        MIL-STD-188-220의 R-NAD 처리율 분석

        The Republic of Korea Army is using R-NAD of MIL-STD-188-220 as a Media Access Control protocol. Under urgent situations, almost all stations transmit data frames and then the network will reach a saturation state. Several articles have been devoted to the study of R-NAD performance. However, most of them focus on comparing the performance of some NADs using network simulation tools. We propose an analytical model to compute the throughput of R-NAD under the assumption of a network traffic saturation. Analytical results were verified by Monte Carlo methods. We have shown that the performance of a success probability and an average idle time remains almost unchanged as the total number of stations increases. We have also shown that Type 1/2/4 operation mode outperforms Type 3 operation mode in throughput. The results showed that the system with a squelch detection achieved a better performance than the one without it. The longer DATA time had a higher throughput.

        Ubiquitous computing is an emerging technic for various areas such as public, private (individual), military, industrial, medical sectors. The applications of ubiquitous computing are expected to be prevailed from home to office. Unfortunately, it is not effective to apply existing system/software development methodologies into this emerging ubiquitous computing applications. In this paper, MBASE (Model-Based system Architecting and Software Engineering) is applied as a development method of ubiquitous computing applications. The advantage of MBASE is to identify mismatches of product, process, property, and success models and resolve them in developing the ubiquitous computing applications. A SmartView, a ubiquitous computing application, is presented as a case study o f MBASE.

        블루오션 전략을 적용한 요구공학 프로세스

        According to the change of customer needs, integration with other systems, and the advent of new technology, it is inevitable for the existing system requirements to be requested to redesign. However, there are actually no methodologies and processes to be able to reorganize the existing requirements or integrate a number of requirements different from each other. The traditional requirements processes do not work when solving such problems. Thus, since the existing approaches to develop requirements are not helpful, many traditional requirement engineering processes can not help falling in Red Ocean. In this paper, in order to solve such the problems, we propose a novel requirements engineering process applying Blue ocean strategy which is used to open a non-competition market not discovered yet. Blue Ocean approach is a novel effective method to elicit and build up new requirements from customers. In order to accomplish the strategy, this paper presents a framework and processes to discover new perspectives and analyze the corresponding requirements. In addition, some pieces of case study are presented to introduce how our approach is applied to practical system developments and the evaluation analysis for how valid it is.

        국가 재정관리제도 개선방안 - 국회 재정심사과정을 중심으로 -

        이 연구는 정부와 의회가 재정심사과정에서 어떤 역할을 하고 앞으로 어떤 역할 변화가 필요할지를 살펴보고 의회의 재정통제권에 대한 바람직한 재정 거버넌스를 모색하였다. 경제성과 정치성의 산물인 재정관리와 관련하여 공공선택이론과 거래비용이론, 주인-대리인이론과 선심성 예산정치이론 등에 근거하여 국회의 재정심사과정에 대한 이론적 논거를 제시하였다. 재정관리 관점에서 정부와 의회의 관계는 본질적으로 정보와 전문성의 비대칭성을 특징으로 한다. 이러한 비대칭성은 재정민주주의를 실현하기 어렵게 만들뿐만 아니라 주인인 국민과 대리인인 정치가와 관료간의 대리관계에서 바람직하지 못한 사회적 후생의 감소 및 거래비용이 발생하고, 결국 재정의 지속가능성을 저해할 수 있다. 이 연구는 경제성과 정치성에 관한 재정관리이론을 재정관리 정책수단에 접목하고 의회의 재정심사와 관련하여 OECD 주요선진국 가운데 대표적인 미국, 영국, 스웨덴 등 3개국의 사례를 분석하여 국회의 재정심사과정에 대한 시사점을 도출한 후, 이 연구가 도출한 재정관리목표에 근거하여 국회 재정심사과정의 개선방향을 제시하였다. This study examines the relevance of the role between Congress and government in congressional budget process and presents new public finance management governance. The theories of political economy of public finance management-pubic choice theory, transaction cost theory, principal-agent model, and pork-barrel politics-give us deep insight on the congressional budget process in South Korea. The asymmetry in information and expertise between Congress and government plays a pivotal role in diminishing social welfare by increasing transaction costs, and eventually affecting fiscal democracy and fiscal sustainability under uncertainty. Using three OECD countries of the congressional budget process as well as snowball sampling method with 68 financial experts, we find the loopholes of congressional budget process in terms of the public finance management reform.

        It is an very important problem what kind of fact the party who charges the insurance should prove by an insurance action. This study treats which party concerned should prove fact of external focusing on a personal accident insurance case. It is an important point specific contents that make up the fact of external, that is what is also included the fact that there is no disease in the body of the insured person. This study is intended to be examined while comparing Korea and Japan precedents and theories for such problems. Burden of proof of legally sufficient cause relationship that the facts and the results injury has occurred that is a function of the body from the outside is in the insurance claimants. Therefore, when two such fact has been demonstrated, it should be interpreted as also estimated that there is no disease insured. As a result, the fact that there is no disease in conjunction with external should be proven to the insurer. Such conclusion is based on the following basis. First, it’s that an insurance consumer should be protected. It’s meant that it’s very difficult to prove no disease insured in particular. The next is that no disease insured is a disclaimer in policy condition.

        영국 보수당-자유민주당 연립정권의 상원개혁 시도

        This article deals with the historical process of Lords reform of the UK, which began with the Parliament Act 1911. The People`s Budget proposed by the Liberal Party in 1909 provoked the Conservative Party to break the convention that Money Bills supported by the Commons should not be vetoed by the Lords. This was followed by the Liberals’ political manoeuvre to weaken the power of the Lords, which had been dominated by the Conservatives and frequently thwarted the Liberals’ reform policies throughout the nineteenth century. The Parliament Act 1911 prohibited the Lords veto over Money Bills and restricted its power to delay the Bills passed by the Commons within two years. Another series of Lords reforms was initiated by Tony Blair’s new Labour government in 1998. Encouraged by the landslide general election victory in 1997, the Labour Party succeeded in removing most of the hereditary peers from the House of Lords. Although the Conservatives fiercly resisted this reform, Blair made the reform Bill passed by both Houses of Parliament. The Labour continued to pursue further reforms of the Lords and the Liberal Democrats supported this process because they wanted to exert political powers through the reformed Lords in the situation that it was very difficult to send enough candidates to the House of Commons due to the first-past-the-post system. The Conservative-Lib Dem Coalition government wanted to reform the House of Lords by making its composition to include more than 80% of elected members. As the Liberal Democrats had already failed to displace the first-past-the-the-post system with an alternative voting system, they began to focus on reforming the Lords in 2012. Their effort was, however, faced with Tory rebel’s resistance in the second reading of the House of Commons, and the House of Lords Reform Bill was abandoned. This triggered political conflict between the Conservatives and the Liberal Democrats. Since winning the majority of the seats of the Commons in the general election 1915, the Conservatives have not paid enough attention to the Lords reform, while attempting to appoint more peers to the Lords, who take favourable attitudes toward the Conservatives.

        브렉시트 : 역사와 정치의 위험한 변증법

        This article aims to analyze the relationship between British history and the Brexit process. It first suggests that some important historical events have led the British public to take skeptical attitudes towards Europe. In order to provide basic knowledge on the European Union, it also explains the role British governments played to integrate Europe. It should be noted, however, that the peculiarity of British history is not the sufficient condition for Brexit. If we took it for granted, we could not explain why Britain had decided to join the European Community in the first place or why she decided to leave it at this particular moment in time. The latter half of this article thus stresses that Brexit is an unexpected and unwelcome consequence of political miscalculation of David Cameron and his Tory followers, who carelessly and irresponsibly evoked the British public`s Euro-skepticism.

        재산명시제도의 개정과 앞으로의 전망

        강제집행절차에는, 청구권의 효율적인 실현을 위한 보조적 제도로서 재산명시제도가 마련되어 있다. 재산명시제도란 간단히 말해, 채무자로 하여금 자신의 재산을 강제로 개시하게 하여 채권자의 급부청구권의 실현을 용이하게 하려는 제도이다. 원래 재산명시제도는 독일법에 있는 제도로서 한국법이 이를 도입한 것이다. 재산명시제도를 도입하는 개정 민사소송법은 1989년 12월에 국회를 통과하고, 199년 9월1일부터 시행되었다. 작년말에 제정ㆍ공포되어 2002년 7월1일부터 시행되는 민사집행법에서는, 다시 재산명시제도의 보완을 위한 입법을 추진하였다. 다른 한편으로 12년의 시행기간이 있었음에도 불구하고, 재산명시제도의 실태를 밝히면서 실증적으로 그 제도의 문제점이나 개선점을 논하는 논고는 거의 찾아 볼 수 없는 실정에 있다. 본고에서는 주로 2001년도까지의 사법연감 등의 제 통계수치를 통하여, 재산명시제도의 문제점과 개선점을 실증적으로 논해 보도록 하겠다. There is a support system for efficiency remedy of creditors right in civil execution process. This is Property Disclosure in Civil Execution. That is a method for easy remedy of creditors right, by mandatory disclosure of debtors property. Originally the property disclosure used in Korean Law came from German Law. Korean Law accepted the property disclosure in 1990. Also Civil Execution Law established in 2002 reformed the property disclosure. However we dont have positive materials that argue the present problems or reform measures on the property, disclosure. This study positively deals with problems or reform measures on the property disclosure, with reference to Court Annual Report mainly.

        연구논문 : 잉글랜드로의 “권력이양”-웨스트 로디언 문제와 맥케이 위원회 보고서를 중심으로-

        최근 캐머런이 이끄는 보수당 정부는 웨스트민스터 의회의 입법과정에 심대한 변화를 몰고 올 법안을 하원에서 통과시켰다. 이 법안의 핵심적인 내용은 하원에 상정된 법안들 중 잉글랜드에 영향을 줄 만한 사안에 대해서는 잉글랜드에 속한 지역구 출신 의원들이 거부권을 행사할 수 있게 해주는 것이다. 본 논문의 목표는 보수당 정권이 이러한 정책을 추진하게 된 정치적 배경을 역사적으로 분석하는 데 있다. 1970년대 말의 노동당 정권은 스코틀랜드와 웨일즈에 자치의회의 설립을 허용하는 권력이양 정책을 추진했는데, 이에 반대하는 세력은 자치의회의 입법권이 중앙의회 의원의 영향력을 잠식할 우려가 있다는 이른바 ‘웨스트 로디언 문제’를 제기했다. 이 문제는 스코틀랜드, 웨일즈, 북아일랜드 뿐 아니라 잉글랜드도 권력이양의 대상이 되어야 한다는 ‘잉글랜드 문제’로 확대되었다. 1970년대의 권력이양이 실패로 돌아가며 잠잠해졌던 이 문제는 블레어의 노동당 정권이 1999년에 권력이양을 실현하면서 보수당에 의해 다시 적극적으로 제기되었다. 보수당-자유민주당 연립내각은 이 문제를 정치 쟁점화하지 않고 맥케이 위원회의 조사에 맡겼으나, 2015년 총선에 승리한 보수당 정권은 결국 위원회의 제안을 바탕으로 이른바 ‘잉글랜드 법을 위한 잉글랜드의 투표’ 법안을 하원에서 통과시켰다. 본 논문은 이러한 시도가 연합왕국의 통합에 어떤 방식으로 작용할지에 대해서도 전망해본다. On October 22, 2015, the Conservative government led by Cameron passed a bill through the House of Commons, which will bring significant changes to legislative procedures at Westminster. In effect, any bills that the Speaker has certified as ‘England-only’ in their entirety will be considered only by English MPs at the Committee Stage. The aim of this article is to historically analyze the political background to the current Conservative government came to pursue this policy. The Labour government in the late 1970s attempted to implement devolution to Scotland and Wales. Opponents of this policy raised the so-called “West Lothian Question,” drawing attention to the fact that the legislative power of national assemblies might erode Westminster`s supreme legislative power. This question soon developed to the English Question that England should also benefit from devolution as Scotland, Wales and Northern Ireland did. This question did not evoke further debate as the efforts for devolution in the 1970s failed due to the lack of electorate support. It was Tony Blair`s Labour government that revived this question by putting devolution into practice in 1999. The later Conservative and Lib-Dem Coalition government set up the McKay Commission to scrutinize this question not least because the question was not on top of their agenda. Commissions are usually used by governments to take the heat off sensitive issues. The current Conservative government is now putting forward an ‘English votes for English laws (EVEL)’ proposal on the basis of the Committee`s report. This article also speculates how this situation will influence the integrity of the United Kingdom.
