        三次元的 都市管理 手段으로서의 建築物 높이基準 設定方向 硏究

        The height of buildings define the skyline of cities, and in recent years, building height control have been approached from urban design aspect to bring about harmonious townscape as well as provide identity of city. Yet in Korea, the building height control has remained based on the width of the road they face. This has resulted in many problems such as skyline control, high density developments in outlying areas, land-use problems and lack of city identity. This research examines the existing height control system, the problems inherent in it and reviews building height control in advanced industrialized countries. The paper examines various urban planning as well as site specific considerations in resolving the problems in the building height control system currently in use, and introduces a new direction in building height control based on the street block.

        외국[고속]철도역세권 개발사례의 비교분석을 통한 계획적 의미에 관한 연구

        The purpose of this study is to analyze the design methods of Railway Station Areas, focusing on analyzing the characteristics of spatial structure, functional program, the circulation of vehicles and pedestrians. In order to analyze three elements, spatial structure, functional program, the system of vehicles and pedestrians circulation, we surveyed seven case studies of the redevelopment of railway station areas, Sinagawa Station, Nagoya Station, Kyoto Station, Hitachi Station in Japan, Euralille Station in France, Basel Euroville Station in Swiss, Utrecht Station in Netherlands. As a result, this study shows that the revitalization, the urban restructure of the centralization strengthen, the creativity of urban image in the aspect of urban spatial structure; mixed-use, complex program in the aspect of land use; multi-level circulation of pedestrian deck, exchanging transit system of mass traffic, pedestrian oriented development in the aspect of the system of vehicles and pedestrians circulation, the diverse main bodies of development of private, public and corporation methods, of the networking of open space and so on.

        공인중개사법에서 개업공인중개사의 정보제공의무와 확인설명의무 - 주거용 건축물에서의 전기통신역무 사용 제한 사례를 중심으로 -

        Under the Licensed Real Estate Agents Act, Licensed real estate agent‘s the obligation to provide information and Obligation to verify·explain is significant that the quality of brokerage services has been improved by specifying the duties of them. However, it is not considered that all of the legal obligations to provide information have been fulfilled because a licensed real estate agent has fulfilled only the obligation to confirm and explain under the Licensed Real Estate Agents Act. Recently, as the housing and residential environments subject to brokerage have become very diverse, the obligation to provide information for licensed real estate agents tends to increase, and under the Licensed Real Estate Agents Act, licensed real estate agents’s the obligation to identify and explain needs to be continuously developed in line with such environmental changes. In this paper, it was derived from the duty of the authorized broker to provide information on residential buildings from the perspective above that matters concerning the provision of telecommunication services. In addition, it was reviewed that it was necessary to be included in the obligation of confirmation and explanation of licensed real estate agents under the Licensed Real Estate Agents Act in the future. We hope that discussions will continue to review specific verification and clarification obligations for brokerage targets in the future. 공인중개사법은 개업공인중개사의 확인·설명의무(공인중개사법 제25조, 동법 시행령 제21조, 동법 시행규칙 제16조)를 구체적으로 규정하였다. 그런데 개업공인중개사는 공인중개사법상 확인·설명의무를 이행한 것으로, 사법상 정보제공의무 모두 이행하였다고 주장할 수 없다. 최근 중개대상물이 매우 다양하고 권리관계가 복잡해 짐에 따라, 공인중개사법에서 정하고 있는 확인․설명의무의 내용만으로 부동한 거래에 필요한 정보를 알기 어렵기 때문이다. 따라서 공인중개사법상 개업공인중개사의 확인·설명의무의 내용과 범위는 이와 같은 거래환경변화에 맞추어 지속해서 발전되어야 한다. 본 논문에서는 개업공인중개사가 주거용 건축물을 중개하는 경우, 중개의뢰인에게 전기통신역무 설치 제약에 관한 사항도 확인․설명의무의 내용이 되어야 한다고 제안한다. 이는 공인중개사의 정보제공 의무로부터 도출되며, 향후 공인중개사법 시행규칙 별지 제20호 서식 개정논의로 이어질 것을 기대한다.

        전자문서의 위변조 가능성과 감식에 관한 연구

        An electronic document is not denied the effect as a document just for being in the electronic form unless there is a special regulation by the Framework act on electronic commerce. However, while an actual document is investigated for evidence through the method of documentary evidence, but there is no regulation on how the evidence investigation should be conducted for electronic documents. That is, the legal procedure law for electronic documents rely on the provisions of the civil procedure law which is a general law, and there is no special regulation regarding the probative force as such is yielded to free non-concrete evidence. Therefore, even if the basic conditions of an electronic document are present, such must be verified individually in case the authenticity is in doubt. Therefore, apart from the conditions to secure authenticity of the electronic documents, the method and procedure for authenticity verification are needed. This is a very practical and urgent matter, and thus this report intends to propose a direction in verification and identification of forgery and falsification regarding the forgery/falsification potential of the electronic documents. The verification method of forgery and falsification of an electronic document is first approached from the perspective encompassing the document originally formed electronically and digitalized document, but the detailed verification methods shall be typed. The document originally formed electronically can employ a special system or electronic signature for identification of forgery and falsification to type the verification method. For digitalized documents, such can be classified into those following the notification of Ministry of Knowledge and Economy and those that are not, and the verification method can be typed accordingly. Especially for digitalized documents, if the document has been scanned into an image file, there is the potential to confirm the authenticity of the document through the characteristics in the document scan process and imaging process other than the certification information such as electronic signatures, and moreover, the normal document verification method can be applied to the identification of electronic documents, further improving the authentication of authenticity for electronic documents.
