        Nicotine exacerbates tacrolimus-induced renal injury by programmed cell death

        Background/Aims: Cigarette smoking is an important modifiable risk factor in kidney disease progression. However, the underlying mechanisms for this are lacking. This study aimed to assess whether nicotine (NIC), a major toxic component of cigarette smoking, would exacerbates tacrolimus (TAC)-induced renal in-jury. Methods: Sprague-Dawley rats were treated daily with NIC, TAC, or both drugs for 4 weeks. The influence of NIC on TAC-caused renal injury was examined via renal function, histopathology, oxidative stress, mitochondria, endoplasmic reticulum (ER) stress, and programmed cell death (apoptosis and autophagy). Results: Both NIC and TAC significantly impaired renal function and histopathology, while combined NIC and TAC treatment aggravated these parameters beyond the effects of either alone. Increased oxidative stress, ER stress, mitochondrial dysfunction, proinflammatory and profibrotic cytokine expressions, and programmed cell death from either NIC or TAC were also aggravated by the two combined. Conclusions: Our observations suggest that NIC exacerbates chronic TAC nephrotoxicity, implying that smoking cessation may be beneficial for transplant smokers taking TAC.

        The research on frequent item set mining is to find out frequent item sets from large database which satisfies the minimum support count. In this paper we propose the Prefix-Tree algorithm which uses the global frequency to create tree and swapping can reduced during tree creation process and no alpha tree will be generated to use the FP-Growth mining directly.

        It is of great significance to reform the patterns of library resource construction and services in MOOC, for example, it can help to fulfill the individual needs of learners, and achieve sustainable development for the library. Firstly, the author analyzes the characteristics of MOOC; secondly, discusses the characteristics of information construction of library; and then designs a knowledge discovery model of the library information resources construction in MOOC; finally proves that it could provide favorable support for the improvement of library resource construction and services to discover knowledge from library data base according to the result of case study.

        淺談中國民族區域自治法監督機制完善

        중국은 다민족국가이고 민족구역자치제도는 민족문제를 해결하는 기본제도이다. 민족구역자치제도란 민족관계, 민족구역자치관계를 조정하고 소수민족의 평등한 자치 권리를 실현하는 법적인 보장제도이다. 중국의 《민족구역자 치법》은 전국인민대표대회에서 제정하는 국가 기본법중의 하나인바 헌법성격의 법률이고 민족자치지방의 "작은 헌법"이라고 불리 우며 민족자치지방의 법률, 법규를 제정하는 법적인 의거이다. 중국의 《민족구역자치법》은 1984년에 반포되고 현재까지 실행되어 오면서 민족구역자치지방의 민주법제 건설을 위하여 큰 역할을 해왔다. 민족구역에서의 민주법제건설을 추진하면서 현재, 《민족구역자치법》에 대한 연구에 있어서 자치기관, 자치 권리 등 관련된 영역의 연구는 이미 광범하고 심도 있게 진행되고 있으며 많은 저서의 발표와 연구논문의 성과를 이루었다. 더불어 《민족구역자치법》 감독메커니즘도 일련의 발전성과를 이루었다. 《민족구역자치법》의 감독메커니즘은 민족구역자치법의 실행을 보장하기 위하여 만들어진 중요한 정책수단인 만큼 《민족구역자치법》이 민족자치지방에서 집행되고 실행됨에 있어서 중요한 의의가 있다. 그러나 중국의 《민족구역자치법》 감독메커니즘은 발전되어온 시간이 짧고, 실행단계에 있어서 집행주체의 수준차이, 공민의 법률의식의 차이 등 원인으로 말미암아 발전이 제약을 받고 있다. 또한 《민족구역자치법》에는 아직까지 위법구제방식이 결여되었고 감독주체, 감독방식, 책임주체 등이 명확하지 못한 단점도 존재한다. 때문에 현재 중국에서 입법, 집행 그리고 법률구제 등 방변에서 《민족구역자치법》 감독메커니즘에 대해 개선하고 적극적으로 발전시키려는 추세가 보이고 있으며 이는 학계의 관심사로도 떠오르고 있다. 본문에서는 중국의 《민족구역자치법》 감독메커니즘에 대하여 요해하고 현재의 발전상황을 소개하며 국외의 발전과 비교, 분석하여 문제점을 파악하고 최종적으로 《민족구역자치법》 감독메커니즘을 개선할 수 있는 발전방향을 제시하려고 한다. China is a multi-nationality country, regional national autonomy system is the basic system to resolve the national problems of China. Regional national autonomy refers to legal norms that adjust relations of regional national autonomy and national relations, and protect the equality and autonomy rights of national minorities. Regional national autonomy is one of the country basic laws enacted by National People`s Congress, is a constitutional law, which is the "mini-constitution" in autonomous areas. It is basis legal basis to develop autonomous local laws and regulations. Supervision system of Regional National Autonomy Law is an important policy for the protection of the implementation of regional national autonomy law. This is significant for the protection of the implementation of the Regional National Autonomy Law in the national autonomous areas. Although China`s law have established complete supervision systems on regional national autonomy, because the time of development is short, law enforcement level and subject of law enforcement is irregularity, the legal consciousness of citizens is scant, causes the Law on Regional National Autonomy also to lack the illegal relief way, the inspector is not clear, the way of supervision is not perfect, the responsibility is not clear and so on flaws. This urgently awaits to consummate. This paper study on the summary and present situation of the supervision system of Regional National Autonomy Law, and then through comparison of the status with foreign and analysis of present situation, and find the issue in the supervision, and ultimately to improve the Law on Regional National Autonomy supervision mechanism.

        浅论新修行政诉讼法中的行政诉讼第三人制度

        中国的行政诉讼第三人是在传统的行政诉讼制度上借鉴民事诉讼当中第三人制度而产生的, 其制定目的在于让更多适格的诉讼主体充分参与行政诉讼, 从而防止行政主体滥用权力, 进而保障行包括诉讼第三人的行政主体之外当事人的合法权益。然而中国的行政诉讼第三人制度由于成长土壤本身较为贫瘠, 其成熟度远不如民事上的诉讼第三人制度。虽然中国自2015年5月1日起开始实施的新《行政诉讼法》对既有行政诉讼法的第三人制度进行了一定的修改, 但即便新的规制, 其制定的仍不够完善, 导致无论在理论界还是实务界均存在着较大分歧。而随着中国法制的不断进步, 人们的法律意识的不断提高, 如何解决行政诉讼第三人制度之不够完善问题逐渐成为了中国行政诉讼制度亟待解救的问题。为此, 本文试图通过对中国当前行政诉讼第三人制度进行概述和相关立法现状进行分析, 以及将中国现有制度同德国等国外行政诉讼第三人制度进行比较, 较为体系化的探明中国当前制度中存在的主要问题和国外制度中值得借鉴之处, 进而提出完善中国行政诉讼第三人制度的浅见。 China's administrative litigation among civil action third person is to learn from third-party system in the traditional institutional and administrative proceedings arising, its purpose is to allow the development of more eligibility main proceedings fully participate in administrative proceedings, to prevent abuse of power by the executive body and thus safeguard the legitimate rights and interests of the line including the third party from the executive body of the parties. However, China's administrative litigation system of third party due to the relatively poor growth of the soil itself, which is far better than the maturity of the civil litigation system on the third person. Although the new "Administrative Procedure Law" Our country since May 1, 2015 start of the implementation of existing third party system Administrative Procedure Law has been some changes, but even the new regulations, the development of the still not perfect, resulting in whether in theory or practice field there are considerable differences. With the continuous progress of China's legal system, the improvement of people's legal awareness, how to solve the problem of inadequate administrative system of the third party becoming the urgent rescue of administrative litigation issues. Therefore, this article attempts through to the third party of the current administrative system overview and analysis of the current situation of the relevant legislation, as well as the existing system of administrative litigation with Germany and other foreign third party system compares more proven system of our country. The current system in the presence of the main issues and foreign systems worth learning place, and then put forward a sound system of administrative proceedings third person humble opinion.

        중국의 환경보호 공중참여제도에 관한 연구

        중국은 20세기 중반 환경영역, 민주주의 정치영역 그리고 환경법학 영역에서 일련의 큰 변화들을 경험하였다. 이러한 변화들은 공중참여가 환경보호의 필연적인 선택이 될 수 있도록 촉구하였다. 1960년대 말부터 시작되어 날로 고조되어 가는 환경보호 운동으로 인하여 환경문제는 인류사회가 보편적으로 관심을 가지는 주제가 되었고 공중참여는 점차 행정영역으로 들어왔으며 새로운 공중참여운동을 일으켰다. 즉 정책수립과 결정과정에서 시민의 참여를 중시하고 정책집행 과정에서도 시민의 참여를 강조하게 되었으며, 이러한 참여는 더 이상 “엘리트”들만의 참여가 아닌 일반시민의 참여를 뜻한다는 점에서 이전과 상당히 다른 양상을 띠게 되었다. 70년대 초에 이르러서는 세계 많은 나라들의 환경규제의 주된 흐름은 ‘명령-규제(命令-控制)’방식이었고 이러한 방식은 환경오염을 규제함에 있어서 효과적이었다. 그러나 인류의 환경보호 의식이 나날이 향상되고 정부의 직능(职能)이 변화됨에 따라 환경문제는 다시 두드러졌고 80년대에 이르러서는 명령-규제방식의 환경통치수단은 더 이상 경제와 환경의 조화로운 발전을 실현할 수 없게 되었다. 비록 많은 나라들에서 환경법에 환경권에 대한 규정을 두고 있지만 90년대에 이르기까지 환경권의 실체성은 제대로 보장받지 못하고 있었다. 이로 인하여 90년대 이후로 국제사회에서 환경입법은 공중의 환경 정보권, 환경 참여권, 환경 구제권에 초점을 맞추어 이루어졌다. 1988년 UN의 유럽경제위원회가 덴마크의 오르후스에서 통과한 《오르후스협약》은 환경보호 공중참여권에 대하여 가장 완벽하게 규정한 국제 환경입법이다. 그러나 중국 《환경보호법》에서 이와 관련된 제도의 규정을 살펴보면 매우 부족하고 대부분의 환경입법은 제대로 작용하지 못하고 있다. 본 논문에서는 공중참여의 정의, 주요내용, 이론적 기초를 상세하게 분석하고 평가하며 현재 중국의 환경보호 공중참여에 관련된 입법규정과 구체적인 실천과정을 살펴보고 공중의 환경 정보권, 환경 참여권, 환경 구제권에 대하여 고찰하며 궁극적으로는 중국의 현재 환경보호 집행부재의 현황에 비추어 중국의 환경보호 공중참여권의 법적보장체계에 대한 개선에 대하여 논의하는 것이 본 연구의 목적이다. In mid-20th century, a series of changes have taken place in the area of environment, democracy and environmental law. Such changes have promoted public participation, which is deemed an inevitable choice in the field of environmental protection. From the late 1960s’, because of the growing environmental protection movements, environmental problems have attracted much attention of human society as a whole. Public participation has exerted much influence on the administrative field, and accordingly, new public participation movement was launched. Much emphasis is put on public participation in the stages of policy formulation and policy implementation. Such participation in a modern sense differs from that in the previous era, as it refers to the participation of the general public, not of the small group of “elites.” In the early 1970’s, many countries employed the “command-control” system of environmental regulation; and this method functioned well in limiting environmental pollution. However, with the heightened environmental protection consciousness and the change of government function, the environmental issues again received much attention. In the 1980’s, the means of environmental control which followed “command and control” model was found not so effective in achieving the coordinated development of economic growth and the environmental protection. Although environmental laws of many countries did have provisions on environmental right, the environmental rights was not fully protected until 1990’s. Therefore, since 1990’s, the international trend in the field of environmental legislation was to focus on the public’s right to have proper information on the environment, the right to participate in the environment issue, the right to environmental relief and so on. The Aarhus convention, which was adopted by the United Nations Economic Commission in Aarhus in 1988, is deemed the most comprehensive international environmental legislation for the protection of public participation in environment issues. However, the relevant provisions in China’s environmental protection law are far from perfect, and most of the environmental legislation in China do not seem to play its due role. In this paper, I will analyze and further evaluate the definition, main contents, and the basic theories of public participation; then I will introduce relevant statutes and specific process regarding public participation in environmental protection in China, and the environmental information right, environmental participation right, environmental relief right. Later I will analyze present situation of environmental protection in China; I will discuss what China can and should learn from the experience of the Aarhus Convention, focusing on the legal system guaranteeing the public participation in environmental protection.
