한국의 납본제도 개선모형에 관한 연구

디지털 시대의 국가도서관은 자국의 모든 오프라인 및 온라인 출판물을 수집·보존해야 하며, 그 책무와 기능을 보증하는 법적 장치가 납본제도이다. 그러나 한국의 현행 납본제도는 인쇄자료에 기반한데다가 부실하며, 특히 전자출판물을 수용하는데 한계가 있어 그 개선방안의 마련이 시급한 실정이다. 한국의 지적 및 문화적 유산이 부실한 납본제도로 인하여 체계적으로 수집·보존되지 못한다면 국가적 비극이 아닐 수 없다. 이에 본 연구는 납본시스템의 법령체계와 구성내용(용어, 납본주체, 피납본기관, 대상자료, 부수와 시기, 보상과 제재, 매체변형과 접근권 등)을 중심으로 개선모형(안)을 제안하였다. In digital environment, the hallmark of the national libraries is its responsibility or function of acquiring and preserving the country’s off-line and on-line publications in term of legal deposit. But the legal deposit system based on print materials in Korea predates the digital age and requires a new legal framework. It would be a tragedy if national library was not to archive the nation’s intellectual and cultural heritage because of limitation of legal deposit system. The purpose of this paper is to analyze form of the current deposit system and to suggest a reform model for legal deposit legislation with priority given to legal scheme and elements(terms, the depositor, the depository, object of deposit, number of copies, time of deposit, compensation and fine, right of migration and free access, etc.).

출판사의 납본 인식을 통한 납본제도 개선방안에 대한 연구

납본은 국가에서 발행되는 모든 자료 수집의 필수적인 방안으로 국가도서관에서는 출판사의 납본을 적극적으로 독려하여야만 한다. 그러나 대형 출판사를 제외하고는 대부분의 소형 출판사들은 국가도서관의 적극적인 납본홍보에도 불구하고 납본이 활성화 되고 있지 않아 납본율이 미흡한 실정이다. 따라서 본 연구는 출판사가 생각하는 납본제도의 문제점과 개선할 점을 살펴보고 이들이 갖고 있는 납본에 관한 인식과 납본을 촉진시킬 수 있는 방안을 제시하였다. 납본을 촉진시키기 위한 방안으로는 첫째, 납본제도의 개선이 납본대상범주의 재구성, 납본 기한의 연장, 납본 보상금의 조정을 위한 보상합의체의 구성, 납본 과태료의 실질 적용, 납본기관의 확대로 이루어져야 한다. 둘째, 납본 절차의 간소화가 납본서류 작성의 편리화, 납본서와 납본 보상 청구서의 일원화로 진행되어야 한다. 셋째, 납본 온라인 시스템의 구축이 납본 온라인 시스템에서 납본서류 작성, 납본여부 실시간 확인까지 이루어져야 한다. 넷째, 납본 홍보 방법이 납본 교육의 의무화, 홍보 우편의 방법 개선, 한국문헌번호센터 홈페이지와 출판유통업체를 통한 홍보로 이루어져야 한다. National libraries have an obligation to meet the information needs of users by collecting as many various materials as possible. As legal deposit accounts for the highest percentage of the collection building methods of national libraries, they are trying to encourage the legal deposit of the publishers. However, the rate of legal deposit for the most publishers are pretty low. Therefore, in this study, the improvement plans of legal deposit system for the purpose of helping legal deposit of national libraries improve smoothly has been investigated by identifying the problems with the legal deposit system that publishers had and by suggesting the matters that should be improved based on the recognition of legal deposit by publishers. The plans for the revitalization of legal deposit for the publishers are as follows: promoting factors of legal deposit systems such as scope, deadline, compensation, fine and legal deposit libraries, simplification of legal deposit procedures, set-up of automated online system for legal deposit and strengthening of the method for promoting and educating the legal deposit.

국내외 전자출판물 납본제도의 분석

Legal deposit system is an important legal instrument for national libraries. But the law or act based on print materials in many countries predates the current information age and requires a new legal framework in order to encompass electronic publications. Many national libraries, therefore, are seeking to encourage their governments to establish legal deposit for publications in the whole range of formats. The purpose of this paper is to analyse a world-wide trends of the legal deposit system for on-line publications as well as off-line materials. The result of this analysis will be used to develop a new model of legal deposit system in Korea. 납본제도는 모든 국가도서관의 자료수집 및 보존기능에 가장 중요한 법적 수단의 하나이다. 그런데 기존의 인쇄자료에 기반한 납본제도로는 전자출판물의 망라적 납본수집이 어렵기 때문에 최근에 상당수의 국가에서 납본법령을 개정하였거나 준비 중에 있다. 이에 본 연구는 법령체계, 납본주체와 피납본기관, 대상자료의 범주, 납본의 부수와 시한, 납본자료의 매체변형, 보상과 제재 등을 중심으로 국내외 전자출판물의 납본제도를 분석하고자 한다. 그리고 연구의 결과는 후속 과제인 국내 납본제도 개선모형의 이론적 기초로 삼을 것이다.

국회도서관 납본 활성화 방안에 관한 연구 - 디지털 학위논문을 중심으로 -

This study empirically analyzed the recognition and current status of university libraries related to the legal deposit of thesis and dissertation and investigated the ways to activate legal deposit to National Assembly Library. As a result, most universities conduct legal deposit of thesis and dissertation. However, most librarians face difficulties resulted from the duplication of deposits to many institutions. In the case that the deposits are not made, the main reasons are the university library’s policies, duplication and inefficiency of the deposit procedures, and the limitation of obtaining copyright agreements. In order to address these limitations and to maximize the social and informational values of thesis and dissertation, this research proposed approaches to legal deposit of thesis and dissertation, including strengthening digital deposit system through the establishment of independent legal deposit law, preparing the effective ways of preservation. constructing an integrated deposit system, and developing professional collection of thesis and dissertation which can consolidate National Assembly Library. 본 연구는 학위논문의 납본과 관련한 대학도서관의 인식 및 실태를 실증적으로 분석하고 학위논문 납본의 저해요인 확인을 통해 국회도서관의 학위논문 납본 활성화 방안을 모색하였다. 분석 결과, 대부분의 대학에서는 학위논문의 납본을 수행하고 있으나, 학위논문을 담당하는 전담부서나 전담인력 배치는 저조한 것으로 나타났다. 사서들은 여러 기관으로의 납본 등 납본업무의 중복으로 인한 어려움에 직면하고 있으며, 납본이 이루어지지 않는 경우 대학도서관의 정책, 납본 절차의 중복 및 번거로움, 저작권 동의서 확보의 한계 등이 주된 이유로 나타났다. 이러한 학위논문 납본에서의 문제를 해결하고 학위논문이 지닌 사회적, 정보적 가치를 극대화하기 위한 방안으로 독립적인 납본법의 제정을 통한 디지털 학위논문 납본 제도의 강화, 디지털 학위논문의 효율적 보존 방안 마련, 통합된 학위논문 납본 시스템 개발, 석박사학위논문 전문 컬렉션 개발을 통한 국회도서관의 위상 강화 등을 제안하였다.

전자출판물 납본제도 도입방안 : 외국사례의 비교연구

본 연구는 전자출판물 납본제도 도입방안에 관하여 외국의 사례를 한국과 비교․분석하고 한국의 온라인 전자출판물 납본제도 도입에 따른 문제점과 도입방향을 고찰하였다. 한국의 온라인 전자출판물 납본제도 도입방안으로 첫째, 한국의 특성에 맞는 온라인 전자출판물 납본법령과 체제마련 및 납본주체와 피납본기관의 명확한 규정 확립 그리고 납본대상 자료의 범주규정 등 온라인 전자출판물 납본제도의 법적 근거마련이 요구된다. 둘째, 온라인 전자출판물은 한정적인 수집이 곤란하므로 자료선정기준 및 자료선정위원회 등의 구성이 필요하다. The purpose of this thesis is to inquire the introduction to the electronic specimen copy presentation system in Korea through the comparison with some foreign country cases. And also we consider the policy options for the introduction to the electronic specimen copy presentation system. As the results of the research, we suggest following alternatives. Firstly, we should prepare the legalistic basis for the presentation laws. Secondly, we also should organize the selection committee which choose the appropriate electronic specimen copy presentation.

도서의 납본과 보상제도 개선방안에 대한 고찰

Legal deposit is a system that a person who publishes in the country a work shall deposit a certain copies of publications in designated libraries or institutions in order to preserve and transfer national knowledge and culture heritage. Under 「Libraries Act」 and 「National Assembly Library Act」, depositors shall present books to the Library and the Library shall properly compensate him/her for such copies presented. This study focuses on presentation and proper compensation of books. This study has reviewed laws and regulations about them in major countries and our country, and analyzed the current status and some problems of our country. This study has analyzed the constitutionality of legal deposit, the refusal of copies presented, and the meaning of proper compensation through analyzing cases on legal deposit. Based on these analyses, it has proposed the modification of regulations on presentation and proper compensation of books, the establishment of specific rules on proper compensation, and the penalties on unfair presentation. 납본제도란 국가지식문화유산을 보존하고 전승하기 위하여 국가에서 발행되는 모든 출판물의 일정 부수를 지정된 도서관 또는 기관에 제출하도록 하는 제도를 말한다. 도서의 경우 「도서관법」과 「국회도서관법」에서 납본에 대하여 규정하고 있고, 납본한 자료에 대하여 정당한 보상을 하여야 한다고 규정하고 있다. 본 연구에서는 도서의 납본과 정당한 보상의 의미와 범위를 중점적으로 살펴보았다. 도서의 납본과 보상에 대한 주요 국가의 법령과 우리나라의 법령 및 현황을 검토해 보고 문제점을 분석해 보았다. 납본과 관련된 판례를 분석하여 납본제도에 대한 합헌성 검토, 납본 거부 및 정당한 보상에 대한 법적 검토와 평가에 기초하여 납본과 보상 관련 규정 정비, 정당한 보상에 대한 구체적 법규의 정립과 처벌 규정 등을 개선방안으로 제안하였다.

온라인 디지털자료의 납본 가이드라인에 관한 연구

본 연구의 목적은 온라인 디지털자료의 망라적 수집과 보존 그리고 접근을 지속적으로 보장하기 위하여 온라인 디지털자료의 납본에 대한 국내․외 법령 및 사례를 참고하고, 국내의 납본 이해 당사자인 저작권 소유․유관 단체 및 기업, 이용자, 그리고 납본 관련 전문가의 자문을 수렴하여 온라인 디지털자료의 납본 가이드라인을 제시하는데 있다. 본 연구에서는 납본기관이 납본 받아야 할 범위를 규정한 납본 범위에서 납본 불이행 시 납본주체에 대한 제재까지 총 14개의 가이드라인을 제시하였다. The purpose of this study is to suggest elements and guidelines for online digital materials in order to ensure its comprehensive collection, preservation, and access in Korea. For the establishment of elements and guidelines, this study examined appropriate advanced countries’ legal deposit Acts, discussed with stakeholders, including experts and copyrighters in related areas, and surveyed library users’ opinions. Finally, this study suggests 14 elements and guidelines.

국내 전자출판물의 납본․수집 현황 분석

본 연구는 최근 3년(2020-2022)간 국내 전자출판물의 납본․자체수집․수증 현황과 ISBN이 발급된 전자출판물의 납본 및 미납본 현황을 분석하였다. 이를 통해 국내 전자출판물의 납본 의무 이행 독려하기 위한 개선방안을 제안하고자 하였다. 먼저 국내 전자출판물의 납본․자체수집․수증 현황의 주요 분석결과는 다음과 같다. 전자출판물 수집형태는 자체수집(57.07%), 납본(41.74%), 수증(1.19%)이었으며, 파일 형식은 전자책(pdf, epub), 웹툰(jpg), 오디오북(mp3)으로 다양하였다. 주로 2012년부터 2022년 사이에 출판된 전자출판물이 수집되었으며, 1960년부터 2011년 사이에 출판된 자료도 일부 수집되었다. 자체수집은 웹툰이 많았고, 납본은 전자책이 주를 이루었다. ISBN 발급 현황을 보면, 자료유형은 전자책(96.2%)이, 주제분야는 문학 분야가 가장 많은 ISBN을 발급받았다. 2020년부터 2022년 사이에 가장 많은 ISBN이 발급되었다. ISBN 발급 상위 10위 발행처의 납본율을 보면, 전체적으로 ISBN 발급을 받은 발행처들의 납본율이 저조하여 이를 개선하기 위한 노력이 필요한 것으로 나타났다. 이에 개선방안으로 발행처의 납본 의무에 대한 인식 제고, 인센티브 제공 및 제재 조치 강화, 납본 현황의 투명한 공개를 통한 자발적 참여 유도, 그리고 ISBN 발급 및 납본 시스템의 데이터 정확성 향상을 위한 기술적 조치의 필요성을 제안하였다. This study analyzed the legal deposit, acquisition, and donation status from 2020 to 2022, along with the deposit status of e-publications with issued ISBNs. Through this analysis, the study derived improvement measures to strengthen compliance with legal deposit obligations for domestic e-publications. The key findings are as follows: The collection methods were acquisition (57.07%), legal deposit (41.74%), and donation (1.19%). The file formats varied, including e-books (pdf, epub), webtoons (jpg), and audiobooks (mp3). Most e-publications collected were published from 2012 to 2022, with some from 1960 to 2011. Webtoons dominated acquired materials, while legal deposits mainly comprised e-books. Analyzing the status of e-publications with issued ISBNs, e-books (96.2%) were most common, with the literature field receiving the highest number of ISBNs. Most ISBNs were issued during 2020 to 2022. Looking at the top 10 publishers, the low legal deposit rate indicates the need for improvement. To address this, proposed improvement measures include enhancing publishers’ awareness of legal deposits, strengthening incentives and sanctions, encouraging voluntary participation through transparent disclosure of the legal deposit status, and improving the accuracy of data in the ISBN issuance and deposit system.

온라인 전자책 보존을 위한 납본제도 개선 방안 연구

This research compares and analyzes the legal deposit of national online electronic publishing and related laws that were recently amended in order to preserve the exponentially increasing number of electronic books(e-books). Based on the analysis, it also seeks ways to initiate a legal deposit system of e-books in South Korea. The research, therefore, defines the exact range and types of e-books. This research proposes three conditions to introduce the legal deposit system in order to preserve South Korean e-books. The first is to establish a clear definition and classification of e-books as data subject to legal deposit for preservation purposes. The second condition is to establish a legal system in order to deposit and collect network(online-exclusive) type e-books. The final condition is to reflect the opinion of publishers and to create security measures against any loss of the companies. 이 연구는 급증하고 있는 온라인 전자책의 보존을 위하여 최근 개정 및 개정 준비 중인 주요 국가의 온라인 전자출판물 납본과 관련된 법령을 비교․분석하고 이를 기반으로 한국의 온라인 전자책 보존을 위한 납본제도 개선 방향을 제시하고자 한다. 한국의 전자책 보존을 위한 납본제도 개선 방안은 다음 3가지로 요약할 수 있다. 첫째, 온라인 전자책 보존을 위한 납본 대상 자료로서의 전자책의 명확한 개념 정의와 범주 설정이 필요하다. 둘째, 국내 온라인 전자책 제작환경을 고려한 납본 주체의 구체화 및 명료화가 이루어져야 한다. 셋째, 납본 포맷, 납본 부수, 시기, 방식, 보상과 제재조치, 납본자료의 이용과 매체변환과 같은 법률적 조항의 내용 보완이 필요하다.

디지털자료 납본에 대한 보상 체계 연구

국립중앙도서관은 2007년 "온라인디지털자료 납본 및 이용에 관한 법률(안)"을 제정하여 시행을 준비하고 있다. 본 연구의 목적은 이 법률(안)의 시행에 앞서 납본 보상금의 산정기준을 제시해 보고자 하는 것이다. 본 연구를 위하여 주요 국가의 디지털자료 납본 현황이 조사되었고, 디지털자료 납본의 주요 이해당사자인 전자책, 음악저작권 관련 단체의 의견이 수렴되었다. 마지막으로 본 연구에서는 디지털자료의 납본에 따른 보상금 산정기준을 제안하였다. The National Library of Korea establishes an Act on Legal Deposit and Use for the Online Digital Products in 2007 and it is preparing an enforcement. The purpose of this study is to suggest rate base on legal deposit of digital products before enforcement of this bill. To reach the goal, this study reviewed the legal deposit acts on digital products in the world. Also the opinion of main stakeholders in this area was collected such as digital book publishers and music copyright association. In conclusion, this study proposed rate base of reimbursement for legal deposit of digital products.
