        국가(기관)범죄에 의한 피해자

        Usually the study of victim of crime is mean victim of crime by a person. But the state(a government agency) crime has a specially aspect comparative of the other crime. Because of the state(or person in a government agency) act the crime, but they change themselves victim by the people that victim of the state act. Truth and Reconciliation Commission, Republic of Korea('TRCK') is constructed for readjust our past history. TRCK received applications of people's difficulties that their experience in past time. The case is 7,539 that the TRCK determine investigation in July. 2007. In recent, TRCK is have five conclusion that concerned of the genocide in Korean War; Dongbakgulja in Naju, Dongchangkyo genocide in Naju, Gumjeonggul in Goyang, Sukdal in Munkeong, 11 division in Hampyong. The case of 'Suji Kim' and the case of 'the committee for reconstruct of Party of revolution by people' that the state act crime win a civil case(compensation for damage). I think that the case of two(civil case) is similar to the victim of the state(a government agency) crime in the Korean War. What is the policy of the victim of killed in the Korean War? I think it is very important part of study and argue now.

        경,검 수사권의 합리적인 조정에 관한 연구

        Police law enforcement authority in the country`s symbol, the police system to keep the democratic rule of law principles is the nation`s basic institutions. This phase of the police in determining the level of democracy in that country can be considered an important indicator. In this study, investigations of police and prosecutors to exercise a reasonable independence from Japan after adjusting for the investigations and take a look at the history of the debate concerning, prosecutors argued that the problems of monopoly investigations. And Germany. France. United States. England. Japan and investigations were reviewed. September 2, 2004 the Attorney General to adjust discretionary power to investigate as the council was composed of police and prosecutors, Sept. 10, police and prosecutors` investigations adjustments consultative body that has established December 16, the police investigation in progress meetings ensure the independence of the opening of the 19 agreed to. However, despite these efforts did not get the expected results. Modern society, human rights interpretation and application of the law and society is at the center of international exchange. Currently the national police and the prosecution of human rights is of utmost importance. The number of lawyers will increase very much. Growth of a lawyer for the crime, including the various social phenomena will lead to legal judgments and legal support. Recent investigations relating to coordination and the efforts of the National Assembly hope to bear fruit. And emphasizing the rights of police and prosecutors to cases of reasonable adjustments is expected to be a reality.

        식물근권에서 분리한 세균의 어류질병세균에 대한 항균활성 효과

        천연 항균물질의 연구는 대부분 식품소재, 특히 약용식물을 대상으로 하여 많은 연구가 진행되어 왔다. 그러나 식품소재의 경우 대량의 추출물 등을 제조하기 위해 많은 양의 재료가 필요하며, 이로 인한 비용 문제가 발생하게 된다. 미생물은 적절한 환경 하에서 대량 배양이 용이하기 때문에 천연항생제로 이용하기 위해 지속적인 연구가 이루어지고 있다. 본 연구에서는 식물병 억제에 효과가 있는 식물근권미생물을 이용하여 어류질병세균 4종을 대상으로 항균활성을 확인하였다. 이 중 항균활성을 나타낸 균 3종을 선발하여 배양액, 상층액, 균체 현탁액으로 나누어 어느 부위에서 항균효과를 나타내는지 탐색하고, 16S rDNA 염기서열 분석을 통해 균을 동정하였다. 12종의 식물근권세균 중 BRH433-2, THJ609-3, TRH415-2 3종에서 항균활성이 나타나는 것을 확인하였다. 세 균주의 배양액, 상층액, 균체 현탁액 중에서는 균체 현탁액이 가장 강한 항균활성을 나타내는 것을 알 수 있었다. 세 균주의 16S rDNA 염기서열 분석 결과, BRH433-2는 Burkholderia gladioli와 99.5%, B. plantarii 98.9%, B. ubonensis 98.5%, B. pyrrocinia 98.3%, B. glumae 98%로 나타났다. THJ609-3은 Pseudomonas baetica와 97.7%, P. moorei와 P. plecoglossicida에 대해서는 각각 97.6%, 97.5%의 상동성이, TRH415-2는 P. koreensis, P. baetica와 98.4%, P. moraviensis 98.3%의 염기서열 유사도를 나타났다. 따라서 3종의 식물근권세균은 충분한 안정성 및 안전성 실험을 실행한 후, 양식산업에 적용하여 항생제 대체 물질로서의 이용가치가 있다고 생각된다. Olive flounder (Paralichthys olivaceus) is an important aquaculture fish species in Jeju Island, South Korea. Due to the intensification of flounder fish farming, huge amounts of chemical antibiotics are used against several fish diseases. This has many harmful side effects on fish, as well as human consumers. Hence, an alternative to chemical antibiotic agents is needed for disease control. In this study, three strains of rhizobacteria (BRH433-2, TRH415-2, and THJ609-3) were isolated from the rhizosphere of plants. Assays of their antibacterial activity against fish pathogens, such as S. iniae, S. parauberis, V. anguillarum, and E. tarda, were performed with untreated broth culture (without cell separation), supernatant, and precipitated pellets separated by centrifugation. Among these, the cell suspension prepared from the precipitated pellet showed significant antimicrobial activity when compared with that of the untreated broth culture and centrifugal supernatant. These results indicate that the three isolated rhizobacterial strains exhibit antibacterial activity. Analysis of the 16S rDNA sequences of the BRH-433-2, THJ609-3, and TRH415-2 strains showed the highest similarity to Burkholderia gladioli (99.5%), Pseudomonas baetica (97.7%), and P. koreensis and P. baetica (98.4%), respectively. We suggest that the strains hold promise in disease management of fish.

        3D 가상치매체험 프로그램이 치매에 대한 태도와 인식변화에 미치는 효과

        가상현실 치매체험 프로그램(EDuVR, Empathy for Dementia using Virtual Reality)은 환자가족, 조호자, 일반인들에게 치매환자에 대한 이해와 공감을 유도하기 위해 제주특별자치도 광역치매센터에서 개발한 360도 가상현실 콘텐츠이다. 치매에 대한 인식개선도구 개발의 필요성에 따라, 치매환자가 겪는 기억력, 지남력, 언어능력, 판단력과 같은 인지기능 저하와 이로 인한 일상생활의 어려움을 환자 일인칭 시점으로 체험하도록 하였다. 본 보고의 전반부에서는 EDuVR에 대하여 소개하였고 후반부에서는 EDuVR 체험이 인식개선에 미치는 효과를 기술하였다. 총 66명의 피험자를 EDuVR 집단(34명)과 교육집단(32명)에 할당한 후, 치매태도검사, 치매인식검사를 사전과 사후에 각각 측정하였다. EDuVR 집단은 추가적으로 VR 경험에 따른 멀미감과 현실감 수준을 측정하였다. 그 결과, 치매환자에 대한 태도 및 인식은 EDuVR의 체험에 따라 긍정적으로 변화하였으며, 이러한 변화는 치매교육의 효과와 다르지 않았다. EDuVR의 체험 후 유의한 수준으로 멀미를 느낀 사람은 1명에 불과하였다. 본 결과는 EDuVR은 짧은 체험시간만으로도 교육과 유사한 수준의 인식개선 및 태도변화를 일으키며, 멀미감이 크게 유발되지 않아 일반대중이 체험하기에 용이한 콘텐츠임을 시사한다. 즉, EDuVR은 치매에 대한 이해와 공감수준을 높이는 유용한 인식개선 도구이다. The Empathy for Dementia using Virtual Reality (EDuVR) system, developed by the Jeju Provincial Dementia Center, is a 3D video system capturing the experience of dementia in a first-person perspective using 360 degree vritual reality (VR) technology. It was developed to create a greater understanding of dementia and to help people empathize with individuals with dementia through an immersive VR experience. The EDuVR shows how a dementia patient has impairments in memory, orientation, language, judgment and problem solving, as well as problems with activities of daily living. The present study reported the effectiveness of the EDuVR experience in changing public awareness of, and attitude toward, dementia. Sixty-six participants were assigned to the EDuVR (n = 34) or the conventional education (n = 32) groups, and two types of questionnaires – attitude and awareness questionnaires – were administered to the subjects before and after the EDuVR experience or education. The simulator sickness and presence questionnaires were administered to the EDuVR group to assess cybersickness and presence of the VR experience. As a results, the attitude and awareness toward dementia patients changed positively in both the EDuVR and the conventional education groups, and these changes did not differ between two groups. Only one person reported a significant level of cybersicness after experiencing the EDuVR system. These results suggest that the EDuVR enhances the level of understanding and empathy for dementia and would be a useful tool for improving awareness in the general public.

      • 경찰의 조직폭력배 대응방안 연구

        현대사회에서 발생하는 다양한 범죄 중에 조직범죄(조직폭력범죄)는 그 피해의 면에서 본다면 다른 어떤 범죄보다도 큰 범죄이다. 일회성이 강한 일반범죄에 대하여 조직범죄는 다수인에 의하여 계획되고 지속적으로 이루어진다는 점에서 범죄의 피해뿐만 아니라 수사의 어려움이 크며, 범죄의 피해자에 있어서도 일반범죄에 확연히 차이가 난다. 1)조직범죄에 관한 정의는 마피아의 발상지라고 할 수 있는 이탈리아, 다양한 범죄조직이 공존하는 미국, 야쿠자(폭력단)로 대변되는 일본 등에서 제시되고 있다. 마피아 등 세계적인 범죄조직들은 그 규모와 범죄활동이 이미 막대해졌기 때문에 국가기관에 의한 통제가 곤란할 정도라고 할 수 있다. 우리나라에서도 다양한 조직범죄에 관한 정의가 제시되어 있다. 이러한 조직범죄에 관한 정의와 함께 조직범죄에 대한 다양한 정책도 또한 제시되고 있다. 하지만 이러한 정책적 제언은 부분적으로 우리나라의 조직범죄에 대한 대책이 되고 있지만, 실제 효과적인가는 의문이다. 우리나라에서 최근 발생한 조직범죄의 유형은 외국의 조직범죄의 유형과 유사하게 유흥업소 갈취, 상가 등의 갈취, 도박장 개장, 보험사기 개입, 유흥업소 등 경영, 연예인 공금, 부동산 이권개입, 건설업계 침투, 기업사냥 및 주가조작, 노사분규 개입, 고리대금업 등으로 이해된다. 조직범죄에 관한 정책으로는 조직범죄에 대한 수사정책과 조직범죄에 의한 피해자를 위한 정책으로 구분하였다. 조직범죄에 대한 수사정책은 범죄조직에 대한 지속적인 수사환경의 조성과 독립적인 수사기구의 구성으로 수립되어야 하고, 조직범죄에 의한 피해자를 위한 정책은 1차적 피해자의 보호와 2차적 피해자의 보호가 동시에 이루어져야 한다. 경찰의 대응방안으로서는 조직범죄에 가장 중요한 기능을 담당할 수 있는 국가기관으로서 효과적으로 경찰인력을 지원하여야 하지만 현재 법제도적인 한계가 있다고 생각된다. 이에 대한 대책의 하나는 일본의 폭력단대책법상의 규정인 ‘지정’제도를 우리 조직범죄의 대책으로 도입하는 것이다. 지정제도는 일본의 경찰이 폭력단을 지속적으로 관리할 수 있는 법제도라는 점에서 우리나라의 경찰에 의한 조직범죄 대책에 유용할 것으로 생각된다. The typical organized crime group of korea is known as "Gogikporyokbae" or "Poryokgogik". It has unique organizational principles, powerful spheres of influence, and pursues economic gain through the use of violence. I think that the crime of Gogikporyokbae(Poryokgogik) is same `organized crime`. While organized crime groups in korea are still very active in gaining funds by such traditional means as stimulants trafficking, gambling, bookmaking, extortion and collecting bouncers` fees, they are launching new types of fund-raising activities, such as intervention in civil affairs and company racketeering. Intervention in civil affairs has aimed at intervening in the daily affairs and routine economic transactions of citizens in which organized crime groups in korea, taking advantage of situations such as out-of-court settlements of traffic accidents, troubles relating to real estate and collection of loaned money, obtain illegal or unmerited from them. The company racketeering involves sophisticated extortion in which organized crime groups in korea target companies while under cover as social or political campaigns. The Law Concerning Prevention of Unjust Acts by Borokudan Members become effective in March 1992. Under this law, if crime groups are declared as "Designated Boryokudan" by the prefectural public safety commission, they are prohibited from conduction activities such as demanding money or property under the influence of th criminal organization, or inducing juveniles into affiliating with the groups. Therefore I think that we must legislate law of Anti-organized crime like japan`s law of anti-Borokudan. Thus we can designate organized crime group in korea and I think that it will the best policy of organized crime.

        범죄피해자를 위한 국가의 책무

        Accountability for victims of crime in the country can be understood in terms of a variety. And the State(agency) for victims of crime policies and actively takes effect on the process than ever before are victims of crime should be in terms of time was troubled. Japan is still not resolved, Military Sexual Slavery by Japan is a problem only in the past history should not be considered by taking a passive attitude. Longer a matter between the countries and the years that the country can avoid the responsibility that the position is not without even convincing. Japan is already experiencing a crime victim , but the damage caused by the crime that occurs in our society experience any crime greater than when the severity of the damage, with an emphasis on the security of human rights internationally, a new change of the country lies in the active duty at the time of the direction can be realized to be capable of presenting. Policies for crime victims in Japan genus forgotten its past present and future, not the people responsible for today is because of our people. Responsibilities of the National Victims of Crime is a crime and crime victims to wear as soon as possible before recovering damages from being reduced to the status that require mental and physical support as private sector with the overall research plan for the activation to be considered at the same time will. Victims of Crime Act and the regulations of the country’s most urgent duty is to the public interest for the victims of crime that can be activated with a plan that will raise.

        지방자치단체 보건의료 사무의 세출예산 구성과 자체재원 비율 - 제주특별자치도 사례를 중심으로

        Objectives: The purpose of the study was to classify the health and medical service affairs of local governments, and to analyze the proportions of non-matching fund by local governments and central government subsidies for local government health budget. Methods: First of all, health affairs of local governments were classified to categories based on health-related laws and previous studies by review of the authors. In order to specify the scale of local government-led health affairs, we allocated 1,916 budget units into 6 main and 24 sub categories of the health and medical service affairs of local governments for the 2020 health budget of Jeju Special Self-Governing Province. For each categories, we compared the total amounts and the percentages of the "central government subsidies", "local government budget - matching fund", and "local government budget - non-matching fund". Results: The total health budget of Jeju Special Self-Governing Province accounts for 1.2% of the total budget. Of the total health budget of Jeju Special Self-Governing Province, the proportion of central government subsidies was 39.6% and the proportions of local government budget-matching fund and non-matching fund were 33.8% and 26.6%, respectively. The proportions of non-matching fund by provincial and basic local governments were 37.3% and 19.9%, respectively. Conclusion: In order for local governments to deal with the health problems of residents, it is necessary to secure and spend more local government budget(i.e., non-matching fund by local government) for health affairs in their administrative jurisdiction.

        해녀 우울장애 환자의 임상적 특징

        Objectives Haenyeo are Korean professional women breath-hold divers in Jeju island. The aim of this study was to investigate the clinical characteristics of depressed Haenyeo group, compared to non-Haenyeo depressed group. Methods This study included 75 Haenyeo and 340 non-Haenyeo with depressive disorders recruited from the Dementia Early Detection Program in Jeju island. Structural diagnostic interviews were performed using the Korean version of Mini International Neuropsychiatric Interview. All patients completed the questionnaires, including the Subjective Memory Complaints Questionnaire (SMCQ), the Patient Health Questionnaire-15 (PHQ-15), and the Blessed dementia scale. Depression was evaluated by the Korean version of short form the Geriatric Depression Scale (K-SGDS) and cognition was assessed by the Korean version of the Consortium to Establish a Registry for Alzheimer's Disease (CERAD) assessment packet. Results Although the mean scores of the K-SGDS were similar between Haenyeo and non-Haenyeo depressed groups, the Haenyeo group showed a higher mean score on the PSQ-15 (p < 0.001, ANCOVA adjusting for age, the K-SGDS and education). The Haenyeo group showed poorer performance on the Korean Version of Frontal Assessment Batter (p < 0.001), the Mini-Mental State Examination in the Korean version of the CERAD Assessment Packet (p < 0.018), the word fluency test (p < 0.001), and the word list memory test (p = 0.012) in ANCOVA adjusting for age and education. The mean SMCQ score was higher in the Haenyeo depressed group than in the non-Haenyeo depressed group. Conclusions The Haenyeo depressed group shows cognitive dysfunction, especially frontal lobe dysfunction, compared to the non-Haenyeo depressed group, indicating the Haenyeo depressed group may have more severe frontolimbic dysfunction due to chronic exposure to hypoxia. The Haenyeo depressed group suffers more somatic symptoms than the non-Haenyeo depressed group.
