      • 가사사건의 상담제도 발전방안에 관한 연구

        건강한 가족관계의 지속적 재구성을 위한 가사상담제도는 최근 변화와 발전을 거듭하고 있다. 이 연구는 현행 가사상담제도의 체계와 운영 현황을 돌아보고, 가사상담제도를 더욱 발전시킬 수 있는 구체적 개선방안을 제시하고자 하였다. 이를 위하여 먼저, 논의의 대상이 된 가사상담의 개념을 명확히 하고 그 필요성과 효용성을 검토하였다. 다음으로, 미국, 독일, 프랑스, 일본, 오스트리아, 호주 등에서 운영하고 있는 다양한 가사상담제도를 조사하였다. 특히 활용 가능성이 큰 미국 캘리포니아 주의 가사상담 관련 법 규정과 오스트리아의 상담 가이드라인을 번역하여 부록으로 첨부하였다. 또한, 우리나라 각 법원의 가사상담제도 운영 실태를 조사하고 이를 분석·정리하였다. 이러한 과정을 통하여 도출된 가사상담제도의 발전방안은 크게 가사상담 활성화를 위한 일반적 방안, 쟁점별 방안, 입법론 등으로 나누어 정리할 수 있다. 일반론으로는 협의이혼의 의사확인사무 및 가족관계등록사무 처리 지침 제4조 제1항의 준수, 법원의 적극적 홍보와 안내, 인적·물적 시설의 확충 등을 제안하였다. 나아가 원칙적 상담제도, 법원 내부 인력의 충원, 상담위원의 관리, 가이드라인의 설정, 상담 유형의 다양화, 가정폭력사건에서의 일반적 상담제한에 관한 논의, 비송사건에서의 상담 활성화, 상담 비용의 문제 등을 쟁점별로 다루었다. 마지막으로는 일반적 상담 의무화에 대한 대안으로서 선택적 상담명령제도의 도입을 제시하였다. 이혼 절차에서의 가사상담이 미성년 자녀를 비롯한 가족 모두에게 실질적 도움을 주는 법원의 후견적·복지적 제도로 정착되기를 바란다. The family counseling system promoting healthy and enduring family relationships has continued to change and make progress. The purpose of the present research is to examine the current system and propose adequate and efficient measures to improve family counseling. After defining the concept of ‘family counseling’, this research explores the necessity and benefits of the system by conducting a comparative law analysis that studies the systems of the United States, Germany, France, Japan, Austria and Australia. In particular due to their applicability in Korea, the Californian legislation on family counseling and Austrian counseling guidelines are discussed extensively. Measures of improving the family counseling system are examined in the following manner. First, general measures are proposed. Second, specific measures such as introducing mandatory counseling, recruiting additional personnel within the court, managing counsellors, adopting guidelines, diversifying counseling methods, and others are explored. Finally, the adoption of optional court-ordered counseling is proposed as an alternative to general mandatory counseling. In-court counseling services should hopefully contribute to establishing a court system of wardship and welfare that can provide actual assistance to minor children and other members of the family.

        츠리(池莉) 소설에 나타난 `집`의 의미 고찰

        본고는 츠리(池莉) 소설을 대상으로 하여, `집`이 어떻게 의미화 되고 있는지를 살펴본 것이다. 츠리는 신분의 상징으로서 집과 젠더수행의 장소로서 집에 주목한다. 첫째, 개인의 신분을 상징하는 부호로서 `집`은 지식인(적)/소시민(적), 문명/비문명, 지식/지식 없음, 정신/반(反)정신, 우/열로 이항 대립항을 구성하고 있다. 츠리는 우월성을 속성으로 하는 집의 이면에 자리한 불합리성과 불공정을 발견함으로써, 신분의 부호로서 이분화된 집의 경계를 허문다. 그녀는 이러한 경계 허물기를 통해, 지식인(적)/소시민(적)으로 이분화된 `집`을 각각 정신과 물질에 상응하는 것으로 배치하고 우열을 논하는 데에서 비껴가면서, 화해를 모색한다. 둘째, 젠더가 (재)생산되는 장소로서 집을 해체한다. 이는 두 가지 측면을 통해 이루어진다. 하나는 사적영역인 집을 경제활동이 이루어지는 공적영역으로 확장하는 것이다. 이때 집은 여성이 경제적인 주체로서 재탄생하는 장소가 된다. 이로부터 수동적이고 종속적으로 인식되어 온 여성성은 주체성과 독립성을 확보하게 되는 것이다. 다른 하나는 남성다움의 동일시로서 집을 재구성한다. 남성다움과 유착한 집은 강력한 남성성을 보여주기도 하지만 남성성의 훼손을 상징하는 장소가 되기도 한다. `집`의 이러한 양가성은 사적영역인 `집`에서는 은닉되고 배제되었던 공적영역에서의 여성(성)을 드러내면서, 남성다움을 전유하는 `집`에 각인된 젠더질서 및 젠더관념을 전복한다. 공적영역에서의 여성(성)의 발견을 통해, 젠더화된 `집`의 해체를 넘어 젠더화된 `일상`에 대한 해체를 모색하고 있는 것이다. 바로 여기에 츠리 서사의 의미가 있다고 본다. This paper examines how `house` is meaningful in Chi Li`s novel. Chi Li focuses on the house as a symbol of status, and the house as a place of gender performance. First, as a sign that symbolizes an individual`s identity, `house` is divided into intellectual and petit bourgeois, and constitutes binarism into civilization/non-civilization, knowledge/non-knowledge, spirit/anti-spirit and superior/inferior. In recognizing the irrationality and unfairness behind house symbolizing intellectual and petit bourgeois, Chi Li shatters the boundaries of the binaralized house as a sign of identity. Second, it dismantles the house as a place where gender is (re)produced. This is accomplished through two aspects. One is to re-define a private area house as a public area in which economic activity occurs. The house, as a public area in which economic activity occurs, becomes a place where women are reborn as economic entities. Passive, dependent femininity is reconstructed as independent and subjective. The other dismantles the definition of the house which is identified with masculinity. The house identified with masculinity is a place that symbolizes the socio-economic capacity of men. According to the socio-economic ability of males, the house is a place symbolizing the realization of masculinity, and it becomes a place to fix the gender order while reproducing masculinity. It may become a place to experience the weakening or defamation of masculinity. At that moment, the house becomes a place where the gender order of masculinity and femininity is overturned. Through this, Chi Li reconstructed, and in a sense revolutionized the definition of the house as a place where traditional gender is (re) produced by dismantling the definition of fixed femininity or masculinity.

        예술고등학교 모델전공 지도자의 지도유형과 지도신뢰 및 지도효율성의 관계

        이 연구는 예술고등학교 모델전공 지도자의 지도유형과 지도신뢰 및 지도효율성의 관계를 규명하는데 있다. 이 를 위하여 서울에 소재하고 있는 H 예술 고등학교에 재학 중인 모델전공 고등학생 1〜3학년 158명에게 받은 설문 지를 최종 분석에 사용하였다. 연구결과는 다음과 같다. 첫째, 지도유형의 하위변인 중 질문지도와 긍정적 피드백 은 지도신뢰에 정(+)적 영향을 미치는 것으로 나타났고 부정적 피드백은 지도신뢰의 하위변인 중 인지적 신뢰에 부 (-)적 영향을 미치는 것으로 나타났다. 둘째, 지도유형의 하위변인 중 질문지도와 긍정적 피드백은 지도효율성에 정(+)적 영향을 미치는 것으로 나타났고 부정적 피드백은 지도효율성의 하위변인 중 인지된 기능수행향상에 부(-) 적 영향을 미치는 것으로 나타났다. 셋째, 지도신뢰의 하위변인 중 인지적 신뢰, 감성적 신뢰는 지도효율성에 정(+) 적 영향을 미치는 것으로 나타났고 행동적 신뢰는 지도효율성의 하위변인 중 인지된 기능수행향상에 정(+)적 영향 을 미치는 것으로 나타났다. 결론적으로 이 연구는 모델 지도분야도 지도유형의 형태에 따라 피교육생 수용반응이 다양하게 나타남을 확인할 수 있는 보고이고 좀 더 긍정적인 수용반응을 나타낼 수 있는 지도유형 내지는 지도교 안에 대한 심도 있는 논의가 필요함을 확인할 수 있는 연구이다. The purpose of this study is to investigate the relationship between instruction type and leadership reliability and instruction effectiveness of high school teacher who majored in model. For this purpose, we selected high school students, grades 1 to 3, who major in modeling at Hanlim Arts School in Seoul. The questionnaire was sampled using convenience sampling, which is one of the nonprobability sampling methods. The questionnaire was prepared reading and fill out by himself, through an evaluation instrument. A total of 158 copies of the collected questionnaires were used for the final analysis, the conclusions drawn from this study are as follows. First, there was a difference in instructional trust and instructional efficiency of model majors according to personal characteristics. First of all gender differences indicate that male students have higher level of instructional trust and instructional guidance than female students, According to the grade level, the first grade showed higher instructional trust and instructional guidance efficiency than the second and third grade students. Second, the instructional types of teacher who majored in model are affecting instructional trust. The low level of Instruction type, question map and positive feedback have a statistically significant effect on Instruction trust, Negative feedback was found to have an inadequate effect on the sub - variables of instruction trust, cognitive trust. Third, the instruction type of the model majors' leaders influenced instruction efficiency. The low level of the instruction type, instruction by question and the positive feedback were found to have a positive effect on the instruction efficiency, and the negative feedback affected, the low level of the map efficiency, the perceived function performance improvement negatively. Fourth, Instruction trust was found to affect Instruction Efficiency. Instruction trust and emotional trust which is the low level of Instruction trust, positively affect instruction effectiveness. Behavioral trust has a positive effect only on the improvement of perceived function performance which is low level of instruction trust

        한국어 초급 교실에서의 교사의 수정적 피드백과 학습자 반응

        This study intends to find the effective corrective feedback to lead the learners’ correction by observing Korean beginner class. The study analysed the videotaped classroom lessons firstly by classifying the errors as grammatical, lexical, phonological and complex errors, secondly classifying the corrective feedback as 6 types according to Lyster and Ranta (1997), and finally classifying the learners’ responses as uptake, no uptake, no opportunity, correction success, correction fail, repeated correction and student generated correction. The result is that recasts were provided in the highest frequency and led to the highest correction but low uptake and low student generated correction, which corresponds to the result of Lyster (1998). However, learners’ responses and teachers’ corrective feedback did not show any significant differences according to error types, which is different from the findings of Lyster (1998). The study also found that the low uptake following recasts occurred because teachers continued the topic, rather than students did not aware the corrective feedback.

      • 재외국민을 위한 가족관계등록사무 처리절차의 개선 방안에 관한 연구

        This report, recognizing the constitutional value of ‘overseas citizens protection’, proposes a couple of ways to enhance procedural rationality regarding family registration for overseas citizens. Overseas citizens, constrained by time and place, have practical difficulties in family registration despite their urgent requirements, but the current family registration procedures leave a lot to be desired in terms of meeting the needs of overseas citizens. A detailed examination of the problems related to family registration procedures, based on a structural analysis of relevant laws and current data, was confirmed by a survey of relevant officials. This report makes the following proposals on how to improve the current system. First, a specialized organization called the ‘Overseas Citizens Family Registration Center’ should be established. This organization would exclusively be in charge of family registrations for overseas citizens under the Seoul Family Court and have court officials with rich legal knowledge and practical experience conduct family registrations, through partial amendment of the 「Act on the Registrations, etc. of Family Relationship」. Second, overseas dispatch of court officials, now only implemented in Japan for diplomatic missions, should be expanded to US, China, etc. where many Korean citizens reside. This improvement might be able to establish a virtuous cycle of ‘accurate recordings in family registers’ through a ‘speedy and efficient registration procedure’ in accordance with ‘due reporting by overseas citizens’.

      • 국민과 함께하는 모의재판 실시 방안에 관한 연구 - 「일반국민용 모의재판 시나리오 모음집」 수록 -

        Considering that the mock trial program for the students has been actively studied and widely carried out, the similar program for the adults is hard to find and relevant materials are rare. The purpose of this research is to propose viable ways of conducting 'the mock trial for the general public'. For this goal, this research examines recent examples of mock trials for the general public through empirical studies, and suggests the ways to make mock trials more successful, and provides sample scripts of mock trial which can be useful at each court. First, after gathering the existing mock trial scripts for the general public, 3 pieces of mock trial scripts have been developed additionally. Each court may use the relevant script for its needs. Furthermore, this research makes step-by-step proposals on the rules in recruiting and organizing the participants. The approach was made prudently in view of various elements, since the adequacy of the participant composition is crucial for the success of the mock trial program. Moreover, the ways to promote ‘the mock trial for the general public’ are devised. As the mock trial is one of the judicial outreach programs for enhancing the empathy between the courts and the people, it is necessary to expand the base where mutual understanding and feedbacks are realized through reflecting the results into the judicial policy or actual trial. This report might contribute to establishing the mock trial as a novel outreach program, which makes relationship between the judiciary and the public much closer and communicative.
