        신종감염병 대유행시 국가위기관리체계에 관한 연구 - 학교감염예방활동을 중심으로 -

        The purpose of this study is to grasp the policy priorities of the school infection control activities to cope with the crisis management of new infectious diseases in Korea. Recently, the number of cases of student infectious diseases has increased rapidly(2.6 times) in recent 3 years. According to NEIS statistics, the number increased from 2013(38,993)→ 2014(75,116)→ 2015(100,871). However, due to the specificity of the school site in Korea, young children who are vulnerable to infection are more likely to spread rapidly and become widespread, resulting in anxiety of the parents and disruption of the school curriculum. In this regard, schools, academies, etc. are vulnerable to infectious diseases and have been linked with the health authorities. However, recognizing the importance of systematic and preemptive preventive measures for educational institutions, Analysis. Among the five areas, the item with the highest importance ranking in the precautionary domain was `Improvement of student education such as development of customized education materials for infectious diseases`(4.56). In other words, it is pointed out that the most important issue is the educational program that can provide practical help to prevent infectious diseases among the students in crisis response management system in case of the new infectious disease(3.94). Identifying and reporting patient infectious disease patients, which shows the highest importance ranking in the early stage of strengthening the response to the outbreak, Transparent disclosure of information on the emergence of new infectious diseases(4.82) (4.55), and in the area of strengthening the system and infrastructure, it was mandatory to establish a comprehensive plan for the field-based infectious disease(4.79). therefore. Efforts should be made to equip the system to regularly provide and check appropriate education and training programs in order to strengthen the competence of the responding personnel in case of the epidemic of new infectious diseases.

        집회에 있어서 경찰권행사의 개괄적 수권조항

        The exercise of police means progressive state activity. The central figure, the purpose of this paper is to look around whether the police laws of our country exist concerning theories and judical precedent and direct the legislation direction of the general empowerment clauses for police authority actions. The Law on Assembly and Demonstration and the Act on the Performance of Duties by Police Officers and are applied as such legal basis. The Clause of General Delegation of Power in the General Police Act must be recognized as a legal and constitutional basis for the police power to be exercised for unlawful a large gatherings of people to cope with various harms resulting from the assemblies. There is about the consideration of the individual empowerment clauses in the police legislative system. In the police law of our country, it is under discussion whether the general empowerment clauses exist.

        경찰권발동의 개괄적 근거와 한계

        현 법치국가에 있어서 경찰권의 발동은 소극적인 공공의 안녕과 질서의 유지에 중점을 두게 되었다. 오늘날 경찰의 직무가 위험방지에만 한정되지 않고 여러가지 국가작용에까지 확장되고 있는 실정이다. 오늘날 경찰의 개념을 형식적 의미의 경찰개념과 실질적 의미의 경찰개념으로 구분하고 있다. 오늘날의 경찰법학은 공공의 안녕과 질서에 대한 위험의 방지에 기여하는 국가적 활동을 포괄하는 실질적 의미의 경찰개념에 근거하고 있는 실정이다. 오늘날 과학문명의 발달에 따라 각종 위험이 계속 증가하고 있으며 경찰작용은 다양한 국가 임무의 수행을 위하여 필요하며, 국민의 자유와 권리의 조화를 위하여 필요하게 되었다. 헌법은 국민의 자유와 권리를 보장하고 있으며 국민의 무제한의 기본권 행사는 상대방인 타인의 기본권과의 관계에서 상충하는 문제가 발생된다. 이러한 기본권의 충돌을 방지하기 위해서는 국가가 국민의 일반적인 생활관계에 관여하게 된다. 이러한 경우에 법적 근거가 있어야 하며, 일반적인 경찰작용에 있어서는 경찰소극의 원칙, 경찰공공의 원칙, 경찰비례의 원칙 등 여러 가지 제한을 받고 있으며, 우리의 경찰법에서도 개괄적 수권조항으로 보여지는 사회공공의 안녕과 질서유지를 위한 경찰권발동을 규정하고 있다. 이와 같이 일정한 조리상의 한계에 위반하여 경찰권이 발동되면 이는 위법이며, 권익침해를 입은 개인은 행정소송과 국가배상을 통하여 권리구제를 받을 수 있다.         기본권보장을 위한 헌법개정의 방향 -건강권을 중심으로-

        In 2015, an epidemic of MERS in relation to the need to clarify the right to health of the people has been raised specifically in the Constitution. if that restriction of fundamental rights for the prevention of infectious diseases, It shall comply with the requirements of fundamental rights and procedural limitations. It is to prevent the violation of the public health advance in the proactive prevention context for people``s health. However, The restriction of fundamental rights to be crime Mutual proportionality for personal gain may need to be reviewed carefully. If undermine respect for the essence of human rights it should not be. In this paper, we propose a constitutional amendment to amendment preferred direction than the right to health as a basic right for. Article 36 paragraph 3 of the Constitution stipulates that “all citizens shall be protected by the State with respect to health”. The current Constitution does not stipulate that “the right to health”. It stipulates that protected by “the State”. MERS in relation to the epidemic, a constitutional amendment would be recognized the right to health as a fundamental right for citizens. The Constitutional Court may be requested not to infringe a healthy life for the country. Also, Health right is a state can request positively. Finally, As a fundamental right in the direction in which the people have recognized the right to health will be a constitutional amendment.

        국가위기확산에 따른 경찰의 비상업무와 역할: 감염병통제를 중심으로

        사춘기청소년 비행 및 건강예방을 위한 경찰의 역할

        본 연구는 사춘기청소년의 건강위험행동 관련 요인들을 확인하는 것이 연구의 목적이다. 사춘기청소년들의 극단적인 문제행동으로 진행되기 전인 건강위험행동은 일반적으로 흔히 건강에 위험하다는 인식에 기반한 하나의 신체적 현상으로서 접근할 수 있다. 이러한 측면에서 사춘기청소년들의 비행 및 건강에 대한 사전예방을 위해 경찰의 역할을 보다 면밀히 분석하여, 사춘기청소년들의 건강위험행동을 감소시킬 수 있는 경찰지원에 대한 기능과 역할에 최선의 노력을 다 하면서 비행예방에 있어서 경찰이 적극적이고 능동적으로 역할을 다 할 수 있는 보다 효율적인 정책적인 제언하고자 하였다. 결국 경찰의 역할을 충실하게 수행하기 위해서는 무엇보다 대국민 홍보와 유해환경 감시활동에 시민들의 자율적 참여 독려가 필요하다. 그리고 사춘기청소년들의 건강행동에 대한 적극적인 전환을 유인하는 정책이 마련되어야 할 것이다 This study aims of the study to determine the health risk factors related to behavior of adolescents.
