There is to consumer affair and the issue which is important for the consumer to secure the fairness of consumer contract. The consumer compares in the business owner and there is a disadvantage from the contract contracting process which follows in the tribe of information is necessary to a consumer affair. And with use of agreement there is to decision of contract contents and there is a disadvantage. For the solution of like this problem about effect of contract provision is from consumer relevant law, it with withdrawal is the invalid provision of contract. Case of invalidity of contract, in compliance with the general consideration of civil law, and provision is from consumer contract relevant law. By the way, for the fairness security of consumer contract from with intention the effort for the agreement of indication is necessary. Namely, provides proper information about the consumer with means that the attainment of the goal which the consumer is economic is possible. In conclution, puts about the invalid unifying provision of consumer contract from consumer organic law, to future the establishment of consumer provision from the before civil law is requested.

불교문화콘텐츠의 개발과 활용방안

The culture in modern society has become the factor that changes human life and has ruled the world of human spirit. KUKBO 173 kinds of 307 ones and BOMUL 956 kinds of 1,469 ones, in total, 1,129 kinds of 1,776 national treasures, showing 63.6% of them, are related to Buddhism. Consequently, it is no exaggeration to say that Buddhist cultural contents are typical of Korea s cultural contents. It is a good thing recently, although it s late, that Buddhist experts and academics show interest in digitalization of Buddhist cultural contents. To go forward with digitalization of Buddhist cultural contents, it is necessary for believers in Buddhism to have interest in it and to draw support from Buddhist circles. Therefore it would be the best way that Buddhist TV takes the role. Buddhist cultural contents can be defined as Creatively produced cultural contents composed of Buddhist cultural heritage, Buddhist way of life, and social phenomena related to them, aiming value of Buddhism by Buddhology . Buddhist cultural contents are fully worthy of using. Buddhist cultural heritage should be popularized and industrialized by making it as digital contents, so people can contact it easily. Buddhism has been putting down roots as symbolic and universal value concept of our own. Buddhist film can be said that it began from such emotional categories. As the starting of Buddhist film was late, Buddhist cultural contents have not put down roots yet. The major problem of Buddhist film is not production but analysis, therefore, it is more important to analyze Buddhist film by Buddhist position than produce Buddhist films. Buddhist circles show interest recently in the industry of animation character. The character industry, regarded as a growth factor of future industry, attract attention of Buddhist circles as well as whole social fields. Hence experts, men of great originality and idea, should be bred up and should take roles for central growth factor leading Buddhist cultural contents. On the basis of this, I suggest that Buddhist TV should consider televise Buddhist films for the promotion of program rating and the diversification of program contents. Also it is necessary that the development of flash animation and character, the most easily approachable Buddhist cultural contents children and teenagers can. I suggest that Buddhist TV hold Buddhist Film Festival with the advantage of cable TV broadcaster. So far any religion-related film festival has not been held in Korea and other countries. If Buddhist TV hold Buddhist Film Festival through preliminary examination and preparation with the advantage of picture missionary media, it will get excellent results. Once Buddhist TV(BTN) hold Buddhist Film Festival successfully, it will grow Buddhist films as Buddhist cultural contents, and contribute to the strengthening of prestige as a Buddhist broadcaster as well as secure program contents. 현대사회에서의 문화는 인간의 생활을 변화시키는 요소로 작용할 뿐만 아니라 정신세계까지 지배하게 되었다. 우리나라의 국가지정문화재 국보 총307종 가운데 173종, 보물1,469종 가운데 956종, 합계 1,776종 중 63.6%에 해당하는 1,129종이 불교와 관련된 문화재이다. 따라서 불교문화 콘텐츠가 한국의 대표 문화콘텐츠라고 해도 과언이 아닐 것이다. 최근 들어 불교학계와 뜻있는 전문가들이 중심이 되어 불교문화 콘텐츠의 디지털화에 관심을 보이고 있음은 늦었지만 다행스러운 일이다 디지털화 작업들이 차질 없이 진행되도록 하기 위해서는 불교인들이 관심을 갖도록 하여 불교계의 지원을 유도하는 역할이 필요한데 이 역할을 불교TV가 맡는 것이 가장 효과적일 것이다. 불교문화콘텐츠는‘불교철학의 입장에 서서 불교적 가치를 지향하며, 불교 문화유산·불교적 생활양식, 이와 관련된 사회적 제반 현상 등을 소재로 하여 창의적인 방법으로 제작된 문화 콘텐츠’라고 할 수 있다. 불교문화콘텐츠는 그 활용가치가 매우 높다. 따라서 전략적으로 디지털콘텐츠화하여 불교문화유산을 대중화하고 산업화하여 많은 사람들이 손쉽게 접촉할 수 있도록 하여야한다. 불교는 우리 민족의 상징적, 보편적 가치 개념으로 자리 잡고 오늘날에 이르고 있다. 불교영화 역시 그러한 정서적 범주에서 출발했다고 할 수 있다. 그럼에도 불구하고 불교영화의 출발은 매우 늦었으며 아직까지 확실한 불교문화콘텐츠로 자리 잡지 못하고 있다. 앞으로 불교영화의 과제는 생산이 아니라 해석에 그 과제가 있으며 불교를 소재로 한 영화를 생산하는 것보다, 영화를 얼마나 불교적인 입장에서 해석해내는가가 관건이다. 불교계에서 최근 들어 많은 관심을 갖게 된 분야가 애니메이션 캐릭터 산업이다. 물론 불교계뿐만 아니라 미래산업의 신성장동력으로 평가 받고 있는 캐릭터 산업은 사회 모든 분야의 관심을 끌고 있다. 따라서 창의력과 아이디어가 넘치는 전문인력을 양성하여 불교문화콘텐츠를 주도하는 핵심 성장동력으로 활용하여야 한다. 이러한 결과를 토대로 불교TV에서도 시청률 제고와 프로그램 콘텐츠의 다양화를 위해 불교영화의 방영을 적극 고려하여야 할 것으로 보인다. 그리고 어린이와 청소년들이 가장 쉽게 접근할 수 있는 불교문화콘텐츠인 플래시 애니메이션과 캐릭터를 개발하는 노력이 필요하다. 케이블TV 방송사라는 장점을 살려‘불교영화제’개최도 고려해볼 만하다. 현재까지 국외는 물론 국내에서도 종교영화를 주제로 한 영화제는 개최된바가 없다. 따라서 철저한 사전 조사와 준비를 거쳐 불교TV가 영상 포교 매체의 장점을 활용하여‘불교영화제’를 개최한다면 상당한 성과를 기대해 볼 수도 있을 것이다. 불교TV(BTN)가 불교영화제를 성공적으로 개최한다면 불교문화콘텐츠로서의 불교영화를 성장시켜 프로그램 콘텐츠 확보는 물론 종교방송사로서의 위상 강화에도 크게 기여 할 것으로 보인다.

채권자취소권의 성질과 원상회복청구의 문제 : 법적 성질 및 부동산경매에서의 문제를 중심으로

채권자취소권의 연혁적 의미와 각국에서의 계수 및 법제화에서는 각각의 특성을 보이고 있다. 우리 민법의 경우, 입법과정에서 구민법에서의 조항에 대한 논의에서 출발하여 원상회복을 규정함으로써 채권자취소권의 본질에 대한 논의가 중요하게 되었다. 채권자취소권의 본질은 자신의 채무의 이행을 통해 채권을 만족시킬 의무를 부담하는 채무자가 악의적이거나 불성실한 행위에 대해 예외적으로 부인하는 것이다 즉, 채무자의 재산감소행위를 부정하고, 그 재산을 채무자에게 복귀시킴으로써 채권자의 채권을 만족시킬 수 있도록 보호하는 것이다. 현행 민법상 채권자취소권의 효력 중 원상회복의 문제는 부동산경매의 과정에서도 중요한 변수가 될 수 있는 것으로, 본고에서는 채권자취소권의 성질에 기초하여 부동산 경매의 배당금 수령시 등에서 발생할 수 있는 문제에 대해 고찰하고 문제해결을 위한 개선방향을 제시하였다. The historical meaning, acceptance and legislation of the creditor s right of revocation differ among nations. In case of our Civil Law, the discussions about its legislation started from those about the clauses of the Previous Civil Law, and in this process the principle of restoration was agreed to and thereby, the discussion about the essence of creditor s right of revocation would be important. Under the current principle of creditor s right of revocation, the debtor s malicious or insincere acts shall be revoked if he or she reduces his/her chargeable properties only to make the creditor s rights not satisfied. Namely, the debtor s asset-reduction acts shall be revoked, and therefore, the assets shall be returned to the debtor to protect creditor s receivables. Under the current Civil Law, the restoration would be an important variable in the process of real estate auction. Based on such attributes of the creditor s rights of revocation, the researcher reviewed the possible problems rising in the process of the real estate auction, and thereby, suggested some reform measures to solve such a problem.

인터넷 보급화와 기술의 발달로 가정 내 가전기기들을 네트워크로 연결하여 서로의 정보를 공유한다. 분산 환경인 연결 동작을 지원하는 시스템을 홈 네트워크의 기술을 바탕으로 사이버 홈이라는 개념이 생겨나게 되었다. 그리고 가전기기들의 인터넷을 통하여 제어할 수 있는 기술들이 생겨났다. 로컬화 되던 가전기기들이 디지털화되고 이기종간 연결을 위해서 미들웨어를 필요하다. 미들웨어를 사용하지 않을 때에는 서로 다른 가전기기들을 연결하여 사용하려면 중간에 Converter를 설치해야만 하는 불편한 점을 미들웨어가 해소해주게 되었다. 미들웨어로 UPnP와 Jini등 다양한 기술들이 생겨났다. 본 논문은 아직 미들웨어의 표준화가 되지 확정 않은 시점에서 미들웨어 하나인 UPnP을 택하여 가정내에서 전자 액자 서비스를 구현하고 그것에 대한 효용성을 보이고자 한다.

The hazard which solves like this problem it stands, the establishment of the regulation which is detailed regarding a succession recovery claim is requested. When seeing from like this side, the regulation of 14 things regarding the succession recovery claim at Germany civil law good instance is a possibility of doing. The legislation which is detailed regarding the application scope, the object and the prescription of succession recovery claim to consider the legal nature with first priority and must become accomplished.
