Wa¨hrend die Auslegung des Enteignungsbegriffs und die Enteignungsdogmatik insgesamt urspru¨nglich von der Judikatur des BGH beherrscht worden waren, mehrten mit der Zeit Entscheidungen des BVerfG, die sich mit der Enteignung und ihrer Abgrenzung von der Inhalts- und Schrankenbestimmung befassten. An sich hatte das VBerfG schon in fru¨hen Entscheidungen seine von der Eigentumsdogmatik des BGH abweichende Auffassung von der Interpretation des Art. 14 GG deutlich gemacht. Der BVerfG hat vor allem durch den Naßauskiesungsbeschluss die Eigentumsdogmatik, die sich in den ersten jahrzehnten der Geltung der grundgesetzlichen Eigentumsgarantie vorrangig auf der Grundlage der BGH-Rspr. entwickelt hatte, entschiedend vera¨ndert worden war. Seitdem hat der neuerliche beschluss des BVerfG eine weitere Za¨sur gebracht. Im Gegensatz zu den alten "Schwellentheorie" des BGH und auch des BVerwG lautete die neue "Trennungstheorie" des BVerfG in den Entscheidung zum Kleingartenrecht und zur Naßauskiesung wie folgt: Enteignung ist der gezielte staatliche Zugriff auf das Eigentum des einzelnen, und zwar durch die vollsta¨ndige oder teilweise Entziehung konkreter subjektiver Rechtspositionen gerichtet, die durch Art. 14 Abs. 1 S. 1 GG gewa¨hrleistet sind. Demgegenu¨ber ist Inhalts- und Schrankenbestimmung alle diejenigen Rechtssa¨tze zu verstehen, die generell und abstrakt Rechte und Pflichten hinsichtlich solcher Rechtsgu¨ter festlegen, die als Eigentum i. S. der Verfassung zu verstehen sind. Danach schließen Enteignung und Inhalts- und Schrankenbestimmung sich wechselseitig aus. Folge dieses Ausschließlichkeitsverha¨ltnisses ist, daß eine verfassungswidrige Inhaltsbestimmung nicht in eine Enteignung umgedeutet und der Verfassungsverstoßß nicht durch Zubilligung einer gesetzlich nicht vorgesehen Entcha¨digung geheilt werden darf.

The incidence of double primary cancer is about 10% in all kinds of cancers. Double primary cancer is usually accompanied by gastrointestinal cancer. Esophageal cancer is supposed to be frequently accompanied by squamous cell carcinoma of the head and neck or the upper respiratory tract, because of such common carcinogens as smoking and alcohol ingestion. Esophageal cancer and hypopharyngeal cancer are usually diagnosed by esophagogastric endoscopy with biopsy. We performed endoscopic ultrasound-guided Trucut biopsy(EUS-TCB) to diagnose a mediastinal mass in a 49 year-old patient, who visited our hospital because of voice change. During procedure, we accidently found enlarged celiac lymph node, and obtained tissue from the mediastinal lymph node and the celiac lymph node. We confirmed double primary cancer of squamous cell carcinoma in the esophagus and the hypopharynx via esophagogastric endoscopy.

Electricnl impedance tomography (EIT) is a technique for determining the electrical conductivity and permittivity distribution within the interior of a body from measurements made on its surface. One recent application area of the EIT is the detection of breast cancer by imaging the conductivity and permittivity distribution inside the breast. The present "gold standard" for breast cancer detection is X-ray mammography, and it is desirable that EIT and X-ray mammography use the same geometry. This paper presents a forward model of a simplified mammography geometry for EIT imaging. The mammography geometry is modeled as a rectangular box with electrode arrays on the top and bottom planes. A forward model for the electrical impedance imaging problem is derived for a homogeneous conductivity distribution and Validated by experiment using a phantom tank.

This study purposes to reconsider the meaning of filmization of korean literary works, specially on the how being adapted from three novels <Dream> by Yi Gwangsu, <Our Twisted Hero;> by Yi mun yeol and <SeoPyeonjae> by Yi cheong jun) and what those mean . As a result, we have been arrived at the true conclusions; Adoption of literary works could create another originality and in some case, filmization could even brighten the right value of literary work, though being transformed in vusual and oral sense thorough adaptive process, and then, primary works could only recover its real originality but also secondary works also produce its creative originality. The theory of filmization of this paper have been supported with reference to Andre Basin & kreuz;er Helmut and so on.( Specially this purpose depends on Kreuzer Helmut's filmischen Adaption 'C type') Actually we could make comparisons between three korean modern novels and same name works of fimization in 1990'. Af first, we colud find out that <Desire, Dream> filmization modified by director Bae Chang ho and the weakness of 'cognitive failure' and confusions of <Dream> by Yi gwang su could been corrected because Yi had concentrated on not on the religious vision but on the religious commandments. In a second filmization , Bak Jong Won 's <Our Twisted Hero> (1992) we colud discover situations reversed in process of filmization . He took advantage of both the narrator as a voice -over and purely first person narrator and the spectator was objectively acknowledged the dramatic situation but the reader was captured by the narrator as a hero keeping the trauma from his young age, therefore he could not real objective situation. In film <Dream>. camera objectively had reflected the political and social conflict in 1960. The narrative characters had partly appeared in confront by both point of view; camera narrative view point and first person view point. Finally in last scene, Han Byeong Tae tells that the fight yet unended. In <SeoPyeonjae>(1993), camera of filmization tried to catch the realistic point and revive by visual and musical plays. The audience captured in that film colud not but immerse in traditional song(Pansori) and play . but in the novel <SeoPyeonjae>(1976), only a family story that has lived on traditional song and play, represent in literary as an tragedy 'Hams story'. We have concluded that Yi tried to discover korean tradition 'Han' as a deep sigh without progressive national emotion In conclusion, we could understand the difficulties of literary works that should represent just on the writing ability. Moerover, korean modern novelists also should have restrained by distorted political and cultural surroundings, Therefore when the filmization of the literary works have arrived at the another problem, some works could not but adapt and review in another perspectives . The filmization of literary works don't interrupt the development of pure korean films. The cultural technology has enhanced the filmization and cultural inventors reproduced much more films and dramas than any other days. In korea, the need of synopsis mass-produced the filmization relied on the korean modern stories. Now, we hope that korean filmization should been clearly investigated and dated and valued every by every and then, mutual relations of korean literary works and film works would been also revealed.

The participation in regular physical exercise can have positive effect on psycho-sociological changes as well as physiological-biochemical changes. Findings in literature concerning the special relationship between psychological wellbeing and regular physical activity have suggested that physical activity may modify state variable such as anxiety and depression. There is evidence that in addition to reducing levels of anxiety and depression. exercise can improve such psychological paramaters as self-confidence. feelings of control. self-determination. self-sufficiency. Exercise as an effective tool in promoting psychological wellbeing, positive and negative addiction to exercise are discussed. In sociological aspects. we have discussed socialization via sport. In general. sport proponents frequently claim that sport produce such desirable traits as democratic citizenship, moral character, adjusted personality. respect for constituted authority. cultivation of discipline. But at the other critics have condemned modern sport for excessive violence. overemphasis on winning. and exploitation of individuals. We have discussed in terms of these contrasting perspective. Whether traits. skills. and value learned in a specific sport context will carry over to other contexts depends upon several dimensions of social interaction.

액체크로마토그래피/질량분석법을 이용한 랫트 혈장내의 Surfactin C의 정량법에 관한 연구

Surfactin isolated from Bacillus subtilis has a strong surface tension-lowering activity, together with antiviral, antitumor, fibrinolytic and hypocholesterolemic activities. LC/MS is a simple, rapid and effective technique for the determination of surfactin C in rat serum. The separation of surfactin was achieved on reverse phase column. The mobile phase consisted of 0.1% trifluoracetic acid in water (A) and acetonitrile (B). As a result of analysis of blank rat serum samples, matrix interference was not shown. The values of precision and accuracy were satisfied w the guideline. A newly developed LC/MS method for the determination of surfactin C was successfully applied in its pharmacokinetic analysis.
