인터넷의 등장에 따른 사이버스페이스의 확장이 많은 변화를 야기하고, 특히 법 영역에서 현실세계의 법체계와 충돌하면서, '사이버스페이스와 법'에 관련된 문제는 우리나라 뿐만 아니라 세계 각지에서 21세기의 가장 중요한 이슈 가운데 하나로 부상하고 있다. 인터넷이나 컴퓨터와 관련된 기술발전의 속도가 빨라지고, 디지털화와 그 결과물인 디지털콘텐츠의 중요성이 증대되고, 전자상거래가 현실세계의 거래에 버금가는 영향력을 갖게 되면서 지적재산권 관련분야의 환경도 급변하고 있다. 특허, 상표, 저작권 등 지적재산권 이용형태의 다양화와 정보 유통형태의 혁신적 발전은 더 많은 정보의 자유로운 이용을 요구하는 이용자와 그러한 환경변화에 부응하는 보호를 요구하는 지적재산권자간의 충돌을 야기하고 있으며, 새로운 유형의 정신적 창작물에 대한 보호와 규율에 대한 논의가 활발히 이루어지고 있다. 이런 상황에서 세계 정치, 경제, 법률을 이끌고 있는 미국의 지적재산권관련 법제의 전개상황을 면밀히 살펴보는 것은 우리의 이익을 지키기 위하여 필수 불가결한 활동이다. Global commerce is apparently here to bind Korean firms as well as Koreans. The advertising, buying and selling of goods and services recognizes no borders. As a result, enforcing territorially based trademark rights has become ever more challenging. Remote trademark owners who peacefully coexisted in a time before the internet and increasing globalism are now bumping heads. The internet also has made it easier for unscrupulous operators to deceive consumers and divert customers from established businesses by misappropriating trademarks on web-sites and in domain names. U.S. federal courts have been willing to help American businesses halt trademark infringements that reaches outside the United States. This is particularly true for e-business, via the internet, and the trend toward enforcement seems to be in favor of the trademark owner. This article discusses this trend as well as the extraterritorial enforcement of trademark rights by U.S. courts under the Lanham Act. It also offers suggestions for protecting valuable trademark rights worldwide. This paper will contribute to global Korean firms and Koreans who carefully read arguments in this valuable literature.

Comparing to other industry sector, a financial business, as information intensive industry is using the information and communication technology for having a chance of cost reduction and profit creation. Especially financial transaction network using internet is now promoting faceless transactions. A new legal system or general revising of the existing legal system relating to electronic financial transactions will be needed for current conventional legal system showing some limit as improper measure which cannot handle various risks originating from faceless or paperless transactions. Currently we don't have a legal system for regulating a new electronic finance business such as issuing electronic money or providing payment gateway system but general actor clause like Civil Act, Credit-specialized Financial Business Act or Basic clause of electronic finance transaction for regulating electronic transactions(authorized by Korea Fair Trade Commission). Complementing loop holes in the law Government is now waiting for enactment of Electronic Finance Transaction Bill containing basic rules of electronic finance transaction and supervision basis of new services such as issuing electronic money or providing payment gateway system. In spite of enacting such a bill some kind of difficulty that hinder systematic supervision or examination for electronic finance was mentioned due to the lack of effort to integrating other scattered law relating electronic finance transaction. Besides problems that we mentioned before, legal problems resulted by various risks relating to the real-name financial transaction system or suspicious financial report and overseas Transferring personal finance information (data) should be reviewed in the near future.
보험사업에서의 블록체인 기술활용, 발전방향성, 그리고 과제

블록체인은 보험사업을 변혁할 수 있는 유력한 선진기술 중 하나로 보험사들 사이에 널리 인식되고 있다. 블록체인은 기존 시스템에 비해 데이터 조작이 어렵고 시스템 장애에 강하다는 우위가 있다. 스마트 컨트랙트를 구현할 수 있는 것도 특징이다. 다양한 플랫폼이 활용 목적에 맞게 사용된다. 국내외 보험회사에서 실용화를 위한 검토가 진행되고 있다. 예를 들면, 국제적 컨소시엄 B3i, AIG의 멀티내셔널 보험, 다수의 관계자들이 참가하는 해상보험 플랫폼 구축 노력 등이 있다. 항공기가 지연될 경우 보험금을 자동으로 지급하는 항공보험 개발도 활발하다. 몇몇 사례들은 제3자가 관리하는 이력 정보를 손해사정이나 주문형 보험에 활용하는 사례들이 등장하고 있다. 보험분야에서의 블록체인 활용을 위한 착안점은 무엇인가? 현재까지 블록체인 적용(시행) 사례는 다음의 세 가지 경우로 정리할 수 있다. 1. 참가자의 범위: ① 보험회사 내, ② 보험회사 간, ③ 보험회사와 벤더 간(에코시스템), 2. 활용하는 이점: ① 분산형대장, ② 분산형대장과 스마트 컨트랙트, 3. 혁신성: ① non-disrupt, ② disrupt 등이다. 미래에는 P2P 보험, 파라메트릭 보험, 마이크로 인슈어런스로 발전할 여지가 있다. 블록체인은 미성숙한 기술인만큼 기밀성 확보, 대량 거래 및 처리 지연에 대한 대응, 외부 데이터 소스의 신빙성 문제, 스마트 컨트랙트 자체의 미비 등 다양한 과제가 지적되고 있다. 에코시스템형 등에서의 데이터 유출 시 책임 소재나 관할권 문제가 새롭게 발생할 가능성도 있다. 보험사업에서의 실용화에는 많은 시간과 투자가 필요하다고 한다. 향후 기술의 진전에 기대함과 동시에 실현 가능성이 높은 영역에서 적극적으로 기술의 도입이 추진되기를 기대한다. Blockchain is widely recognized among insurance companies as one of the powerful advanced technologies that can transform the insurance business. Compared to existing systems, blockchain has an advantage in that it is difficult to manipulate data and is resistant to system failures. It is also characterized by being able to implement smart contracts. A variety of platforms are used for different purposes. Domestic and foreign insurance companies are reviewing for practical use. For example, there are international consortium B3i, AIGs multinational insurance, and efforts to build a marine insurance platform in which multiple stakeholders participate. The development of aviation insurance that automatically pays insurance in case of flight delay is also active. In some cases, there are cases in which history information managed by a third party is used for damage assessment or on-demand insurance. What is the starting point for the use of blockchain in the insurance field? The blockchain application (implementation) cases so far can be summarized in the following three cases. 1. Scope of participants: ① Within insurance companies, ② Between insurance companies, ③ Between insurance companies and vendors (ecosystem), 2. Benefits: ① Distributed ledger, ② Distributed ledger and smart contract, 3. Innovation : ① non-disrupt, ② disrupt, etc. In the future, there is room for development into P2P insurance, parametric insurance, and micro insurance. As blockchain is an immature technology, various challenges are being pointed out, such as securing confidentiality, responding to mass transactions and processing delays, problems with the reliability of external data sources, and insufficiency of the smart contract itself. In the case of data leakage in an ecosystem type, there is a possibility that a new issue of responsibility or jurisdiction may arise. It is said that a lot of time and investment is required to put it into practical use in the insurance business. We look forward to the advancement of technology in the future, and at the same time expect that the introduction of technology will be actively promoted in areas with high feasibility.

본 논문의 목적은 불교의 도입이 중국의 명(名)의 이해에 가져온 변화를 살펴보는 것이다. 이를 위해 우선 명(名)의 의미를 언어학적 층위에서의 이름과 철학적 층위에서의 이름으로 구분하여 개념 분석하였다. 이 개념 분석을 통해 우리는 이름에서 발생하는 언어적 의사소통의 문제가 있었다는 것을 정리할 수 있을 것이다. 다음으로 명(名)에 대한 개념에 결부된 윤리학적 맥락과 형이상학적인 맥락을 분리하였다. 윤리학적 맥락에서는 개념에 따라 부여되는 윤리적 행동과 개인의 반응에 관한 문제들을 다루었다. 한편, 형이상학적인 맥락에서는 학파에 따라 개념과 실제 사이의 간극을 해결하는 방법을 다루었다. 마지막으로 불교의 중관 사상이 도가 학파에서 주장했던 개념과 실제 사이의 불일치성을 어떻게 새롭게 접근하는지를 보일 것이다. The purpose of this paper is to examine the changes in the understanding of the concept of 'ming' (名) in China brought about by the introduction of Buddhism. To this end, the paper first analyzes the meaning of 'ming' (名) on two levels: as a linguistic term and as a philosophical concept, summarizing the issues related to linguistic communication arising from names. Next, the paper separates the ethical context from the metaphysical context associated with the concept. In the ethical context, it addresses issues related to ethical actions and individual responses ascribed to the concept. Meanwhile, in the metaphysical context, it explores how different schools of thought resolved the gap between concept and reality. Finally, the paper discusses how Buddhist Madhyamaka philosophy offers a new approach to the inconsistency between concept and reality, as asserted by Daoist schools.
유전영동을 기반으로 하는 탄소 나노구조의 선택적인 분리

Dielectrophoretic behavior of semiconducting single-walled carbon nanotubes(SWNT) was investigated theoretically and experimentally. The surface conductance of nanotubes was modulated using anionic and cationic surfactant mixtures. The experimental results indicate that dielectrophoretic behavior of SWNT highly depends on the procedure of mixing two opposite-charged surfactants. Clausius-Mossotti factor was calculated by measuring zeta potentials and solution conductivity. Raman spectroscopy was used to characterize the dielectrophoretically deposited nanotubes arrary. We found that metallic nanotubes were selectively separated from the nanotubes suspension, resulting from modulation of surface conductance of semiconducting SWNT.

Recently, the importance of reinforcing the durability of automobile parts to withstand high load inputs has increased. The insulator, located on the top of the strut or shock absorber of the front and rear suspension and attached to the body, transmits loads from the wheel and road surface, insulates vibration and shock, and contributes to ride comfort and handling performance. However, the existing insulator’s inner rubber experienced excessive deformation during durability testing, leading to weakened durability and creep performance. To address this issue, increasing the rubber’s hardness was attempted, but this resulted in inferior NVH (Noise, Vibration, and Harshness) and R&H (Ride and Handling) performance. In this study, the insulator’s structure was redesigned by eliminating the existing inner/outer rubber structure and applying a stopper structure to the upper and lower parts. This design aimed to implement secondary characteristics under large load inputs, according to actual vehicle requirements. The redesigned insulator demonstrated improved durability and characteristics, optimized weight reduction.
