Understanding FERPA Implications of the Family Educational Rights and Privacy Act

This article examines two major issues in the case law surrounding the Family Educational Rights and Privacy Act (FERPA), a federal law that was intended to safeguard student records and also has the potential to withhold federal funding from educational institutions that violate this law. The first issue is that the FERPA statute does not support a private cause of action for individuals to bring suit. Rather, FERPA s penalties to educational institutions are essentially the potential loss of federal funding. The second issue addresses the question of what amounts to an education record under FERPA. Courts seem to favor schools by finding no education record when a document is questionable. However, courts require the release of information when an agency seeking to protect the student is requesting the information.

포괄적 노동시장을 위한 재규제 Re-regulating for inclusive labour markets

돌봄노동과 비정규계약, 비공식고용 그리고 조직 경계를 넘나드는 복잡한 고용관계의 증가 등으로 인해 현재의 고용규제가 적절하고 포괄적인 보호를 제공하지 못하고 있다는 국제적 증거들이 증가하고 있다. 그 결과 주류 경제학자들은 고용관련 규제의 철폐를 요구하고 있고, 여타 평론가들도 표준고용관계 및 관련 규제가 오직 내부자들에게만 도움이 되고 있으며 고용상의 지위와 무관하게 보편적인 사회적 보호가 제공될 필요성에 더욱 주목해야 한다고 주장한다. 이 논문은 더욱 보편적인 사회적 보호를 강화하고, 사용자로 하여금 매우 다양한 고용상의 지위에 대하여 고용보호를 확대적용하고 촉진할 것을 의무화하는 것을 결합한 새로운 접근이 필요하다고 주창한다. 이 접근의 핵심 주장은 다음과 같다. 첫째, 사용자들이 너무 많은 비용을 국가에 떠넘기고 복지시스템에 적절한 금전적 기여를 하지 않는다면 사회적 보호는 유지될 수 없다. 둘째, 고용규제는 소득 및 사회적 보호뿐만 아니라 그 외 여러 기능을 한다. 본문에서는 고용규제의 8가지 기능을 확인한 후, 규제를 더욱 포괄적이게 하고 사용자의 책임을 촉진하기 위한 관련 개혁방안을 제안한다. 마지막으로, 더욱 보편적인 사회적 보호와 확장된 고용규제는 주로 국가의 적극적인 태도에 달려 있지만, 노동자와 시민이 자기 목소리를 내고 또 권리의 이행을 감시 및 촉진할 기회를 확대하는 것 또한 고려되어야 한다고 주장하며 관련된 몇 가지 개혁 방안을 제안한다.

Background: Welders are exposed to many known and suspected carcinogens. An excess lung cancer risk among welders is well established, but whether this is attributable to welding fumes is unclear. Excess risks of other cancers have been suggested, but not established. We investigated welding cancer risks in the population-based Canadian Census Health and Environmental Cohort. Methods: Among 1.1 million male workers, 12,845 welders were identified using Standard Occupational Classification codes and followed through retrospective linkage of 1991 Canadian Long Form Census and Canadian Cancer Registry (1992e2010) records. Hazard ratios (HRs) were calculated using Cox proportional hazards models based on estimated risks of lung cancer, mesothelioma, and nasal, brain, stomach, kidney, and bladder cancers, and ocular melanoma. Lung cancer histological subtypes and risks by industry group and for occasional welders were examined. Some analyses restricted comparisons to blue-collar workers to minimize effects of potential confounders. Results: Among welders, elevated risks were observed for lung cancer [HR: 1.16, 95% confidence interval (CI): 1.03e1.31], mesothelioma (HR: 1.78, 95% CI: 1.01e3.18), bladder cancer (HR: 1.40, 95% CI: 1.15e1.70), and kidney cancer (HR: 1.30, 95% CI: 1.01e1.67). When restricted to blue-collar workers, lung cancer and mesothelioma risks were attenuated, while bladder and kidney cancer risks increased. Conclusion: Excess risks of lung cancer and mesothelioma may be partly attributable to factors including smoking and asbestos. Welding-specific exposures may increase bladder and kidney cancer risks, and particular sources of exposure should be investigated. Studies that are able to disentangle welding effects from smoking and asbestos exposure are needed.

Now, more than ever before, teachers in New Zealand are expected to address national curriculum principles and embrace culturally responsive pedagogies for teaching and learning with ethnically diverse students. In 2013 the New Zealand Census identified an increasing contrast between adult and youthful populations, with the greatest numbers of young people under 20 now coming from ethnically diverse groups. In contrast, art teachers remain predominantly European-New Zealand. As a European-New Zealand pre-service art teacher educator in the secondary school sector, I was prompted to focus on two professional imperatives: Increasing my emphasis on strategies for pre-service art teachers to embrace pedagogical competencies for teaching art with culturally diverse students| and critically engaging with practicing art teachers, through research in secondary schools, to gauge their cultural responsiveness to students. This paper offers a ‘snapshot’ of both imperatives.
