        중국 스마트도시의 네트워크안전관리에 관한 법적 고찰

        차세대 정보기술의 적용은 도시운영의 효율을 크게 높일 뿐만 아니라, 더욱 많은 네트워크안전의 위험요소를 가져왔다. 중국의 스마트도시 네트워크안전관리는 네트워크 인프라리스크가 날로 심각해지면서 시스템정보가 쉽게 침해되면서 이른바 '시험적 운영을 통한 사후문제처리'가 가진 업무처리상의 3대 문제점을 가져왔다. 또 '정보보안'에서 '네트워크안전'으로의 전환은 이미 정보보안분야의 총체적이고 종합적이며 융합적인 변화 추세를 반영하고 있으며, 스마트도시 네트워크안전 문제는 새로운 시대적 배경으로 인해 전통적 네트워크 보안 문제에 대해 심화되었음을 알 수 있다. 이에 본 연구에서는 중국의 네트워크보안의 적절성 문제에서 출발하여 스마트도시의 기술집약성의 특징을 결합하여 중국 스마트도시의 네트워크보안에 현존하는 문제를 검토하였다. 전통적인 네트워크안보와의 비교분석을 통해 스마트도시의 보안은 정적 방어 안전에서 역동적 이용 안전으로, 단일 국지적 보안에서 전체적 보안으로, 사전 통제에서 사후적 평가 강화로 전환되어야 한다는 것을 알 수 있다. 스마트도시의 네트워크안전관리는 반드시 이러한 세 가지 변화추세에 부합해야 자신의 발전방향에 맞는 법률과 제도의 보장 메커니즘을 세울 수 있다. 따라서 스마트도시의 네트워크보안은 기존의 네트워크보안 관련 법률제도에서 스마트도시 네트워크보안의 특수성을 결합하여 제도적으로 최적화되어야 하며, 구체적으로 다른 법률과의 연계, 핵심 네트워크 인프라 및 보안 모니터링, 사후 손실 위험 분산 메커니즘의 구축 등 세 가지 측면에서 이루어져야 할 것이다. The application of new generation information technology not only greatly improves the efficiency of urban operation, but also brings more cybersecurity risks There are three major problems in the cybersecurity governance of smart cities in China, namely, the increasingly severe risk of network infrastructure, the vulnerability of system information, the lack of in-process evaluation and post rescue. Through the comparative analysis with traditional cybersecurity, it can be found that the cybersecurity of smart city should change from static defense security to dynamic utilization security, from single local security to overall security, from focusing on pre control to strengthening evaluation in the process and relief afterwards. Therefore, the cybersecurity of smart city should be optimized on the basis of the existing cybersecurity legal system combined with the particularity of the cybersecurity of smart city. The network security governance of smart city must conform to the three changing trends before we can establish the legal system guarantee mechanism which conforms to its own development direction. In terms of legislation, we should start from the perspective of information security risk management, step by step, aim at cultivating the internal governance mechanism of information controllers, build sufficient legal deterrence through the external incentive of legal responsibility, and promote information holders, controllers and regulators to actively perform their legal responsibilities. In the protection of critical infrastructure, hierarchical management and specialized agency management are required, and evaluation standards in the operation process are refined to establish a complete indicator system. In the construction of the mechanism of post-incident loss risk, the government can first provide detailed regulations on the circumstances under which the government assumes full responsibility, and other parts can use the insurance system to allow data owners, controllers, and users to share the risk of loss in the form of insurance premiums, thereby constructing a complete post-incident loss risk dispersion mechanism.

        Serum Insulin-Like Growth Factor Binding Protein 7 as a Potential Biomarker in the Diagnosis and Prognosis of Esophagogastric Junction Adenocarcinoma

        Background/Aims: Esophagogastric junction adenocarcinoma (EJA) is a malignant tumor associated with high morbidity and has attracted increasing attention due to a rising incidence and low survival rate. Pathological biopsy is the gold standard for diagnosis, but noninvasive and effective tests are lacking, resulting in diagnoses at advanced stages. This study explored the diagnostic value of insulin-like growth factor binding protein 7 (IGFBP7) in EJA. Methods: A total of 120 EJA patients and 88 normal controls were recruited, and their serum levels of IGFBP7 were measured by enzymelinked immunosorbent assay. Receiver operating characteristic (ROC) curve analysis was used to assess the diagnostic value, and Pearson chi-square analysis was used to evaluate the correlation between IGFBP7 and clinical parameters. Kaplan- Meier survival analysis was carried out to assess the effect of IGFBP7 on overall survival (OS). Results: The levels of IGFBP7 were higher in both early- and late-stage EJA patients than in normal controls (p<0.001). The area under the ROC curve for EJA patients was 0.794 (95% confidence interval [CI], 0.733 to 0.854), with a cutoff value of 2.716 ng/mL, a sensitivity of 63.3% (95% CI, 54.0% to 71.8%) and a specificity of 90.9% (95% CI, 82.4% to 95.7%). For the diagnosis of early-stage EJA, the same cutoff value and specificity were obtained, but the sensitivity of IGFBP7 was 54.3% (95% CI, 36.9% to 70.8%). Patients with low IGFBP7 protein expression had lower OS than those with high expression (p=0.034). The multivariate analysis showed that IGFBP7 is an independent prognostic factor for EJA (p=0.011). Conclusions: Serum IGFBP7 acts as a potential diagnostic and prognostic marker for EJA.

        The implications of signaling lipids in cancer metastasis

        Metastasis is the most malignant stage of cancer. Lipid metabolic abnormalities are now increasingly recognized as characteristics of cancer cells. The accumulation of certain lipid species, such as signaling lipids, due to the avidity of lipid metabolism may be a causal factor of tumor malignant progression and metastatic behavior. In this review, we first describe signaling lipids implicated in cancer migration, invasion and metastasis. Next, we summarize the regulatory signaling hubs of lipid anabolic and catabolic metabolism. We then address lipid-rich circulating tumor cells (CTCs) and the lipid composition of exosomes budded off from tumor cells. We also present advances in targeting the regulatory hubs of lipid metabolism and signaling lipids in cancer therapy. Given the complexity of metabolic disorders in cancer, the development of significant portfolios of approaches to target signaling lipids by the integration of multiple chemical modulations, as well as molecular imaging modalities, should offer promising strategies for cancer therapy.

        Insurability of Drunk Driving Liability in China - From the Perspective of Public Function of Liability Insurance -

        음주운전 책임의 보험적용 가능성, 즉 보험사가 피보험자의 음주운전으로 인한 교통 사고에 대해 보험금을 지급해야 하는지에 대하여 중국 내에서 논란이 있어 왔다. 이는 현재 발효 중인 입법과 상충되는데, 1995년 제정된 ‘보험법(保险法)’은 2002년, 2005년, 2013년 개정되면서 이에 대해 부정적인 시각을 견지해 왔다. 또 2006년 ‘자동차교통사 고 강제보험 조례(机动车交通事故责任强制保险条例)’ 제22조는 이 문제에 대하여 별도 의 규정을 두고 있지만, 이견이 있다는 지적에도 2019년 개정이 이루어지지 않았다. 2012년 최고인민법원은 ‘도로교통사고 손해배상 사건의 적용에 관한 법률의 일부 문제 에 관한 최고인민법원의 해석(最高人民法院关于审理道路交通事故损害赔偿案件适用法 律若干问题的解释)’을 공포하고, 제18조에서 이를 지지한다는 입장을 확정하였다. 이처 럼 규정들의 충돌은 법관의 사법 실무에 난제로 작용하고 있다. 한편, 10여 년 전부터 법관이 음주운전 책임의 보험적용 가능성을 지지하는 판례가 나오기도 하였는데, 2006-2012년 168건, 2013-2019년 262건으로 확인되었다. 또 같은 조문을 적용할 때 판사 가 내리는 결론이 일관되지 않은 것으로 나타났다. 책임보험의 공적 기능이라는 관점에 서 볼 때, 음주운전 책임의 보장성이 뒷받침되어야 한다는 점도 법관들이 갈수록 지지 하는 요인이다. 책임보험의 공적 기능은 다른 보험에 비해 피보험자와 피해자를 더 많 이 보호함으로써 국가 금융 리스크 관리의 방안이 된다. 이는 미국의 실무와 이론에서 책임보험의 급속한 발전을 비롯하여 음주운전 책임 문제를 해결하는 근본적인 동력이 라는 것을 증명하고 있으며, 그 진행 과정에서 도덕적 문제를 배제할 수 없다. 중국의 이와 같은 논란과 관련하여 균형 잡힌 책임보험의 공적 기능과 상업적 관계를 발전시키 는 데는 최근 영국의 자동차보험제도 개혁의 성과를 참고하여 중국 입법을 보완하여야 할 필요가 있을 것이다. 이에 본 연구에서는 먼저 자동차 음주운전의 보험금 지급과 관련하여 중국 입법에서의 충돌 여부를 확인하고, 실제 사례에서 판사의 지지 관점을 분석한다. 이를 다시 책임보험의 공공기능 관점에서 음주운전의 위험성을 입증한다. 이를 통해 책임보험의 공공기능과 상업성을 어떻게 균형 있게 할 것인지에 대하여 의견 을 제시하였다. The insurability of drunken driving liability, that is, whether insurance companies should pay for traffic accidents caused by the insured who is a drunk driver, has always been a controversial issue in China. Current legislation is conflicting. Insurance Law of the People’s Republic of China 1995 insists a negative view through the amendments in 2002, 2005, and 2013. Article 22 of Regulation on Compulsory Traffic Accident Liability Insurance for Motor Vehicles 2006 specifically this issue is believed to be ambiguous and still did not respond it in the 2019 revision. the Supreme people's Court in 2012 enacted the Interpretation on Several Issues Concerning the Application of Law in the Trial of Cases on Compensation for Damage in Road Traffic Accidents, which has established a supportive position in Article 18. These conflicts have been bringing difficulties to Judges in judicial practice. On the other hand, Judges have been increasingly inclined to support the insurability of drunk driving liability in judicial cases since more than a decade ago, as confirmed by the results of 168 cases between 2006 and 2012 and 262 sample cases between 2013 and 2019. However, these cases also show that the conclusions reached by judges in the application of the same provision are not uniform. From the perspective of the public function of liability insurance, the insurability of drunk driving liability should be supported, which is also the main reason why more and more Judges have been becoming supporters. Compared with others, the public function of liability insurance means that it can provide more protection both for the insured and victims, as a result, it would be a financial approach in governing risks of the State. And the practice and theoretical research in the US have proved that it is the fundamental driving force for the rapid development of liability insurance, including settling the problem of drunk driving, and the decline of moral hazard is also essential for the developing process. As far as the dispute, we should balance the relationship between public function and the commercial nature of liability insurance in the development, improve Chinese law by learning from the reform achievements of the UK in recent years. Accordingly, this article is divided into four parts. First of all, conflicts in current Chinese legislation are sorted out; secondly, there comes an analysis of the supporting views by Judges in judicial cases; thirdly, a key argument is demonstrated, that is, the insurability of drunk driving risk should be affirmed from the perspective of the public function of liability insurance; finally, the focus is how to balance the public function and commercial nature of liability insurance.

        An Investigation into the Characteristics of a Novel Rotatable Pantograph Catenary System for High-Speed Trains

        High speed trains receive traction electrical energy from a high-voltage catenary via a pantograph catenary system (PCS). As the velocity of trains increases, the traditional PCSs face signifi cant challenges, such as strong aero resistance under highspeed conditions, severe electrochemical corrosion caused by poor contact between the pantograph strip and the catenary, harmful wear both on the pantograph strip and the contact wire produced by high-speed sliding friction between them, etc. The eff ectiveness and reliability of the PCS has a direct impact on the performance and safety of the HTS power supply. In order to alleviate some of these bottleneck eff ects related to the operation of the currently used PCSs, especially under high-speed conditions, this paper proposes a novel confi guration where rotatable pantograph rollers replace the currently used pantograph strips. As the sliding friction is now replaced by rotating friction, this has numerous benefi ts, such as less friction heat, better heat dispersion and improved catenary-tracking performance. Moreover, should the whole system be modularized, it could adapt to diff erent levels of traction power through adjusting the number of rollers.

        Lactate exacerbates lung damage induced by nanomicroplastic through the gut microbiota–HIF1a/PTBP1 pathway

        Exposure to nanomicroplastics (nano-MPs) can induce lung damage. The gut microbiota is a critical modulator of the gut–lung axis. However, the mechanisms underlying these interactions have not been elucidated. This study explored the role of lactate, a key metabolite of the microbiota, in the development of lung damage induced by nano-MPs (LDMP). After 28 days of exposure to nano-MPs (50–100 nm), mice mainly exhibited damage to the lungs and intestinal mucosa and dysbiosis of the gut microbiota. Lactate accumulation was observed in the lungs, intestines and serum and was strongly associated with the imbalance in lactic acid bacteria in the gut. Furthermore, no lactate accumulation was observed in germ-free mice, while the depletion of the gut microbiota using a cocktail of antibiotics produced similar results, suggesting that lactate accumulation in the lungs may have been due to changes in the gut microbiota components. Mechanistically, elevated lactate triggers activation of the HIF1a/PTBP1 pathway, exacerbating nano-MP-induced lung damage through modulation of the epithelial–mesenchymal transition (EMT). Conversely, mice with conditional knockout of Ptbp1 in the lungs (Ptbp1flfl) and PTBP1-knockout (PTBP1-KO) human bronchial epithelial (HBE) cells showed reversal of the effects of lactate through modulation of the HIF1a/PTBP1 signaling pathway. These findings indicate that lactate is a potential target for preventing and treating LDMP.

        Model tests on bearing capacity and accumulated settlement of a single pile in simulated soft rock under axial cyclic loading

        The research reported herein is concerned with the model testing of piles socketed in soft rock which was simulated by cement, plaster, sand, water and concrete hardening accelerator. Model tests on a single pile socketed in simulated soft rock under axial cyclic loading were conducted and the bearing capacity and accumulated deformation characteristics under different static, and cyclic loads were studied by using a device which combined oneself-designed test apparatus with a dynamic triaxial system. The accumulated deformation of the pile head, and the axial force, were measured by LVDT and strain gauges, respectively. Test results show that the static load ratio (SLR), cyclic load ratio (CLR), and the number of cycles affect the accumulated deformation, cyclic secant modulus of pile head, and ultimate bearing capacity. The accumulated deformation increases with increasing numbers of cycles, however, its rate of growth decreases and is asymptotic to zero. The cyclic secant modulus of pile head increases and then decreases with the growth in the number of cycles, and finally remains stable after 50 cycles. The ultimate bearing capacity of the pile is increased by about 30% because of the cyclic loading thereon, and the axial force is changed due to the applied cyclic shear stress. According to the test results, the development of accumulated settlement is analysed. Finally, an empirical formula for accumulated settlement, considering the effects of the number of cycles, the static load ratio, the cyclic load ratio and the uniaxial compressive strength, is proposed which can be used for feasibility studies or preliminary design of pile foundations on soft rock subjected to cyclic loading.

        Shen-Kang protects against tacrolimus-induced renal injury

        Background/Aims: Evidence suggests that Shen-Kang (SK), a traditional Chinese herbal medicine, protects against various types of renal injury. In this study, we evaluated whether SK treatment confers renoprotection in a rat model of chronic tacrolimus (TAC) nephropathy. Methods: Rats were treated daily with TAC (1.5 mg/kg, subcutaneously) and SK (450 mg/kg, intravenously) for 4 weeks. The effects of SK on TAC-induced renal injury were assessed by measuring renal function, urine albumin excretion, histopathology, inflammatory cell infiltration, expression of profibrotic (transforming growth factor β1 [TGF-β1] and TGF-β inducible gene-h3 [βig-h3]) and proinflammatory cytokines, oxidative stress, and apoptotic cell death. Results: Administration of SK preserved glomerular integrity (fractional mesangial area and Wilms tumor 1-positive glomeruli), attenuated tubulointerstitial fibrosis, and reduced the number of ectodermal dysplasia 1-positive cells, and this was paralleled by improved urine albumin excretion and renal dysfunction. At the molecular level, SK treatment suppressed expression of TGF-β1/Smad2/3, βig-h3, and proinflammatory cytokines. Oxidative stress and apoptotic cell death were significantly decreased with SK treatment, and apoptosis-related genes were regulated toward cell survival (active caspase-3 and the B-cell lymphoma-2/ Bcl2-associated X [Bcl-2/Bax] ratio). Conclusions: SK protects against TAC-induced renal injury.

        ORiginal Article : Tryptase and Protease-Activated Receptor 2 Expression Levels in Irritable Bowel Syndrome

        Background/Aims: Previous studies have revealed that mast cells (MCs) may activate the protease-activated receptors and release of neuropeptides involved in the pathogenesis of irritable bowel syndrome (IBS). The levels of proteaseactivated receptor 2 (PAR-2) and tryptase can contribute to understanding the pathogenesis of IBS. Methods: Colonoscopic biopsies were performed of 38 subjects (20 with IBSdiarrhea [IBS-D], eight with IBS-constipation [IBS-C], and 10 healthy volunteers). The mRNA and protein levels of tryptase and PAR-2 were assessed by real-time PCR and Western blot. The levels of vasoactive intestinal peptide (VIP), substance P (SP), and calcitonin gene-related peptide (CGRP) were measured by immunohistochemistry, and MCs were counted by toluidine blue staining. Results: Significant increases in the mRNA expression of tryptase (p<0.05, IBS-D, IBS-C vs control) and PAR-2 (p<0.05, IBS-D, IBS-C vs control) and in the tryptase protein level (p<0.05, IBS-D, IBS-C vs control) were detected in IBS. Elevations of MCs, CGRP, VIP and SP (p<0.05, IBS-D vs control) were observed for IBS-D only. Conclusions: Tryptase levels may upregulate the function of PAR- 2, resulting in the release of neuropeptide and they were correlated with clinical symptoms associated with IBS.         Effects of bmim[PF6] treatments with different concentrations on microbial activity of Saccharomyces cerevisiae

        −To study the role of ionic liquid as a solvent in whole cell biocatalyst, it is necessary to probe the effects of ionic liquid treatments on microbial activity. In this paper, Saccharomyces cerevisiae was selected as a test bacterium to study the effects of bmim[PF6] ionic liquid in different concentration on yeast activity through determining the growth curve, sugar degradation curve, microbial activity, colonial morphology and cell morphology. The results revealed that the growth of yeast is inhibited strongly in low concentration ionic liquid, while the lethal effect is feeble in high concentration ionic liquid. This result was totally different from that of supercritical CO_2 treatment or high concentration benzene methanol treatment which would lead most yeast to death.
