        공공사업 예정공사비에 대한 실증적 접근

        Looking at current construction costs estimations of publicly declared public works, there are many instances where estimation criteria are ambiguous and doesn't imply the reality. Up to date, estimation criteria for calculating construction cost estimations are simply by unit area multiplication and stochastic construction cost estimation. However, possibility of making errors are high due to using uniform data that excludes each public work's specifications and environmental conditions. Further, on the aspect of cost management, there is certain limitation in the efficiency of cost management in order-placing stage and commencing-work stage; while efficient cost management and reduction of expenses are highly possible during initial stages of the project. In this respect, the paper adopts positive approach with regards to construction cost estimations of public works and draws common elements from calculation tables of the construction cost estimations from 3 completed domestic construction works; after which, the paper analyzes whether business exposition, construction guide and publicly-declared estimated construction costs that the orderer issued are calculated economically and properly; deducing problems in the process, the paper seeks to recommend rational calculation method on this.         공익성 확장의 경계에 위치한 공익사업과 사업인정 의제 - 골프장 조성사업에 대한 헌재 결정례를 중심으로 -

        공익 또는 공익성이란 대표적 불확정 개념으로 정치, 경제, 사회적 상황에 따라 변화하는 개념이다. 최근 다양한 공공필요에 따라 공익성은 점차 확장되고 있고, 새로운 영역의 공익사업이 나타나고 있다. 골프장은 이러한 공익성의 확장에 따라 새롭게 공익사업으로 인정을 받은 대표적 사업으로 토지수용권이 부여되고 있다. 본 연구의 목적은 골프장을 대상으로 공익사업 인정으로 인한 사업인정 의제의 결정이 적합한 결정인지를 확인하는 데 있다. 분석결과 골프장 조성사업은 공익성의 확장에 따른 경계에 있는 사업임을 확인하였다. 즉, ‘공익사업을 위한 토지 등의 취득 및 보상에 관한 법률’에 따른 토지수용권을 부여 받기 위해서는 사업인정 절차를 거쳐야 하나, 대부분의 공익사업들이 개별법에서 사업인정 절차를 의제 받고 있는 실정이고, 골프장 조성사업 역시 이와 다르지 않다. 그러나 공익사업의 효율적 추진을 위한 사업인정 의제는 절차의 간소화를 위해 헌법의 일반원칙인 비례원칙이 요구하는 공⋅사익 간의 정치한 비교형량이 결여되고 이는 우월한 공익성을 기반으로 하는 토지수용권의 흠결을 초래하는 우려가 있다. 공익성 확장에 따라 새롭게 공익사업으로 인정받고 있는 골프장 조성사업의 경우 공⋅사익 간의 비교형량이 필요하 므로 무차별적인 사업인정 의제는 제한되어야 한다. 그리고 공익성의 확장에 따른 경계에 있는 사업으로써 사업인정 의제를 통한 사업추진의 시급성, 효율성 확보 보다 공익과 사익 간의 정치한 비교형량을 통해 공‧사익 간 충돌을 방지하고, 제도적 보완을 통한 사회적 갈등을 조정하는 것이 필요하다. Public interest is a typical indefinite concept, which can change depending upon political, economic and social environments. Recent trends show that a new scope of public works has emerged as the idea of public interest is gradually expanded to meet different kind of public needs. A good example is that golf course construction project becomes newly categorized as public works with the right granted to expropriate private land ownership as the scope of the public interest broadens. The purpose of this study is to investigate whether or not the constitutional court s ruling in favor of the legal fiction of authorization and permission for golf course construction project should be a proper decision. The result shows that golf course construction project lies at the edge of public and private interests, and thus it is necessary to limit the extent to which authorization and permission for such project are legally fictionalized. In other words, although it is required that public works should take legal procedure to obtain the right of expropriation pursuant to Act on the Acquisition of Land, etc. for Public Works and the Compensation, most of them can get such right through legal fiction stipulated by other individual Acts, and so can golf course construction project. However, it is growing concerns that legal fiction in order to simplify the procedure for public works can lead to lack of ad hoc balancing between public and private interests requested by the constitutional principle of proportionality, thereby flaws in the right of expropriation based upon superior public interest. Therefore, indiscreet legal fiction should be minimized to achieve balancing between public and private interests in the case of golf course construction project, which has been adopted as one of the new public works. Furthermore, it is necessary to impose legal fiction on such project lying on the boundaries of public interest, not from the needs of urgency and efficiency of the project itself, but from those of preventing and arbitrating social conflicts between public and private interests through ad hoc balancing

        공공건축공사 유형별 사후평가기준에 관한 연구

        최근 건설산업은 다양화, 복잡화, 초고층화의 사업수행 변화와 경기하락 및 건설사 공급과잉으로 합리적인 수익률을 기대하기 어려운 실정이다. 이에 따라 건설사업 시행에서 사업성의 성공을 위한 방안이 매우 필요하며 특히, 사업의 성패를 판단할 수 있는 사업타당성 분석이 더욱 중요해졌다. 이에 국가에서는 실효성 있는 사업타당성조사에 필요한 자료를 제공하기 위해 건설공사 수행결과가 당초 주어진 목표를 달성하였는지, 그리고 건설공사 수행으로 인하여 어떠한 변화와 효과가 이루워 졌는지에 대한 평가를 진행하고 있다. 이 평가의 대상은 건축분야의 경기불황으로 인해 사업타당성 검증이 고조되자 2010년부터 일부 건축공사를 포함하여 시행하고 있다. 이와 같이 평가대상의 확대에 맞추어 기존 사후평가기준에 대한 개정을 거듭하였지만, 광범위한 분야의 건설공사특성을 포괄하는 평가항목 및 기준의 한계점을 극복하지 못한 실정이다. 즉, 토목 및 SOC공사만을 대상으로 한 사후평가기준을 다양한 변수를 내포하고 있는 건축공사의 평가기준으로 사용하기에는 평가기준의 변별력에 한계를 가진다는 것이다. 그러므로 건축공사의 실효성 있는 사업예측자료를 얻기 위해서는 검증 된 사업평가의 요소를 기반으로 건축공사의 각 유형에 따라 특화된 사후평가기준을 수립하여 이를 기준으로 평가가 이루어져야 한다. 그중에서도 특히 공공건축공사는 사회기반시설로 다양한 종류의 건축적 특성과 상업 및 공익적 목적의 비율이 다르게 내포되어 있기 때문에 더욱더 사후평가기준에 대한 중점적인 고려가 필요할것으로 판단된다. 이에 본 연구는 공공건축공사를 대상으로 시행하는 사후평가에 대한 객관적 평가기준을 수립하고자, 세부화 된 선행연구의 건설공사 사후평가항목과 사업평가 중점요소를 토대로 건축공사 특성에 적합한 구체적이고 특화된 사후평가기준을 제시하고자 한다. Recently, the construction industry is in a situation that it is difficult to expect a reasonable rate of profit due to a change in project execution such as diversification, complication and high rising, an economic decline, and an oversupply by constructors. Accordingly, it is very necessary to establish a plan for success of business in executing a construction project, and it became especially more important to analyze the business feasibility to judge the success or failure of business. So the government is evaluating whether the execution results of construction projects have achieved their originally given goal and what changes and effects have been realized due to the execution of construction projects, to provide necessary data for an effective business feasibility study. The object of this evaluation is including some building construction projects from 2010 as the verification of business feasibility rose due to business depression in the architectural field. The revision of the existing post-evaluation criterion was repeated according to the expansion of evaluation objects like this, but it could not overcome the limit in evaluation items and criteria including the characteristics of construction projects in wide fields. That is, it has a limit in the discrimination capacity of evaluation criteria to use the post-evaluation criterion for only civil and SOC projects as an evaluation criterion for architectural projects containing various variables. Therefore, in order to obtain effective business prediction data on architectural construction projects, it is necessary to establish a specialized post-evaluation criterion according to each type of architectural construction projects based on the verified factors of project evaluation and to evaluate it based on this. Of them, especially the public architectural construction project contains different architectural characteristics and commercial and public purpose ratios of various kinds as an infrastructure, so it is judged that it will be necessary to consider the post-evaluation criterion more in priority. So this study aims to present a specific and specialized post-evaluation criterion suitable for the characteristics of architectural construction projects based on the post-evaluation items of construction projects and the core factors of business evaluation in the detailed previous studies in order to establish an objective evaluation criterion for post-evaluation that is carried out for the public architectural construction projects.

        국제건설계약과 해외 투자개발사업과 관련한 연구의 회고와 전망

        본고는 국제거래 중 가장 규모가 크고 복잡한 유형인 국제건설계약과 아울러 해외 투자개발사업과 관련한 연구의 회고와 전망을 기술하고 있다. 이를 위해 우선 우리나라 건설사들이 시공자로서 해외건설 사업 수주를 둘러싼 전개과정과 아울러 수반된 여러 가지 문제점들을 일별해 보고 있다. 그리고 발주자와 시공자간 체결하는 국제건설계약 및 수많은 하도급 및 기자재 공급 업체들과의 하도급계약 상의 주요 쟁점들을 망라해 정리하고 있다. 그러한 쟁점들로는 공기지연과 공기연장을 둘러싼 메카니즘, 시공자의 의무와 책임제한, 사정변경과 불가항력, 공사변경, 시공자의 하자담보책임, 건설공동수급체, 건설하도급 법률관계, 독립적 은행보증 등이 있다. 또한 클레임과 클레임 판단에 있어 엔지니어의 이중적 역할 및클레임 단계 이후의 분쟁해결 또한 주요 쟁점에 해당한다. 앞으로 필요한 해외건설 분야 연구과제로는 중동 국가들의 건설 관련 법제 연구와 아울러 시공자 중심의 연구뿐 아니라 한국 기업들이 앞으로 발주자 역할도 많이 할 것이기에발주자 관점에서도 균형감있는 연구가 필요하다. 또한 신재생에너지 분야, 특히 해상풍력사업의 건설계약에서 기존에 주도했던 EPC계약이 아닌 새로운 유형의 건설계약 형태가 나올 수 있기에 그에 관한 연구도 중요하다. 해외 투자개발사업은 몇 가지로 구분할 수 있는데, 첫째, 투자유치국가의 민관협력(pubicprivate partnership) 법제에 따라 추진되는 개발사업으로서 발주국가의 입찰절차를 통해 진행되는 방식, 둘째, 민자발전사업자들이 추진하는 ‘독립적인 민자발전사업(independent power producer project, IPP사업)’, 셋째, 석탄, 석유, 천연가스 및 철광석, 구리 등의 광물 등을 탐사하고 개발하는 자원개발사업, 넷째, 상기의 PPP, IPP 혹은 자원개발도 아니면서 민간 개발사업자가 차제적으로 투자개발사업을 추진하는 분야가 있다. 이들 네가지 유형의 투자개발사업에는 각각의 차이점이 존재하지만, 공통적으로는 프로젝트 파이낸스를 통해 이루어진다. 본고에서는 이러한 국내 기업들 해외 투자개발사업을 전개해 왔던 추이와 문제점, 그리고 그러한 투자개발사업과 관련한 계약적 및 법적 쟁점들을 두루 살펴보고 있다. This article describes the past, present and future of the legal researches regarding international construction contract and overseas investment development projects, all of which are the most complex deals among various types of international business transactions. For the purpose of this article, it first gives an overview and history of international construction projects conducted by Korean construction companies as main contractor. The article further briefly deals with major issues in international construction contract, including but not limited to: (i) the mechanism of delay and extension of time, contractor’s duties and limitation of liabilities, changed circumstances and force majeure, variations, contractor’s defect liability, joint venture or consortium, subcontract relation, and independent bank guarantees. Other important issues include claims by employer or contractor, engineer’s dual roles as the employer’s agent and the adjudicator of claims raised, and resolution of construction dispute. This articles suggests that further legal researches necessary in international construction contract should include construction related laws and regulations in middle east Asian countries, researches to be conducted from employer’s perspective as well as contractor’s perspective, and new construction contract scheme under renewable energy sector, particularly marine wind power project, which is going to be a hot issue in near future. On the other hand, overseas investment development projects can be divided into four different areas as follow: (i) pubic-private parnership projects to be implemented under PPP related law or policy of the hosting country; (ii) independent power producer projects to generate necessary amount of power; (iii) exploration and development of natural resources such as coal, oil, natural gas, iron ore, etc.; and (iv) other type of investment development projects except the above three different categories. The common feature of these four different categories is that all of those projects should be definetely implemented through project finance to raise necessary amount of loans although they have some different features. This article deals with the history and overview of Korean companies’ overseas investment development, trials and errors occurred therefrom, and primary contractual and legal issues of such projects.

        Analyzing Characteristics of Construction Complaints with Construction Project Type

        Conflicts in a construction project not only make negative impacts on project performance such as schedule delay or cost overrun but also require social cost to resolve the conflicts. Although the conflict needs a preemptive management because a conflict usually begins with a complaint, existing studies have focused on conflict resolution after it occurs. This study identifies and categorizes complaints which mainly appear in the construction projects. Those complaints were evaluated and quantified in terms of occurrence frequency and potential to conflict through a questionnaire survey with industry experts. Using the survey results, this study examines the characteristic of complaints in linear project and clustered project, and analyzes what kind of complaints occur by project type. As the results, this study derives the complaints with high potential to the conflicts that should be managed first during managing a construction project in each project type.

        발주자 관점의 생산적인 건설 프로젝트와 영향요소의 분석에 관한 연구

        고속도로 건설공사의 경우 기존에 건설된 고속도로에 대한 유지관리비가 증가하고 있어 신규 건설에 필요한 투자비에 대한 효율성의 혁신 및 프로젝트의 품질을 향상시키기 위한 생산성 관리가 필요한 시점이지만, 아직까지 고속도로 건설공사에 대한 생산성 및 성과 측정에 대한 명확한 기준이나 방법, 필요성이 제대로 정립되지 못하고 있는 실정이다. 이에 본 연구는 발주자의 주요 업무인 사업관리 측면에서 생산적 프로젝트의 5가지 주요 구성 요소를 정의하였다. 그리고 생산성에 주요한 영향을 미치는 43개 생산성 영향요소를 정의하고 이들을 세 개의 레벨로 구성된 위계체계로 정의하였다. 또한 고속도로 건설공사의 최대 발주자인 한국도로공사를 대상으로 설문조사를 수행하여 정의된 생산성 영향요소들이 생산적 프로젝트의 달성에 미치는 영향 정도를 파악하고 개선수요 정도를 파악함으로써, 사업의 성공적인 수행을 위하여 중점적으로 관리하여야 할 영향요소를 제시하였다. The productivity management of highway construction is required to innovate the efficiency of investment The productivity management of highway construction is required to innovate the efficiency of investment cost for newly constructed projects and to improve the quality of these projects, as the maintenance and management expenses are steadily increasing for existing highways under operation. However, clear criteria, methods or requirements to measure the productivity and performance in the construction of highways have not been properly established yet. This study defined 5 major elements of the productive projects in terms of construction management which is one of major tasks of the owner. There were the 43 influential elements significantly affecting on the productivity and these elements were categorized into the hierarchical structure which was composed of 3 levels. Also, this study conducted a survey for Korea Expressway Corporation who is the largest owner in Korea’s highway construction. As a result, major project performance indicators, which should be addressed for management, to execute the projects successfully, are presented through understanding the extent of the affection of productivity elements on the elements of project performance to attain the productive projects and through understanding the extent of demand to be improved.

        공공건설사업의 계약변경 현황 분석에 관한 연구

        공공건설공사의 특성상 공사 수행 중 계약변경 또는 설계변경이 불가피한 경우가 많다. 이러한 계약변경은 사업을 수행하는 과정에서 직접비뿐만 아니라, 예산확보의 문제 등에 의한 공기연장을 수반하여 간접비 증가의 문제를 야기한다. 따라서 본 연구에서는 계약변경이 공사비와 공사기간에 미치는 영향과 손실을 정량화하기 위한 7가지 지표를 도출하여, 예정가격 100억 이상의 공공ㆍ문화체육시설을 대상으로 시공단계에서 발생되는 계약금액 조정 및 공기연장 사유별 발생현황에 대한 실태조사 및 분석을 실시하였다. 그 결과, 계약금액 조정 사항 중 공사비는 1000억이상의 대형공사, 최저가방식, 계속비공사일 때 크게 상승하며, 건당 3.4회의 설계변경에 의해 평균 8.8%가 공사비가 상승하였다. 공사기간은 대형공사, 턴키방식, 장기계속공사로 진행될 때 크게 증가하여 건당 평균 25.3%의 공기가 연장됨을 알 수 있었다. 본 연구를 통해 시공단계에서의 계약변경은 설계품질, 발주기관의 기본계획 수립단계에서의 체계적인 검토, 낙찰방법 및 계약성질 등에 영향을 받음을 알 수 있었다. 이러한 다양한 원인들에 대한 면밀한 검토 및 추가 보완을 통해 향후 Cost Overrun Risk 식별 및 관리에 활용될 수 있을 것이라 판단된다. Because of the characteristics of public construction project, there are many cases of contract change or change orders during the construction. The contract change is accompanied by not only direct expenses but also time extension caused of budget securing problem, etc. during the project, so it increases problems such as the increase of indirect expenses, etc. Therefore, this study drew 7 indexes which can quantify effects and loss made by contract change on construction cost and construction period and inspected and inspected/analyzed adjustment of contract occurred at the stage of construction and occurrence situation by reasons of time extension for pubicㆍcultural sports facilities whose estimated expenses are more than 10 billion. As the result, among the adjustments of contract, construction expenses are greatly increased in case of huge construction, the lowest expenses method and continuous non-construction. And, construction expenses of average 8.8% were increased by change orders of three and four times per a case. The construction period was greatly increased in case of huge construction, turnkey method and long-term continuous construction, so time of average 25.3% per a case was expanded. In this study, contract change at the stage of construction is influenced by systematic inspection, successful bid, contract characteristics, etc. at the stage establishing designing quality and fundamental plan by orderer. Through the minute inspection and additional supplementation for the various reasons, this study will be applied to discriminate and manage Cost Overrun Risk in the future.

        인공신경망 기반의 공공청사 공사비 예산 예측모델 개발 연구

        Predicting accurately the construction cost budget in the early stages of construction projects is crucial to support the client's decision-making and achieve the objectives of the construction project. This holds true for public construction projects as well. However, the current methods for predicting construction cost budgets in the early stages of public construction projects are not sophisticated enough in terms of accuracy and reliability, indicating a need for improvement. The objective of this study is to develop a construction cost budget prediction model that can be utilized in the early stages of public building projects using an artificial neural network (ANN). In this study, an artificial neural network model was developed using the SPSS Statistics program and the data provided by the Public Procurement Service. The level of construction cost budget prediction was analyzed, and the accuracy of the model was validated through additional testing. The validation results demonstrated that the developed artificial neural network model exhibited an error range for estimates that can be utilized in the early stages of projects, indicating the potential to predict construction cost budgets more accurately by incorporating various project conditions.

      • 공공부문 건설공사의 입찰담합 유발요인 및 조달정책의 개선방향

        입찰담합은 경쟁에 의하여 결정되어야 할 낙찰자와 낙찰가격 등을 입찰참가자들이 사전에 결정하는 행위이다. 입찰담합은 다른 참여자의 경쟁참여를 사실상 배제하여 기회의 공정성과 경쟁원리를 훼손함으로써 생산의 효율성을 저해한다는 점에서 문제이다. 본 논문은 공공부문의 건설조달에 있어서 입찰담합이 발생하는 요인을 고찰하고 입찰담합을 예방하기 위한 정부조달 정책의 개선방향을 제시하는 것을 목적으로 한다. 건설분야 정부조달에 있어서의 입찰담합을 방지하기 위한 주요한 개선방향은 다음과 같다. 첫째, 정부조달 과정의 투명성과 공정성에 관한 기준을 재설정하여야 한다. 둘째, 진입제한 장벽이 있는 일부 건설시장의 참여자를 확대하여야 한다. 셋째, 불공정하도급에 대한 규제를 강화하여야 한다. 넷째, 건설보증을 강화하여 시장의 부적격업체에 대한 필터링 기능을 활성화하여야 한다. 다섯째, 담합에 대한 제재의 실효성을 강화하여야 한다. This research aims to identify major factors that generate bid rigging in public construction projects in Korea by examining regulatory and institutional features of the government’s procurement contracts, characteristics of the Korean construction industry and forms of bid-rigging practices. It explores how bid rigging in the construction industry, in practice, hinders other competitors from participating in contract competition in public construction projects, while demonstrating the ways in which this type of prearranged business agreement impairs the principle of equal opportunity and competition and therefore decreases efficiency and productivity. The research also endeavors to find better policy measures for government construction procurement in order to prevent illegal bid rigging in public construction projects. The following policy implications related to the prevention of bid rigging in public construction projects are presented as a result of the empirical investigation: (1) the degree of transparency and fairness in the standards and procedures of government procurement needs to be reconsidered; (2) existing entry barriers in some areas of construction markets, such as the turn-key sector, should be lifted in order to enlarge the number of competitors vying for public construction projects; (3) legal regulation against the violation of fair trade laws through illegal bid rigging must be enhanced; (4) the monitoring function of the market against unqualified companies needs to be activated through the consolidation of the construction guarantee system; and (5) penalties against illegal bid-rigging practices need to be practical in order to increase the level of legal enforcement.

        PURPOSES : This study aims to survey and analyze the status of the design and completion documents output delivery system in public construction projects in order to assess the problems of the Ministry of Land, Infrastructure and Transport (MOLIT)'s electronic delivery system, with a focus on roads and rivers, and to offer improvement measures. METHODS: This study first surveys and analyzes laws and existing study trends with regard to the design and completion documents output delivery system in public construction projects. It further analyzes the status of the output delivery system in public construction projects, including roads, rivers, expressways, water resources, and railroads. In addition, a comparative analysis of the current electronic delivery system of MOLIT and Korea Expressway Corporation in the road field is conducted, and the problems and improvement measures for MOLIT's electronic output delivery system are presented. This study seeks to analyze problems and prepare improvement measures with regard to road and river public construction projects, as ordered by MOLIT’s five regional offices. RESULTS: This study sought to prepare the electronic output delivery system with regard to public construction projects and present the analysis of its major problems and improvement measures in four categories: “the preparation of electronic design documents output delivery system improvement measures including inspection and delivery,”“preparation of guidelines, systems, etc., concerning electronic design documents,”“preparation of improvement measures for the construction project management system and electronic design document support tools”, and “linking of MOLIT's electronic output delivery system with relevant agencies and the expansion thereof to local governments.” CONCLUSIONS : This study analyzed the current status and problems of the MOLIT's electronic output delivery system in the field of road and river construction projects, and presented corresponding improvement measures. This study is expected to address the problems of the MOLIT's electronic output delivery system, and to provide the foundation for the preparation of an efficient electronic output delivery system for design and completion documents. In addition, this study is expected to boost the quality and utilization of the electronic design documents output, and to exchange, share, and link construction information among relevant agencies so as to prepare the foundation for sharing construction information.
