      • 國際海峽의 上空飛行에 관한 法的考察

        The freedom of overflight of international straits conferred by Article 38 of the Geneva Convention on the High Seas raises various questions as to the power of states bordering straits to restrict that freedom and impose obligations on aircraft in transit. Transiting aircraft mayconsiderably affect a littoral state's interests in regulating flight traffic, limiting dangerous or harmful activities such as flight exercises or refueling while in flight, and restricting military activities prejudicial to the defense or security of the coastal state. In examining some of the air law implications of the Law of the Sea (1982), two main issues arise. The first concernes the scope of the right fo transit passage for aircraft guaranteed by the Convention in international straits, archipelagic air routes, and exclusive economic zones. The term "transit passage" raises the question of possible restrictions on rights of overflight on the analogy of the question of "creeping jurisdiction." The Convention has introduced new areas of conflicting rights. International aviation, which is dependent on unambiguous operating rules, may have to face conflicting claims and legal requirements because of the uncertainties in the legal status of those new areas. This article deals with such new issues of international aviation law.

        The purpose of this article is to introduce the reader to The Latin American Civil Aviation Commission and emphasize on the importance of the organization in solving regional civil aviation problems. This will be done by briefly outlining: (1) the current status of Latin American civil aviation; (2) the actual LACAC organization and its envisioned role in Latin American civil aviation and ; (3) the work of the First and Second LACAC Assemblies. The article will also attempt to explain the growing influence of LACAC on international civil aviation and suggest new propositions to study more with relation to the above-mentioned.

      • 二國間 航空協定의 輸送力 規制條項에 대한 考察

        Generally speaking, there are the provisions on capacity control in bilateral air agreements. The Bermuda Agreement (Bermuda I, 1946) was a pioneer agreement and had produced notable results over its thirty-year life. The plain fast was, however, that the day-to-day management of their bilateral civil aviation relations on the basis of Bermuda I was providing more and more complex. The words of the original text did not really bear on many of the problems which had arisen in recent years. They felt these difficulties applied particularly over the question of capacity on the North Atlantic routes . The decline in traffic prospects following the Middle East conflict, the rise in fuel costs and the international recession had combined to cause severe problems on the North Atlantic between 1974 and 1976. In those difficult years they experienced the use of capacity as the main competitive tool oil the route. The New Bermuda Agreement (Bermuda II, 23 July 1977) is not a rigid system and allows the operator a considerable measure of freedom in the expercise of his own judgment about the way the market is going to develop. But it permits governments to challenge the individual judgments of operators and to suspend within certain limits increases in capacity. Bermuda II has reduced Fifth Freedom rights drastically. Bermuda II does not go all the was to full predetermination of capacity and schedule control. Consequently it can be expected that there will be a world-wide acute tendency to have at least some of the rules newly agreed upon incorporated in the existing air agreements. Among those new rules it seems that those regarding capacity will attract a great deal of attention. The danger of Bermuda II in this respect is not so much that it invents something that never existed before, but that it legalizes existing tendencies by showing the way how to exercise autherity over foreign airlines, capacity that is considered too big.

        이 硏究는 1992학년도의 한국항공대학교 신입생 의식구조의 조사를 토대로 한 새로운 학생생활지도 방안을 設定하기 위해서 마련된 것이다. 특히 이 연구의 진행과정에서는 최근 東北아시아의 국제정치 및 경제사정등의 극적인 變化가 학생생활에 미치는 영향 도 깊이 고려하였다. 뿐만 아니라 지난 오랜동안 한국항공대학교가 위치한 이 캠퍼스지역에 가로놓인 많은 어려운 장애 물과 악조건들이 학생들의 학습활동이나 연구생활에 미치는 악영향등도 충분히 유의하였다. 이 硏究의 두번째 목적은 무엇보다도 학생들의 進路지도를 적극 강화하고 보완하는 방안이 생활의 勉學분위기를 조성 하고 활기찬 학습 및 연구생활에 더욱 크게 이바지 하게 될 것이라는 점을 크게 유념하였다. This study is to eatablish "New Directions of Guidance for Students Life on the Basis of Research into Freshmen's Way of Thinking(1992)" in Hankuk Aviation University. In the process of this research, Particularly, we have deeply considered into the great influence upon the students life from the recent dramatic change of international polities and economic circumstances of Northeastern Asian countries. On the other hand, we have kept in mind very difficult conditions and circumstances laid in this campus area which have greatly influenced upon the very hard and inconvenient studing life of students for a long time past. The second objective of this research is to study of New Directions of Guidance for Making New job of Graduates and future new plan for variable social life after graduation. We believe such methods of New Guidance will remarkably devote on the effective and industrious studing life of students of Hankuk Avation University.

      • 堪航性改善通報와 航空機製造物責任에 관한 法的考察

        In many industries, regulatory guidelines have developed to help prevent defective products from entering the market and to deal with defective products once they reach the consumer. The civil aviation industry also has developed guidelines dealing with defective products. The aviation community has an important interest in assruing aviation manufactures promptly advise users of defects in their products after the sale. The purpose of this article is to study on the Airworthiness Directives system under U.S Federal Aviation Regulations part 39. This article will also explain on the developments of the law in this area with relation to Aircraft Manufa cturer's Liability for Defects in Construdtion and Design. Manufacturers have a continuing post-sale duty to adequately warn users of defects and to develop corrective measures. Aviation consumers are generally advised of dangerous product conditions in FAA airworthiness directives or manufacters' service bulletin.

        Methotrexate 치료를 받고 있는 활동성 류마티스 관절염 환자에서 etanercept의 유효성과 안전성에 관한 연구

        목적 : 류마티스 관절염을 앓고 있는 한국인 중에 기존 DMARDs로 치료 실패하였고, 고정용량의 MTX를 복용하고 있는 환자들에 있어서 etanercept의 유효성과 안전성을 평가하고자 하였다. 방법 : 기존 DMARDs로 치료 실패한 활동성 류마티스 관절염 환자 76명을 대상으로 하여 단일군, 공개시험을 하였다. 대상 환자들은 고정용량의 MTX를 복용하면서 etanercept 25 mg을 1주일에 두 번 피하 주사하였으며 12주간 투여하였다. 유효성은 ACR 20, ACR 50,조조강직 시간으로 평가하였고, 약제의 안전성은 이상반응 등으로 평가하였다. 결과 : 대상 환자는 총 76명으로 평균 연령은 45.2세, 남자 5명, 여자 71명이었다. 84.4%인 54명이 12주째에 ACR 20을 만족하였고, 53.1%인 34명이 12주째에 ACR 50을 만족하였다. 조조 강직 시간은 치료 전 203.3분에서 치료 12주째 42.6분을 평균 74.5% 호전되었다. 가장 흔한 이상반응은 주사부위 반응이었다. 이외에도 상기도 감염, 오심, 안면부종 등이 발생하였으나 심각한 부작용은 없었다. 결론 : etanercept는 효과적이고, 안전한 류마티스 관절염 치료 방법이며 특히 MTX치료에도 불구하고 활동성인 류마티스 관절염에 기대되는 치료라고 할 수 있다. Background : This study was performed to investigate the efficacy and safety of etanercept in active rheumatoid arthritis patients with stable dose of methotrexate in Korean. Methods : In a 12 week, single arm, open trial, we assigned 76 patients with active rheumatoid arthritis who had an inadequate response to disease-modifying antirheumatic drugs. Patients received twice-weekly subcutaneous injections of etanercept 25 ㎎ while containing to receive methotrexate at a stable dose of 7.5~25 ㎎ per week. The clinical response was defined as the percent improvement in disease activity according to the criteria of the American Collage of Rheumatology (ACR) at 12 weeks. Results : Etanrecept led to significant improvements in disease activity and was safe and well tolerated. At 12 week, 84.4% of the patients receiving 25 ㎎ of etanercept achieved a 20% ACR response, and 53.1% of those receiving etanercept achieved a 50% ACR response. The most common adverse event was injection-site reaction. Other advanse events were upper respiratory infection, nausea, and facial edema, but there were no serious adverse events associated with etanercept. Conclusion : In active rheumatoid arthritis patients, etanercept was safe, well tolerated, and provided rapid clinical improvements.

      • 領空과 宇宙空間의 限界에 관한 法的 考察

        航空.宇宙科學의 발달로 宇宙空間의 利用이 확대되고 있는 오늘날 국가의 防衛側面에서도 領空의 방위를 어느 高度 어느線까지 할 수 있는 것인지, 또 그것이 妥當한 것인지에 대해서 규명하기가 매우 복잡하면서도 그 만큼 戰略的으로 중요성을 띠고 있음을 알 수 있다. 宇宙空間이 인류의 새로운 開拓地가 된 오늘날 많은 나라들이 宇宙空間을 自然資源化하려는 노력을 더하여 領空에 대한 主勸行使의 기준이 점차 모호해 지고 있는 점도 새로운 문제로 지적할 수 있다. 종래 국제법규에 의한 規制가 宇宙空間과 空氣가 존재하는 부분을 합친 空間에 궁극적으로 미치고 있는 이상 포괄적인 宇宙法(Space law)의 새로운 구성을 생각할 때, 宇宙空間의 法的地位 및 管轄과 종래의 空間法과의 空間管轄의 관계는 現行法의 存在, 不存在를 막론하고 당면 필요한 考察의 第1步인 것은 두말할 여지가 없는 일이다. 이상과 같은 관점에서 領空과 宇宙空間의 限界에 대한 法的 考察을 시도하게 된 것이다. One of the first issues which arose in the evolution of air law was determination of the vertical limits of air space over private property. The search for a solution of the problem of demarcating the two different legal regimes(functionalism and spatialism) governing the space above the Earth has undoubtedly been facilitated. The most important issue in this context relates to the problem of a right of passage for space craft through foreign air space in order to reach outer space. The path towards the successful delimitation of outer space from territorial space is doubtless narrow and stony but the establishment of a precise legal framework, consonant with the basic principles of international law, for the future activities of states in outer space will, it is still believed, remove a source of potentially dangerous conflicts ketween states, and furthermore afford some safeguard of the rights and interests of non-space powers which otherwise are likely to be eroded by incipient coustoms based on at present almost complete freedom of action of the space powers.

      • 마이크로 센서에의 응용을 위한 SnO₂_(-x)열산화 박막의 특성

        SnO_(2-x) thin films were prepated by thermal evaporation of metal tin granules on silicon wafer and were oxidized under various furnace termperature in exposure to O_(2). Mobility, carrier concerntration and resistivity of the SnO_(2-x) thin films were measured by Hall effect measurement and 4-point probe method. The temperature profile in thermal oxidation showed great effects on electric properites and surface structures of the thin films. The thin films were used for the sensing membrane of C_(4)H_(10) microsensor. The contact characteristics of Pt electrode-SnO_(2-x) and sensing properties of the films were investigated.
