        한국전통간장의 맛과 향에 관여하는 주요 향미인자의 분석(III) -향기성분 분석 -

        This study was carried out in order to investigate effective aroma components of Korean traditional soy sauce. Volatile aroma compounds were extracted by solvent extraction, TMS esterification of methyl acetate extracts and SDE, and analyzed by GC/MSD. 140 voltile aroma compounds were detected by three different extraction methods. Most abundant volatile compounds were acids and phenols and identified aldehydes, hydrocarbons, ketones, furans, furanone, alcohols, esters, nitrogen compounds, sulfur compounds and thiazoles, too. In the analytical sensory evaluation of soy sauce aroma, there were significant differences between each soy sauce sample in all test item. To sum up, Sweet odor was high in Kyupjang. Nutty odor and traditional soy sauce odor were similarly high in Kyupjang and high concentration soy sauce. Kyupjang had high score in overall odor preference than Chungiangs. The result of multiple regression of soy sauce odor characteristics and gas chromatography pattern demonstrated that offensive and sour odor was affected by octadecanoic acid. Contributive compounds to sweet odor were 1,2-benzenedicarboxylic acid and 3,6-dioxa-2,7-disilacotane. Benzoic acid 4-methyl ethyl ester and nonacotane were identified as major compounds of nutty odor. Contribu live variables of traditional soy sauce odor were benzoic acid 4-methyl ethyl ester and 9,12-octadecadienoic acid. The main factors of odor preference were 3-methyl pentanoic acid, acetic acid, 2,6-dimethyl heptadecane and 3,6-dioxa-2,7-disilacotane.

        Henoch-Sch$\"{o}$nlein 자반증 환아에서 동반된 공장-공장형 장중첩증 1례

        저자들은 복부 통증 및 구토를 주소로 내원한 HSP를 진단받은 5세의 남아에서, 복부 초음파 검사를 통해 공장-공장형 장중첩증을 진단하였으며 그 후 자연감압으로 증세가 호전되었고, 복부 전산화 단층 촬영 검사로 자연정복되었음을 확인한 환아 1례를 경험하였기에 보고하는 바이다. Gastrointestinal involvement occurs in two thirds of children with Henoch-Sch$\"{o}$nlein purpura (HSP) and intussusception is by far the most common abdominal complication. Intussusception in HSP almost originates in the small bowel, which is in contrast with idiopathic intussusception. Earlier diagnosis and prompt treatment of intra-abdominal complications can reduce the mortality and ultrasound is the imaging modality of choice in evaluation the bowel manifestations of HSP. We report a case of jejuno-jejunal intussusception associated with HSP in a 5-year-old boy who presented with diffuse abdominal pain and vomiting after a few days of HSP onset. Abdominal ultrasound demonstrated intussusception in the jejunum with well defined target appearance because of the thickened intussusceptum, which disappeared on the computerized tomographic examination checked approximately 24 hours later. A brief review of literature was made.

        한국전통간장의 맛과 향에 관여하는 주요 향미인자의 분석(II) - 질소 화합물, 유리아미노산 및 핵산관련물질 분석 -

        This study was carried out in order to analyzed the changes in nitrogen containing taste compounds of three different types of traditional Korean soy sauce with varing ripening period, and to investigates correlation between sensory characteristics and taste compounds contents via contents assay and sensory evaluation of soy sauce samples. Total nitrogen, ammonia type nitrogen and amino type nitrogen contents showed the highest value in Kyupjang. 17 kinds of free amino acid was detected in Chungjangs and 16 kinds of free amino acid was detected in Kyupjang. Nucleotides and their related compounds detected were hypoxanthin, xanthin, IMP, AMP, Inosine, ADP. Free amino acid and nucleotides and their related compounds contents were highest in Kyupjang. Nitrogen related compounds content of high concentration soy sauce ripened over 150 days increased similarly with Kyupjang. In the sensory evaluation of soy sauce taste, Chungjang samples acquired the highest score in the offensive taste test while Kyupjang marked highest score for sweet taste, nutty taste, taste preference. High concentration soy sauce ripend over 150 days yielded the result similar to that of Kyupjang. Sweet taste showed positive correlation with nitrogen compounds. The materials that showed positive correlation with nutty and traditional soy sauce taste and taste preference were nitrogen compound, IMP, AMP. Except for tryptophan, all free amino acid showed positive correlation with nutty and traditional soy sauce taste. Particulary, taste preference correlated to lysine, aspartic acid and glutamic acid.

        국제저작권소송에서의 준거법 결정에 관한 국제적 동향

        국제교역과 인터넷의 발전은 저작권 분야에서 섭외적 사건들의 증가를 초래하였다. 국제저작권소송이 다른 민사소송과 차이나는 점은 관할 및 준거법 지정과 관련하여 나타난다. 일반적으로 국제민사소송에서 관할과 준거법 지정은 국제사법법원칙 및 각국의 국내 국제사법에 의해서 결정되는데, 저작권의 경우 국제저작권조약에 의한 별도의 원칙이 존재한다. 이것은 저작권 속성인 속지성 및 무체재산권성에서 유래하는 것이다. 현재 국제저작권소송에 관한 관할과 준거법을 지정하는 통일된 원칙이 확립된 것은 아니나, 베른협약을 시작으로 국제조약, 각국의 국내저작권법 및 국제사법 또한 보호국법주의를 원칙으로 한다. 그러나 베른협약상 준거법지정에 관한 규정의 불명확성과 적용범위의 한계는 국제저작권분쟁이 증가하고, 그 대상이 다양해지면서 혼란을 가중시키고 있다. 본 연구는 국제저작권소송에서의 준거법지정과 관련하여 각국의 법제, 국제조약상 준거법 지정의 원칙, 그리고 우리나라 국제사법 및 조약과의 관계에서 준거법지정의 원칙을 고찰한다. 여기서 단순히 기존의 저작권 침해형태에서 나아가 인터넷에서 발생하는 편재적(遍在的) 형태의 저작권 침해의 경우, 기존의 준거법지정원칙의 문제점을 지적한다. 본 연구는 국제저작권분쟁의 공평하고 통일된 해결을 위하여 준거법지정을 위한 단일한 원칙을 정립할 필요가 있다는 데 공감하고, 미국, 유럽 및 일본에서 이루어지고 있는 통일규칙 제정안을 살펴본다. 만약 이러한 단일의 원칙을 정립한다면, 그것은 저작권의 특수성을 고려하고, 저작권과 관련된 기술의 발전을 이해하며, 기존의 준거법지정원칙으로 해결되지 못한 문제들(예컨대 편재적 침해(遍在的 侵害))을 포함하는 것임과 동시에, 국제사법적 관계의 당사자간의 정의와 형평, 그리고 사법자원의 효율성을 모두 충족시킬 수 있는 것이라야 할 것이다. 이런 의미에서 ALI원칙, CLIP원칙, 일본 투명화프로젝트의 입법제안에 대한 검토는 향후 통일적 입법안의 마련 및 저작권 관련 국제사법원칙들을 정립해 나가는데 있어 중요한 참고자료가 될 것이라고 생각한다. Copyrights are increasingly traded internationally as the development of transportation and the internet. At the same time, questions of jurisdiction and choice of law have become increasingly important in the field of intellectual property law. The existing legal framework for deciding jurisdiction and choice of law rules for copyright law derives from two sources, copyright rules(domestic copyright law and International instruments on copyright) and private international law rules(domestic private international law and international instruments). Because of the intangibility of copyright and lex loci of private international law, both rules hardly seem to be in harmony. Specifically the internet makes the choice of law more difficult in international copyright disputes. Generally, by the article 5(2) of Berne Convention, under the territoriality, the rule of the choice of law is lex protectionis. As the article 5(2) is very ambiguous and polysemous, lex protectionis in the choice of law is not sufficient to solve the problems related whole international copyright disputes, for example, ubiquitous infringement of copyright. This study reviews the general rule of the choice of law under the international copyright legal framework and then points out the deficits of the rules. It also examines the rule of the conflict of law under the Korean private international law. After considering the current environment of choice of law rules, it studies the international efforts to unify the international conflict of law rules. For this, it compares three proposals from ALI principles, CLIP and the Global COE project.

        『서곡』의 아랍인의 꿈에 나타난 윌리엄 워즈워스의 서사시적 영웅상

        This paper examines William Wordsworth`s epic heroism in `Arab Dream` of The Prelude, analyzing the `knight` of uncouth shape and `deluge` in the desert. The knight`s story can be read as another version of Don Quixote, and the deluge as an allusion to Robert Southey`s deluge epic, Thalaba, the Destroyer. Echoing with and alluding to these books, Wordsworth presents an attractive but futile chivalry in quest to preserve community by burying books. In literary dimension, this shows a kind of misreading or misapplication of books, for chivalrous action sticking to the physical world makes one blind to the truth itself, and in the historical dimension, this reveals self-criticism and social-reflection with regard to French Revolution, as Wordsworth himself considers the `deluge` of `guilt` and `ignorance` leading to the failure of French Revolution. In Arab Dream, Wordsworth implies his reawakening to the validity of literature as well as reflections on French Revolution, suggesting epic heroism of poetic vocation as an alternative to revolutionary activism. Wordsworth tries to rebuild community fulfilling the poet`s task, instead of seeking disquietude as a world-deserting and world-deserted knight-errant.

      • 프란츠 리스트의 가곡 "Pace non trovo"와 <순례 연보> 제2권 중 "Sonetto 104 del Petrarca"의 비교

        The aim of this study is to understand the "Sonetto 104 del Petrarca" from the Annees de Pelerinage better through a comparative study of Liszt`s song and piano work based on the same Petrarchan sonnet. At first, the emotional essence of Petrarca`s sonnets expressed in the song has been examined. Next, such emotional contents and the those expressed in the piano work are compared in order to figure out Liszt`s arrangement techniques and his intentions. Since technical virtuosity in Liszt`s works tends to overshadow its emotional contents, special attention has been paid to the works`s inception and background to promote more balanced understanding of his works. Through analysis of Liszt` works, it became clear that the musical elements such as the progression of melody, harmony, and rhythmic pattern are closely related to the emotional contents of the sonnets. The switch between the major and minor as well as the expressive marks are utilized to reveal the emotional changes in the sonnets, and word-painting is used for concrete representation of the textual contents. Each emotional contents such as the happiness of love, uplifted mind, and passionate psychological states are expressed though appropriate musical means. In a word, Liszt`s songs contribute greatly to clarify and deepen the emotional contents contained in the sonnets. As a result of subsequent comparison of the two versions, it is clear that the modulation and detailed harmonic progression as well as other musical elements such as the melodic progression, rhythmic patterns, and harmonic usage are utilized intact in the piano works without any major changes. In the piano versions, however, the characteristic brilliant cadenza-like passages are interpolated in addition to such common features. These passages are not for empty display of superficial virtuosity but for effective expression of human cordiality. Therefore, it is more important to grasp the hidden emotional contents than just concentrated on its technical brilliancy. Furthermore, the piano versions utilize wider tonal range as a result of frequent appearance of octave doubling or transposition of the melodies in the vocal versions. Such adjustments are necessary for maximizing piano`s potentiality. Through this comparative study, it became clear that the piano version of the sonnet manages to express the emotional contents of the original sonnet without the help of the text. As a result, the intended emotional essence can be recognized more clearly, and the meaning and intention of the musical technique can be appreciated deeply and distinctly. Considering in terms of Liszt`s similar arrangements of other songs, it is clear that he should have an experience-based conviction on the power of purely instrumental music which conveys the emotional contents without any help from the actual text.

        컴퓨터 프로그램 저작물 침해 시 손해액 산정에 관한 판례연구 - 서울고등법원 2013.4.10. 선고 2012나68493 판결을 중심으로

        대상판결은 컴퓨터 프로그램 저작물 침해 시 손해액 산정에 관한 판결로, 프로그램의 정품 소매가격 자체를 손해액 산정 기준으로 하고 있어 주목 받았다. 이는 종래의 엄격한 차액설에서 벗어나, 침해자에 대한 제재적 효과까지 감안하여 손해액을 산정한 판결로 평가되며, 사회적으로 만연한 프로그램 불법복제 관행에 경종을 울리는 계기가 되었다. 본 연구는 대상판결에서 손해액 산정의 법이론적 근거가 무엇인지 민법과 저작권법을 통해 살펴보고, 대상판결이 갖는 의미와 이후 판결들에 미친 영향들에 대하여 논의하고자 한다. 우선, 대상판결에서 손해는 규범적 손해개념에 기초한 것이다. 저작권 등 지적재산권에서 손해란 권리자가 누려야한 시장기회의 상실을 의미하는 것으로, 구체적인 일실이익 산정과는 구별되어야 할 것이다. 둘째, 손해액 산정에 관한 저작권법 125조는 손해의 개념과 연관 지어 해석되어야 할 것이다. 따라서 규범적 손해개념에 입각한다면, 동법 제125조는 손해의 발생과 관련하여 이를 추정하거나 의제해 주는 것이 바람직하다 할 것이다. 마지막으로 그럼에도 불구하고 지나치게 과다한 손해액 산정은 손해의 공평한 부담이라는 손해배상제도의 취지에도 맞지 않다고 생각한다. 대상판결 이후 후속판결들을 살펴보면 대체로 공평한 부담이라는 견지에서 손해액을 선정하려는 법원의 노력이 보이는 것 같다. This case is a ruling on the calculation of damages infringing copyrighted computer program works, and it is noted that the retail price of the program itself is based on the calculation of damages. This is evaluated as a judgment that calculates the damage amount considering the sanction effect on the infringer, deviating from the strict balanced damage theory, and triggered alarm on program piracy practices in the society. This study examines the legal theory of damages calculation in this case through civil law and copyright law, and discusses it’s implications and impact on subsequent cases. First of all, I will examine the meaning of damages in this case and the problem of the method of calculating the amount of damages. First of all, damages in this case are based on normative damages. Damages in intellectual property rights, such as copyright, means loss of market opportunities for the owner, and should be distinguished from the calculation of specific profits. Second, section 125 of the Copyright Act on the calculation of damages should be interpreted in connection with the concept of damages. Therefore, based on the normative concept, it would be desirable for Article 125 of the Act to estimate or agenda arising out of the occurrence of damages. Lastly, I do not think that too much damage calculation does not fit the purpose of the damage system, which is a fair burden of damage. Subsequent rulings after the final ruling seem to show the court"s efforts to select the amount of damages in the light of the generally fair burden.
