        영화 ‘김광석’에 비추어본 김광석법과 공소시효배제: 공동체적 관점과 피해자적 관점을 중심으로

        영화 ‘김광석’과 관련하여 형사법적으로는 몇가지 영화의 내적·외적 쟁점이 부각되어 왔다. 소위 ‘모델영화’라고 동 영화는 김광석의 사망(영화에서는 이를 변사자라고 표현한다)과 관련하여 이미 공소시효가 만료된 사건의 공소시효에 대한 진정소급효가 가능한가의 문제이다. 동 영화는 그의 죽음이 자살인지 타살인지 다시 재조사 할 것을 주장한다. 다만, 그와 같은 재조사가 수사의 단서로서 국가형사사법기관에 의한 적법한 절차로 이행하기 위해서는 공소시효가 만료되지 않아야 한다. 그러나 동 사건은 2007년 개정된 현행 형사소송법 제249조 및 2015년 신설된 소위 태완이법이라 칭해지는 형사소송법 제253조의2 살인죄 공소시효배제규정에 의하더라도 공소권이 부존재하다는 결론에 이른다. 따라서 법의 제정 또는 관련법의 개정을 통해 공소시효에 관한 규정을 새로이 정립한다고 한들, 그와 같은 관련법의 진정소급효를 인정하지 않는 한 김광석의 사망은 여전히 수사 또는 공소제기가 불가능하다. 그 결과 소위 ‘김광석법’을 제정한다고 한들, 그 자체가 진정소급효의 법적 승인이 핵심내용이 되어야 하는 것이다. 여기에서는 의문사 사건의 공소시효의 진정소급효를 예외적으로 인정할 것인가 여부에 대하여 우선 공소시효의 법적 성질 및 그 함의를 살펴보고, 소위 김광석법의 본질이 진정소급효이어야 하는지를 법리적으로 검토한 후에, 그 판단을 국가형벌권 및 공동체가치의 측면, 그리고 피해자적 관점에서 논의하고자 한다. 물론 법리적 결론과 현실적 필요성 사이에 괴리가 발생할 수 있고, 그것이 우리의 법생활에서 지극히 예외적인 일은 아니다. 이를 법적 공백이라고 하며 입법론적 문제로 다루고 있다. 결론적으로 공소시효제도는 헌법원리를 직접 반영하는 제도가 아니므로, 사법제도가 어떠한 형사정책적 목적을 추구하는가에 따라, 그리고 사회구성원들의 법감정의 변화에 따라 그 존치, 중단 또는 배제가 좌우된다. 그리고 우리 형사사법은 공소시효제도를 원칙적으로 인정하면서 헌정질서파괴범죄와 같은 반인륜적 범죄들에 대하여 특별법의 제정을 통해 그 중단이나 배제의 진정소급효를 허용하는 방식을 취하고 있다. 여기에서는 살인죄의 공소시효에 대하여도 진정소급효를 인정할 수 있겠는가의 문제를 몇 가지 논거를 통해 긍정하고자 하였다. 물론 이 역시도 형사정책적 영역이므로 살인죄 공소시효의 진정소급효에 대한 찬성이나 반대 중 어느 한 쪽이 완전한 정의일수도 없고 완벽하게 옳을 수도 없다. 다만, 법리적 측면뿐만 아니라 공동체 전체의 시대감정과 연대성의 차원에서 접근한다면 보다 정치한 논거를 찾아낼 수 있지 않을까 한다. The movie titled “Kim Gwang Seok” showed in 2017 was focused on his lifetime, especially his death. He led popular movement in 1980’s as well-known song and his song has been loved even now. He passed away in 6. Jan. 1996 and investigative authority reached conclusions of his death as suicide after drinking but director of this movie as well as journalist has entertained a suspicion about announcement of investigative authority and had ridden down his death and expressed that in accidental death. But his death or accidental death passed over statute of limitations on murder at this point in time. As that result, although the true criminal would be found, he/she couldn’t be under indictment in this case. Statute of limitations means a legislative enactment prescribing the period of time within which proceedings must be instituted to enforce a right or bring an action at law. That system is accepted for offender, because this is justified for considering of legal stability as time passed. In addition, the reason that it is impossible for investigative authority to attain proof after long time because physical evidence may be scattered and lost, which makes it extremely difficult to have a fair trial, can make to reduce the criminal justice costs. But Legislative proposal of a so-called ‘Kim Gwang Seok Bill’ suggests the retroactive effect of statute of limitations on murder. This proposal presents a question, that what is substantial justice in our society. Similarly to respond to this question, the revised Criminal Procedure Law so-called, ‘Taewan-Law’ acted in 2015 abolishes the statutes of limitations on the murder crimes. But this revision couldn’t be retroactively appled in the Kim’s case because statute of limitations on his case had been statute-barred in 2011 already before ‘Taewan-Law’ was in effect for murder crime. So new bill is to be enacted for crime of expiration of the statute of limitations like Kim’s case inevitably and legalistically.

        토르소 원형설계를 위한 피복인간공학적 분석방법

        The purpose of this study was to provide basic data for a more functional torso's pattern by analyzing multidimensional anthropometric measurements and the wearing condition. For the functional torso's pattern drafting, the fitness state of basic torso's patterns(4 types) was compared and evaluated from the cross-sectioned overlap maps by $moir{\acute{e}}$ topography. The results were as follows: 1. According to the measurements of four patterns by using the one-dimensional measurement, the amount of ease in girth item for pattern A was the smallest. The ease of clothes was affected by the position of dart, the amount of dart, and the drafting method. 2. As the results of wearing evaluation by $moir{\acute{e}}$ topography method, pattern B had the largest space length for hip part, pattern A, C and D had the largest space length for bust part. Also, in the all measurement items, pattern A had the smallest amount of ease. The space length for bust and waist part of pattern B was smaller than pattern D, but, for abdomen and hip part of pattern B was larger than pattern D. The space length of pattern C was revealed intermediate for all measurement part. 3. The significant difference of space length of each pattern was shown in all parts except bust part(p<.05). The amount of space was affected by the amount of dart, the characteristics of the somatotype, and the drafting method.

        개구장애를 동반한 피부근염 환자 증례

        Dermatomyositis (DM) is an idiopathic inflammatory connective tissue disorder and a systemic autonomic immune disease which shows a progressive muscle weakness and characteristic rash. It is identified by a characteristic rash accompanying, or more often preceding muscle weakness. Pathognomonic skin lesions are a blue-purple discoloration on the upper eyelids with edema (heliotropic rash), a flat red rash on the face and upper trunk, and erythema of the knuckles with a raised violaceous scaly eruption (Gottron's papule). The myopathy represents inflammatory and degenerative changes primarily affecting proximal muscles. DM often involves GI tract and respiratory system with as risk of 15-25% internal malignancy. It's managed with sun protection since muscle weakness as well as a rash could be aggravated by sun exposure. Systemic corticosteroid is an initial therapy and other immunosuppressive agent has been used as alternatives. Facial muscles are unaffected and masticatory muscles are rarely affected in DM. We present trismus close to muscle contracture in a patient with DM. Therefore, it needs continuous mouth-opening exercise to prevent progressive muscle contracture and to ensure normal mouth opening.

        목운동에 따른 목과 어깨부위의 체표변화에 관한 연구

        With the wide range of movement, the movement of neck accompanies the body surface change of neck and shoulders. And neck corresponds to the collar of garment, meaning that the body surface change of this part affects the construction of patterns for collars. So the purpose of this study was to manifest the changes of body surface in the neck and shoulder accompanied with the movement of the neck and to draw up the facts worth consideration when constructing the collar pattern. In this study, the draft of body surface of neck and shoulder was drawn up by gypsum method according to the 5 movements (standing at attention, neck bending - front, back, right, left). The length of body surface was measured and analyzed by ANOVA, post hoc test, correlation and regression analysis using SPSS 10.0 for Windows. The variation of the surface of neck was remarkable in the vertical lines than the horizontal ones. So the height of collar should be established considering the range of movement of the neck. It was the raising amount of c.f(center front) of neck and girth of neckbase (back) that were proved to have significantly varied after movement. With correlation analysis done, in every movement, the raising amount of side and the girth of neckbase had remarkably positive relation. The movement of the neck accompanied the variation of body surface in the shoulder as well. It was the part of scapula and side of neckbase that the variation was notable, suggesting that the surplus is needed in these parts.

        치태에서 분리된 Streptococcus mutans에 대한 서양산 고추냉이(Armoracia rusticana) 뿌리 추출물의 항균효과

        천연항균제의 개발에 대한 관심이 날로 증가하는 가운데, 다수의 연구들에서 Escherichia coli, Salmonella typhimurium, Pseudomonas aeruginosa, Vibrio parahaemolyticus, Staphylococcus aureus, Bacillus subtilis, Aspergillus parasiticus, Helicobacter pylori 등 다양한 세균들에 대한 서양산 고추냉이의 항균 효과가 밝혀진 바 있다. 서양산 고추냉이가 치아우식증의 원인균인 Streptococcus mutans에 대해서도 항균성을 나타낸다는 보고가 있으나, 아직까지 구강내에서 분리된 임상분리균주를 대상으로 한 연구는 미진한 실정이다. 본 연구에서는 사람의 구강내에서 분리 및 동정된 Streptococcus mutans에 대한 서양산 고추냉이 뿌리 추출물의 항균 효과를, 대표적 항균제인 클로르헥시딘과 비교하여 알아보고, Streptococcus mutans 표준균주에 대한 서양산 고추냉이 뿌리 추출물의 효과와 비교하고자 하였다. 항균 효과를 평가하기 위해 최소억제농도와 최소살균농도를 측정하여 다음과 같은 결론을 얻었다. 1. 본 연구에서 Streptococcus mutans 임상 분리균주와 표준균주에 대한 서양산 고추냉이 뿌리 추출물의 최소억제 농도는 각각 평균 $0.083{\sim}0.25%$ ($833.33{\sim}2500 ppm$), 평균 0.25%(2500 ppm)으로 나타나, 두 종류의 균주에 대한 항균 효과에는 뚜렷한 차이가 없는 것으로 나타났다. 2. 서양산 고추냉이 뿌리 추출물은 $0.083{\sim}0.25%$의 농도에서 클로르헥시딘($0.0021{\sim}0.0041%$)과 대등한 항균 효과를 가지는 것으로 나타났다. Recently interesting in development of antimicrobial agent from natural origin has been increased in these days. Many studies have been reported antimicrobial effect of Horseradish(Armoracia rusticana) root extracts against various microorganisms such as Escherichia coli, Salmonella typhimurium, Pseudomonas aeruginosa, Vibrio parahaemolyticu, Staphylococcus aureus, Bacillus subtilis, Aspergillus parasiticus, Helicobacter pylori. The main component related to antimicrobial activity in horseradish is well known as allyl isothiocyanate(AIT). In this study, we investigated the antimicrobial effects of Horseradish(Armoracia rusticana) root extracts against Streptococcus mutans isolated from human dental plaque, Streptococcus mutans reference strain and compared with that of chlorhexidine. Horseradish root extracts and chlorhexidine were tested to determine their minimum inhibitory concentration( MIC) and minimum bactericidal concentration(MBC). The result of this study can be summerized as follows; 1. Horseradish root extracts showed antimicrobial effect against both S. mutans isolated strain and reference strain, their MIC were respectively $0.083{\sim}0.25%$ ($833.33{\sim}2500 ppm$), 0.25% (2500 ppm). Horseradish root extracts showed antimicrobial effect against S. mutans isolated strain at same or slightly lower concentration compared with MIC of reference strain. 2. $0.083{\sim}0.25%$ horseradish root extracts showed similar antimicrobial effect with chlorhexidine ($0.0021{\sim}0.0041%$).

        Characterization of Rice Mutants with Enhanced Susceptibility to Rice Blast

        As a first step towards identifying genes involving in the signal transduction pathways mediating rice blast resistance, we isolated 3 mutants lines that showed enhanced susceptibility to rice blast KJ105 (91-033) from a T-DNA insertion library of the japonica rice cultivar, Hwayeong. Since none of the susceptible phenotypes co-segregated with the T-DNA insertion weadapted a map-based cloning strategy to isolate the gene(s) responsible for the enhanced susceptibility of the Hwayeong mutants. A genetic mapping population was produced by crossing the resistant wild type Hwayeong with the susceptible cultivar, Nagdong. Chisquare analysis of the F2 segregating population indicated that resistance in Hwayeong was controlled by a single major gene that we tentatively named Pi-hy. Randomly selected susceptible plants in the F2 population were used to build an initial map of Pi-hy. The SSLP marker RM2265 on chromosome 2 was closely linked to resistance. High resolution mapping using 105 F2 plants revealed that the resistance gene was tightly linked, or identical, to Pib, a resistance gene with a nucleotide binding sequence and leucine-rich repeats (NB-LRR) previously isolated. Sequence analysis of the Pib locus amplified from three susceptiblemutants revealed lesions within this gene, demonstrating that the Pi-hy gene is Pib. The Pib mutations in 1D- 22-10-13, 1D-54-16-8, and 1C-143-16-1 were, respectively,a missense mutation in the conserved NB domain 3, anonsense mutation in the 5th LRR, and a nonsense mutation in the C terminus following the LRRs that causes a small deletion of the C terminus. These findingsprovide evidence that NB domain 3 and the C terminus are required for full activity of the plant R gene. They also suggest that alterations of the resistance gene can cause major differences in pathogen specificity by affecting interactions with an avirulence factor.

        직접메탄올연료전지 시스템에서의 수소이온고분자전해질막의 역할 및 현황

        Mobile devices in the next generation such as camera, cell phone, network, Note PC, etc. require higher power and energy sources due to convergences of various functions. Direct methanol fuel cell (DMFC) has been focused as an attractive power source, but there are critical issues involved in its commercialization with regard to the core technologies of materials, components, and system. The requirements of key technologies are differentiated from applications and fuel supply methods. Here, the roles of the proton-conducting membrane are discussed and the current status of DMFC systems is discussed in terms of proton conductivity, methanol permeability, and water management. Materials such as perfluorinated and partially fluorinated membranes, hydrocarbon membranes, composite membranes, and other modified ionomers have been studied. These would explain the critical issues of DMFC and the role of membranes for commercialization.

      • 결혼이주여성과 한국여성의 양육 스트레스 비교

        Purpose: The purpose of this study was to compare parenting stress between married migrant women and Korean women. Methods: Subjects were 68 married migrant women and 70 Korean women raising children aged seven years or younger, living in three different cities in Gangwon Do. To measure parenting stress, we used Kim`s (1997) questionnaire that had been modified from Richard & Abidin`s (1990) Parenting Stress Index (PSI). Results: There were significant differences between the two groups in age, academic credentials, job, monthly income, and achievement of maternal role. No statistically significant differences were found for parenting stress scores (p<.355), but there was a significant difference in the child characteristics of parenting stress (p<.007) between the two groups. There were no differences in the demographic variables influencing parenting stress between the two groups. Conclusion: The development of multi-cultural parenting and family support programs should consider the nationality and marital satisfaction of the family.
