Proposal for Reformation of Patentability Standards Against Predatory Innovation

Present patent law system and the standard of examination of patentability have not kept pace with the rapid development of high technology industry. Idemitsu Kosan having original material patents in the display market have tried to build patent portfolios using chemical combination inventions as one of the patent strategies to extend their monopolization with their market power. Recently, domestic material firms cannot enter into the display market because of such chemical combination patents, so competitor have brought patent invalidation lawsuits against the invalid patents in Korea, Europe and Japan. These strategic patenting, however, may block competitors’ exploitation of follow-on invention, and as a result, such conduct adversely affects consumer’s welfare to enjoy high quality and cheap products by preventing free competition. If the predatory innovation such as combination patents of Idemitsu Kosan restricts the competition or actually monopolizes the relevant market, such conduct shall be subject to Section 2 of the Sherman Act as monopolization or attempted monopolization by considering two prongs of the dominant firms’ blocking intent and the patent’s validity. To reduce anticompetitive predatory innovation or invalid patents causing patent disputes, and to differentiate true improved invention from predatory innovation in OLED industry, and thereby, encouraging free competition market without anticompetitive coercions, uniform and effective patent system including patent examination guidelines should be established.

Objective : The purpose of this paper is to report the improvement of 3 patients with uterine fibroid treated by herb medication based on Shanghanlun disease pattern identification diagnostic system. Methods : According to 'Disease Pattern Identification Diagnostic System based on Shanghanlun Provisions', they were diagnosed with Taeyang-byung, Yangmyung-byung. They took different herb medications more than 8 weeks according to their diagnosis. The size of uterine fibroid was estimated by ultrasonography. Results : The size of uterine fibroid reduced from 3.94cm to 2.55cm on first patient, 5.20cm to 4.86cm on second patient, 12.63cm to 7.77cm on third patient. Conclusions : Herb medication not only reduced the size of uterine fibroid but also improved symptoms such as dysmenorrhea, vaginal bleeding, pelvic discomfort, fatigue. In addition, this is the first case report treating the uterine fibroid with herb medication of shanghanlun in Korea.
The Second Reidemeister Moves and Colorings of Virtual Knot Diagrams

Two virtual knot diagrams are said to be equivalent, if there is a sequence S of Reidemeister moves and virtual moves relating them. The difference of writhes of the two virtual knot diagrams gives a lower bound for the number of the first Reidemeister moves in S. In previous work, we introduced a polynomial qK(t) for a virtual knot diagram K which gave a lower bound for the number of the third Reidemeister moves in the sequence S. In this paper we define a new polynomial from a coloring of a virtual knot diagram. Using this polynomial, we give a lower bound for the number of the second Reidemeister moves in S. The polynomial also suggests the design of the sequence S.
