Objectives: In March 2023, an alternative school in the Republic of Korea reported 12 cases of shigellosis. This study aims to analyze the epidemiological characteristics in order to determine the cause of the cluster outbreak of shigellosis and to develop prevention strategies.Methods: This study focused on 12 patients with confirmed Shigella infection and investigated their demographics, clinical features, epidemiology, diagnostics, and antimicrobial susceptibility. Following the identification of Shigella, we conducted follow-up rectal smear cultures to manage patients, implementing isolation and control measures.Results: This study investigated the emergence of multidrug-resistant Shigella following missionary activities in Cambodia, documenting a cluster infection within an alternative school in Daejeon, the Republic of Korea. The outbreak affected 56 participants, resulting in the confirmation of 12 cases. The incidence rates varied by gender and occupation, with higher rates among males and teachers. All 12 cases demonstrated multidrug resistance. Challenges included delayed pathogen confirmation and suboptimal adherence to isolation criteria. The incident prompted revisions in the criteria for isolation release, focusing on symptom resolution. The study underscores the necessity for strengthened surveillance, educational initiatives focusing on prevention in endemic areas, and improved oversight of unlicensed educational establishments.Conclusion: Successful response strategies included swift situation assessment, collaborative efforts, effective infection control measures, and modified criteria for isolation release. Continued surveillance of multidrug-resistant strains is recommended, especially in regions with a high prevalence.
채무자회생법상 해지 가능한 쌍방미이행 쌍무계약의 의미 고찰 - 대법원 2021. 5. 6. 선고 2017다273441 전원합의체 판결을 중심으로 -

대법원 2021. 5. 6. 선고 2017다273441 판결(이하 ‘대상판결’)은 민간투자법상 이른바 BTO 계약의 관리 · 운영 단계에서 사업시행자가 파산한 경우에 파산관재인이 채무자회생 및 파산에 관한 법률(이하 ‘채무자회생법’) 제335조 제1항에 의한 해지권을 행사할 수 있는지 문제된 사안에서, 공법적 법률관계에도 채무자회생법 제335조 제1항이 적용 또는 유추적용할 수 있다고 하면서도, 이 사건에서 문제가 된 실시협약은 쌍방미이행 쌍무계약에 해당하지 않는다는 이유로 해지권을 부정하였다. 우선 본고는 공법상 계약으로서의 민간투자사업 실시협약은 채무자회생법상 해지규정을 적용할 수 있음을 보였다. 이후, 채무자회생법상 해지가능한 쌍방미이행 쌍무계약의 요건을 검토하여, 이 사건 실시협약에서 사업시행자의 유지 · 관리의무와 대전광역시의 사용 · 수익권 부여 의무는 상호 대등한 대가관계에 있으며, 전체 기간을 고려할 때에도 상호 견련성 있는 계속적 계약임을 밝혔다. 나아가, 사업시행자의 수익이 관리 · 운영 단계에 이르러 비로소 발생한다는 점을 고려할 때, 시설이 완공된 이후 미이행이 발생하더라도 이를 쌍방미이행 쌍무계약으로 보는 것이 BTO 계약을 체결하는 양 당사자의 의사에 부합한다는 점을 지적하였다. 본고는 해지권을 인정할 경우 민간투자법상 계약 전반에 대한 도덕적 해이를 우려한 다수의견의 논거에도 의문을 제기하였다. 채무자회생법상 보장되는 파산관재인의 해지권을 부정하는 경우, 주무관청이 계약을 해소하려 하지 않으면 파산으로 사업수행능력이 없는 사업시행자 측은 계약의 구속력에서 벗어날 방법이 없어 계약이 교착상태에 빠질 수 있다. 나아가, 해지권 행사로 인한 도덕적 해이의 문제는 해지권 자체를 부정할 것이 아니라 개별적 · 구체적 판단을 통해 신의칙에 따른 예외를 인정하거나, 해지 시 지급금 액수를 조정하는 방식으로 해결하는 것이 타당하다. 대상판결의 다수의견은 BTO 방식의 민간투자사업에서 채무자회생법 해지규정을 통한 투자금 회수의 가능성을 차단하였다. 이에 따라 향후에는 파산 시 민간투자 사업자의 권리를 실시협약 체결 단계에서 상세히 규정하는 것이 중요해질 것이다. 또한, 일견 쌍방미이행 쌍무계약으로 보이는 상황에서도 계약이 양측 모두에 의해 해지되지 않고 교착상태로 남아 있을 가능성이 존재하므로, 그 공백을 입법적으로 어떻게 해결할지에 대한 고민이 필요할 것으로 생각된다. The Supreme Court en banc decision 2017Da273441 May 6, 2021 (hereinafter referred to as “the Case”) inferred that Article 335 paragraph (1) of the Debtor Rehabilitation and Bankruptcy Act applies either directly or analogously to the case where the project implementer goes bankrupt during the management and operational stage of a BTO contract, while at the same time denying the right to terminate the implementation agreement of the Case on the grounds that it did not constitute a bilateral contract unfulfilled by both parties. This paper demonstrates that the Debtor Rehabilitation and Bankruptcy Act can be directly applied to agreements under public-private partnership projects. Furthermore, after reviewing the requirements of bilateral contracts unfulfilled by both parties, this paper concludes that the implementation agreement of the Case fulfills to be (i) in an equal obligation relation, (ii) and in an unfulfilled state by both parties. Afterward, this paper questions the majority opinion of the Case concerning the moral harm that the recognition of the right to terminate might bring. If the bankruptcy trustee"s right to terminate is denied, the possibility of the contract reaching a deadlock increases. In order to resolve the moral hazard that might be caused by the exercise of the right to terminate, it is better to acknowledge the exceptions according to the principle of good faith, or to adjust the amount of payment upon termination through specific individual judgments. Since the Case denied the bankruptcy trustee’s right to terminate the implementation agreement, it is expected in the future that project implementors of public-private partnerships cannot seek a return of investment capital by claiming this right. Accordingly, it will become important to specify the rights of the project implementer in the event of bankruptcy when signing the contract. In addition, with the Case rises the possibility of the contract reaching a deadlock, further emphasizing the necessity of seeking out ways to solve this legislative void.
지리적 가중회귀모형을 이용한 지역별 걷기실천율의 지역적 변이 및 영향요인 탐색

Purpose: Walking practice is a representative indicator of the level of physical activity of local residents. Although the world health organization addressed reduction in prevalence of insufficient physical activity as a global target, the rate of walking practice in Korea has not improved and there are large regional disparities. Therefore, this study aimed to explore the spatial variations of walking practice and its associated factors in Korea. Methods: A secondary analysis was conducted using Community Health Outcome and Health Determinants Database 1.3 from Korea Centers for Disease Control and Prevention. A total of 229 districts was included in the analysis. We compared the ordinary least squares (OLS) and the geographically weighted regression (GWR) to explore the associated factors of walking practice. MGWR 2.2.1 software was used to explore the spatial distribution of walking practice and modeling the GWR. Results: Walking practice had spatial variations across the country. The results showed that the GWR model had better accommodation of spatial autocorrelation than the OLS model. The GWR results indicated that different predictors of walking practice across regions of Korea. Conclusion: The findings of this study may provide insight to nursing researchers, health professionals, and policy makers in planning health programs to promote walking practices in their respective communities.
벼 오존가스 노출에 따른 초기 생육 및 안토시아닌 생합성 변화 분석 연구

Recently, the concentration of fine dustcausative substances (NOx, VOC, etc.) in the atmosphere has increased, resulting in high concentrations of tropospheric ozone (O3) and increased damage to crops. This study aimed to analyze the impact of high concentrations of ozone gas on the initial growth of rice plants and investigate the relationship between ozone damage resistance and anthocyanin biosynthesis. To achieve this, rice plants were exposed to elevated levels of ozone gas using an ozone chamber, and subsequent measurements were taken to assess changes in growth, the percentage of damaged leaves, and the anthocyanin content. The results revealed that varieties with a higher proportion of damaged leaves exhibited a relative increase in anthocyanin biosynthesis following ozone exposure. Notably, detrimental effects on growth, such as decreased biomass, were mitigated. Additionally, Anthocyanin biosynthesis genes in rice were listed by selecting homologous genes from Arabidopsis and Maize. The expression of OsF3H2, OsFLS1 and OsLDOX3 was induced during ozone treatment. This result is expected to contribute to the study of the protection mechanism of plants from ozone damage.
