중국 최고인민법원은 '특허권 침해분쟁 소송사건 심리에 적용하는 법률에 관한 약간의 문제 해석'에서, 특허청구범위의 해석, 특허실시행위, 비침해항변, 침해배상액의 산정, 생산방법의 추정, 비침해확인의 소에 대하여 규정하고 있다. 이 사법해석은 2010년 1월 1일부터 시행되어 지식재산권 침해분쟁을 운영하는 기준으로서 활용되므로, 각 규정의 내용 및 의미를 제공하고자 한다.
Dynamic Corrective Brace를 이용한 특발성 척추측만증의 치료효과에 관한 증례보고

Objective: This study is designed to evaluate the Effectiveness of dynamic corrective brace on patient of idiopathic scoliosis. Methods: We have investigated 3 patients with idiopathic scoliosis, confirmed X-ray and weared dynamic corrective brace from Decemder 2003 to December 2004. Result: After 12 months of application with dynamic corrective brace, One case, the T-spine Cobb's angle correctability was 47% and the L-spine was 84%, another case, the L-spine Cobb's angle correctability was 59%, the other case, the T-spine Cobb's angle correctability was 32% and the L-spine was 52% Conclusion: These results suggest that the dynamic corrective brace was effective treatment modality on patient of idiopathic scoliosis.

The RAK has in general adopted the provisions of the paris principles to a far greater extent than many other cataloguing codes. And the analyses confirm that the determination of the main entries in German cataloging rules is a rather complex process and one which can result in inconsistent, arbitrary decisions. And the selection of the main entry requires a considerable amount of decision making which is time-consuming and costly. From the point of view of computers, all entries are equal as points of retrieval. In light of the above considerations the most important recommendation to be made is that the main entry principle be abandoned from cataloging theory and practice and be replaced by the title entry. It would eliminate the need for personal judgments required by the present rule. In so doing, it would bring uniformity and Standardization to cataloging practice. Use of the title entry would reduce the time and effort spent on the selection of the main entry which serves no important purpose in the catalog. Therefore title entry is more developed finding device than author entry in direct approach for document retrieval

Supposed to have one of the largest unconventional natural gas(shale gas) reserves after Poland in European continent, France engaged early in 2008 to examine the feasibility of shale gas exploration in her territory. But in the face of growing anti-shale gas mobilization of numerous ecological associations and local residents worrying about environmental impact of pollution in the use of hydraulic fracturing, the only available technology in digging the shale gas up to the present but may cause ineluctably ground water contamination, earthquakes and depleting water resource, etc., French National Assembly finally voted in july 2011 the law prohibiting hydraulic fracturing in shale gas prospection and exploration. In this essays, we will examine some informations about shale gas reserves in France, and introduce controversies on shale gas exploitation in France since 2008. And specially, we will try to compare and analyse different argumentations of pro- and anti- shale gas advocates in order to show the controversy structure and identify the major actors engaged in that conflicts around shale gas, and finally prospect some possible outcomes of that controversies around shale gas exploration in France. 유럽에서 폴란드 다음으로 대규모 셰일가스 층을 자국영토에 보유한 것으로 알려진 프랑스는 2008년부터 일찍이 셰일가스 개발에 대한 타당성 조사에 착수하였다. 그러나 셰일가스 채굴을 위해 사용되는 수압파쇄공법에 내재된 환경적 위험요인(지하수 오염, 지진유발, 수자원 고갈)들이 환경단체와 개발지역 주민들에 의해 꾸준히 제기되면서 프랑스는 2011년 7월, 세계에서 최초로 수압파쇄공법을 이용한 셰일사스의 탐사 및 채굴을 금지하는 법을 제정하였다. 이 글에서는 프랑스의 셰일가스 매장량에 대한 정보를 검토하고 2008년부터 현재까지 지속되고 있는 셰일가스의 개발을 둘러싼 논쟁을 소개하면서 2011년 7월, 프랑스에서 수압파쇄법을 이용한 셰일가스 개발이 금지되기까지의 과정 및 이 금지법의 발효이후에도 현재 진행 중인 논쟁 및 셰일가스 찬/반론의 근거를 비교·분석할 예정이다. 또한 셰일가스를 둘러싼 프랑스의 논쟁구도 및 논쟁에 개입하는 주요 행위자의 특징을 식별하고 향후 프랑스에서의 셰일가스 개발 전망 혹은 가능성을 예측해 볼 것이다.

<P>Cold-formed steel design standards such as AIK, AISI, CSA, EC3, AIJ etc. which were suggested through experimental and numerical research with many parameters to estimate the failure mode and ultimate strength of bolted connections were summarized according to four failure modes of bolted connections ; net section fracture, end shear out fracture, bearing fracture and block shear rupture. These design equations which have been revised until recently were classified into some expressions based on types of shear connections, use of washer, requirements of ductility, shear lag effect, ratio of bolt diameter to thickness etc. In this study, it is shown that there are differences between the standards with respect to same failure mode and, in order to verify their applicability in predicting ultimate behavior of connections, the comparisons among current design codes and two existing test results of connection specimens fabricated from common steel and low ductility steel were made. It is recommended that AISI specification for bolted connections governed by net section fracture, end shear out fracture and bearing fracture, and CSA design code for block shear rupture within limited edge distance be used. In addition, revised formula for block shear rupture considering bearing fracture is suggested.</P>
