      • 구미4공단지정 지역의 주거환경 및 민가의 공간구성적 특성에 관한 연구

        The study aims that research the characteristic of housing environment on 4 villages in the reserved area for Kumi national industrial park. Especially theses villages based on traditional agricultural economic living, will be changed to the industrial park, and so it need to record the village history and the distribution of existing house buildings and also to preserve the heritages of tangible & intangible culture. Thus the study bases on the housing environment for a history and living of housing. The contents of study is limited to declare the characteristics of the spatial plan of villages and the traditional house's typology. By the application of the space syntax analytic method, to four villages and it's houses, the actual surveying and interviewing and questioning were proceeded as the primary and main surveying on 8, 1997 and the supplementary surveying on 25-28, 8, 1998.

        Effect of moderate exercise training and low-fat diet on peritoneal macrophage immunocompetence in high-fat diet-induced obese mice model

        This study investigated the effect of moderate exercise training on macrophage immunocompetence in high fat diet-induced obese mice. To determine the differential effects of exercise training and low fat diet on macrophage, C57BL/6 male mice (4 week old,n = 32) were fed high-fat diet for 5 weeks to induce obese. The high fat-induced obese mice were then divided into four groups and differently treated by high/low fat diet and exercise training for a further 8 weeks; HHC (13 weeks high-fat diet), HHE (13weeks high-fat diet with 8 weeks Exercise training) and HLC (5 weeks high-fat diet and 8 weeks low-fat diet), HLE (5 weeks high-fat diet and 8 weeks low-fat diet with exercise training). The exercise groups were performed on a motorized treadmill, running for 30-60 min/day at 10-22 m/min, 0% grade for 8wks. Body weight was significantly decreased for those with a low-fat diet and exercise training (HLE). Macrophage phagocytosis was significantly increased by low-fat diet and exercise training (HLE). The percentage of stimulation of NO release induced by LPS was higher in HLE than in other groups. The percentage of stimulation of IL-1βrelease induced by LPS was higher in HHE and HLE than in other groups. The percentage of stimulation of IFN-γ release induced by LPS was higher in HLE than in other groups. These findings suggest that moderate exercise and low-fat diet have beneficial effects on macrophage immunocompetence in high fat diet-induced obese mice.

        The purpose of this study is to introduce emotional evaluation model of apartments' exterior environment in order to qualitatively improve residental environment and comfortableness of apartments. Two apartment housing estates recently built in the Daegu and one in the Kwangju area were selected for the purpose of this study. In this study, theevaluation group consisting of residents(housewife), 30 undergraduates and 30 students of architectural major field evaluated the extent of emotion by physical elements of the subject apartments on the basis of 30 SD emotional tranquility scales of each group. For this experiment, photographs were taken on March 23, 2000, and the evaluation of the extent of emotion was made on June 21, 2000. Effective statistical result values were drawn by analysing the data obtained, using the SPSSWIN statistical program.

        공용침해로 인한 손실보상이 성립되기 위해서는 공공필요를 위하여 법률이 정한 재산권의 공권적 침해로 인하여 개인에게 특별한 희생이 발생하여야 한다. 이러한 공용침해로 인한 손실보상을 올바로 이해하기 위해서는 현행 헌법의 테두리 내에서 재산권이 갖고 있는 법적 의의와의 관련 속에 공용침해의 요건 및 손실보상의 내용과 범위 등이 검토되어야 할 것으로 생각된다.

        이 건 대법원의 판단은 토지의 평면적 이용관계에 집착하거나 도시철도법상 지하부분에 대한 토지수용상의 보상산정기준인 입체이용저해율은 미실현 공간에 대한 표준적인 층별효용을 감안한 것이 아니라는 점을 간과한 오류를 범한 것이라고 할 것이다. 즉, 토지의 입체적 이용관계에 따른 등기설정이 가능한 현실정을 감안 한다면, 토지의 지하부분에 공공시설을 설치하기 위해 사업주체가 원고 소유 토지의 지하부분에 대한 사용은 입체적 토지이용관계에 있어서는 토지의 일부에 대한 수용에 상당한다고 할 수 있고, 토지의 입체적 이용관계에 있어서 잔여 토지 부분인 해당 지하면 이상의 토지에 대한 이용관계에서 발생하게 되는 부대비용은 토지수용법 제47조의 사업손실에 해당한다고 할 수 있다는 점, 이러한 부대비용의 발생은 현재의 과학기술수준으로도 해당 공공사업의 시행 당시에 이미 예측가능하고 특정 가능하다는 점 및 토지의 지하에 지하철과 같은 공공시설이 존재하게 됨으로써 지가의 상승이 아닌 지가의 하락과 같은 사회적 손실을 입게 된다는 점 등을 감안할 때 헌법 제23조의 정당한 보상의 실현이라는 차원에서 이 건과 같이 지하철 구조물과 신축계획 건물의 안전을 위하여 지하철 구조물 상부에 장스팬보와 옹벽 및 방수층 설치와 기계식 주차시설의 설치가 필요하게 되어 그와 같은 구조·용도 및 설비 변경을 위하여 소요되는 변경설계비와 추가공사비는 합리적인 범위 내에서 사업 손실로서 보상되어야 할 것이다.

        소위 "공익사업법"상 협의취득의 법적 성질 - 대상판례 : 대법원 2006. 10.13. 2006두7096 건물철거대집행계고처분취소 -

        From a point of spirit of the legislative which regulate administrative contract, if the administrative contract mainly take aim at public interest, it shall belong to the public law(namely "public law contract") on the following ground; First, Public interest takes precedence of private interest in connection with §37 ② Constitution. Second, any administrative contract shall stay within the boundary of legalism as possible, because current constitution exceptionally approves administrative contract to ensure the participation of citizen in the administrative process under the representative system. Finally, in comparison with right relief procedures, current administrative litigation system, which adopt inquiry by virtue of judge, easy system of provisional relief, very strict administrative proxy execution procedure and so on, is more convenient for citizen and friendly with human right than civil litigation system. Therefore, it is reasonable and consistent with the spirit of the so-called "Public Utilities Act" to conclude that the contract of land acquisition by agreement for public interest belong not to civil law but to public law. Considering that §3 supplementary provisions of "the Public Utilities Act", "any disposal․procedure and the others taken under the late act are considered to be taken under the correspond provisions of this act", do not exclude the written promise to remove the built voluntary and the duty to remove the built voluntary due to the written promise, it is reasonable to conclude that the duty due to the written promise belong to the duty of current law, namely public law duty based on §89 "Public Utilities Act".
