드론 분류 및 규제 관련 법령 개정안에 대한 소고

4차 산업혁명의 꽃은 역시 드론이다. 인공지능과 딥러닝, 초연결사회, 빅데이터 등 많은 것들이 있으나, 이들이 탑재될 곳은 역시 무인이동체인 드론이다. 드론은 하늘만 나는 것이 아니라, 때론 땅위를 달리기도 하고, 물 위와 물속을 자유자재로 다니게 된다. ‘인공지능 드론봇’은 인간을 대신해 위험하고 어려운 작업을 척척 해 줄 것이다. 해킹이나 고장으로 인한 오작동은 인간이 막기 어렵다. 다른 드론봇으로 막아야 할 만큼 강력하다. 우리에게 급속도로 들어와 버린 드론에 대해 공부해야 한다. 기본적인 조작법과 조종자격의 취득, 수색·촬영·측량·관측·탐사·감시·단속·관리·심리치료·물류·방제·광 고 등 드론의 활용에 이르기까지 무한한 분야에서 자기 분야에서 쓸 수 있는 기능을 속히 익혀야 한다. 이와 아울러 빈발하는 드론 사고의 예방과 대응을 위한 조치들을 해야 한다. 본 논문에서 안전한 비행 여건의 확보를 위해 항공안전법령 개정안에서 실기시험을 폐지하는 대신 모든 단계에서 필기 및 실기시험을 실시하고, 일정 기준 이하는 민간분야에 이를 맡기도록 하여 효율성을 꽤하도록 하여야 한다. 아울러 급증하는 드론사고의 신속, 정확한 처리를 위해서 이미 양성되고 있는 드론전문가들을 교육 시켜서 드론사고조사관을 활용하여야 할 것이다. 드론으로 편리해지는 그러면서 도 안전한 삶의 터전을 만들어 나가는 것이 우리 앞에 닥쳐온 과제로 남았다. 스페인 경찰 속의 까딸루냐 자치주경찰에 관한 연구

스페인 까딸루냐 지방은 최근 독립운동으로 인해 전세계의 주목을 받는 지역이다. 정치적 혼란기에 자치주경찰은 국가경찰의 법집행을 피하거나 방해하는 듯한 모습을 보여 수사를 받는 처지에까지 이르렀다고 한다. 우리도 자치경찰을 도입하고자 하는 시점에 있기 때문에, 국가경찰과 자치경찰간 의 협력, 조정, 유사시의 동원 및 지휘문제 등을 분명해 규정해 놓아야 한다. 또한 시도민들과 자치경찰관들이 경찰을 중앙의 권력을 시행하는 권력의 시녀가 아니라, 자신들의 권한과 의무를 위임해 준 아바타로 생각하고 사랑해 주어야 자치 경찰이 성공을 거둘 것이다. 까딸루냐 자치주경찰은 독립성이 강한 자치경찰이고, 까딸루냐 사람들에게 자신 들의 정체성을 길거리에서 일깨워 주는 상징이랄 수 있다. 우리에게도 이러한 책임 의식을 갖게 하는 하나의 상징체로 자치경찰이 우뚝서야 한다. The Catalan province of Spain is a region of worldwide attention due to the recent independence movements. In the political turmoil, the local police have reached the point where they appear to be avoiding or interfering with the law enforcement of the national police and being investigated. Since we are also in the process of introducing autonomous police, it is necessary to clarify the cooperation and coordination between the national police and the autonomous police, mobilization in case of need, and the issue of command. Also, the autonomous police will be successful if the democrats and the autonomous police officers think and loved the police as avatars who delegate their powers and duties to the police, not as the maidens of the power to enforce the central power. 프랑스 경찰제도에 관한 연구

프랑스의 경찰제도는 프랑스의 역사적 산물이라고 할 수 있다. 특히, 프랑스의 자치경찰제도는 우리나라 제주특별자치도의 자치경찰을 태생시키는데 많은 시사 점을 준 제도이다. 프랑스는 독특하게도 군인경찰제도가 먼저 생기고 관련법도 먼 저 제정되어 명실상부한 국가경찰제도로 발전했고, 내무부 국립경찰은 20세기 들 어와서 본격적으로 발전하기 시작했다. 통일 이후의 국경수비, 해안경계, 사회적 혼란 수습 등에서 우리의 전투경찰의 효용은 아주 클 것이다. 프랑스의 군인경찰 은 신분이 군인이면서도 일반경찰 임무를 수행하고, 시골지역에서 경찰임무 외에 도 시장이 요청하는 임무를 수행할 수 있다. 우리의 전투경찰도 통일 이후에는 많 은 군인과 장비 및 시설을 흡수하여 프랑스의 군인경찰과 같이 시골지역의 치안, 도심지의 폭동 등 위험한 임무에 투입하도록 해야 할 것이다. 이러한 점을 염두에 두고 프랑스 경찰제도를 살펴보았다. The french police systems is also the historical heritage. Especially the municipal police systems helped many implications to make born Jeju province municipal police in Korea. France has typical police system history. The Gendarmerie had been born before National Police was emerged. And for Police law, the Gendarmerie has that law in advance in 18 century. The National Police has began his development from 20C. If 2 Koreas are united , the combat police can be very useful for border guarding, coast guarding and social turbulance suppressing. Gendarmes of France are military but do the general police works. And they can do what the mayor requests to do in rural area. Korean combat police can absorb many army officers, their equipment facilities and can do like french gendarme, policing in rural places, handle difficult works such as urban riots after the reunification of the 2 Koreas. French people’s characters are similar to those of Korean people. So we can import many french police systems and can infilterate them in korean systems easily. Those researches have to be done to improve Korean police systems.

멕시코경찰 제도 및 운영상의 시사점

멕시코는 우리와 멀지만 또 가까운 나라이다. 지구 반대편에 위치하여 쉽게 갈 수 있는 곳은 아니지만, 우리의 조상들이 살기 좋은 땅을 찾아서 이주해 간 곳이라고 한다. 우리와 혈통이 아주 가까운 사람들이 사는 곳인 것이다. 멕시코는 스페인 의 300년 지배와 식민지시절 계층이 고착화되어 제도는 스페인식이지만, 운영은 식민지의 처절한 아픔들이 그대로 이어져 가고 있다고 볼 수 있다. 부정부패의 깊 은 늪과 미국을 시장으로 하는 마약까르뗄들의 전쟁으로 말미암아 좋은 제도가 제 대로 작동하지 못하고 있다. 지방자치가 발달하여 경찰제도도 연방과 주 및 지방 경찰로 분리되어 있고, 서로 협력도 잘 하고 있으나, 마약까르뗄과의 유착, 부패로 말미암아 치안서비스의 질은 그다지 좋다고 할 수 없는 수준이다. 마약까르뗄의 퇴치를 위해 주단위로 연방경찰 또는 주경찰에게 지휘권을 이양하여 하나의 경찰 체계처럼 움직이는 ‘단일 지휘체계’ 계획을 점차 시행하고 있으나 기초자치단체장 들의 반대에 부딪히기도 하고 있다. 멕시코의 자치경찰제도에서 우리가 참조해야 할 것은 우선 연방경찰 즉 국가경찰이 대규모 범죄조직이나 마약․납치범죄에 대한 강력한 응징력을 지니고 있어야 하고, 각급 경찰기관간의 협력을 잘 조정하 는 체계와 관례를 가져야 한다는 것이다. 특히, 북한과 맞서고 있는 우리의 현실을 볼 때, 위급상황에서 ‘단일 지휘체계’를 구성하고 훈련하는 것은 매우 중요한 일이 라고 하겠다. 무엇보다 자치경찰을 실시하기 위해서는 정치권과 경찰의 청렴성이 담보되어야 한다는 것이다. 강도보다 더 무서운 존재로 즉 부정적인 존재가 되어서는 안 되기 때문이다. 멕시코처럼 수사업무를 검찰에만 주어서는 부패의 문제를 해결할 수 없다는 것을 보게 된다. 국가경찰, 자치경찰이 수사를 나누어서 하고, 공무원범죄에 대해서는 모두 수사를 할 수 있도록 하여야 견제와 균형의 원리에 의해 부패를 예방하고 오로지 국민을 위한 권한행사가 될 것이기 때문이다. 멕시 코는 우리에게 이렇게 타산지석이 되고 있다. 향후 많은 교류로 한류가 세계를 한 국으로 가까워지게 한 것처럼 치안한류로 온 세계사람들이 안전한 치안환경에서 살 수 있게 도와야 할 책무가 우리에게 주어졌다고 볼 수 있다. Mexico is a far land but not so away from us. It locates opposite side of Korea. So we cannot go there easily. But many of our ancesters moved there long long ago to find ideal land to live. So we are very close with mexicans in genetic relations. Mexico was colonized for 300 years by spaniards and the social ranks of that era remained until now. So the systems are similar to spain but the working stream of those are very different from them. Corruption, and drug cartels who fight against each other make the system roles badly. Because of the developed local self-governing system, police is also devided by federal, provicial and cities. Every police cooperates well with each other but some police institutes are stuck with the drug cartels. And some are very corrupted. So the level of security for the citizens is very low. The Mexican Federal government want to try to install ‘Mando Unico, Unique Direction System’that means that the city police concede their direction to the federal police or state police. Some city mayors are not pleased to concede their power to more big government. We can learn some points from mexican police. First the Federal police, National police has to maintain the power to suppress the big crime organizations, drug and kidnapping crimes. And national police has to get good systems for coordinating the police institutions. South korea is faced against the north korea, so we have to make a unique direction system for the emergency case. The most important thing for getting the independent local police is the transparency of the politics and the police. Unless we can encounter a rotten tiger. And the more important thing is that the investigation work has not to reside only in the prosecutors’offices. That work has to stay in national and local police. And it is better that both police can investigate the public officers’corruptions. Mexico is a good book to study. Like K-move makes the world come near us, the K-police move makes the world safe.

탐정업 관리제도의 입법방향에 관한 연구

그간 국회에 제출되었던 민간조사업 관련 법안은 모두 회기 종료로 폐기되고 금번 20대 국회에서 윤재옥, 이완영의원의 공인탐정법안 2건이 발의되어 있다. 탐정업 관리제도가 도입되어야 한다는데 대해 정부부처는 물론 학계에서도 큰 이견이 없었 다. 그럼에도 불구하고 입법이 이루어지지 않은 것은 탐정업의 본질적인 법적 성격 에 대한 이해가 부족하여 퇴직경찰 일자리 창출 등 부수적 효과를 앞세운 것 등에 원인이 크다고 할 수 있다. 윤재옥의원안(2016)의 제안이유에서와 같이 탐정업은 우리나라만을 뺀 OECD 34개 국 모두 금지하지 않고 있고 각 나라의 실정에 적합하게 자격인증·교육·영업등록등 여러 관리시스템을 통해 국민의 권익을 보호하기 위한 탐정업의 장점은 활용하면서 프라이버시권 침해 등 단점은 최소화하고 있다. 우 리나라도 오류입법으로 인해 금지된 탐정업 서비스를 다른 선진국과 같이 적정한 관리·감독으로 수요자가 탐정 업 서비스를 믿고 이용하게 하고, 사생활 침해 등 부작용을 방지하기 위한 적절한 관리제도를 마련하여 국민의 권리보호와 탐정업의 건전한 발전을 도모하여야 할 때 다. 이를 위해 법학자 및 법조계 특히 경찰행정법 관련 학자들을 중심으로 보다 많은 연구가 이루어지고, 관련 학회·변호사 단체·관련 부처·국회 등이 공동으로 세미 나와 홍보를 함으로써 입법을 앞당겨야 한다. Proposed bills of private investigation had been abandoned due to ending of national assembly session and the two draft bills have been proposed by congressman Yun Jae Ok and Lee Wan Young. Introduction of private investigation is agreed by government agencies and academia. However the delayed legislation has been caused by lack of understanding on the characteristics of legal concept on the private investigation and by only focusing on side effects such as creating jobs for retired police officers. Like as the draft bill explanation proposed by congressman Yun Jae Ok(2016), except for South Korea, all 34 nations of OECD members allow private investigation and with various management systems for qualification recognition, training, registration and others, benefits of private investigation have been utilized and shortcomings of that such as infringement on privacy have been minimized. This is right time to adopt the private investigation service with proper management and supervision like as developed nations for customers relying on the service, for preventing negative effects including violation of privacy for citizens’ right protection and development of the service. For this goal, more researches by police administration law related scholars academic are required and it is better to speed up legislation by advertisement and seminars with related academic communities, congress, public and private agencies.

자치경찰시대의 치안 관련 위기관리 방안

청와대 지방분권위원회는 광역자치경찰제도에 관한 방안을 곧 내놓고 시범운영 을 거쳐 2020년에는 본격적으로 시행한다고 하고 있다. 자치경찰제도가 더욱더 안착되려면, 전국적 또는 광역적 위기상황에서 자치경 찰력을 잘 활용하여 이를 극복할 수 있는 체계를 갖추어야 한다. 국가경찰조직만 으로 해결할 수 없는 일이 많아지는 현대의 위기상황으로 인해 자치경찰이 발달하 고 지방분권화가 많이 진행된 미주 및 유럽경찰에서도 신중앙집권화가 나타나고 있다. 멕시코 등 까르뗄(Cartel, 갱단) 등 군 및 경찰력의 무장에 맞서는 조직들이 나타나고 있는 곳에서도 단일지휘체계(Mando Unico)를 진행하고 있다. 우리나라도 시행착오를 최소화하며 시민들의 민의가 잘 반영되는 자치경찰제도 의 성공적 안착을 위해서 위기관리를 위한 체계를 더욱 세밀히 연구하고 준비하여 나가야 한다. As a result of the crisis in modern times, which can not be solved only by the national police organization, the new centralization is emerging in the American and European police, which have developed autonomous police and have been decentralized much. Mexico where Cartel(gangs) are fighting against the armed forces of the military and the police is running a single command system (Mando Unico). should also study and prepare the system for crisis management in order to minimize the trial-and-error and ensure the successful settlement of the self-governing police system, which reflects the citizens' citizenship.
