        1. Decisions of the Constitutional Court mean many times a kind of political decisions under the guise of judicial decisions. In a sense Decisions of the Constitutional Court mean legislations. 2. ``Verfassungsgerichtbarkeit`` is a very important institution for guarantee of the Constitutionalism, but there may be troubles between ``Verfassungsgerichtbarkeit`` and democracy. 3. There have been disputes about Judicial Activism and Judicial Passivism. But for the harmony between ``Verfassungsgerichtbarkeit`` and democracy, adopting multi-level scrutiny has very important meaning. 4. As the main theoretical foundation for multi-level scrutiny, I think the Political Process Theory of Judicial Review in the U.S. is more persuasive.

        요한복음 5:1-18의 내러티브 읽기

        The article explores the characterization of the crippled man in John 5:1-18. The portrayal or characterization of the crippled man is closely related to the overall plot of this healing narrative (John 5:1- 47). The article tries to investigate the sign of healing, the dialogue over the sign to understand the characterization of the crippled man in 5:1-18. The sign of healing is closely related to John's characterization of Jesus as God's divine agent to do God's work and that of the crippled man as a helpful clue to understand the identity of Jesus. The article focuses on the characterization of the crippled man by way of the dialogue with Jesus in the healing miracle (5:1-9). The man in some ways is identified with a representative or symbolic role as the Judeans. Furthermore, the man seems to reflect the disability of the suffering Judean multitude. The healing narrative will show his collaboration with the Judean authorities. Related to this man's characterization is the final vignette of the Sabbath controversy, which clearly demonstrates the disposition of the Judeans. The characterization of the man is negatively described. The article shows that although the man is now cured physically, he is not cured spiritually; his faith has not grown. Finally, the healing of the invalid man reflects God's involvement in this present world. To project the idea of Jesus' divinity, the man functions as a foil to demonstrate God's healing work on humanity. Jesus as the healer asks whether humanity is willing to be healthy, both directly and indirectly.

        政黨解散審判에 관한 小考

          The Korean Constitutional Law has introduced the institution of compulsory dissolution of political party since 1960. According to Article 8 Section 4 of the Constiutional Law, a political party shall be dissolved only when its purposes or activities are contrary to the fundamental democratic order, and only in accordance with the decision of the Constitutional Court.<BR>  Such institution of compulsory dissolution of a political party is on the one hand an expression of militant democracy, but on the other hand it is an expression of strong guarantee of existence of a political party.<BR>  This study argues some important issues about sustantial conditions and procedual matters, especially the meaning of the fundamental democratic order. I insist that "the fundamental democratic order" in Article 8 Section 4 is neither the liberal democratic order nor the social democratic order. I argue that it is the core of democratic order.

        요한복음의 하나님에 대한 소고

        요한복음의 하나님은 누구인가? 그 하나님을 어떻게 알 수 있는가? 많은 요한학자들은 이 질문을 주로 신학적인 관점으로 설명하고 있다. 본 논문은 요한복음 본문에 등장하는 하나님과 예수를 ‘아버지와 아들’의 상호관계성의 관점에서 인물성격을 분석하고 있다. 그 이유는 ‘예수를 보면 하나님이 보인다’는 관점이 ‘아들을 보면 아버지가 보인다’로 연결되기 때문이다. 요한복음 안에 하나님은 직접적인 등장인물로 나타나지 않지만, 요한복음 전체의 내러티브 맥락에서 하나님의 성격과 역할, 즉 참됨, 유일성, 초월성, 선재성, 영원성, 영광의 계시의 신학적인 특성들은 아버지와 아들의 상관관계를 통해 더욱 분명하게 제시된다. 하나님의 창조사역과 구원계획은 재창조자로서의 예수의 역할 속에 대변된다. 하나님과 예수의 상호관계성을 통한 신적인 계시의 공유는 그 예수를 믿는 자들에게 하나님의 생명이 주어지게 되며, 이는 요한복음의 저술목적을 분명히 드러내고 있다(20:31). 요한복음은 다양한 인물들이 등장하여 각각 독특한 성격을 드러내고 있다. 특히 예수의 신원과 역할을 이해하는 것은 영생에 이르는 믿음과 구원과 밀접한 관계가 있다. 하나님에 대한 이해는 예수를 통해서, 그리고 다양한 등장인물들과 관계성의 의미론적인 관점을 통해서 더욱 분명히 드러난다. 요한복음에서 예수의 역할에 대한 기독론과 구속론의 신학적인 담론의 배경은 하나님의 구원계획을 어떻게 이해하는가에 달려 있다. 하여 아버지와 아들로서의 상관관계에 따른 하나님의 생명과 구원을 제시하는 하나님의 계시는 다른 인간들에게 그 생명을 함께 누리는 기회를 제공하게 된다. This study aims to explain the characterization and role of God in John's Gospel. How can we understand the God as the character in John's Gospel? Many Johannine scholars have been answered the question mainly in various theological terms and discourses. Rather than focusing on describing the God Himself, this study focuses on the examination of the narrative interactivity and characterization between God as the Father and Jesus as the Son. It means this study shows that ‘to understand Jesus as the Son is to understand God as the Father’(Jn. 14:9). The theological aspects of God’s characterization, such as, truthfulness, uniqueness, transcendence, preexistence, eternity, and the revelation of glory are clearly manifested through the narrative interactivity between the Father and the Son. The creation activity of God is clearly represented with the role of Jesus as the recreator. The divine sharing of God's revelation with Jesus endows with the eternal life to those who believe in Jesus; this definitely points out the purpose of writing John’s Gospel (20:31). Owing to the interactive relation between the Father and the Son, the life and redemptive salvation of God can provide the graceful opportunity of sharing to others through the revelation of God.

        요한복음 21:1-11의 내러티브 읽기 - 베드로의 인물성격과 역할을 중심으로 -

        This article is a critical narrative analysis of John 21:1-11 by focusing on the characterization and role of Peter. The article assumes that John 21 is a natural narrative continuation of the previous chapters (1-20) and it tries to explore a narrative analysis of the fishing expedition and the miraculous catch of 153 fishes. The article is divided into four main scenes (vv. 1-3; vv. 4-6; vv. 7-8; and vv. 9-11) and investigates the critical narrative meaning of the engagement and interaction of main characters, Peter, the beloved disciple, and the risen Jesus. The emphasis is put on the characterization of Peter who engages in four different scenes in John 21:1-11. Peter lead the other six disciples on a fishing expedition(vv. 2-4), but they did not catch any fish that night. When the risen Jesus commanded them to cast the net on the right side of the boat, they caught a large number of fish. The beloved disciple recognized the miraculous catch of fish as a discerning sign pointing to Jesus on the beach, and delivers the confessional cry (“It is the Lord”) to Peter alone(21:7). Peter quickly wraps himself with his undergarment and jumps into the sea. The characterization of Peter (a bold leap-passion and action) and that of the beloved disciple (a confessional cry-perceptual faith) are not contrasting but cooperative toward the recognition and approach to the risen Jesus. Thus both disciples represent the ideal discipleship in Johannine community. The article emphasizes the role of Peter as a skillful missionary equipped with great power and care. Peter is the only disciple who obeys Jesus’ command (“bring some of the fish”) and draw the net, full of large fishes, 153, ashore without any damage on the net or losing any of the fishes by demonstrating his powerful missionary skill. The specific number ‘153’ also prophetically anticipates Peter’s missionary capability and accomplishment in a symbolic and historical representation for “catching men.” Peter’s powerful action in 21:11 implies his special role as a responsible leader for the Johannine community to bring people to Christ. For the mission and leadership of the community that exceeds the concerns and interests in John 1-20, the risen Jesus appears again to challenge his disciples (Peter) to draw the people and take care of them for the kingdom of God.

        요한복음 17장 어떻게 읽을 것인가?

        The prayer itself (John 17) is not separated from the overall literary chiastic structure of Jesus' farewell discourse (John 13-17). Under the rubric of the structure, John 17 is parallelled with John 13, and is also a variation of the prologue section (1:1-18). The prayer is artistically constructed along with the threefold spiralling movement that is accompanied by the three different objects of Jesus' prayer: Jesus prays for himself (1-8), his disciples (9-20), and all believers (20-26). To understand the nature of Jesus' prayer, we must first understand the identity and the mission of Jesus in John 17. John's use of both narrative time and narrative space highlights the transcended consciousness that indicates a supra-human understanding of time and space. Within this structure, Jesus' prayer moves towards the climactic petition that is itself a literary unity emphasizing the unity among believers. The idea of unity(oneness) among believers is modeled on the unique and deep interrelationship of the Father and the Son. This paper mainly focuses on Jesus' vision for the church that Jesus envisages in John 17. The prayer convincingly shows that Jesus' mission is to seek the glory of God as the ultimate sacrifice (sanctification) through his crucifixion. Jesus' followers are likewise called to seek the glory of God through the unity among them by the name of God. By this, John 17 ultimately shows the vision of Jesus for the church.
