기초자치단체장 정당공천폐지와 반부패전략

2014년 6월 4일 실시된 지방선거에서 가장 중요한 관심은 기초자치선거의 정당공천폐지였다. 한국에서 전국동시지방선거 여섯 번을 치루는 동안 선거부패가 심각하였다. 최근까지의 연구결과를 살펴보면 기초자치단체장들의 중요한 부패요인은 왜곡된 선거제도라고 나타났다. 그 중에 정당공천제의 하향식공천과 공천헌금이 부패요인에서 가장 중요하다고 조사되었다. 우리나라의 경우 지역주의가 강한 정당의 특징이 있기에 일부 지역에서는 특정 정당의 공천만 받으면 지방선거에서 당선이 되는 독특한 정치구조이다. 이로 인해 많은 폐해가 나타나고 있다. 이러한 문제점을 해결하기 위해서 현 정당공천제의 장ㆍ단점 비교와 일반국민들과 정치인, 전문가의 의견을 비교ㆍ분석하였다. 이러한 분석을 토대로 우리나라가 선진화된 민주정치를 구현하기 위해 필요한 요건인 정당공천폐지와 반부패전략을 제시하려고 한다. The biggest concern in the upcoming local election on June 4, 2014 is the abolition of party nomination in local government elections. South Korea faces the sixth nationwide local election on top of the research findings until recently that point to the distorted election system as the most important corruption factor of local government leaders. The biggest causes turned out to be the top-down nomination and nomination offerings of the party nomination system. Noted for the strong regionalism among political parties, South Korea is characterized by a peculiar political structure under which candidates can win in a local election in certain regions as long as they have been nominated by a certain party. It has so far brought about seriously harmful consequences. In an attempt to help to resolve those problems, this study set out to compare the advantages and disadvantages of the current party nomination system and compare and analyze opinions between the general public and politicians and experts. Based on the analysis results, the study would propose the abolition of party nomination and anti-corruption strategies necessary to implement advanced democratic politics in South Korea.

정부가 지역정책을 효과적으로 수립하고 지역주민을 만족시키는 정책을 운영하기 위해서는 지방자치단체의 생활서비스 영역의 실태분석과 생활서비스 수준을 측정하고, 지역유형을 분류하여 그 격차를 살펴보아야 한다. 이를 위해서는 어떻게 생활서비스 영역을 개별 혹은 관련 영역으로 구분하고, 현재 지방자치단체의 수준을 측정하여 지역유형을 분류하고, 지역 격차의 수준을 측정하는가가 중요하다. 우리나라 지방자치단체에서 생활서비스가 불균형적으로 제공되고 있는 문제점을 해결하기 위해서는 정부가 우선적으로 투자해야 할 분야를 확인하고, 전략적인 예산지원과 유인 제도를 마련해야 한다. In order for government to establish regional policy effectively and satisfy administer policy upon these regional residents, they investigate the local self-governing body`s living service domain condition and measure its standard. It is a way to classify regional types and observe the disparities. This research analysis is also performed in the interest of the local self-governing body to develop the living service domain, classify related domain, monitor present standard of regional self-governing body, classify an area types, and level of an area disparity. It is precedence for government administration to confirm a sphere of investment, prepare strategic estimated support and induce system to improve Korea`s disproportional and problematic living service within the regional self-governing body.

A case study on the corruption within the local government level demonstrated the seriousness of its condition. Its condition threatens the regional development and settlement surround the local autonomy. In order to confirm these corruption data is reliable, the head of the local government gathered several interviews and surveys of entire heads of the local government. Using these interviews and surveys, the frequency analysis, technique statistical data analysis, and factor analysis are performed to search the solution to corruption. As a result of the analysis, the causes of corruption, and its prevention strategies are discovered. It consists of individual behavioral factors, institutional factors, and environmental factors.

서울시 구(區)별 영상산업 입지의 공간적 결정요인 분석

본 연구는 서울시 25개 구, 354개의 스크린 수를 이용하여 영화상영관의 입지 패턴은 지역의 공간적인 연계성에 의해서 입지함을 GIS를 이용한 공간파급력 비교와 공간회귀모형을 이용한 공간결정요인을 이용하여 도출하였다. 스크린 수를 분석의 Z값으로 설정하여 영화상영관의 공간파급력을 분석한 결과, 서울의 영화상영관은 강북, 강남, 강서, 강동 4개 지역을 중심으로 영향력이 생성되는 것으로 분석되었으며, 4개 주요 중심축의 영향력 파급 결과, 상대적으로 영화상영관 스크린 수가 많은 지역의 파급력은 평면적으로 넓게 파급되기보다는 지역 내에서 높게 영향력이 생성되는 것을 보여 주변 인구가 영화상영관이 있는 지역으로 이동하여 영화매체를 관람하는 것으로 분석되었다. 영화상영관의 스크린 수에 직접적으로 영향을 미치는 공간적인 결정요인을 공간회귀모형을 이용하여 분석한 결과, 출판, 음반, 공연 관련 업체가 많을수록 영화상영관의 스크린 수가 증가하는 것으로 나타났다. This study shed light on searching spatial location pattern of movie theaters by operating screens in theater as proxy variable to find spillover effects and spatial determinants. After taking procedure to find spatial spillover effect by GIS 3D analyst, movie theaters in Seoul metropolitan area are formed in four categorized regions, such as Kangbuk, Kangnam, Kangseo, and Kangdong. Regions which have larger number of screens than others show that they affect to relevant regions directly. In addition, this study analyzes that people have tendencies to visit movie theater while they use other similar facilities such as music, publishing, and public performance facilities. Therefore, trend of agglomeration of similar enterprise including motion picture industry has a spillover effect and economy of scale when they are gathered in specific regions which are specialized as certain usage.

군사법경찰관(헌병)의 직무집행 관련법규 정비에 관한 연구

국민의 자유와 권리를 보호하고 사회공공의 안녕과 질서의 유지를 위한 경찰행정 작용은 엄격한 법치행정 원칙이 요구됨으로 법령집행 등의 직무를 충실히 수행하기 위해서는 필요한 조치를 규정해야 한다. 이는 군조직에서 실질적으로 범죄예방 및 수사 그리고 군장병들의 권익을 보호하는 중요한 임무를 수행하고 있는 헌병과인 군사법경찰관에게 적용되는 내용이다. 그러나 현재 군사법경찰관의 직무와 관련된 법규는 군사법업무와 관련된 규정을 명시하고 있는 「군사법원법」이 유일하며, 일반 경찰조직에서 가지고 있는「경찰관직무집행법」과 같은 직무규정이 제정되어 있지 못하고, 다른 법령의 인용이라는 막연한 상태 하에서 군사법경찰관의 직무수행에 대상이 되는 일반 군인들은 구체적이고 체계적인 법률도 없이 명령과 하위규정 등에 의해 신체의 자유를 침해받고 있어 심각하게 생각하지 않을 수 없다. 따라서 헌병이 범죄수사를 함에 있어 장병과 국민 모두가 수긍할 수 있도록 헌병의 직무에 대한 법적근거를 입법화하여 명확히 규정하는 것이 장병의 인권 보장과 군의 전투력 향상에 기여할 수 있을 것이다. 이 연구에서는 경찰조직의 경찰관직무집행법과 유사한 헌병의 직무집행을 위한 작용법의 근거를 마련하기 위한 필요성과 가칭 군사법경찰관직무집행법(안)을 제시하였다. The military law police, which is representative law enforcement agency under existing Military Court Law in the Republic of Korea, has more command and enforcement rights than other arms of service to maintain order, regulation and combat power force of the Army. The mission of the military police, however, has been conducted under presidential decrees which has insufficient grounds or statues framed by the delegation of authority. The objective of the paper would explore pressing concerns about rearrangement plan for「Act on the Performance of Duties by Military Law Police」and suggest the draft of the legislation within the cognizance of these vulnerability. Specific proposals of the draft would be amended underlying on current「Act on the Performance of Duties by Police Officers」. Both agencies of the military law police and the civilian police has same ultimate object: Crime Prevention. Direct application of the 「Act on the Performance of Duties by Police Officers」, however, could be risen certain issues because each organization exists for different targets: the people belong to the army and the citizen. Nevertheless, the author claims that 「Act on the Performance of Duties by Police Officers」should be formed the basis of rearrangement plan when the 「Act on the Performance of Duties by Military Law Police」is amended in the Assembly. Legal and institutional rearrangement would be urgent issue for proper performance of military police`s duties because they actively contribute to national security even though the military police fulfill their duties for different target to the police.
