        이 글은 법원에서 헌법판단이 이루어지는 사례를 공법영역과 사법영역으로 나누어 살펴본다. 먼저, 행정법 등 공법영역에서는 헌법이 직접 적용되는데, 근래 행정법상의 일반원칙 중 평등원칙, 비례원칙, 신뢰보호원칙 등이 헌법에 근거를 둔 헌법상 원칙으로 인정되고, 이러한 원칙들이 당해 재판의 결론을 좌우하는 주된 판단기준으로 작용하는 경우가 많아지고 있다. 즉, 법원은 종래 행정법 영역에서 심사기준으로 작용하던 행정법상의 일반원칙인 평등원칙, 비례원칙, 신뢰보호원칙의 근거가 헌법에 있음을 분명하게 밝히면서 헌법재판소의 결정례를 인용하는 등으로 헌법에 관한 법리들을 수용하고 있다. 더 나아가 헌법에 근거하여 적극적으로 적법절차의 원칙과 같은 새로운 행정법상의 일반원칙을 인정하고 이를 심사기준으로 적용하기도 하였다. 민법 등 사법영역에 있어서는 원칙적으로 일반조항을 매개로 헌법이 간접 적용된다. 즉, 법원에서는 연명치료 중단 사건에서처럼 민법 제103조의 반사회적 법률행위 조항, 종립 사립고등학교 종교교육 사건에서처럼 민법 제750조의 위법행위조항 등 일반조항을 매개로 헌법판단을 하여 왔다. 그러나 법원은 성전환자의 행복추구권 등을 근거로 구 호적법상 호적정정절차에 따라 성전환자의 성별정정을 허가할 수 있는 것으로 해석한 것과 같이 일반적인 법률해석에 있어서 헌법의 영향을 고려하기도 하였다. 또한, 헌법상 양성평등 조항 등을 근거로 종원(宗員)의 자격을 성년 남자만으로 제한하던 종래의 관습법을 폐기한 것처럼 관습법에 대한 사실상의 위헌심사를 하기도 하였다. 그리고 헌법상 경영권을 근거로 정리해고시 노동조합과 ‘합의’한다는 단체협약을 ‘협의’의 의미로 해석한 것처럼 사인간의 법률행위를 해석함에 있어서도 헌법의 영향을 고려하기도 하였다. The Constitution was directly applied to the public law including sub-disciplines such as the administrative law. First of all, recently, the principles of equality, proportionality and protection of reliability, which were general principles of the administrative law, were accepted as the principles of the constitutional law based on the Constitution. These principles are increasingly becoming the critical standard of judgement in ruling relevant cases. In other words, the courts are decidedly enunciating that the general principles of the administrative law, including the principles of equality, proportionality and protection of reliability which once served as judgment standards in the field of the administrative law, were grounded in the constitution. Courts are accepting constitution theory and citing case rulings made in the counstitutional court. Furthermore, courts actively accepted new general principles of the administrative law such as the principle of due process based on the constitution, and applied these new principles as ruling standards. The general clause was indirectly applied in civil law which includes the Civil Act. Courts have been making constitutional decisions through the general clause. A decision on the termination of life prolonging treatment on the basis of Civil Act Article 103 regarding antisocial legal actions, and a case ruling on religious education taught in private high schools founded by religious groups on the basis of Civil Act Article 750 are examples of the constitutional influence. The court considered the implications of the constitutions when making a general legal interpretation. This is illustrated in a court"s ruling to authorize the change of legal gender according to the currently defunct Family Register Act following the family register correction for sexual transgenders based on the court"s interpretation of the right to pursue happiness for sexual transgenders. The court also ruled, in practice, a common law unconstitutional by deciding that limiting the qualification requirement to register in the family registry to adult males was against the constitution citing the constitutional provision on gender equality, which brought an end to the existing customary law. The court also considered the implications of the constitution when interpreting legal actions between corporations and individuals. The court’s decision on layoffs made on the basis of constitutional management rights interpreted collective agreement’s term “agreement” with labor unions as “discussion”.

        대학 성폭력 상담자의 직무수행에서의 어려움에 관한 질적 연구

        연구목적: 본 연구는 대학 성폭력 상담자가 직무를 수행하는 과정에서 경험하는 어려움을 심층적으로 담아내고 이해하는데 있다. 연구방법: 연구를 위해 4년 이상 경력을 갖고 있는 대학 성폭력 상담자 9명을 연구참여자로 모집하여 일대일 심층면담을 실시하였다. 면담 내용은 전사되었고 연구자의 노트 등의 자료를 수집하여 지속적 비교분석 방법을 통해 질적 분석을 실시하였다. 연구결과: 연구 결과, 대학 성폭력 상담자들이 직무수행에서 경험하는 어려움은 여섯 개의 범주로, 전문성에 대한 고민, 열악한 업무환경, 낮은 지위와 권한으로 인한 업무의 한계, 외부의 위협과 적대적 태도, 민감한 성 문제를 다루는 데서 오는 스트레스, 사회적․제도적 지원체계의 문제점으로 나타났다. 논의 및 결론: 본 연구 결과는 효율적인 대학 성폭력 상담 환경 조성 및 상담자 교육, 치유를 위한 시사점을 제공해 주었다. 연구의 마지막에 후속연구를 위한 제언을 제시하였다. Purpose: This study aims to capture and understand in depth the difficulties experienced by college sexual violence counselors in the process of their job performance. Method: For the study, nine college sexual violence counselors with more than 4 years of experience were selected as research participants and interviewed. Interviews were transcribed and researcher s notes were collected. The data were analyzed by using Constant Comparative Analysis method. Results: Results revealed 6 categories of counselors’ difficulties: Concerns over professionalism, Poor work environment, Limitations of work due to low status and authority, External threats and hostile attitude, Stress of dealing with sensitive sexual issues, and Problems with social and institutional support systems. Conclusion: This study provided implications for creating an efficient college sexual violence counseling environment and educating and healing counselors. Finally, suggestions for future studies were presented.

      • 일본 탄소중립 법제에 나타난 지방분권에 관한 연구: 기후변동법과 지구온난화 대책 추진에 관한 법률을 중심으로

        As a global paradigm, “2050 Carbon Neutrality” is in full swing, and maintenance is taking place in all fields, including the economy, industry, and society of each country. Korea’s “Basic Law on Low Carbon Green Growth,” which will take effect in 2022, has also been greatly supplemented compared to Korea’s existing Carbon Neutral Response Act, dealing with strengthening the role of local governments and citizens in all areas, but there are still limitations in local governments’ calls for autonomous carbon neutrality. On the other hand, Japan’s climate change legislation specifically stipulates calls for active and voluntary cooperation between ‘local public organizations’, industries, and citizens. In addition, in the case of Japan’s Climate Change Act and the Global Warming Measures Promotion Act, local governments’ policies can be implemented quickly and autonomously in accordance with the correction. Through the case of Japan’s climate change-related legislation, which deals with decentralization and local autonomy as important, we intend to derive meaningful implications for the carbon neutrality of local governments in Korea. Through this, it is expected that in line with the acceleration of the carbon-neutral city, Korea’s regional industrial advancement and balanced regional development can be promoted.

        2004년부터 2019년까지 국내 영유아 교육 분야 실행연구 논문의 동향 분석

        본 연구의 목적은 2004년부터 2019년까지 국내 영유아 교육 분야에서 출간된 실행연구의 동향을 분석하는 것이다. 본 연구의 분석대상은 각 대학의 석·박사 학위 논문 23편과 한국연구재단의 등재 학술지 및 등재후보지에 게재된 논문 97편으로 총 120편의 영유아 교육 분야 실행연구 논문들이다. 분석기준은 시기, 목적, 주제, 방법으로 했으며, 방법 측면에서 구성원의 형태, 연구 방법의 기준으로 분류하였다. 연구 결과는 첫째, 시기별 분석으로서 지난 16년 동안 실행연구의 출간이 지속해서 증가해왔으며, 2016년부터 2019년까지 가장 많은 실행연구가 출간되었다. 둘째, 연구목적에 대한 분석으로 전문성 발달을 위한 연구가 가장 많았다. 셋째, 연구주제에 대한 분석으로 개별교실 차원이 가장 많았고, 그중에서 교수·학습방법 탐색이 가장 높았다. 넷째, 연구 방법에 대한 분석으로 구성원의 형태는 공동연구가 단독연구보다 높았으며, 연구 방법에 대한 분석으로는 질적연구가 120편 중 113편으로 대부분을 차지했다. 이러한 연구 결과를 토대로, 향후 국내 영유아 교육 분야에서 실행연구가 나아가야 할 방향 및 발전방안을 논의했다. The purpose of this study is to analyze the trends of educational action research in Korea from 2004 to 2019. 120 action research of early childhood education were selected for the purpose of analysis, which were theses, 23 master s and doctorate papers at each university, and 97 research papers included in academic journals that registered and were going to register with the National Research Foundation of Korea. The analysis criteria were based on the study time, purpose, theme, method and in terms of method the members were classified by their form and research methods. First, as a result of the time when the studies were conducted, the publication of action research has been steadily increasing over the past 16 years, with the largest number of action research published from 2016 to 2019. Second, as for the purposes of the studies, the largest number of the studies aimed to accelerate the development of professionalism. Third, regarding research themes, the most dominant individual classroom dimension, Specifically, exploring the method of professors and learning was the highest. Fourth, in an analysis of research methods, form of the members were the joint studies outnumbered the studies conducted by single researchers, qualitative studies accounted for 113 of the 120. Based on the results, the direction and right development plan for that in the future of domestic action researches in the area of early childhood education were discussed.

      • 멀티플랫폼 시대 TV 프로그램 평가요소에 대한 탐색적 논의 : 기존 시청률 조사의 문제점과 빅데이터 활용을 중심으로

        다매체 다채널 시대로 변화하면서 하나의 TV 콘텐츠가 주목받는 것은 이전보다 어려워졌고, 시청자가 적극적으로 콘텐츠를 공유하고 활용하는 방법 또한 매우 다양해졌다. 다양한 콘텐츠가 존재하고 원하는 콘텐츠를 시공간적 제한 없이 소비할 수 있는 환경 하에서 콘텐츠 평가의 중요성은 더해졌다. TV 프로그램을 평가함에 있어 기존에는 시청률이 주된 지표로 사용되었다. 하지만 고정형 매체에서 이동형 매체로 시청 환경이 변화하고, 가족 단위에서 개인 단위 소비로 시청 행태가 변화하고 있는 현 시점에서 기존의 피플미터를 통한 양적 시청률 평가 방식은 정확한 측정에 있어 한계를 가지게 되었다. 이러한 맥락에서 본 연구는 본격적인 빅데이터 분석을 활용하는 시스템이나 모델 구축에 앞서서 멀티플랫폼 환경에서 보다 신뢰성 있는 TV 콘텐츠 평가를 위해 반드시 포함되어야 요소에 대해, 최근 다양하게 시도되고 있는 사례를 중심으로 탐색적으로 살펴보고자 한다. As people are getting used to multi-media and multi-channel environment, people actively enjoy and share content in various ways. We can watch TV programs regardless of time and space through VOD services. Also, we are more and more commonly watching media content with portable devices rather than with television in our home and consuming TV programs more individually than as a family. However, previous way of evaluating TV program tends to rely on the simple audience ratings based on the people-meter arousing necessity for a new way of evaluating TV program. In this context, this study aims to search factors that need to be considered to have a more credible evaluation on TV content in the multi-platform environment. This study provides exploratory analysis concentrating on various cases that are newly tried recently. More specifically, limitations of the previous audience ratings are analyzed and developments in recent alternative TV program evaluation models are discussed. Finally, we bring out factors and directions of the advanced TV program evaluation model utilizing big data.

        공정무역 커피에 대한 소비가치가 브랜드 태도와 구매의도에 미치는 영향

        When purchasing products or services, consumers tend to purchase multiple value attributes through the acquisition of a product rather than physical characteristics. This study empirically analyzed the relations between consumption value, brand attitude, and purchase intention of customers purchasing fair-trade coffee, by dividing consumption values that would have significant effects on consumers' actual purchase behavior into five levels. Among the consumption value factors of customers purchasing fair-trade coffee, the functional value, social value, emotional value, and rare value all had significant effects on brand attitude and purchase intention while the influence of situational value on brand attitude and purchase intention was not verified. These finding are partially concordant with those of preceding studies, and the consumption value of consumers purchasing fair-trade coffee has positive effects on purchase behavior; therefore, it would be necessary for companies selling fair-trade products to understand consumers' specific values. Moreover, analysis of the influence of brand attitude on purchase intention of customers purchasing fair-trade coffee revealed that purchase intention increased when brand attitude was higher. These finding indicate that it is necessary to identify measures to increase purchase intention by targeting consumer groups with high brand attitude with intensive promotions.

        국가 사이버보안 수준 향상을 위한 GCI의 지표개선 방안

        The Global Cybersecurity Index (GCI) developed by the International Telecommunication Union (ITU) is used to diagnose a country's cybersecurity development level and to strengthen its cybersecurity capabilities. This paper analyzes GCI and tries to suggest a way to strengthen its effectiveness. In addition, we analyze the GCI version 1~GCI version 4 evaluation index in advance, and examine the development plan through SWOT analysis. Through this, basic principles for GCI improvement and utilization will be established, and new indicators related to the GCI version 5 questionnaire will be discovered and suggested. This paper is expected to be used as basic data for GCI performance analysis and improvement plan. In addition, it is intended to contribute to enhance the effectiveness of GCI and the nation's cybersecurity capabilities by proposing more advanced proactive and reactive indicators to be applied to the future GCI evaluations. This paper is an improvement and development for the research result of [1].

        농업경영비즈니스과정 효과분석 및 발전방안

        The purposes of this study were (1) to highlight the importance of farm management. (2) to develop a profitable farm management system through the combination of agricultural techniques and business competencies. (3) to shift management attitudes and habits of the program participants from being passive and dependent toward being proactive and self-disciplined. (4) to help cultivate one`s own life through self-consciousness participation in educational activities and lectures of celebrities. This research was conducted involving 30 farms that participated in the business program. The program imparted knowledge on vision, marketing, business skills, and management strategies such as cross strengths, weaknesses, opportunities, threats (swot) analysis, product life cycle (plc), the 4p(product, price, place, promotion) of marketing, etc. The study recommends: (1) to encourage farms to enhance their business competencies; (2) to find out solutions for urgent management problems (3) to construct a system for leading farms (www.lfcenter.com) and on-line communities and (4) to implement a profitable business model for leading farms. It was noted that the farms were eager to participate in such business programs. In the future, this kind of program should be promoted in other areas so that more farms could enhance their business competencies.

        고급레스토랑 이용고객의 체면민감성이 과시소비성향과 구매의도에 미치는 영향

        This study carried out empirical analysis of the effect on conspicuous consumption and purchase intention by social face sensitivity of customers who have eaten at luxury restaurants. Adult male and female customers aged 20~60 years who lived in Seoul and who had experience eating at luxury restaurants were selected as survey participants. The results of this study are as follow. First, social face sensitivity factor had a significant effect on preference for famous brands and seeking fashion. On the other hand, among social face sensitivity factors, shame consciousness had a significant effect on otheroriented conspicuous consumption. Thus, the hypothesis was partially accepted. Second, among social face sensitivity factors, other-conscious social face had a significant effect on purchase intention. Thus, the hypothesis was partially accepted. Third, preference for famous brand and seeking fashion had a significant effect on purchase intention. However, other-oriented conspicuous consumption tendency had no effect on purchase intention. Thus, the hypothesis was partially accepted. If studies on various consumption sentiment variables continue to be made, these may be usefully utilized for establishing marketing strategies of companies.
