based on our survey, we compared the perception of self-disclosure between male and female. In this survey, 18 college couples and 38 students were conducted, and a total of 5 questionnaire survey papers in 4 different types, with 69 questions were used. As a result, we learned that male and female have differences in perception of self-disclosure. Women, who value intimacy, were more active at self-disclosure in their relationship. Also, men did not show much tendency at self-disclosure connected to intimacy. Yet, both genders believe that the self-disclosure have influence on the development of their relationship. Also, male showed listener-centered self-disclosure tendency, while female showed speaker-centered self-disclosure tendency. In general, we learned that the people surveyed have both positive and negative tendencies in self-disclosure by oneself, but most respondents have a positive tendency in self-disclosure by others. In the contrary, the people surveyed say that they have a negative tendency when others avoid self-disclosure. We also measured how comfortable a person feels depending on whom the conversation partner is, and the results showed that the people react more positively to the partner’s self-disclosure than to the self-disclosure of oneself.

      • IMPACT OF SELF-DISCLOSURE AND AUTHENTICITY OF INFLUENCER ON CONSUMER REACTION: FOCUSING ON MEDIATING EFFECT OF ENVY

        In the world of SNS, once ordinary users get recognized for discriminated fashion taste, they affect other users’ choice of fashion products. Fashion companies capture the importance of these influencers and tries to take advantage of their ability. However, the benefits offered to influencers such as financial compensation may provoke negative consumer reactions. The purpose of this study is to identify what aspects of SNS influencers and how they influence other fashion consumers. We suggest that influencers’ self-disclosure and authenticity of posts are important factors which elicit positive response from consumers. We also investigate the psychological mechanism of envy which can mediate the impact of self-disclosure and authenticity on consumer response. This study was conducted by an online survey of 120 Korean women in their 20s and 30s with a 2 x 2 between-group experimental design. The data was collected from 28 November to 5 December 2016. The collected data was analyzed using SPSS 23.0 for ANOVA analysis and regression analysis. The results were as follows. The main effect of authenticity was confirmed, while self-disclosure did not play a significant role, which indicates authenticity is the main factor in exercising influence on consumer response. The interaction of authenticity and self-disclosure was also observed. The participants of high in both self-disclosure and authenticity showed the strongest consumer reaction. However, the participants of high self-disclosure and low authenticity induced the weakest consumer response. For the impacts of self-disclosure and authenticity on envy, the participants exposed to the condition of both high self-disclosure and authenticity showed benign envy. On the other hand, malicious envy was aroused when both self-disclosure and authenticity were low. In relations between authenticity and consumer response, partial mediating effect of benign envy and malicious envy was confirmed. But, there was no mediating effect between self-disclosure and consumer response. This research on consumer response to influencers’ posts will provide key implications to fashion companies in building marketing strategies. In order for influencers' posts displaying their daily lives to have a positive impact on consumer response, not only self-disclosure but authenticity has to be considered. Such posts can induce benign envy and subsequently impact consumers indirectly. Influencers’ posts which narrow the gap between daily lives and products and raise the authenticity are important keys to successful marketing.

        자기 노출 요구 및 응답에서 대화자 양측의 불만족 유발 양상 -드라마 ‘갯마을 차차차’를 중심으로-

        Self-disclosure is a communicative behavior through which individuals sincerely and intentionally communicate novel truth and traditionally private information about themselves to one or more individuals. People decide whether to self-disclose based on their socio-cultural background and personal differences, and evaluate the situation, including the purpose, benefit, and risk of self-disclosure. This study explored aspects of dissatisfaction experienced on both sides when people are asked to self-disclose and do so. The drama “Gaetmaeul Chachacha” was analyzed as a source. Scenes chosen for analysis were self-disclosure situations, including follow-up questions and reactions, considering verbal and nonverbal hesitation cues. Regarding the questioner's problems, two problem types were suggested: being unprepared to listen and insincere questions. Concerning the respondents' problems, four types were suggested: ignoring the questioner’s intentions, focusing only on conveying the facts, excessive consideration for others, and failure to set self-disclosure boundaries. By examining examples of unsuccessful questions and reponses in self-disclosure from the speaker and listener’s perspective, the results could create a foundation for appropriate self-disclosure.

        SNS 중독 경향자의 온라인 자기개방 수준에 따른 외현적/암묵적 자존감의 차이

        This study investigated the effect of social network services (SNS) on implicit and explicit self-esteem, according to users’ self-disclosure levels. 294 university students were recruited, with 88 SNS users selected and assigned to high-addiction and low-addiction groups, each having scored above or below 15% on the SNS Addiction Tendency Scale. Measured by Online Self-Disclosure Questionnaires, participants were distributed into an SNS high-addiction / high-disclosure group (HH; N = 30), an SNS high-addiction / low-disclosure group (HL; n=30), and an SNS low-addiction control group (LN; N = 28; control). A Self-Esteem Implicit Association Test and the Rosenberg Self-Esteem scale were both used, finding that the HL group showed lower implicit self-esteem compared to the LN, but no significant difference in explicit self-esteem. Meanwhile, the HH group showed lower explicit self-esteem compared to the LN, with significant difference in implicit self-esteem. Individuals with SNS addiction tendencies, avoiding self-disclosure, showed defensive self-esteem characterized by low implicit self-esteem. Those who frequently disclosed themselves on SNS showed fragile self-esteem, characterized by low explicit self-esteem. This study confirms the differential effect of self-disclosure among SNS addiction tendencies, accounting for subtypes of self-esteem, and calls for intervention concerning defensive and fragile self-esteem. 본 연구는 사회 연계망 서비스(Social Network Service: SNS) 중독 경향자의 온라인 자기개방이 외현적 및 암묵적 자존감에 미치는 영향을 확인하고자 하였다. 대학생 394명을 대상으로 SNS 중독 경향 척도를 실시하여 SNS 중독 경향 집단과 SNS 저사용 집단으로 나누고, 온라인 자기개방 설문 점수를 반분하여 SNS 중독 경향-고자기개방 집단(High addiction-High disclosure: HH) 30명, SNS 중독 경향-저자기개방 집단(High addiction-Low disclosure: HL) 30명, SNS 저사용 집단(Low addiction-Null: LN) 28명으로 총 88명을 선별하였으며, 암묵적 자존감 연합검사와 자기보고식 설문지를 통해 암묵적 및 외현적 자존감을 측정하였다. 실험 결과, LN 집단에 비해 HL 집단의 암묵적 자존감은 낮았으며 외현적 자존감에선 차이가 없었다. 반면 LN 집단에 비해 HH 집단의 외현적 자존감은 낮았으며 암묵적 자존감에선 차이가 없었다. 본 연구는 SNS 중독 경향-저자기개방 집단에서 낮은 암묵적 자존감을 특징으로 하는 방어적 자존감 특성을 확인한 반면 SNS 중독 경향-고자개개방 집단에서는 낮은 외현적 자존감을 특징으로 하는 손상된 자존감 특성을 확인하였다. 이를 통해 SNS 중독 경향자의 온라인 자기개방과 자존감의 하위 유형 간 차별적인 패턴을 보았고, SNS의 자기개방 수준과 자존감 유형을 고려하여 SNS 중독 예방에 효과적인 훈련 프로그램을 개발할 수 있을 것으로 시사된다.
