      • 개인방송 콘텐츠 시청자의 바이럴 행동 의도에 영향을 미치는 요인에 대한 연구 : 정교화 가능성 모형을 중심으로

        YouTube, the world second most visited website and the most popular video sharing platform, has become an important place for online word-of-mouth. With this growth, personal webcasters, so-called YouTube creators, are gradually expanding their influence in social media. In this study, we are going to focus on examining the antecedent factors which make personal webcasting content go viral. Our study adopt the Elaboration Likelihood Model (ELM) to identify central (i.e., argument quality) and peripheral (i.e., creator credibility and platform credibility) cues that affect personal webcasting content viewers’ cognitive and affective attitude, and their viral behavior intention toward the YouTube channel. In addition, the moderating effect of issue involvement between central and peripheral cues and viewers’ attitude toward the YouTube channel will be examined.

        저령차전자탕을 이용해 현훈을 치료한 환자의 특징 고찰 : 63례의 후향적 분석

        Purpose: The purpose of this study was to conduct a clinical analysis of patients treated for dizziness with Jeoreongchajeonja-tang, evaluate the effect of Jeoreongchajeonja-tang administration, and present indications of Jeoreongchajeonja-tang in dizziness. Methods: A retrospective study was conducted on 63 patients who were admitted to the Oriental Hospital of Se-Myung University from August 2012 to June 2019, complaining of dizziness, so who took Jeoreongchajeonja-tang. Results: 1) As a result of the analysis of the general characteristics of patients who took Jeoreongchajeonja-tang with dizziness, women were 2.7 times more than men. The age distribution was: patients in their 70s, 36.5%; in their 50s, 20.6%; in their 60s, 15.8%; and in their 80s, 12.6%. Patients had a history of hypertension (46.0%), diabetes (22.2%), stroke (17.4%), lung disease (12.6%), and cancer (11.1%). According to the diagnosis, 48 patients (76.1%) were assigned to the peripheral dizziness group, 7 patients (11.1%) to the central dizziness group, and 8 patients (12.6%) to other dizziness groups. 2) Compared with the peripheral dizziness group, the central dizziness group was older, their history of hypertension 8.4 times greater, their history of stroke 7.8 times greater, and the duration of herbal medicine administration was longer. 3) The vertigo grade was significantly decreased after taking Jeoreongchajeonja-tang (p=0.000). 4) As age increased by one year, odds ratio of improvement in the vertigo grade decreased by 0.924 times after taking Jeoreongchajeonja-tang (p=0.010). 5) Sex, disease duration, past history, diagnosis, the duration of herbal medicine administration, whether or not Yanggyuksanhwa-tang was combined with the Jeoreongchajeonja-tang and whether or not Western medicine was used did not affect improvement in the vertigo grade after taking Jeoreongchajeonja-tang. Conclusions: In patients with dizziness, Jeoreongchajeonja-tang can be used as a treatment without side effects

        독활지황탕가미를 이용한 암 수술 후 조기 회복 : 연속 증례 보고

        Objectives: Fatigue, malnutrition, and weight loss are common complaints after undergoing surgery for cancer. These symptoms can be associated with Yin-Deficiency (陰虛) of Exhaustion syndrome (虛勞). Therefore, this study aimed to determine if it is possible to use Dokhwaljihwang-tang, which originates from Yukmijihwang-tang, for enhanced recovery after cancer surgery. Methods: After cancer surgery, Dokhwaljihwang-tang-gami was administered three times a day, in 80-120 ml doses at a time. Results: In four cases of gastric, colorectal, and thyroid cancer, enhanced recovery was achieved using Dokhwaljihwang-tang-gami to treat general weakness, fatigue, and pain in the surgical site after cancer surgery. Conclusions: Dokhwaljihwang-tang can be used for enhanced recovery after cancer surgery.

        중소기업적합업종제도의 국제통상법 적용대상 적격성 및 위배 가능성에 대한 연구 - 동반성장위원회의 2013년도 중소기업 적합업종(품목) 지정권고를 중심으로 -

        In 2013, the National Commission for Corporate Partnership (NCCP or Commission), established pursuant to the Act on the Promotion of Collaborative Cooperation between Large Enterprises and Small-Medium Enterprises, added three manufacturing and 15 service sectors on the list of businesses suitable only for small and medium enterprises (SMEs) in addition to existing 82 manufacturing sectors. According to the guidelines made by the NCCP, non-SMEs or conglomerates are recommended to restrain their businesses in the designated sectors for the protection of SMEs. The NCCP’s guidelines are recommendations, not regulations, but companies that refuse to accept the recommendations are instructed by the Small and Medium Business Administration (SMBA) to adjust their businesses. Those that do not follow the SMBA’s order can be subject to imprisonment of under a year or fines of 50 million won or less. The paper here pays attention to the part that the guidelines apply to not only Korean domestic companies but also foreign companies. The purpose of this paper is to analyze the NCCP’s guidelines from the perspective of international trade law. The paper first examines whether the Commission’s guidelines designating SME-suitable business areas can be regarded as measures under international trade law, and if so, then whether the measures are inconsistent with any international trade law, particularly TRIMs Agreement, GATS, Korea-US FTA and Korea-EU FTA. 대·중소기업상생협력촉진에관한법률에 근거하여 설립된 동반성장위원회(동반위)는 2013년 제조업 3개 품목과 서비스업 15개 업종을, 기존의 제조업 82개 품목에 더하여, 중소기업적합업종으로 지정하고, 중소기업의 보호를 위해 중소기업이 아닌 기업, 즉 대기업의 해당 업종에서의 활동 자제를 권고하였다. 비록 동반위의 중기적합업종 지정권고행위 자체는 법적 구속력이 없는 권고일 뿐이라 할지라도, 그 지정권고에 대한 위반 행위는 결국 1년 이하의 징역 또는 5천만원 이하의 벌금 등 중소기업청장에 의한 행정제재로 이어질 수 있다. 이와 관련하여 본 논문이 주목하는 부분은 이러한 중기적합업종제도가 국내 대기업뿐 아니라 외국 대기업에도 적용된다는 점이다. 본 논문은 국제통상법적 측면에서 동반위의 중기적합업종 지정권고를 분석하는 것을 그 목적으로 한다. 본 논문은 먼저 중기적합업종제도가 국제통상법의 적용대상인 조치에 해당하는지 여부를 살펴본 다음, 그렇다면 그러한 조치가 TRIMs협정, GATS, 한·미 FTA, 한·EU FTA 등의 국제통상법을 위반하고 있는지 여부를 검토한다.

        한일청구권협정 중재절차조항에 대한 국제법적 고찰 - 강제동원 손해배상 판결에 대한 일본의 중재위원회 개최 요청을 중심으로 -

        The judgement of the ROK Supreme Court concerning compensation claims filed by forced labor victims during Japan’s colonial occupation, delivered on October 30, 2018, has raised many controversial legal issues. Among those issues, this paper focuses on international law issues regarding Japan’s invocation of the dispute settlement procedure under Article 3 of the Agreement on the Settlement of Problem concerning Property and Claims and the Economic Cooperation between the Republic of Korea and Japan (hereinafter “the Agreement”). In regard to this matter, Japan first requested diplomatic consultations with Korea under Article III.1 of the Agreement. Japan then invoked the arbitration proceedings under the Agreement, by requesting to establish an arbitration board, in accordance with Article III.2 and subsequently Article III.3. In the meantime, Korea has not taken any steps in the dispute settlement process of the Agreement. This paper purports to study arbitration procedural rules under Article 3 of the Agreement from the international law perspective, focusing on Japan’s aforementioned request to establish the arbitration board and Korea’s silence against such request, and thus to develop Korea’s possible legal defenses on the matter at hand. The paper first provides a brief background of the subject matter, and then examines major procedural and substantive legal issues relevant to this matter. This subject matter is significant, because it is the very first case where the arbitration proceedings has been ever invoked since the entry into force of the Agreement. The current circumstances, with a series of similar court rulings and similar pending cases, render it more necessary than before to study this topic. 2018년 10월 30일 대법원은 일제 강제동원 피해자의 일본기업을 상대로 한 손해배상청구 사건에서피해자인 원고의 승소를 확정하는 전원합의체 판결을 내렸다. 본 판결에 대하여 일본 정부는 「대한민국과 일본국간의 재산 및 청구권에 관한 문제의 해결과 경제협력에 관한 협정」(이하 “청구권협정”) 제3조 제1항에 따른 외교적 협의를 요청한 데 이어 제2항과 제3항에 따른 중재위원회 개최를 순차적으로 요청하였지만, 한국 정부는 동 분쟁해결절차에 참여하지 않고 있다. 본 논문은 본 사안, 즉 청구권협정에 기한 일본의 중재위원회 개최 요청 및 한국의 불응과 관련하여 대두될 수 있는 청구권협정 제3조 중재절차조항상의 쟁점을 국제법적 측면에서 살펴보고 한국의가능한 법리적 대응논지를 모색해 보고자 한다. 이를 위해 본 논문은 먼저 본 사안의 배경을 간략히개관한 후, 청구권협정 제3조 제2항 이하 중재절차의 이행과 관련된 주요 절차법적 및 실체법적 쟁점을 검토하고 논의한다. 본 사안은 청구권협정 체결 이래 제3조 제2항 이하의 중재절차로 나아간 첫 번째 사례인 바 그 의의가 크다 할 것이며, 본 사건과 유사한 사건에 대하여 본 판결과 같은 취지의 판결이 잇따르고 있는 현 상황에서 관련 연구의 필요성은 더욱 있어 보인다.

        초등학교 고학년의 게임 몰입 경험이 문제적 게임 이용에 미치는 영향에서 부모 감독의 조절효과: 조절 손상과 과도한 시간 소비를 중심으로

        This study investigates the moderating effect of parental monitoring on the relationship between flow experience and problematic game use of upper elementary school students. Control impairment and excessive playing are focused on as main symptoms of problematic game use. The data of 21,021 upper elementary school game users from the ‘2021 Comprehensive Survey on Game Excessive Immersion’ published by the Korea Creative Content Agency (KOCCA) was used for the analysis. Pearson correlation analysis was performed, and PROCESS macro was used to assess the moderating effects. Flow experience in gaming was positively correlated with control impairment and excessive playing. Parental monitoring was negatively correlated with flow experience in gaming, control impairment, and excessive playing. Parental monitoring moderates the relationship between the flow experience in gaming and the main symptoms of problematic game use (control impairment and excessive playing). These results show that the flow experience in gaming can affect the problematic game use of upper elementary school students. This study suggests that parental monitoring, a healthy parenting behavior, can be a protective factor for game use problems.

        제3국 우회 역외보조금에 대한 규제 동향에 관한 소고

        The transnational subsidies have been actively used in China’s Belt and Road Initiative, and the issue of transnational subsidies has recently come to the fore in the international trading system. Due to its circumventing nature where foreign governments subsidize their own manufacturers in third country markets, transnational subsidies are not included within the purview of subsidies, disciplined under the Agreement on Subsidies and Countervailing Measures (“SCM Agreement”) of the World Trade Organization (“WTO”), and thus cannot be directly bound by the rules of the WTO SCM Agreement. The rules of international trade law regulating transnational subsidies are still absent, but in 2021 two regulatory bills on transnational subsidies were proposed by the European Union (“EU”) and the United States (“US”), respectively. Although both of these bills were initially proposed concerning China's transnational subsidies, the regulations, once enacted, can be applicable to not only China but also Korea. Accordingly, the purpose of this paper is to study the regulatory trends of the transnational subsidies by focusing on those two bills. This paper first introduces the limitations of the current WTO rules to regulate transnational subsidies, emanated from China’s Belt and Road Initiative. Next, this paper reviews the recently proposed regulatory bills on transnational subsidies by the EU and the US, respectively. Last but not least, this paper examines the WTO compatibility of the proposed EU and US regulations on transnational subsidies, and analyzes their implications. 중국의 일대일로 사업에서 역외보조금이 적극적으로 활용되면서, 국제통상체제에서 역외보조금의 문제가 본격적으로 대두되고 있다. 특히 제3국을 우회하여 공여된다는 그 특성상 역외보조금은 세계무역기구(“WTO”)의 보조금 및 상계조치에 관한 협정(“보조금협정”)상의 보조금 정의를 벗어나 관련 규율의 직접적인 적용이 어려운 문제가 있다. 이러한 역외보조금의 문제를 규율하는 국제통상규범은 아직까지 부재한 상태이나, 2021년 유럽연합(“EU”)와 미국에서 관련하여 주목할 만한 법안이 각각 발의되었다. 비록 이들 두 법안은 모두 중국의 역외보조금을 염두에 두고 발의된 것이기는 하나 그 적용 대상이 비단 중국에만 국한된 것은 아니므로 해당 법안들의 입법 시 우리나라도 그 적용을 받을 수 있다. 이에 따라 본 논문은 이들 법안을 중심으로 역외보조금에 대한 규제 동향을 살펴보고자 한다. 이를 위해 본 논문은 먼저 중국이 일대일로 정책에 따라 지급하는 역외보조금에 대한 현행 WTO 규범의 한계를 소개한다. 다음으로 본 논문은 역외보조금 규제와 관련하여 최근 발의된 EU와 미국의 법안을 차례로 살펴본다. 끝으로 본 논문은 EU와 미국의 역외보조금 규제의 WTO 합치성을 검토하고 그 시사점을 논한다.
