        구성요건과 위법성의 구분

        Diese Aufsatz sollte zur Systembildung von Unterscheidung zwischen Tatbestandmäßigkeit und Rechtswidrigkeit beitragen. Diese Darstellung sollte zeigen dass das Prinzip für die dogmatische Zuordnung der einzelnen Erlaubnissätze in koreanische StGB fruchtbar zu machen. Der Tatbestand ist schon negativ betroffen, wenn dem Täter die Verantwortung für den Erfolg nicht zugeschrieben werden kann, weil der Grund des Erlaubnissatzes allein in der Fremdverantwortung oder gar in eimem gänzlichen Fehlen von Verantwortung liegt. Besteht der Grund der Erlaubnis dagegen in Vehältnismäßigkeiterwägungen. Nach dem Gesagten sind nämlich all jene Erlaubnissätze als zurechungsausschließend zu betrachten, die wertungsmäßig allein auf dem Prinzip des Verantwortungsauschlusses beruhen. Dagegen sind diejenigen Erlaubnissätze, die zumindest auch dem Abwägungsprinzip unterliegen als Rechtfertigungsgründe zu betragten. Die konkrete Folgerung aus dem Verantwortungsprinzip betrifft die Einwiligung und die Pflichtenkollision. Nach der hier vertretenen Auffassung ist die Zuordnung der Einwilligung und der Pflichtenkollision in den Bereich der objektiven Zurechnung und damit die Annahme eines Tatbestandauschlusses unumgänglich.

        태권도 음악품새 훈련 프로그램이 과체중 초등학생의 신체구성과 혈중지질에 미치는 영향

        The goal of this research is to determine if rhythmic Taekwondo Poomsae training can improve the health of over weight elementary school students and to examine its effectiveness in health enhancement by studying the comparative analysis on general and rhythmic Taekwondo Poomsae training program on body composition and blood lipid level in over weight elementary school students who participated in the training for twelve weeks in two separate groups of the exercise group and the control group. The results are as follows. First, the exercise group showed significant change in weight and BMI before and after workout, but there wasn`t meaningful differene in skeletal muscle mass while there was none for the control group. There wasn`t significant difference between two group(p<.05). Second, for the rhythmic Taekwondo Poomsae, there was significant difference in TC, LDL-C, TG, and HDL-C, decreasing TC, LDL-C and TG and increasing HDL-C. However, for the general Taekwondo Poomsae, there was decreasing in TC and increasing in HDL-C, but did not show meaningful difference while there were decreasing in LDL-C and TG, showing meaningful differences. For the difference in the density between two groups, there were significant changes in TC and LDL-C while there were not significant changes in HDL-C and TG(p<.05). As shown above, rhythmic Taekwondo Poomsae training program for over weight elementary school students showed statistically significant changes in weight and BMI between before and after workout and showed more positive effects than general Taekwondo Poomsae did. Also, Taekwondo Poomsae training program showed signigicant difference in every TC, HDL-C, LDL-C and TG between before and after workout, The significant difference between two groups in TC and LDL-C made it possible to be more effective exercising program in the general gyms.

        The purpose of the research is to develop a device to prevent secondary contamination by particles removed in the cleaning process of small precision plastic lens injection molds. The particle capturing device consists of two-fluid jet injection inlet for cleaning and another inlet of atmospheric air to maintaining the cleaning effect and an outlet for inhale the particles by applying vacuum pressure. The optimal air intake size was 0.12L and the outer shape of the device was proposed to have an inclination of 45°. In addition, a baffle was installed between the injection and the suction port inside the device to maximize the cleaning and capturing effect. The optimal length of the baffle was evaluated by analyzing the flow and particle behavior. The length of the cylindrical shape of the baffle with a constant cross section is suitable for 1.8L, 2.4L, and 3L, and the optimal length for the conical shape of the baffle was evaluated to be 3L.

        Correlation of gingival biotypes with clinical parameters

        1. 목적 이 연구의 목적은 기존의 평가기준에 따라 관찰자에 의해 주관적으로 판단된 치은형과 실제 치은두께와의 상관관계를 규명하고 임상검사 시에 측정할 수 있는 변수들과 치은두께의 연관성을 평가하는 것이다. 2 방법 211명의 치과대학생(22-43세, 평균 24.7세)을 연구대상으로 하여 상악중절치부위에서 국소마취하에 근관 치료용 파일을 치은에 삽입하여 두께를 측정하고 임상검사를 통해 치주낭깊이, 치태지수, 치은지수, 치은퇴축, 체형 및 비만도, 피부형, 치경부의 형태, 관측자가 임의로 판단한 치은형을 기록하였다. 임상사진으로 치관의 폭경과 길이의 비율, 치은외형의 만곡정도를 조사하고 평행촬영법을 이용한 방사선사진으로 치아의 장평비율 및 치아의 치관 폭경과 치경부 폭경의 비율을 조사하였다. 전체 대상을 치은의 두께를 기준으로 평균두께보다 얇은 군과 두꺼운 군의 두 개의 군으로 분류하여 임상검사 사에 측정한 변수들이 각 군 간에 유의할 만한 차이를 보이는지와 임의로 판단한 치은형이 실제 치은두께와 연관이 있는지를 알아보았다. 통계처리는 Student t-test를 이용하였다. 3. 결과 치주낭 깊이, 치은지수, 체형 및 비만도, 피부형, 치아의 형태, 치경부의 형태, 치아의 장평비율의 경우 실제 측정하여 얻은 치은의 두께와의 상관관계는 통계적으로 유의성이 없었다. 치은의 형태는 치은의 두께와 상관성은 보이고 있으나 통계적으로 유의하지 않았다. 관측자가 임의로 평가한 치은형과 실제 측정치도 유의할만한 일치를 보이지 않고 있다. 4. 결론 치은의 형태는 치은의 두께를 예상하는데 약간의 도움이 될 수 있으나 실제 치은의 두께는 임상적으로 간단히 측정할 수 있는 겸사지수들과 직접적인 상관관계를 보이지 않았다. 따라서 치료결과의 예측에 있어서 치은형을 분류하여 예상하는 것은 큰 도움이 되지 않는다고 할 수 있다.

      • 나선형 마이크로/나노 로봇의 규모와 표면특성이 유영에 미치는 영향에 관한 수치적 연구

        This study analyzed the swimming characteristics of helical micro/nano robots in the no-slip condition and the slip condition. For the micro/nano scales with Knudsen number greater than 0.01, the Maxwell slip model was applied to analyze the effect of slip on the wall. Micro/nano swimming robot with a large Knudsen number had a large slip effect, which caused the swimming speed to be relatively slow. Meanwhile, the flow characteristics were analyzed considering the effects of hydrophilicity and hydrophobicity on slip. We found that even if the Knudsen number is constant, when the surface effect of the swimming robot is hydrophilic, the propulsion force increases compared to the case of hydrophobicity. The propulsion efficiency also demonstrated the same trend as the swimming speed, and the maximum efficiency was 0.097%, which is the efficiency of the no-slip condition on the wall.

        약식절차 개선방안에 관한 연구

        The merit of summary procedure lies in the fact that it is conducted not by public trial but by documentary examination thus enabling minor and simple criminal cases to be processed quickly. But it is pointed that in real, summary procedures take too much time. The range of subjects competent for summary procedure is narrow, the formality in demanding summary orders is unclear, and regulations concerning forwarding cases to procedures in public trial by authority need reforms. Also, unreasonable results brought by applying the principle of 'prohibition against a change to the disadvantage of the accused, process delays in public trial demanded cases, sudden increases of appeals of public trial demanded cases are pointed out as the problems of current public trial demand procedure provisions. In order to solve these problems, improvements such as the followings are required. First, improvements for speeding up the process of summary cases. 1) Shortening terms of criminal indictments by, creating manuals for cooperation between the police and the prosecutors office, making summary indictments utilizing electronic documents. 2) Shortening terms of document examinations by assigning summary orders to exclusive courts. 3) Shortening terms of executions of summary orders by. assigning conveyance locations, clarifying provisions stipulating conveyance by public announcement, conveying orders by electronic documents. Second, rationalizing summary procedure 1) Adjusting subjects of summary procedure 2) Clarifying forms of demanding summary orders 3) Improving provisions stipulating public trial submissions by authority Third, suggestions on improving public trial procedure provisions 1) Excluding application of the principle of 'prohibition against a change to the disadvantage of the accused'. 2) Introduction of dismissal without of oral proceedings and expanding the range of trials by default 3) Introduction of special provisions regarding summoning the accused demanding public trial. 4) Simplifying the procedure of public trial demands Fourth, suggestions on restraining public trial demanded cases entering the Supreme Court 1) Introducing appeal courts in High Courts 2) Limiting causes of appeal in minor cases such as summary cases If the above suggested improvements come true, the summary procedure will make much more contribution not only to efficient case handling of the criminal judiciary agencies or organizations, but to speedy release of defendants from the burden of the procedure.

        지르코니아/알루미나 복합 지대주의 생물학적 안정성에 관한 연구

        The purpose of the present study is to evaluate the biological stability of the zirconia/alumina composite abutment by histologic and radiographic examination in clinical cases. 17 partially edentulous patients (5 men and 12 women, mean age 47) were treated with 37 implants. The implants were placed following the standard two-stage protocol. After a healing period of 3 to 6 months, zirconia/alumina composite abutments were connected. All radiographs were taken using paralleling technique with individually fabricated impression bite block, following insertion of the prosthesis and at the 3-, 6-, 12 month re-examinations. After processing the obtained images, the osseous level was calculated using the digital image in the mesial and distal aspect in each implant. An ANOVA and t-test were used to test for difference between the baseline and 3-, 6-, 12 months re-examinations, and for difference between maxilla and mandible. Differences at P <0.05 were considered statistically significant. For histologic examination, sample was obtained from the palatal gingiva which implant functioned for 12 months. Sections were examined under a light microscope under various magnifications. Clinically, no abutment fracture or crack as well as periimplantitis was observed during the period of study. The mean bone level reduction(${\pm}standard$ deviation) was 0.34 rom(${\pm}\;0.26$) at 3-months, 0.4 2mm(${\pm}\;0.30$) at 6-months, 0.62 mm(${\pm}\;0.28$) at 12-months respectively. No statistically significant difference was found between baseline and 3-, 6-, 12-months re-examinations (p > 0.05). The mean bone level reduction in maxilla was 0.33(${\pm}0.25$) at 3-months, 0.36(${\pm}0.33$) at 6-months, 0.56(${\pm}0.26$) at 12-months. And the mean bone level reduction in mandible was 0.35(${\pm}0.27$) at 3-months, 0,49(${\pm}0.27$) at 6-months, 0.68(${\pm}0.30$) at 12-months. No statistical difference in bone level reduction between implants placed in the maxilla and mandible. Histologically, the height of the junctional epithelium was about 2.09 mm. And the width was about 0.51 mm. Scattered fibroblasts and inflammatory cells, and dense collagen network with few vascular structures characterized the portion of connective tissue. The inflammatory cell infiltration was observed just beneath the apical end of junctional epithelium and the area of direct in contact with zirconia/alumina abutment. These results suggest the zirconia/alumina composite abutment can be used in variable intraoral condition, in posterior segment as well as anterior segment without adverse effects.
