        자본시장법상 투자계약증권에 관한 소고 - 부동산개발사업 간접투자에의 투자계약증권 규제 적용 가능성 및 타당성 연구 -

        IMF사태 이후 기업구조조정 지원을 위하여 본격적으로 도입된 부동산 간접투자 시장은 국제금 융시장의 불안과 부동산 침체국면 진입의 반사적 효과에 힘입어 부동산직접투자의 대안으로 급성 장하였다. 부동산투자회사법과 간접투자자산운용업법, 신탁법 등에 의해 주로 규율되던 부동산간 접투자는 이후 포괄주의 규제방식을 도입한 자본시장과 금융투자업에 관한 법률에 따라 부분적으 로 통합되어 규율되어왔다. 동법은 전통적인 개념의 증권 외에 미 연방증권법상의 투자계약증권개 념을 도입하여 새로운 유형의 간접투자상품을 규제할 수 있는 근거를 가지고 있다. 최근 부동산 간접투자 시장에서는 기존의 간접투자방식을 이용하지 아니하거나 새로운 형태의 사업구조를 만드는 등의 방법을 이용하여 규제를 피하려는 시도가 생겨나고 있다. 자본시장법은 기존의 규제에 포섭하기 어려운 새로운 유형의 간접투자도 투자자계약증권으로 포섭하여 규제할 수 있는 법률적 근거를 가지고 있으나, 투자계약증권의 개념이 명확하게 정립되어 있지 않아 실무 상 이에 대한 규제를 실제 적용한 예는 아직 찾기 어렵다. 따라서 거래의 안전을 도모하고 투자자 의 보호를 위해 이러한 수익형부동산투자를 투자계약증권에 포섭하여 각종 규제조항을 적용시킬 수 있을지에 대한 검토가 필요하다. 특히 투자계약증권의 적용과 관련하여 기존의 간접투자 유형 및 유사수신행위와의 구별 기준을 명확하게 정립하고, 구체적으로 어떠한 규제가 적용될 수 있는 지, 그와 관련한 해석론상의 문제점은 없는지에 대한 계속적인 연구가 필요할 것이다.

        Tree Management and Characteristics of the Terraced Flower Beds in Changdeok Palace

        Terraced Flower Beds is a artificial scenery feature creating esthetical scenery by adopting flowering plant or the feature of staffage such as stone one, strangely shaped stones, chimney, fence and etc psychologically. From ancient times, palace garden was planned thoroughly and created but nowadays due to excessive growing of the root part of tree left alone like natural forest shape stone part has been damaged so become a risk for maintaining cultural assets. Hence, this study was to prepare the evidence for the management of Terraced Flower Beds in other areas by selecting the representative Terraced Flower Beds remaining in Changdeok Palace and looking into existing state and analysing the tree management and characteristics performed up to now, main result come out here is as following. First, it was judged that also appropriate management plan for the principle of general arrangement plan and the environment of each target place is necessary when making a management plan of Terraced Flower Beds in Changdeok Palace. It seems to be required of suitable plan according to the environment of the location of Terraced Flower Beds rather than applying lump-sum management plan to Terraced Flower Beds different with the shape, scale, steep, planting trees and buildings of Terraced Flower Beds. Second, through analysing planted trees in Terraced Flower Beds we could see the rate of using shrubbery high. And for the quantity of tall tree, the whole area of Uiduhap has more than other Terraced Flower Beds and it is considered that security solution is necessary for handicapped circumstances of growing tall trees on a slope field. Third, as a result of anaysing how to arrange Terraced Flower Beds it is required to be established regular maintenance plan for the damage of stone axis due to growing of root part of tree. Fourth, based on anaysing current planting situation through documentation materials for the method of arranging Terraced Flower Beds of traditional rooms including palace, case study and specialists‘ review arrangement of large poles is necessary step by step because they have become a danger feature for safe managing, specific arranging plan should be done also for left alone trees with naturally forest shape. We are willing to give meaning to this study because it suggested the developing direction of arranging trees of Terraced Flower Beds in traditional rooms focusing to the case of Terraced Flower Beds in Changdeok Palace.

        Internal Transcribed Spacers (ITS)로 분석한 국내 Rubus 재배종의 계통학적 유연관계

        The bramble cultivated widely in South Korea, which is known as Bokbunja-ddal-gi, is regarded as having originated from Korean native Rubus coreanus. This study was carried out to obtain basic phylogenetic information on Korean cultivated bramble (KCB) by comparing the internal transcribed spacer (ITS) regions with those of R. coreanus, blackberry (R. lanciniatus), black (R. occidentalis) and red (R. idaeus) raspberry. Sequences of the ITS 1 suggest that some KCB accessions share a significant similarity with both R. occidentalis and R. coreanus in the ITS 1 region. The ITS 2 sequences of the three KCB accessions clustered more closely to those of two R. occidentalis accessions than to those of R. coreanus. These results suggest that there exist variations in the sequences of ITS among KCB accessions and KCB accessions are more closely related to black raspberry than R. coreanus in the ITS regions.

        Chloroplast DNA Spacers로 분석한 국내 Rubus 재배종의 계통학적 유연관계

        There is a considerable difference in morphological traits between Bokbunja cultivated in Korea (KCB) and Korea native Rubus coreanus, contrary to the conviction that the cultivated Bokbunja is the domestication of R. coreanus. To infer the phylogenetic relationship of KCB with other Rubus species, we compared the chloroplast DNA spacers of KCB with those of several Rubus species including black raspberry, R. occidentalis. The three chloroplast DNA spacers, atpB~rbcL, trnL~trnF, and trnT~trnL, were amplified using the specific primer pairs and converted to Single Strand Conformational Polymorphism (SSCP) markers. The SSCP makers of the chloroplast DNA spacers showed a considerable variation both within and among Rubus species. In the phylogenetic tree generated by the SSCP markers, KCB accessions were located in the same clade with R. occidentalis, but R. coreanus accessions in the different clade. Also, in the phylogenetic tree by the nucleotide sequences of the chloroplast DNA spacer trnL~trnF, KCB located in the same clade with R. occidentalis but not with R. coreanus. These results suggest that the three KCB accessions share higher similarity with R. occidentalis than with R. coreanus in the three chloroplast DNA spacers.

        Phylogenic Relationships of Rubus Species Revealed by Randomly Amplified Polymorphic DNA Markers

        Korean cultivated bramble, which is known as Bokbunja-ddal-gi is regarded as having originated from Korean native Rubus coreanus. However, little scientific evidence and significant morphological differences between Korean cultivated bramble (KCB) and R. coreanus throws doubt on the ancestry of KCB. This study was carried out to obtain phylogenetic information on KCB by comparing its nuclear genomic background with those of R. coreanus, black (R. occidentalis) and red (R. idaeus) raspberry, blackberry (R. lanciniatus), and R. crataegifolius. A total of 99 random amplified polymorphic DNA (RAPD) markers were generated and used for phylogenetic analysis of 76 Rubus accessions. Accessions of each species were grouped into each distinct subclade by the RAPD markers at a similarity coefficient of about 0.59. The KCB subclade formed a clade with R. occidentalis and R. crataegifolius subclades at a similarity coefficient of 0.47. The R. coreanus subclade formed a clade with R. idaeus, R. lanciniatus, and R. crataegifolius subclades at a similar level of genetic similarity. Only one KCB accession from Hoengsung was included in the R. coreanus subclade. The accession shows leaf and flower characteristics differed from the rest of the KCB accessions. The phylogenetic relationship inferred from the RAPD markers suggests that the nuclear genomic background of KCB accessions which show morphological similarity to black raspberry is more closely related to black raspberry than to R. coreanus. This brings about the need for close scientific evaluations on the ancestry of KCB at both morphological and molecular levels.       • 총체맥류 파종량이 생육시기별 벼 식물체 질소 동화 과정 Glutamine Synthetase(GS), Glutamate Synthase(GOGAT), Glutamate Dehydrogenase(GDH) 효소 활성에 미치는 영향

        국내의 조사료원으로써 양질의 조사료 생산 및 이용을 위해 총체맥류의 논재배 면적이 최근에 급증하고 있다(1998년(10a)→2006년(9787a), 농림부). 총체맥류 재배시 최대 조사료 생산을 목적으로 다량의 종자를 파종하고 있으며 파종량이 많을수록 더 많은 토양중의 질소분을 흡수, 이용하기에 동일 포장에서 바로 이어서 재배되는 벼 식물체의 질소분의 흡수, 이용에 영향을 미치므로 토양 중의 질소 수지 조사에 의한 벼의 시비 처방의 필요성이 제기되고 있다. 현재 총체맥류 생산답에서의 벼 재배시 총체맥류 생산시의 파종량과 토양의 질소량을 고려하지 않고 벼에 대한 재배가 이루어지므로 총체맥류 재배답에서의 벼 재배시 벼 식물체의 질소 이용에 대한 조사를 위하여 2007년 전북농업기술원의 포장에 총체 맥류 파종량을 기준으로 총체 보리, 이탈리안라이그라스의 재배답을 각 각 4구씩 구획하였으며 2008년 6월 5일 5개의 벼 품종을 각 파종구에 이앙하였다. 5개의 벼 품종들은 7개의 주요 생육시기별로 샘플링 하여 질소 동화 과정에서 중요한 작용을 하는 Glutamine Synthetase(GS), Glutamate Synthase(GOGAT), Glutamate Dehydrogenase(GDH)를 분석하였다. 분석 결과 GS, GOGAT, GDH 효소의 활성은 벼 식물체의 주요 생육시기가 진전됨에 따라 점차적으로 증가하여 유수형성기와 수잉기에서 이앙기의 약 1.3 ~ 5.5배 증가하였으며 출수기에 접어 들면서 점차 감소하였다. 파종량별 GS, GOGAT, GDH 효소의 활성에서 신농흑찰벼의 GOGAT 효소의 활성은 이탈리안라이그라스 재배답에서만 파종량이 많을수록 효소의 활성도 높아졌으며, 큰눈벼의 총체보리 재배답, 신농흑찰벼의 이탈리안라이그라스 재배답과 호품벼의 총체보리 재배답에서만 파종량이 많을수록 GS 효소의 활성이 증가하였다. 이상의 결과는 본시험에서 사용한 총체맥류 파종량의 범위에서는 총체맥류 재배답의 벼 재배시 질소 동화에 관여하는 GS, GOGAT, GDH 효소의 활성에 유의한 영향을 미치지 않는 가능성을 시사한다. 본 연구는 농촌진흥청 주관 농업기술센터 공동연구과제의(과제번호-200803A01082002) 일환으로 수행됐다.

        대면종사자 교육이 서비스몰입과 직무만족, 조직몰입에 미치는 영향 -항공사,호텔종사자 중심으로-

        Research that examines approaches for improving frontline service employee(FLSE) commitment to service in the context of service factory is relatively scarce. According to Schmenner(1986) the landscape of service is divided into 4 quadrants with hotel and airlines belongs to service factory quadrant. Using a sample of 278 from service factory, we examined the effect of training(formal training, coaching) and FLSE commitment to service on job satisfaction and commitment to the firm. In this study, 5 hypotheses based on literature reviews were employed. The data and hypotheses were examined using structural equation modeling(SEM) by AMOS. Our findings indicate that both formal training and coaching has positive impacts on FLSE commitment to service. Specifically, informal coaching in daily life has stronger influence than traditional formal training on FLSE commitment to service. Thus, managers as well as new employees need to be trained repeatedly and systematically. The results also showed that FLSE commitment to service improves job-related outcomes such as job satisfaction and commitment to the firm. Therefore, FLSE commitment to service has to be emphasized in the service factory. The contribution and limitations of this research were discussed and the future possible researches were mentioned.
