정부의 예산증액동의권과 국회의 자율적 예산조정권 - 헌법 제57조의 해석과 적용을 중심으로 -

제헌 이후 예산관계법이 제정되면서 헌법에 근거하지 않는 정부 편의적인 수단들이 대거 도입됨에 따라 국회와 정부 사이의 예산에 관한 권한의 균형이 무너지게 된다. 견제와 균형의 원칙에 입각하여 볼 때 국회의 예산심사권을 지금보다는 확대하는 방안을 강구할 필요가 있다. 그것은 예산집행단계에서 정부의 편의성 제고에 상응하여 국회에 예산심사과정에서 자율적인 조정권을 인정하는 것이다. 구체적 방안으로, 정부가 편의적 예산집행의 수단으로 적극 활용하고 있는 항의 하위단위인 세항과 세세항에 대해서는 국회에 예산심사에서 헌법 제57조에 따른 정부의 동의 없이 항의 금액 범위에서 감액한 예산을 가지고 자율적으로 조정할 수 있는 권한을 인정하자는 것이다. 그것을 위하여 헌법을 개정할 필요는 없고, 헌법 재해석으로 충분하다. 국회의 예산조정과정에서 항의 하위단위에서 새 비목을 설치할 필요가 있을 때도 같은 취지에서 정부의 동의가 필요 없다고 해석하는 것이 적절할 것이다. The Executive-Legislature balance of budgeting power has been tilted towards the government because of the adoption of a lot of means in budget-related laws which provide convenience to the government in budget execution but not exactly conform to the Constitution. Therefore, based on the principle of checks and balances, the National Assembly needs to explore ways to expand its authority in budget examination. One of the solutions corresponding to the increased convenience in government’s budget execution is to provide the National Assembly with more discretion in budget amendments. More specifically, pursuant to the Article 57 of the Constitution, the National Assembly can be given the authority to make amendments without the consent of the government to the amount of budget cuts on sub-items which the government takes advantage of as a means of budget execution. If it would be the case, there is no need to amend the Constitution besides reinterpretation of the Constitution for it. In the same vein, it would provide a reasonable ground for the National Assembly not to seek the consent of the government when it needs to create sub-items of expenditure in the budget amendment process.

As the size and complexity of software increases, it is important to ensure the quality of software through testing. Many organizations refer to international standards or test process models to improve the quality of software through establishing a systematic test process. However, these standards and process models provide general processes that do not reflect the characteristics of the domain or the organization's test policies and strategies. To establish a test process that reflects the characteristics of the organization, test policies and strategies based on the organization's quality objectives and the organizational and domain characteristics should be reflected. This study proposes specific methods for eliciting activities and information to establish organizational software test policies and strategies that are essential to establishing a test process that reflects the characteristics of the organization and the system.
