혁명적 낭만주의로 본 임화의 시관

본 연구는 1930년대 중·후반 임화의 시론과 그의 시, 그가 비평의 대상으로 삼은 작품을 비교 분석하는 작업을 통해 임화가 창조하고 체현하고자 한 시관과 특성이 무엇인지 역추적하는 작업이다. 임화는 서정주의 「서풍부」와 안용만의 「강동의 품」, 윤곤강의 「희망」을 각각 현실이 고매한 상태에 도달한 시, 민족성과 향토에 대한 사랑이 잘 드러난 시, 아이러니와 패러독스로 시정신을 담보한 시라고 극찬한다. 이를 통해 임화가 경향시에서 사상성과 계급성뿐 아니라 내용과 형식의 통일을 중요시하고 경향시를 역사적인 의미의 전체적인 시로 발전시키기 위해 노력했다는 것을 알 수 있다. 임화가 비판한 정지용의 「고향」과 신석정의 「밤이여, 그것은 단조(單調)한 비극(悲劇)이 아니다」의 작품 분석을 통해서는 그가 시인의 대상적 실천과 관계된 부분을 매우 중요하게 생각한다는 것을 역추적할 수 있다. 임화가 중요하게 생각하는 혁명적 낭만주의와 주체의 실천적 모습을 이들 시에서 찾을 수 없는데 이것으로서 임화 시론의 중심 줄기는 시대 정신을 반영할 뿐만 아니라 실천이 전제된 생활이 담보돼야 한다는 것을 알 수 있다. 또한 방언을 시어로 선택한 백석의 시를 거론하지 않은 것을 통해 방언은 시가 담당해야 할 사회적 기능을 수행할 수 없으며, 임화에게 민족어로서의 시어는 역사성과 계급의식을 드러내는 현실 반영의 수단이자 혁명적 교화기능까지 수행하는 도구여야 함을 알 수 있다. 이러한 분석을 토대로 1930년대 중·후반 임화의 이데올로기는 시론의 추진력을 부여했으며. 그의 시관은 현실과 생활, 그에 따른 시대정신의 중요성을 강조하면서도 시의 속성으로서 혁명적 낭만주의, 감정, 고매한 시정신과 수단으로서 언어를 중시했다는 것을 알 수 있다. This study tries to understand what Mr. Im Hwa tries to create and realize with his works by analyzing and comparing his works on his views on the poem and his critical view on the other`s works. Im Hwa has highly praised the “Seopungbu” of Suh, Jeong-ju, “Dream of Gangdong” of Ahn, Yong-man and “Hope” of Yoon, Gon-gang as the poems which put the reality to the ultimate state, well expressed the love of ethnic people and homeland and used the irony and paradox in a poetic way. Through the analysis of his criticisms on the poems, we can understand that Im Hwa has put priority on not only ideology and classes but also the uniformity in contents and style and that he had made effort to develop the trendy poems to the poem having the historical meaning and total meaning. The findings of the analysis of his criticism on “Home town” of Jung Ji-yong and “Night is not the monotonous tragedy” of Shin Seok-jeong, we can find out that he put great emphasis on the poet`s relation to the practices. The revolutionary romanticism and the subject`s practical appearance which Im Hwa put emphasis on cannot be found in these poems. This shows that the critical point of Im Ho`s view on the poem reflects not only the spirit of the time but also that the practice should be the basis for them. In addition, the fact that he did not take care of the poem of Baek Seok, who selected the dialect as the words for poem shows that the words for poem is not only the means for him to show the history and recognition of class but also the means for revolutionary educational functions. These analyses show that the ideology has granted the power to his views on poems and that his view on poem has put emphasis on not only the importance of reality, life and spirit of times but also language as means for revolutionary romanticism, emotion and highly esteemed poetic spirit.

무선 센서 네트워크 기반의 모니터링 센서 로봇 시스템

본 논문에서는 무선 센서 네트워크을 활용한 모니터링 센서 로봇 제어 시스템 응용에 대해서 기술한다. 저전력, 초경량의 모니터링 센서 로봇을 통해서 주변 환경을 원격 감지하며, 로봇간의 ad-hoc networking을 통하여 모니터링 센서 로봇의 방향 및 속도를 제어하도록 하였다. 이러한 무선 센서 네트워크 기반의 모니터링 센서 로봇 시스템은 인간의 접근이 어려운 유해 환경이나 공장, 발전소 등의 위험지역에서 원격 관찰 및 탐지 등의 목적으로 활용 될 수 있다. This paper deals with monitoring sensor robot control system for the application of wireless sensor network. In order to control the direction and speed of robot via remote sensing environment, low power, low weight sensors with ad-hoc networking between robots' sensors have been used. These wireless sensor network based robot monitoring system can be used for remote observation and detection of robots in the areas such as factories, power plants and other dangerous areas which are difficult for human access.

한국형 수사와 기소분리모델의 전망과 경찰의 과제

현행법을 해석할 경우 수사권과 기소권은 분리되어 있지 않으며 수사권은 경찰과 검찰에게 배분되어 있다. 경찰의 경우 수사개시권과 수사진행권은 가지고 있지만, 수사권의 핵심인 수사종결권은 검사만이 가지고 있다. 뿐만 아니라 검사는 경찰에 대한 수사지휘권을 가지고 있다. 현재 가장 논쟁중인 것은 수사권과 기소권을 분리할 것인가에 대한 것이다. 수사권이라는 국가의 기능이 양 국가기관에 분리되어 있을 경우에는 법치 국가적 원리 중 권력분립의 원칙에 따른 `견제`의 원리가 적용된다. 견제권한은 검사가 경찰에 대해서만 부여되어 있고, 경찰이 검사에 대해서는 부여되어 있지 않다. 범죄와 관련된 국가기능은 `범죄의 예방과 진압`, `정당한 형벌에 대한 청구`라고 본다면 검사가 이러한 기능을 모두 가지고 있고 경찰은 부분적으로만 가지고 있다는 것은 효율성의 원리에 반한다. 범죄의 예방과 진압과 관련된 전문기관인 경찰이 담당하고, 이 후 사법부에 대하여 정당한 형벌의 청구는 법률전문가인 검사가 담당하는 것이 `효율성의 원리`에 부합한다. 수사권독립을 이루기 위해서는 국민의 신뢰를 확보해야 한다. 경찰수사에 대한 불신, 불공정성, 비전문성문제를 해결하여야만 경찰에게 수사권을 주는것에 대한 국민의 신뢰가 확보될 수 있다. 그렇지 않다면 경찰의 권한이 더욱 강력해지며, 통제되지 않기 때문에 경찰국가화될 수 있기 때문이다. 이를 위해 첫째, 수사의 `전문성`을 강화해야 한다. 즉 국민에게 수사에 관한 조직과 인력, 전문성이 뛰어난 경찰이 수사를 진행하는 것이 효율적이고 합리적이라는 점을 알려야 한다. 수사와 공소를 분리하여 각각의 전문성을 강화하는 것은 정치적 외압을 최소화하는데 도움이 될 것이다. 둘째, 수사의 `공정성`과 `투명성`을 제고해야 한다. 셋째, 수사과정에서 `인권보호제도` 강화해야 한다. Bei der Polizei haben zwar die Polizeien die Befugnisse zur Aufnahme und Verlauf eines Ermittlungsverfahrens die Stellung der Polizei, aber die Befugnis zur Beendigung der Untersuchung, die die wesentliche Befugnis der Ermittlungsbehorden, wurde nur Staatanwaltschaft erteilt. Zudem hat Staatanwaltschaft einen Weisungsrecht gegen die Polizei. Wenn die staatliche Funktion der Ermittlungsbehorden beide staatliche Einrichtungen abgetrennt wurde, wendet ein Prinzip der gegenseitigen Kontrolle nach dem Gewaltenteilungsprinzip an. Die Staatanwaltschaft kann sich in die Tatigkeit der Polizei durch einzelne Anordnungen einschalten, dagegen wurde diese Befugnis zur Kontrolle die Polizei gegen die Staatanwaltschaft nicht erteilt. Wenn die staatliche Funktion in Bezug auf die Kriminalitat Sowohl “Bekampfung und Unterdruckung von Kriminalitat” als auch “Die Forderung der gerechten Bestrafung” ist, wurde es gegen das Leistungsprinzip verstoßen, dass die Staatanwaltschaft diese gesamte Befugnisse hat und die Polizei teilweise diese hat. Das Leistungsprinzip funktioniert besser, wenn die Polizei sich auf die Bekampfung und Unterdruckung von Kriminalitat und danach die Staatanwaltschaft, die einen Rechtsexperte ist, sich auf die Forderung der gerechten Bestrafung gegen die Gerichtswesen nehmen soll. Zur Unabhangigkeit von Staatsanwaltschaftlicher Befugnis an die Polizei soll sie Vertrauen vom Staatsburger schaffen. Nach die Polizeien die Probleme des Misstrauens uber die polizeilichen Untersuchung, die Ungerechtigkeit und die Unprofessionalitat losen wurden, wurde der Staatsburger darauf vertrauen, dass die Ermittlungsbehorde den Polizei erteilt wird. Andernfalls werden die Befugnisse der Polizei weiter starker konnte, ein Polizeistaat onhe Kontrolle werden sein. Zu diesem Zweck soll die Professionalitat der Untersuchung sich gestarkt werden. Die Polizei soll den Staatsburger darauf ansagen, dass es effizient und vernunfig ist, die Polizei die Untersuchung zu verlaufen, weil die Polizei in Bezug auf die Untersuchung geubte Areitskrafte, strukturiertes System und die hervorragende Professionalitat hat. Es wird nutzlich , jede Professionalitat durch die Trennung zwischen Ermittlungs- und Strafverfolgungsbehorden zu starken, damit politischer Druck minimiert wird. Zweitens sollen “Gerichtigkeit” und “Durchsichtigkeit” der Untersuchung aufbessern werden. Dritt sollen die Starkung von “Menschenrechtsschutz” im Ermittlungsverfahren geschafft werden.

동영상내의 물체 추적에 관한 연구

이동 물체 검출 및 추적은 과중한 연산량에 의해 초당 처리할 수 있는 프레임의 수가 적게 되거나 정합 과정이 단순하여 추적을 실패하는 문제점들이 있다. 본 논문에서는 동영상내에서 이동 물체를 검출하고 추적하는 새로운 접근 방법을 제안한다. 입력된 영상으로부터 배경과 물체를 분리하기 위해 background subtraction을 이용하였고, 분리된 물체들은 이진 연결 요소 분석을 통하여 세그먼트 된다. 그리고 물체의 추적을 위하여 Kalman filter를 사용하였다. 본 논문의 실험에서는 야외에서 촬영한 비디오 시퀀스를 이용하였으며, 물체 검출 및 추적이 조명 변화, 그림자에도 잘 적응함을 증명하였다

  21st century, The time of unlimited competition can express information war. There are increasing companies which have been damaged by a leakage of own technology. They exert themselves to collect information on national security and advanced science technology while they enact laws and regulations to protect themselves from losing such information. Enforcement of the Korean laws and regulations is limited only to some violations on the collection of such information.<BR>  Therefore, it is necessary for the Korean government to revise the relevant laws and regulations for the effective enforcement on the industrial spies. The study is to review the information on the types of the activities of industrial spies and the condition of industrial information protection of the Korea.<BR>  In addition, the study reviews the "Unfair Competition Prevention and Trade Secret Protection Act" which was revised in 2004, Jan. The Act prescribes concrete types of the acts of infringing on trade secrets. The Act defines trade secret as any technical or operational information useful for any production and sale methods and other business activities, which is not known to the public, has an independent economic value, and has been maintained in secret by considerable effort.<BR>  However, many remain unclear as to the scope, purpose and practical application of the Act. This study will help you understand the concept of the industrial spy and introduce the guidelines to protect the benefit of our national property and ourselves. Especially, the study reviews the problems on the protection of the industrial information in Korea. It is intended to provide practical advices and guidance concerning the litigation of trade secret disputes. The study begins by discussing the Act that are available for the protection of trade secrets. It also discusses briefly the criminal statutes relating to the theft of trade secrets. Finally, The study provides some advices in the revision of the Law.

새로운 형사제재 도입의 필요성과 문제점

The criminal system of most countries focus on the traditional criminal sanctions. But social conditions and patterns of crimes are largely changed in these days. So we have to think about the new forms of criminal sanctions to handle out these problems. This study is about the Inception and Problem of the new forms of criminal sanctions, including life imprisonment, dayfine, restorative justice etc. This article describes the criminal sanctions such as the current punishment and handling of public security. This paper to research a foundation theory and law-policy base on the whole criminal sanctions changing. To achieve this, currently being discussed in our country to discuss the introduction of the new criminal sancions were outlined. Especially this study examined discussion focuses on legislative direction shown in the revised penal code bill. The following suggestions on the improvement of the current criminal sanctions. first, we should reconsider the death penalty and imposition of life imprisonment without the possibility of parole also should be approached carefully. second, we should be considered introduction of the Day-Fine System By modifying today fine system. This paper proposed to examine the introduction of restorative justice and restitution through Diversion strategy spread by social sanctions should be further developed, Pointing out the problems of preventive criminal toward criminal policy.
