        민간조사제도 도입 시 주요 쟁점 연구 : 자격요건 및 시험·교육과목을 중심으로

        사회안전에 대한 국민 요구수준의 지속적인 향상에도 불구하고 제한된 인력·예산 등 국가경찰력의 한계로 인해 민간 보안산업 영역의 확장은 필연적이라 하겠다. 특히 가출인 및 아동·여성 실종자 탐지나 사기 등 재산범죄 피해 구제를 위한 대안 마련 필요성이 강력히 제기되면서 민간영역의 정보·수사 서비스제공을 위한 법률적 기반 구축이 시급히 요구되고 있다. 최근 들어 민간조사제도 관련 법제정을 위한 토론회가 연이어 개최된 것 또한 이를 반증한다고 할 수 있겠다. 이 논문에서는 이러한 국민 여망을 반영하여 법제적 정비를 통해 민간조사제도가 도입될 경우 우선적으로 고려되어야 할 몇 가지 주요 쟁점에 대해 다루어 보았다. 특히 제도 도입 시 민간조사관의 업무범위나 한계와 함께 가장 핵심적으로 검토해야 할 문제라 할 수 있는 자격요건과 시험과목 및 교육훈련 방안에 대해 집중적으로 논의하였다. 자격요건과 관련하여서는 다양한 학계의 의견에도 불구하고 연령제한이나 결격사유를 규정함에 있어 여타 유사 직렬과 비교하여 헌법상 직업선택의 자유 보장 차원에서 최소한의 제한만을 허용하는 것이 바람직하다 여겨지고, 시험면제 대상의 범위를 적절히 조정함으로써 자격요건을 강화할 수 있을 것이라 생각된다. 아울러 민간조사활동 중 발생할 수 있는 고객 개인정보 유출 등 사생활침해 우려를 불식시키기 위해서는 '정보접근권'에 대한 명확한 인식과 함께 윤리의식 강화 및 전문 능력 함양을 위한 교육과목 구성 등이 가장 중요한 만큼 '업무범위'를 바탕으로 한 충분한 사전 '직무분석'을 거쳐 시험과목과 연계할 수 있는 교육·훈련 체계 마련이 무엇보다 시급히 선결되어야 할 것이다. This article discusses some major issues on implementation of the private investigation system in Korea, especially focusing on the requirements, qualifying exam and education subjects for the private investigator. Needless to say, the introduction of the private investigation system in Korea seems inevitable, seen from the recent expansion of the private security sector in accordance to a public opinion, particularly for finding the runaways, lost children and women. This study aims at suggesting the desirable and appropriate alternative on the age limit, conditions for disqualification, examination subjects and curriculum for education and training of the private investigators. To sum up briefly, when it comes to the age limit and unqualified conditions, it seems affordable to restrict them to a minimum considering the constitutional right on career choices. Instead it can be possible to make them more strict by adjusting the range of the exempted from qualification exams. This is not significantly different from those of the major countries such as U.S.A, UK, Canada, France, Japan. It also need to prepare well-organized education and training program relevantly related to the exam subjects by the 'duty analysis' based on the scope of the private investigator. I suggest some basic law subjects like an outline of law, private investigation law including ethics, intelligence analysis, negotiation science, and psychology etc. as mandatory subjects for the private investigators.

        Catechol-O-methyltransferase (COMT; EC 2.1.1.6) is the enzyme which catalyzes the transfer of methyl group to the catecholamine neurotransmitters from its methyl donor S-adenosyl-L-methionine. Partially purified COMT from rat liver has been used to measure the concentration of catecholamines in the blood through solvent extraction and thin layer chromatography after converting ^3H-methyl derivatives of catecholamines. To improve this inconvenient and fluctuating method, an attempt was made to use COMT gene for the measurement of catecholamines. Specific primers, COMT5P (5'-TGC TCA GAG GTG CTT TGA AG-3') and COMT3P (5'-GGA GCC GCA GAA GGT CA G-3'), were used to amplify COMT gene from human placenta cDNA library. The amplified COMT gene through 35 cycles of polymerase chain reaction was cloned into T-vector and the nucleotide sequences are determined by automatic sequencer. Human COMT has two common variants, a thermostable high activity form which has valine at amino acid 158 and a thermolabile low activity form which Has methionine at the same position. The cloned COMT gene in this study has both variants. Clone 4 and 5 have valine at amino acid 158 (guanine at nucleotide 472) and clone 1-3 have methionine at this site (adenine at nucleotide 472). In addition to this, there are other DNA polymorphisms in COMT gene at nucleotide 101, 102 (amino acid 34, a structural mutation cysteine/serine) and nucleotide 186 (a silent mutation). All of the clones have cysteine at amino acid 34 (guanine and adenine at nucleotides 101 and 102) and cytosine at nucleotide 186 except clone 3 which has thymine at this nucleotide. Clone 4 and 5 are thermostable high activity variants, suggesting being more useful for the measurement of catecholamines after expressing the gene.

        The development of the measurement technology has occupied an important position of not only the electrical, electronic but also scientific technology sphere. In the past, the abnormal current detector was used by the analog method, had many the trouble and the inconvenience of measurement, dissatisfied the accuracy and had difficulty in storing, preserving the data. In this paper, these are improved by using single-chip microcontroller which detects the abnormal current and saves in back-up RAM after digitizing. For the efficient management, processing of the memory, it was used the index method. The data in the memory can be transmitted to the personal computer by the serial communication, and also be independently transmitted by the parallel communication to the personal computer which is interfaced with. The software to control system components are structured in assembly language and C language, in order to process and analyze the software is used in C language.

      • 백일해 백신이 Streptozotocin 유발성 당뇨백서의 당대사에 미치는 영향

        Streptozotocin(STZ) may produce a permanent form of insulin-dependent diabetes (IDD) in experimental animals. This STZ-induced diabetes has become an useful model to study the pathogenesis of IDD in man primarily because it approximate clinical findings and also because it lends itself easily to controlled manipulation. The diabetogenic activity of STZ, however, is known to be modified by several agents such as nicotinamide, diazoxide, adrenergic blockers and pertussis vaccine (PV). The present study was undertaken to observe the protective effect of PV or boiled pertussis vaccine(bPV; incubating the PV at 80℃ for 30 minutes) against the development of IDD induced by STZ in young rats, and also the effect of PV on the activities of glycolytic & gluconeogeneic enzymes in both liver and muscle of rat. PV at a dose of 1.2×10^(10) microorganism was administrated intrapntoneally on 3days before & 7days after a single injection of STZ (GO㎎/㎏ body wt). The blood glucose and insulin levels were measured at 1st wk, 2nd wk, 4th wk, 6th wk and 8th wk after STZ injection, and the enzyme activities were exemined at 8th wk. The following results were obtained. 1. No significant difference was noted in blood glucose levels between STZ group and STZ+PV or STZ+bPV groups (P>0.05). 2. Blood insulin levels in STZ group decreased significantly from 2nd wk(P<0.05). Compared with STZ group, blood insulin levels in STZ+PV & STZ+bPV groups were higher, but not a significant value except at 2nd wk in STZ+PV grouP (P<0.05). 3. Compared with STZ group, hepatic glycolytic enzyme activities were significantly increased in STZ+PV or STZ+bPV groups, and muscular glycolytic enzyme activities were significantly increased in STZ+PV or STZ+bPV groups. 4. Compared with STZ group, hepatic gluconeogeneic enzyme activities were significantly increased in STZ+PV or STZ+bPV groups. These results suggest that the PV has somewhat protective effects on blood insulin levels and tissue glycolytic enzyme activities in rats, but it could not reduced blood glucose levels significantly, probably because of excessive increase of hepatic gluconeogeneic enzymes.

        It may be difficult to differentiate renal cell carcinoma involving collecting system from renal pelvis urothelial tumor invading into renal parenchyma. The purpose of this study was to find out CT differential points of two diseases. 15 cases suggested invasion into other compartment in CT images were selected and evaluated about the presence or absence of hydronephrosis, CT renal function, renal contour changes due to mass and tentative diagnosis. Renal cell carcinoma was characterized by no hydronephrosis(80%), normal CT renal function (100%) and outward bulging mass(100%). However, renal pelvis urothelial tumor showed hydronephrosis(70%), abnormal CT renal function(60%) and preserved reniform shape(100%). In conclusion, renal contour changes and CT renal function are reliable criteria in differentiating two diseases.

        In this paper, a reference model following control system using a fuzzy logic controller (FLC) is proposed. A reference model whose response does not overshoot and has a fast rise time is designed. A FLC is designed to follow as close as possible the response of the reference model. The proposed design method has the robustness and the optimal tracking property under modeling error, disturbance and parameter perturbations. The proposed designing method is compared using a PD controller throughout the experiment. The effectiveness of the proposed designing method is verified through computer simulation and experiments for the second-order and the first-order reference model.
