The Employment Security Act(hereinafter referred to as “ESA”) is a representative law regulating labor market intermediaries such as employment agencies. ESA can also be applied to the emerging platform economy based on digital technology. The platform brokers mediate workers and labor demanders through platforms. It has the basic structure of the multi-faceted labor transaction brokerage relationship, and shows that the platform has both status of the employer and agency. Discussions for regulating platform labor relations are diverse. However, recent discussions related to this are mostly based on platform as an employer. However, considering the legislative reality of Korea, this approach has limited application. Therefore, it is necessary to examine the possibility of regulating the platform as a modern employment agency based on the intermediary personality of the platform. By regulating the platform as a modern employment agency, platform-workers, as a job seeker, can be prevented from undertake illegal and bad working conditions. Moreover, the job seeker can be assure to accurate information in the labor market. Regulating the platform-agency can reduce the risk of intermediary exploitation, protect personal information of the job seeker. However, analytical premise is needed to apply ESA to platform-agency. In order to compensate for these limitations, it is suggested that legislative method of providing labor in the form of multi-faceted intermediaries and the responsibility of intermediary employers should be unified around the ESA, while establishing special rules for the digital employment agency within ESA.

DAB 시스템에서 낮은 복잡도와 효율적인 구조를 갖는 FEC 설계

본 논문에서는 DAB 시스템에서 사용하는 FEC(Forward Error Correction) 블록을 하드웨어 크기를 고려하여 효율적인 구조를 갖도록 설계하였다. DAB 시스템의 FEC 블록은 크게 스크램블러(에너지분산), 리드-솔로몬 코더, 길쌈 인터리버로 구성된다. RS 디코더 블록 중 키 방정식을 계산해 내는 블록과 길쌈 인터리버가 차지하는 하드웨어 비중은 굉장히 크다. 본 논문에서는 스크램블러 부분에서 데이터의 시작을 알려주는 신호의 효율적인 검출기법을 제안하고, 리드-솔로몬 디코더 블록의 수정 유클리드 알고리즘을 효율적인 하드웨어로 구현하기 위한 새로운 구조와 길쌈 인터리버에서 최적의 메모리 구조를 효과적인 구조를 제안한다. 제안한 구조에서는 단지 8개의 GF 곱셈기와 4개의 덧셈기만을 가지고 RS 디코더의 수정 유클리드 알고리즘을 구현하였으며, 2 RAM(128)과 4 RAM(256)을 가지고 컨벌루셔널 인터리버를 구현하였다. 제안한 구조로 설계했을 경우 디코더 블록이 Altera-FPGA 칩(FLEX10K)에 모두 들어갈 수 있었다.

근로권의 재해석

In order to establish the role of The Employment Security Act(hereinafter referred to as “ESA”) in accordance with changes in the labor market environment, it is necessary to review the significance of the ‘right to work’ under the Constitution, which is the guiding philosophy of ESA. The modern significance of the right to work should be reviewed from three perspectives: “freedom of work choice”, “provision of work opportunities”, and “guarantee of the working environment”. First, “freedom of work choice” is the exercise of the right to self-determination in order to realize human dignity in work. Second, “provision of work opportunities” says the opportunities for work should be interpreted as implying the provision of ‘decent work’. Finally, “guarantee of the working environment” means that labor market intermediaries, such as employment agencies who are in charge of employment services to job seekers in the labor market, should be responsible for providing accurate information to the underprivileged in the labor market so that they can work in the most legal places and blocking bad jobs. 「직업안정법」의 이념으로서 근로권의 현대적 의의를 ‘근로선택의 자유’, ‘근로기회의 제공’, ‘근로환경의 보장’의 세 가지 측면으로 나누어 살펴보아야 한다. 첫째, 근로선택의 자유는 결국 노동에서의 인간존엄을 실현하는 것이며, 이것은 곧 노동에의 자기결정권 행사를 의미한다. 둘째, 근로기회의 제공은 근로의 권리의 내용 중 가장 실천적 기능을 수행하는 요소이다. 국가는 국민들에게 직접 일자리를 창출하기도 하고, 고용서비스나 직업훈련 등을 통해 간접적으로 고용을 촉진 또는 유지할 것을 지원하기도 하며, 실업상태의 사람들에게 일시적 생계유지를 보조하기도 한다. 국가는 국민들의 근로기회 제공을 위해 고용서비스 기능을 민간과 협력하여 수행한다. 그러나 다른 한편 고용서비스에 참여하는 민간의 노동시장 매개인들은 중간착취의 위험성 및 사용자책임의 회피처로 이용될 위험성을 항상 내포하고 있기 때문에 이들에 대한 규제와 주의가 필요하다. 즉 국가는 고용매개인들로 하여금 구직자들에게 정확한 정보를 전달하고, 질 나쁜 일자리에 대한 소개를 사전 차단하도록 규율함으로써 구직자들의 근로의 권리를 보장할 수 있다. 셋째, 근로환경의 보장은 실질적으로 노동법의 보호대상으로 되는 임금근로자 등 취업자 중 일부에게만 적용되는 한계가 있다. 다만 구직자들에게 근로환경이 좋은 일자리를 소개하는 것으로 간접적이고 사전적인 근로환경의 보장의 내용을 실현할 수 있다. 구직자를 위하여 적어도 나쁜 일자리로의 유입을 사전에 차단하는 것은 가능하다. 이를 위해서는 나쁜 일자리임을 확인할 수 있는 중간 매개인들의 역할이 다시 한 번 강조되어야 한다. ‘근로선택의 자유’, ‘근로기회의 제공’, ‘근로환경의 보장’이라는 근로권의 내용들 별개의 요소로서 각각 실현되거나 보장되는 것이 아니며, 상호 유기적으로 연관되어 보장되어야 ‘근로권의 실현’이라는 하나의 목적을 달성할 수 있을 것이다.

Methylation이 心筋細胞膜에서의 ATP에 의한 Calcium Transport에 미치는 影響

For the purpose of studying the properties of calcium pump, the effect of methy lation on the ATP-induced Ca-transport in the isolated porcine sarcolemmal vesicles which were loaded with high KCI was investigated. 1) Ca-transport by ATP was increased significantly, compared to control sarcolemmal vesicles. 2) Ca-transport of the vesicles preincubated in the methylation medium without PM II was increased by ATP, but less than control sarcolemmal vesicles. 3) Ca-transport of the vesicles preincubated in the methylation medium with PM II was decreased by ATP in the KCl medium, but increased in NaCI medium. But Ca-transport by ATP in the methylated vesicles in the reaction medium (NaCI and KC1) was significantly decreased, compared with Ca-transport by ATP in the nonmethylated vesicles. From the above results, it was suggested that methylation of membrane protein by PM II can change the membrane properties or the activity of calcium ATPase transporting calcium.

An Efficient FEC design with Low Complexity and new Architecture for Digital Audio Broadcasting

Lift-off를 이용한 DLC-coated Si-tip FEA 제조에 있어서 gate 절연막의 측면에 DLC가 coating되는 것을 방지하기 위해 기판 상에 Al 희생층을 경사-회전 증착한 뒤 DLC를 coating하고, 다음으로 희생층을 식각하여 tip 이외의 DLC를 제거하는 방법을 제안하였다. 이러한 Al희생층을 이용한 lift-off공정에 의해 제조된 DLC-coated Si-tip FEA의 전류전압 특성과 전류 표동 특성을 조사하였으며, gate 누설 전류의 감소와 방출 전류의 안정성을 확인하였다. For the DLC-coaled Si-tip FEA, the modified lift off-process, by which DLC coated on both gate electrode surface and gate insulator in the gate aperture could be removed, was proposed. In the process, the Al sacrificial layer was deposited on a tilted and rotated substrate by an e-beam evaporation, and DLC film was coated on the substrate by PA-CVD method. Afterward the DLC was perfectly removed except the DLC films coated on emitter tips by etch-out of Al sacrificial layer. Current-voltage curves and current fluctuation of the DLC-coated Si-tip FEA showed that the proposed lift-off process played an important role in decreasing gate leakage current and stabilizing omission current.

Purpose: To report a case of vitreous inflammation (vitreous web) after intravitreal bevacizumab injection accompanying pars plana vitrectomy (PPV) for the treatment of proliferative diabetic retinopathy with vitreous hemorrhage. Case summary: A 41-year-old female who underwent panretinal photocoagulation for diabetes mellitus (DM) retinopathy presented with decreased visual acuity in her right eye which was caused by vitreous hemorrhage. The patient underwent PPV with intravitreal bevacizumab injection. One day after surgery, the vitreous hemorrhage cleared and there was no inflammation in the anterior segment; however, multiple inflammatory white strands (vitreous web) were found in the vitreous cavity. She was diagnosed with non-infectious endophthalmitis and treated with topical steroid and additional oral steroids, resulting in clearance of the vitreous web on postoperative day 4. One month later, vitreous hemorrhage occurred in the other eye. PPV without bevacizumab injection cleared the vitreous hemorrhage with no evidence of vitreous web. Conclusions: Vitreous web-like inflammation can occur after intravitreal bevacizumab injection accompanying PPV for the treatment of DM vitreous hemorrhage. After eliminating infectious endophthalmitis based on lack of pain, conjunctival injection, anterior chamber hypopyon, and inflammatory cells, the web can be cleared without invasive intravitreal antibiotics injections.
