성범죄자 약물치료과정에 따른 2차 범죄화 가능성에 관한 연구

오늘날 국내에서 일어나는 성범죄는 다른 강력범죄와 마찬가지로 범죄로 인한 피 해정도와 재범률이 상당히 높은 범죄로 인식되고 있다. 성범죄 및 이를 행한 범죄자 의 심각성 등이 대두되며 전자발찌부착, 물리적 거세, 화학적 거세 등 여러 가지의 대처방안들이 모색되었다. 2010년 검거된 강력사범 중 46%가 재범자로 나타났고, 특히 방화 68%, 강도 63%, 살인 62%, 강간 46%에 이르고 있어 재범방지와 관련된 교화프로그램의 개정 및 구축 사회적 공감대 형성과 관심이 필요한 상황이 되었다. 한 여론조사에 의하면 성범죄자 전자발찌 착용이 성범죄 예방에 도움이 된다는 의견은 46%, 도움이 되지 않는다는 의견은 52%인 것으로 나타났다. 성범죄자 신상 공개제도의 경우 ‘성범죄 예방에 도움이 된다.’는 의견이 67%, ‘도움이 되지 않는다.’ 는 답이 29%로 각각 집계되었다. 이번 주제에서는 이론과 선행연구 등을 토대로 재범방지의 측면에서 작게는 범죄 예방론 관점, 넓게는 사회적으로 대두되는 약물치료 혹은 화학적 거세의 실효성에 대 한 쟁점을 논하고자 한다. 국가적 차원에서의 약물치료 등의 제도는 필수적으로 이루어져야 한다. 일련의 법 집행에 의해 약물치료명령을 받은 대상자는 교정단계 또는 재(再) 사회진출 이 후에 도 판결에 근거하여 약물치료를 정기적으로 받게 되어있다. 하지만 이는 자신이 행한 범죄에 대한 근본적인 뉘우침이 선행되어야 치료로 인한 범죄억제예방효과 또한 증대된다. 고려해볼 사항은 ‘자존감 하락’을 염두 해야 한다. 기본적인 약물치료는 협의적으 로는 교정처우의 개념이며, 광의적으로는 자기통제력이 약한 범죄자의 정상적인 사회 복귀에 방해가 되는 특정요인을 관리·감독하는 것이다. 즉, 범죄자의 사회복귀는 특 정문제에 대한 재범 없이 치료와 함께 교정시설 내에서 교육받은 일련의 프로그램을 활용하여 정상적인 사회생활을 영위하게 되는 것이다. 헌데 자신의 성적 능력의 하락 으로 인한 자존감 혹은 자신감의 하락은 타 차원에서의 자존감 등의 하락 야기하며 이는, 정상적인 사회활동을 기대할 수 없게 된다. 나아가, 단순한 성적 자신감의 하락 으로 시작된 일련의 정신적 문제는 결국 생활환경과도 연관되어진다. 이는 ‘하위문화 이론’적 접근에서 자신감 하락 등으로 인한 중상층으로의 계층이동이 불가능 하게 되 고 결과적으로 범죄 노출, 발생빈도가 많은 하위계층에서의 노출이 증가된다. 즉, 다 시금 처음 성범죄라는 행위를 저지른 범죄자가 생활고 등의 문제로 인한 강도, 살인 등의 다른 유형의 강력범죄를 저지른다는 것이다. 약물치료의 시행은 현재 성범죄자들을 관리·감독하는 데에 필요한 시행이라는 점 은 이견이 없다. 성충동 약물치료 제도를 성공적인 아동 대상 성폭력범에 대한 재범방지책으로 적 극적으로 활용하여야 할 시점이다. 이와 더불어 잠재적인 재범 혹은 강력범죄의 발생 을 막기 위한 인권관련 요인의 다방향성을 추구해보아야 할 시점이라고 할 수 있다. 약물치료의 효과가 성범죄자의 성충동 억제를 의학적 근거에 기초하여 성범죄 재범 행위에 효과성이 있다는 안심과 시행이 아닌 아직 보고되지 않거나 가능성이 있는 요인들에 대해서도 충분한 개방적 사고방식이 필요하다고 보여 진다.한다. Heumann 法에 依한 Indigo 合成의 考察

Indigo has been known as one of the oldest natural dyes and taken from the leaves of the plant called indigofera tinctoria and has been used as a blue pigment or vat dye for wool and cellulose fiber so far. Numerous methods have been proposed since Bayer's synthesis of indigo in 1870, but all of them present many difficulties in the practical operations. The method discovered by Heumann in 1890, consisted of the caustic soda fusion of alkali salt of phenylglycine-o-carboxylic acid to form indoxyl, which undergoes quantitative oxidation in alkaline solution to indigo, have been widely used, cormmercially until recently. But there are also many problems on the preparation of anthranilic acid. The oxidation process of phthalic amide to anthranilic acid is the most important stage in the Heumann process because the yield of anthranilic acid varies widely according to the reaction time and temperature. In this study, the effects of reaction time and temperature were discussed and the optimum conditions of the oxidation process were checked out, and then, on the preparation of indigo from anthranilic acid, the 2-step process, taking off the separation of phenylglycine-o-carboxylic acid, was attempted and compared with the normal process. The results show that the yield of anthranilic acid was increased with increasing of time and temperature of the reaction up to 60min., 72℃, and then decreased in contrast with the fact that common reactions maintain the constant value. The by-product which was separated from the filterate on the process of anthranilic acid preparation was identified with the phthalic acid formed by the unoxidation or over-oxidation. The yield of indigo prepared by 2-step process dropped a little compared with the normal process, but it seems to be very interesting in the commercial preparation of indigo.

Solubilities of benzene and toluene in water and 4M aqueous solutions of urea, monomethylurea and N,N'-dimethylurea were obtained by an ultraviolet method at various temperatures between 0 and 40℃. Calculated transfer thermodynamic data of benzene and toluene from water to aqueous solutions of urea derivatives were interpreted in terms of iceberg formation and hydrophobic interaction. Higher solubilities of aromatic compounds in methyl substituted urea solutions are due to the higher contribution of the hydrophobic interaction, and so, methylurea and N,N'-dimethylurea are seemed to be better hydrotropic agents than urea itself.

형사정책시스템 알고리즘 구축 과정에서의 편향성

자동화된 의사결정 형태로 발전 운용하고자 하는 형사사법 알고리즘의 효율성과 효과성을 파악하며, 알고리즘의 부정적 효과라 이해하는 편향성(bias)을 줄이기 위한 논의가 필요하다. 예측적 경찰활동이란, 능동적 범죄예측의 방식에서 현장 정보나 일선 관련 정보가 아닌 순수 사회 데이터를 활용해 통계적 예측을 통해 범죄 예방 또는 경찰의 개입 대상을 결정하는 것이다. DAS, PredPol, COMPAS 등의 시스템이 존재하나, 국내는 현재까지 진화된 방식의 기술적 논의와 테스트 단계일 뿐 법·제도적으로 갖추어야 할 요소와 알고리즘 구축에 대한 논제가 많다. 그런데도 쟁점은 기술 발달 측면에 가려져 있다. 따라서 기술적 측면을 배제하고 인문사회과학 영역에서 형사사법 알고리즘 시스템 도입에 선두 국가인 미국의 사례를 통해 그 문제점과 쟁점을 파악하는 것 또한 중요하다. 예측 치안을 어우르는 형사정책 분야에서 알고리즘의 자동화된 판단이 수반하는 편향성을 검토하고, 문제를 해결하기 위한 규범적 측면과 자료수집과 활용 측면에서 세밀한 보완과 구축의 전제적 필요성을 구상해보고자 한다.

4,4'-비스-(2-보로노-4-히드록시-벤젠아조)-비페닐의 합성 및 산 염기 지시약으로서의 성질

A dye, 4,4'-bis-(2-borono-4-hydroxy-benzeneazo)-biphenyl, was synthesized by coupling benzidine tetrazonium salt with m-hydroxybenzeneboronic acid. The dye was soluble in alcohol and it's maximum absorption wavelength (λ_max) and molar extinction coefficient(ε) in ethyl alcohol were 466㎚ and 3.81× 10 exp (4) respectively. The color of the dye was pale yellow(λ_max 400㎚) in acidic aqueous solution and deep blue (λ_max 581㎚) in alkaline aqueous solution, indicating the possibility of using as a neutralization titration indicator. The transition range of the dye as titration indicator was shown to be pH 7.3-8.5 and the equilibrium constant (K_HIn) was 1.90× 10 exp (-8). When the dye was compared with phenolphthalein in the neutralization titration experiment, similar results were obtained.

청소년 환각물질 흡입 사범의 실태분석에 관한 연구

청소년들의 환각물질 흡입은 흡입 자체만으로도 신체적·정신적으로 손상을 가져올 뿐만 아니라 사회적으로도 큰 문제를 가져올 수 있다. 이러한 문제를 살펴보기 위해 국내 환각물질 흡입의 실태를 살펴보고, 환각물질 흡입을 사전에 예방할 수 있는 대책방안을 마련하고자 하 였다. 환각물질 흡입 실태는 대검찰청, 한국마약퇴치운동본부 등 유관기관의 실태자료와 관 련 선행연구들을 기반으로 하여 분석을 실시하였다. 환각물질 실태는 대검찰청 ‘마약류 범죄백서’ 등을 통해 최근 2017년부터 2019년까지 연도 별 환각물질 흡입사범의 자료를 사용하였고, 연도별 단속현황·직업별 현황·연령별 현황· 검찰 처리내역·1심 재판결과 등을 통해 실태를 살펴보았다. 이를 통해, 첫째, 형사사법기관 등 유관기관의 예방활동의 강화, 둘째, 청소년 유해환경 감시단 및 유해환경 신고포상금 제도 의 적극적인 홍보, 셋째, SNS 등 인터넷에 의한 정보의 차단 등을 환각물질로부터 조기에 차 단시킬 수 있는 방안으로 제시하였다. 폴리프로필렌 纖維用 反應性染料의 合成

폴리프로필렌纖維는 他纖維에 比하여 機械的, 化學的性質이 매우 優秀하나 難染性 때문에 衣料用으로는 別로 쓰여지지 않고 있다. 폴리프로필렌의 染色性을 向上시키기 爲한 많은 硏究와 特許가 나와있으나 이들 大部分은 纖維의 개질등에 의한 방법으로서, 纖維에 직접, 견고한 染色을 할 수 있는 染料의 硏究는 거의 없다. 著者들은 카르벤을 生成시키므로써 他 纖維에는 勿論 폴리프로필렌纖維에 直接 染色될 수 있는 새로운형의 反應性染料를 合成하였다. 卽 알데히드基를 가지는 分散染料와 토실히드라진으로부터 合成한 새로운 反應性染料로서 폴리프로필렌을 染色한 結果, 濃色의 堅固한 染色物을 얻을 수 있었다. Although isotactic polypropylene gives an excellent fiber having high tenacity, abrasion resistance and chemical stability, it has not been widely used as a fabric for chlothing because of its poor dyeability. A number of methods for improvement of its dyeability have been proposed, but they were too complicated and/or gave damage its original excellent properties of polypropylene. We now wish to report the synthesis of a new reactive dye for polypropylene fiber by means of carbenic process. A reactive dye was synthesized from azo disperse dye having an aldehyde group and tosylhydrazine. By using this synthesized reactive dye, polypropylene fiber was dyed to thick and fast color.

The solubilities of benzene in water and aqueous urea solution were determined by an ultraviolet method at various temperatures between 0°and 40℃. Solubility minimums, ΔH_sol _min corresponding to a zero heat of solution appeared in 1∼3 M aqueous urea solution as well as in water, and they were shifted to lower temperature side in accordance with the increase of urea concentration. Calculated transfer thermodynamic parameters of benzene from water to urea solution and solubility mininmums were interpreted in terms of iceberg formation in solution and also support the concept that urea acts like a structure breaker in water.
