지방자치단체의 행사용역계약의 법적 개선방안

우리나라 지방자치시대는 20여 년간 우여곡절을 겪으면서 그 뿌리를 정착시켜 나가는 과 정에 있다. 그 과정에서 국내외 경기 침체에 따른 지방의 세수 감소 등으로 지방재정이 극 도로 어려움에 처해 있음에도 일부 지방자치단체의 경우 방만한 사업을 무리하게 추진하거 나 복지재정 급증으로 재정위기를 맞고 있다. 그러므로 지방자치단체장의 불필요한 사업 추진, 선심성 행사 축제의 남발을 막기 위해 서는 지방자치단체의 예산 편성과 각종 대규모 사업 및 축제와 행사에 대하여 매년 효율성 을 분석하고, 실제로 행사의 성공적 개최를 위해 우선적으로 행사용역계약 시행에 있어서의 투명하고 공정한 절차가 필요하다. 행사용역계약의 법적 개선방안으로 우선 불공정한 하도급 방지 방안으로 저가낙찰에 대 한 저가심사제 도입으로 공정하고 자유로운 경쟁체제를 유지하고, 하도급 사전승인제 등 행 정기관의 승인절차를 명문화 할 필요가 있다. 둘째, 시행령에 낙찰기준과 연계하여 규정하 고 있는 ‘협상에 의한 계약’을 일반경쟁입찰, 제한경쟁입찰 등과 마찬가지로 계약방식의 일 종으로서의 위상을 부여하여 이를 법률에 근거를 두고, 기존의 계약방식과의 관계를 보다 명확하게 하고, 평가항목의 세분화 및 평가위원회의 구성과 운영에 있어서 투명성을 보장하 여야 한다. 셋째, 행사용역 특수성에 맞는 계약방식의 명문화가 필요하다. 행사용역입찰만 을 다루는 명문화된 법적 규정이 없어 다른 일반용역이나 내자 또는 공사 등의 입찰에 관련 된 법을 준용하여 입찰과정이 진행되고 있는 실정이며, 사전자격등록제도의 활성화를 위해 서 관련법의 정비가 필요하다. 넷째, 계약의 전과정을 공개하여 행사용역계약에 있어서 투 명한 운영이 필요하다. 행정기관의 일방적인 정보제공이 아니라 국민에게 실질적으로 도움 이 되고 국민적 관심이 높은 기관별 주요 핵심 사업들이 정책 실명제 중점관리 대상에 포함 되도록 하여, 정책의 투명성과 책임성 제고뿐만 아니라 국민과의 소통증대로 대국민 신뢰도 를 향상시킬 필요가 있다. 연간 약 120조원에 달하는 공공조달시장은 민간부문을 견인하면서 국가경제의 근간을 이 루고 있다. 특히 지방자치단체의 계약은 개인의 이익을 추구하는 사인 간의 계약과는 달리 공공복리 추구라는 목적을 달성하기 위하여 체결되며, 이에 따라 계약관련 법령 및 규정을 운용하고 있다. 계약업무담당자에게는 자의적인 행위를 방지하고 회계질서를 엄정하게 유 지하는 동시에 예산집행의 공익성, 공정성, 경제성 확보가 요구되므로 계약관계 법령이 정 하는 바에 따라 행사용역계약업무를 처리하여야 할 것이다. Due to the active social welfare policy of the central government, the burden of public finance in local government is steeply increased. Eventually local governments shall soundly and efficiently operate their finances in order to foster the welfare of residents. Therefore to avoid unnecessary projects and awful festivals of heads of local governments is needed transparency and fair procedures in the event of a contract with local governments. We may consider the following elements as ways to improve the existing system concerning Event Service Contracts of the Local government. Firstly, We may consider fair transactions in subcontracting. Secondly, establishing new status of conclusion of Contract by Negotiation, and providing related legal system as Method of Event Service Contracting. lastly, We may consider Publication of Information Pertaining to Contracts.

독일의 국토 및 지역계획 I : 성립과정과 조직체계

Arbeit beschaeftigt sich mit dem Entstehungsprozess und demOrganisationssystem der Raumordnung und Paumplanung in der Bundesrepublik Deutschland.Selbstverstaendlich hat die deutsche Raumplanung eine laengere Geschichte und eine besondere 이 글은 국토 및 지역계획과 관련하여 오랜 역사와 독특한 전통을 갖고 있으며, 무엇보다도 연방주의의 정치적 질서 아래 다극 분산적 국토발전을 꾸준히 추구해 온 독일을 사례로 공간계획의 성립과정과 체계를 살펴보고자 한다. 독일의 공 간계획은 20세기에 들어 본격화되었으며, 제2차 세계대전 후 1960년 중반에 들어서서야 비로소 오늘날과 같은 통일적 형 태의 공간계획이 확립되었다. 독일의 국토 및 지역계획은 행정계층별 계획에 대한 실정법이 마련되어 있고, 국토 및 지역 개발 계획(기본계획)과 토지이용계획에 대한 법적 체계로 이원적 성격을 띠고 있다. 특히 분권주의 전통을 반영하여 주정부 가 공간계획에 고권을 갖고 있으며, 특히 최하위 행정단위인 게마인데에서 강력한 법집행이 이뤄지고 있다.

우리나라 낙후지역 개발정책의 평가와 발전과제

In the processes of industrialization and urbanization since 1960?s, regional disparities in Korea have been intensified. Under regional disparities in development policies between urban and rural areas, broad non-urban and rural areas have experienced a period of underdevelopment and become depressed. Even though the government has implemented various types of development policies for depressed regions, the problems of these regions still remain. This study aims to evaluate the development policies for the depressed regions in recent years and to examine new perspectives to solve this problem. In order to improve current policies for depressed regions, the study also suggests alternative policy directions and targets, an integrating approach of the diversified programme, an introduction of the place-based development policy, and an utilization of new strategic tools, etc. 우리나라는 1960년대 이래 급속한 산업화 및 도시화 과정에서 지역간 격차가 심화되어 왔다. 특히 수도권과 지방 간 그리고 도시와 농촌 간의 불균등 발전이 중첩되고 있는 국토공간에서 농산어촌으로 대별되는 광범위한 지역들이 국가발전의 주도적 흐름에서 벗어나거나 발전의 모든 여건들이 지속적으로 약화되는 주변화 경향을 겪어 왔다. 물론 그 동안 이러한 낙후지역을 개발하기 위해 다양한 정책들을 추진되어 왔으나, 여전히 저발전의 악순환 속에서 크게 벗어나지 못하고 있다. 이 글은 우리나라에서 그 동안 추진되어 온 낙후지역에 대한 개발정책을 종합적으로 분석·평가하고, 이를 토대로 낙후지역 개발을 위한 과제와 향후 바람직한 정책방향을 모색하고자 한다. 특히 이 글은 몇 가지 대표적인 낙후지역 개발정책과 사업의 문제점을 검토하고, 아울러 대안적 전략을 제시하고자 한다.

회귀분석에 의한 $Si_3N_4$세라믹 절삭공구의 공구수명 추정

In this study, four kinds of $Si_3N_4$-based ceramic cutting tools with different sintering time were fabricated to investigate the relation among mechanical properties, grain size and tool life. They were used to turn gray cast iron at a cutting speed of 330m/min and depth of cut of 0.5mm and 1mm in dry, continuos cutting conditions. Multiple linear regression model was used to determine the relations among the mechanical property, grain size and the density. It was found that the combination of hardness and fracture toughness showed a good relation with tool life. It was also shown that hardness was the most important single element for the tool life.

This paper aims to find the proper way to prevent the decline in urban center of Andong city as they develop a new town nearby with Gyeongsangbuk-Do provincial office located in. To prevent the decline in urban center, they need to introduce various methods to revitalize it, establish relevant legal bases, make well-structured plans, promote mutual agreements on urban revitalization, and develop a lot of practical business. Andong city should try to aggressively invent for public affairs and find spatial models to help enhancing symbolism, history and resident community of the old downtown. 이 글은 경상북도청 이전 및 신도시 건설에 따른 안동시의 기존 도심의 공동화 방지 방안을 모색한 것이다. 안동시의 도심공동화를 방지하고 활성화시키기 위해서는 우선 도시재생의 기법을 도입해야 할 뿐만 아니라 법적 지원근거와 체계적 계획이 요구됨은 물론이고, 공공과 민간이 협력하여 도심활성화의 합의기반을 조성하고 실천성 있는 다양한 사업개발이 필요하다. 안동시는 좀더 적극적인 공공투자에 나서야 할 것이며, 아울러 원도심의 상징성과 역사성, 주민 커뮤니티(공동체) 등 장점을 살리는 공간모델을 찾아야 할 것이다.

品質이 從業員의 滿足度에 끼치는 影響에 관한 硏究

Recently both producers and consumers have increased their interest in quality. There are a couple of reasons why quality has been the focus of both parties. The preference of quality to price by consumers, the increased income of consumers, the shift of consumer’s preference due to the rapid change of technology, the shortenings of product life cycle, the increasing cost of energy, and the importance of product’s safety. Quality also affects the industrial organizations in several aspects. Such as the reputation or the image of the firms, productivity, market share, profitability, employee’s motivation, cost, and the satisfaction of employees. Here one of them is the degree of satisfaction of employees. Many papers have articulated that quality has impacted the satisfaction of employees. However, there are few papers which study the impact of quality on the satisfaction of employees with relevant hard data. Therefore, the purpose of this paper is to analyze the impact of quality on the satisfaction of employees with hard data. Specifically, this paper is to identify probable facfors to affect quality, to analyze the degree of employee's satisfaction through quality, and to identify some factors which affect the satisfaction of employees most strongly. In this paper six factors which affect quality are identified. They are the quality of raw materials and parts, the flow of processes, the degree of recognition on quality by employees, preventive maintenance, education and training on quality to employees, and quality circles. 280 employees of H company are chosen for analysis. 5-scale Likert questions are prepared. Collected data are analyaed by SPSS/PC+employeeing multiple regression Before making any conclusions, some tests are conducted to verify the hypothesis of regression such as the linearity, normality, multicolinearity, and the independence of independent variables. To test hypothesis residual analysis are conducted. By the value of Beta, we reach to the conclusion statistically that the most important factor is the flow of processes. Next is preventive maintenance. Quality is a very crucial factor which strengthens the competitiveness of firms. And it also increases the satisfaction of employees. Therefore, managers should acknowledge the importance of quality. Quality should be strategically considered and used a competitive weapon to increase the firm’s status in the market.

Si₃N₄계 세라믹 절삭공구의 절삭특성 평가

This study is performed to develop the Si₃N₄ based ceramic inserts. Si₃N₄ with addition of SiC and Al₂O₃ is investigated to determine the possibility to be a new tool. The tool life of Si₃N₄ insert with more than 20wt% SiC is shorter than commercial Si₃N₄ insert during machining both heat treated SCM440 and gray cast iron. Even though SiC has higher hardness than Si₃N₄, its chemical affinity to the iron on high temperature may causes deterioration of tool life. To the contrary, Si₃N₄ insert with Al₂O₃ shows increase of tool life up to 300% compared to the commercial Si₃N₄ insert. It may attribute to the high temperature stability of Al₂O₃. Further study will be focused on the optimization of ceramic inserts with the composition of Si₃N₄ and Al₂O₃.
