도심재개발사업의 상가세입자 정당보상에 관한 연구 : 용산 구역 사례를 중심으로

본 연구는 주택세입자에 비해 상대적으로 보상제도가 미비한 상가세입자들의 도심재개발사업에서 상가세입자의 정당보상요구에 대한 분석을 실시하였다. 이를 위하여 상가세입자들이 현행 영업보상에 대한 만족도와 요구사항을 포함한 사회적 인식을 분석하였다. 상가세입자 정당보상에 대한 인식분석 결과 도시정비사사업에서 상가세입자 손실보상은 최초 3년간의 평균이익을 기준으로 하여 최대 4개월분만 보상하는 기준에 대해 상가세입자들은 90.2%가 불합리적이며 개선이 필요하다고 응답하였으며, 영업손실에 대한 정당한 보상을 위해 어떠한 사항이 반영될 필요가 있는지 분석결과 대부분의 상가세입자들은 권리금 보상과 개발이후에 우선 입주권 등 재입주할 수 있는 권리를 보장해 주는 것이 필요하다고 판단하고 있음을 알 수 있었다. 이상의 분석결과를 기반으로 상가세입자 정당보상을 위한 시사점은 다음과 같다. 첫째, 권리금을 보상해 주어야 한다. 현재의 영업보상에서 이주대책이 없는 상태로 가장 큰 불만은 보상액 과소인 권리금 인정여부였음을 살펴 볼 수 있었다. 둘째, 도시정비사업 완료 후 기존 세입자에게 사전 협상 및 우선 입주 권리를 보장해 줄 필요가 있다. 셋째, 영세 상가세입자들의 재정착률 제고를 위해서 공공이 영세 상가세입자를 대상으로 저렴한 임차료로 공공임대상가를 운영할 필요가 있다. This study has committed an analysis on the proper compensation requirements for commercial tenants in urban redevelopment. For this, the requirements and social perception of the commercial tenants to current business compensation were analysed. After the cognition analysis on proper compensation for commercial tenants, 90.2% of the commercial tenants replied that the loss compensation with the standard of compensating only maximum 4 months according to initial 3 years of average profit is unreasonable and needs improvement. Through the analysis to find out what other factors can be reflected for proper compensation on business compensation, it was realized that most commercial tenants had made a judgement that compensation of the premium and priority of moving, things that insure the right to move in again were needed. Based on above analysis results, the implication for the proper compensation of commercial tenants are as following: First, the premium money must be compensated. The major discontent for not having a migration alternative was the underestimation of the compensation money without the acknowledgement of premium money. Second, negotiation beforehand with the tenant and priority of moving needs to be ensured after the completion of urban redevelopment. Third, a public leased commercial district on inexpensive rent should be run in order to enhance the rate of resettlement of small-scale commercial tenants.

Awakening of Wartime Sexual Assault in Paco's Story by Larry Heinemann

The U.S. government has taken the sexual assault of U.S. troops lightly, even though aware of the prevalence during the Vietnam War. Some conscientious veterans admitted and confessed to this fact, but the US media also did not report it much. However, Paco's Story (1986) by Larry Heinemann specifically describes the mass sexual assault of a Vietnamese sniper who killed two US sentry soldiers. The National Book Awards 1987 winning novel confirms the public's consensus on this issue. This paper studies the reality and problems of sexual assault in the U.S. military by analyzing Paco's Story by Larry Heinemann with the main question of whether sexual assault against an enemy can be admitted in a wartime situation. This article starts with introducing the US military sexual violence and media awareness of it at that time and analyzes the novel over the two scenes of sexual intercourse. The writer analyzes the first scene that Paco's squadron raped a Viet Cong female sniper while paying attention to the presence of the men's sexual desire in the criminal act in addition to racism and misogyny. Next, this research goes to the second scene of the imaginary love affair between Paco and Cathy, looking for the answer of what stands for Cathy's existence to Paco. Lastly, this research is expected to contribute to studying wartime sexual assault in other countries including the Vietnam War.

비엣 탄 응웬의 동조자에 나타난 형제애 고찰과 국제관계론적 해석

비엣탄응웬(Viet Thanh Nguyen)의 소설 동조자 속 세 명의 남성 등장인물들은 베트남전쟁과 이후 시기를 거치는 동안 자유주의와 공산주의의 서로 다른 정치이념을 추구하면서도 서로의 안위를 우선한 진한 형제애를 가진다. 그들의 형제애는 동포애와 인류애로 확장될 만큼 당시뿐만 아니라현재 베트남, 미국, 한국과 같은 베트남전쟁 당사국 사이에 조성된 우호적인 국제관계에 시사하는 바가적지 않다. 이 논문은 응웬의 화제작『동조자』에 등장한 남성 등장인물들이 함께 살아가고자 하는 형제애에 담긴 함의를 주로 베트남전쟁 이후 국제관계를 중심으로 고찰한다. 이를 위해서 우선 이 작품에대한 일반적인 연구 경향과 형제애를 설명한 선행연구를 비판적으로 분석함으로써 국제관계론적 해석의 필요성을 진단한다. 다음으로 형제애를 중심으로 본문을 다시 읽고 나서, 베트남전쟁 시기와 이후국제정세와 정치이념의 허구성을 밝힌 다음 소설에 나타난 형제애의 의미를 조명하고, 그것을 국제관계론적으로 당시 상황에 적용한다. 이 연구는 기존 접근법들과 다르게 중간자 역할을 담당한 주인공과그의 친구들 간 우정이 현재의 국제관계에도 적용 가능한 평화윤리가 될 수 있음을 밝혔다는데 의의를둔다. 더하여 이 논문은 미국과 프랑스 등 서방, 중국과 러시아의 공산주의 세력, 일본제국 등의 외세개입 때문에 발생한 베트남 등 아시아 국가들의 아픈 역사에 대한 공감대를 강조한다. 마지막으로 소설의 결말에서 주인공이 우리는 살 것이라고 다짐한 문구가 가진 함의에 대한 고찰을 후속 연구로 예상한다. During the Vietnam War and later periods, the three male characters in Viet Thanh Nguyen's novel, The Sympathizer, have a strong brotherhood that prioritizes each other's safety while pursuing different political ideologies of liberalism and communism. Their brotherhood has many implications for the friendly international relations established between the countries, such as Vietnam, the United States, and South Korea, to The Vietnam War as well as at the time, as it extends to fraternity and humanity. This paper examines the implications of the brotherhood in which the male characters in Nguyen's hottest work, The Sympathizer, want to live together, focusing on international relations mostly after The Vietnam War. To this end, this paper first diagnoses the necessity of interpretation in terms of international relations theory by critically analyzing the general research trend and previous studies that explained brotherhood of this work. Next, after rereading the text focusing on brotherly love, the researcher reveals the fictitious nature of the international situation and political ideology during and after The Vietnam War, and then illuminates the meaning of brotherly love in the novel, and applies it to the situation at the time in terms of international relations. Contrary to the existing approaches, this study is especially meaningful in revealing that the friendship between the protagonist, who plays the role of intermediary, and his two friends, can be a peace ethics applicable to current international relations. In addition, this paper emphasizes the consensus on the painful history due to the foreign intervention of Western countries such as the United States and France, Communist forces of China and Russia, and the Empire of Japan. Finally, a follow-up study is expected to examine the implications of the phrase in which the protagonist vowed to live in the plural at the end of the novel.
