      • 척추주위근을 침범한 신경통양 근위축증 (Neuralgic Amyotrophy) 2례

        Neuralgic amyotrophy is a clinical syndrome of unknown etiology characterized by the acute onset of severe shoulder girdle pain followed by motor weakness or paralysis, and variable sensory loss. Up to 90 percent of patients eventually recover within the third years and the treatment is symptomatic. Neurologic findings and electrodiagnostic studies are only useful diagnostic methods of neuralgic amyotrophy and other laboratory testing are frequently normal or nonspecific. We report two cases of neuralgic amyotrophy with paraspinal muscles involvement with review of literature.

      • 商法 第401條의 法理에 관한 考察

        This thesis discusses liability of the director for damages to the third party. According to the theory of juridical person, the fundamental principle of private law, the director of Stock corporation, the organ of juridical person, is not directly liable to the third party. However, Article 401 of the Commercial Code provides that if directors have neglected to perform their gross negligence, they shall be jointly and severally liable for damages to the third party. But there are several academic problems about §401 Commercial Code because its provision has lousely used and never clearly defined. They are as follows; ① What is the legal nature of director’s liability to the third party? ② Is the task­negligence of this provision damaging against the third party? ③ Is the limit of application of this provision confined to direct damage or to indirect damage or otherwise both direct and indirect damage inclusive? ④ Can the liability of this provision be compatible with the liability of the tort of Civil Law? ⑤ Is the third party of this provision inlcusive of the Stockholder of the corporation? This thesis reaches valid conclusion in the light of distinct logic based on fundamental principle of private law and the present situation of financial circle in our country. It is concluded that the director’s liability is special tort liability, that the tasknegligence means the task­negligence against corporation, that the damages include both of those direct and indirect, that the liability of this provision can be compatible with the liability of tort of Civil Law, and that the stockholder shall be included in the scope of the third party.

        신탁의 종료, 변경, 합병 및 분할

        신탁은 비교적 장기간 존속하는 법률관계이다. 따라서 경제상황의 변화나 법제도의 개정 등에 의하여 신탁설정 시에는 합리적이었던 신탁조항이 불합리하게 되는 경우도 발생하고, 처음부터 신탁의 존속 자체가 신탁의 설정목적에 반하게 되는 경우도 일어날 수 있다. 이러한 경우에는 신탁을 변경하거나 종료할 필요가 있다. 본고에서는 법무부의 「신탁법」 개정시안 중에서 신탁의 종료, 변경, 합병 및 분할에 대하여 해설한다. 법무부의 「신탁법」 개정시안에서는 신탁의 변경에 관한 일반규정과 신탁의 합병 및 분할 규정을 신설하고, 신탁의 변경과 종료를 동일한 환경에서 규율할 수 있도록 규정을 정비한다. 그 결과, 신탁의 변경이 보다 유연하게 행하여지도록 함과 동시에 위탁자, 수탁자 및 수익자의 이익을 적절히 확보하여 합리적이고 효율적인 신탁의 운용을 가능하게 한다. 법무부의 「신탁법」 개정시안의 주요내용은 다음과 같다 : 1. 신탁은 원칙적으로 위탁자, 수탁자 및 수익자 전원의 합의로 변경할 수 있다. 2. 신탁행위 당시에 예견하지 못한 특별한 사정이 발생한 경우에는 위탁자, 수익자나 수탁자는 신탁의 변경을 법원에 청구할 수 있다. 3. 신탁의 합병과 분할에 관한 규정을 신설한다. 4. 신탁의 종료사유를 법정하고, 위탁자와 수익자의 합의로 언제든지 신탁은 종료할 수 있다. 5. 신탁종료 후에 잔여재산은 잔여재산수익자 또는 귀속권리자에게 귀속한다. 6. 수탁자는 신탁종료 후 신탁의 계산을 하여야 한다. 7. 유한책임신탁의 청산절차를 의무화하고 있고, 일반 신탁에서는 신탁행위 또는 신탁 관계자의 합의에 따라 청산할 수 있음을 규정하고 있다. A trust is a legal relationship to exist for a relatively long-time. Therefore, reasonable changes in the trust terms are sometimes needed for the efficient operation of them. This paper introduces the modification and the termination regulations from the Trust Act, drafted and proposed by the Ministry of Justice. In the draft, the regulations are developed and clarfied regarding the modification and the termination of the trust. Combination(merger) and division regulations are newly introduced. As a result, trusts are now subject to easy changes. The main contents of the draft are as follows: (1) A trust may be modified upon consent of the settlor, trustee and all beneficiaries(§ 98 ①). (2) Under the special circumstances unanticipated at the time of the trust creation or settlement, the settlor, the beneficiaries or the trustee may request any change thereto before the court(§ 98 ③). (3) A trustee may combine two or more trusts into a single trust or divide a trust into two or more separate trusts(§§ 89-96). (4) When the cause originally provided in the deed of trust occurrs, or the purpose of the trust is accomplished or becomes unattainable, the trust shall be terminated(§ 97). (5) A trust may be terminated at any time upon the consent by the settlor and all the benificiaries(§ 98 ①). (6) The trust property is transferred to the beneficiary or any of the specified persons due to the termination of trust(§ 100 ①). (7) In case where the trust is terminated, the trustee shall perform the last accounts on the trust affairs, and obtain the approval of the beneficiary, the trust manager or the spicified owner(§ 102 ①).

      • Anisakis 幼蟲의 感梁率 및 抵抗性에 관한 硏究

        We investigated the parasitism of an Anisakislarvae by the infection rate and the average number of parasites we also observed the temperature resistance of marine fishes which were caught in the near sea along the coast of Kyungnam province(Korea) from November, 1989 to March, 1990. And we investigated the resistance of an Anisakis larvae after seasoning them. 1. The results of the infection rate examined for 10 kinds of fishes are as follow : the infection ratio of Anisakis larvae 100% in Trichiurus lepturus, 100% in Scomber japonicus, 100% in Paeudosciaema manchurica, 100% in Seriola guinqueradiata, 100% ub Mugil cephalus, 90% in Astroconger myriaster, 80% in Limanda herzensteini, 20% in Pleuronich thus cornutus, 10% in sepiella maindroni and no Anisakis larvae among 10 Octopus rariabilis. 2. The average numbers of parasites in each fish are as follow : 36.2 in Trichiurus lepturus, 15.0 in Scomber japonicus, 47.3 in Pseudosciaema manchurica, 8.3 in Seriola gusinqueradiata, 34.0 in Mugil cephalus, 38.7 in Astroconger myriaster, 8.0 in Limanda herzensteini, 0.7 in Pleuronichthys cornutus, 0.6 in Sepiella maindroni, and O in Octopus rariabilis. 3. As for the resistance to water temperature : Anisakis larvae dead immediately in higher than 60℃ water, survived 5 minutes in 50℃ water, survived 70minutes in 40℃ water, survived 8 days in 30℃ water, survived more than 10 days an 20℃ water, survived 16 hours in -5℃ water, survived 8 hours in -10℃ water, survived 6 hours in -15℃ water, survived 2 hours and 10 minutes in -20℃ water, survived 1 hour and 45 minutes in -25℃ water. 4. The resistance of Anisakis larvae to seasonings ; The larvae survived 30 minutes in sojoo, 3 hours and 30 minutes in wasabi juice, 12 hours in soybean sauce, 14 hours in soybean paste mixed with red peppers and vinegar, 17 hours in Japanese soybean sauce, 18 hours in sesame oil, 39 hours in vinegar and 60 hours in garlic juice.

        흉부손상후 전신마취중 발생한 지연성 기흉

        A 62-year-old female patient was scheduled for emergent explo-laparotomy under general anesthesia because of traffic accident. Preoperative checked chest x-ray showed multiple fractures of the ribs but didn't show the sign of pneumothorax or hemothorax. she had no dyspnea. Compared with previous value(PaO2; 210.5 mmHg), Arterial PO2 value(PaO2; 143.0 mmHg) was reduced significantly two hours after starting general anesthesia. Chest x-ray was taken in the operating room, which showed pneumothorax in the right side lung. The patient was treated with immediate closed thoracostomy. She recovered uneventfully three days later with complete resorption of the pneumothorax. (Korean J Anesthesiol 1997; 32: 1028∼1030)

        대전시 3 대 하천의 수질 및 식물플랑크톤상에 관한 연구

        The studies on physico-chemical factors and phytoplankton at the 3 rivers in the Taejon city were conducted from November 1997 to May 1998. The Results were as follows; In the water quality, the down streams were generally worse than the upper streams. Water temperature was varied from 2.4℃ to 23.0℃; DO from 1.80㎎/ℓ to 17.6㎎/ℓ ; pH from 4.7 to 10.4 ; BOD from 0.78㎎/ℓ to 8.80㎎/ℓ; COD from 0.32㎎/ℓ to 8.26㎎/ℓ ; SS from 2.0㎎/ℓ to 43.0㎎/ℓ ; total phosphate was from 0.001㎎/ℓ to 0.709㎎/ℓ ; total nitrogen 0.01㎎/ℓto 11.69㎎/ℓ . In phytoplankton species, they were identified as total 191 taxa composed of 8 classes, 18 orders, 35 families, 74 genera, 152 species, 35 varieties and 4 forms. The dominant species were Synedra ulna in Taejon-chon, Diatoma vulgare in Yudong-chon, Oscillatoria princeps, Scenedesmus gadricauda, Synedra ulna, and Diatom vulgare in Gap-chon. Standing crops of phytoplankton were from 2,076 cells/㎖ to 97,356 cells/㎖.

        Flame retardant and mechanical properties of polyethylene/magnesium hydroxide/montmorillonite nanocomposites

        Polyethylene (PE) provides good flexibility at low temperatures, chemical stability, and electrical performance that makes it an ideal insulating material for wire and cable, but it has low melting point and is flammable. In fire events, PE must be modified with additives to enhance its flame retardancy and satisfy the fire safety standards. In this study, we used the LDPE and cross-linked polyethylene (XLPE) as the matrix, added nanoclay montmorillonite (MMT), flame retardant magnesium hydroxide (MH) and compatibilizer LDPE grafted maleic anhydride (LDPE-g-MA). The PE/PE-g-MA/MH/MMT nanocompo-sites were compounded using the twin screw extruder, then were injection molded into the standardized specimens. The properties of nanocomposites were characterized with XRD, TGA, and DSC techniques and LOI, tensile, and impact examinations. The results showed that the interlayer of OMT (modification of organoclay) modified with dodecylamine expanded to about 4.1 A˚ and there was no 2θ peaks between 1.5˚ and 10˚, indicating that the dispersion of nanocomposites were exfoliation structure from XRD pattern. The tensile and impact strengths were enhanced with LDPE-g-MA and clay added. The increase in char residual of nanocomposites indicated that the thermal stability at elevated temperatures improved. The XLPE nanocomposites achieved the effective level of flame retardancy.
