주한미군 주둔과 한국경찰파견사는 그 시대를 함께 하고 있다. 사실 미군기지가 들어서 있는 지역의 주민들이나 미군기지에서 일하는 한국인 노동자 등 몇몇 부류를 빼면 대다수 한국인들에게 주한미군은 일상 삶에서 존재하는 실체다. 사실 세월이 상당히 많이 흘렀음에도 불구하고 주한 미군 문제 논의의 수준과 방향은 크게 나아지고 있지 않다. 반미론은 주한미군의 부정적인 측면만을 또 친미론은 주한미군의 긍정적인 측면만을 강조한 채 평행선만을 그어 오고 있다. 주한미군에 대한 논쟁속에 현상 유지론만 되풀이되어 왔다. 이에는 주한미군부대내 민원 소통창구인 한국경찰의 파견 여부 등 근본 문제에 대한 공론화 자체를 당국이 차단해 온 것도 사실이다. 그렇다면 주한미군내 한국경찰의 파견을 어떤 관점에서 새롭게 성찰해야 할 것인지에 대해 의문이 제기될 때가 되었다. 항간에 일간 신문지상에 한국경찰이 주한미군의 심부름꾼 역할을 하는 창구라고 하는 일방적이고 근거 없는 보도를 한 사실도 있고, 정기국회에서 까지 미군 부대내 한국경찰 존치 당위성 여부를 논했던 적이 있다. 한국경찰은 자국 땅에 주둔하는 미군부대내 자국민 인권과 미군범죄 발본색원, 외사공조 우위 확보를 위해 노력하고 있으며 각종 반미단체 불법 기습시위 등에 대비 하고 있다. 본 논문은 용산기지에 미군이 주둔한 이후 파견된 경찰의 역할과 현주소를 전달하고 이 분야의 후속 연구과제를 위한 기초자료를 제공하고자 작성되었다.

한국전쟁 시 한국경찰의 활동 분석

본 논문은 한국전쟁 시 한국경찰이 수행한 역할을 총력전 수행의 핵심적 요소로 거 론되는 삼위일체(Trinity)에 의하여 분석한 후, 현 시대에 부합되는 함의를 도출하기 위한 목적으로 작성하였다. 이를 위하여 총력전, 삼위일체에 관한 개념을 정리하여 소 개하고, 경찰의 기본적인 임무와 역할에 안보가 포함되어 있다는 사실을 제시하면서, 한국전쟁에서의 한국경찰의 활약을 분석하였다. 분석의 결과 한국전쟁에서 경찰은 정부·군대·국민의 삼위일체된 전쟁수행을 위한 촉매제로서 기능하였고, 국토를 수호하는 데 크게 기여하였다. 한국전쟁 시에 경찰은 국가의 공권력을 집행하고, 군대의 군사작전을 지원하며, 국민을 통제하는 역할을 적극 적으로 수행하였다. 경찰은 공권력이 미흡한 건국의 시기에 국가를 통합하고, 이념을 통일시키며, 창군의 시기에 적극적인 공비토벌작전에 나섰는데, 한국전쟁에서의 역할 도 그 연장선이었다고 평가하였다. 한국군의 역량 강화로 인하여 유사시 경찰의 군사적 역할이 줄어들었을 것으로 인식하지만, 핵무기의 사용이나 대규모 특수전 부대의 후방 침투를 고려할 때 이후의 전쟁에서도 경찰이 적극적인 군사적 임무를 수행해야할 가능 성은 낮지 않고, 따라서 경찰은 이러한 필요성에 대비해두어야 할 것이다. This paper is written to analyze the South Korean police’s role in the Korean War based on the theory of trinity, which was introduced by Carl von Clausewitz as a key condition for the victory of a total war. For this purpose, it introduces the concept of the total war and the trinity, explains the national security elements in the police’s basic mission and examines the history of the South Korean police especially during the Korean War in this regard. As a result, this paper found that South Korean police acted as a semi-military force even before the Korean War and that characteristic was applied during the entire Korean War. The South Korean police enforced the public law and the government’s authority, actively supported the military and controlled the South Korean people to win the war. This kind of South Korean police’s role ensured the trinity among the government, armed forces and people in the Korea War and contributed to the winning of the war. The police may not need to perform this kind of active role now due to the strong South Korean military. However, South Korean police should recognize and prepare for its similar role in the next war, especially because of possibility of the attack to the real area by weapons of mass destruction such as nuclear weapons.

한국 경찰협의회와 미국 경찰노조에 관한 비교

미국, 독일, 프랑스에서는 경찰의 노조가입이 허용되어 있고, 영국도 직장협의회가 있다. 2006년과 2007년 ILO에서도 소방, 교도관, 교육관련 기관 공공 서비스 노동자, 지자체 공공서비스 노동자 및 근로 감독관이 스스로의 선택에 따라 조직체를 결성하고 가입할 수 있도록 보장할 것을 한국 측에 권고한바 있다. 한국에서도 찬반론이 대립하는 가운데 한국에서는 경찰 노조 추진위를 결성하여 경찰노조를 설립하는 데 공식, 비공식인 노력을 해오고 있었다. 무궁화클럽과 폴네띠앙 등은 ‘경찰 노조 추진위’를 구성하여 경찰노조 설립을 추진해왔다. 하지만 정치권의 관심과 경찰조직내부의 여론만으로는 경찰노조나 경찰직장협의회에 대한 과도한 기대내지는 반감이 있을 수 있다. 이미 미국, 프랑스, 독일, 영국등에서 허용되어 운영 중인 경찰노조와 경찰 직장협의회는 공무원노조나 공무원 직장협의회와는 다를 수밖에 없다 . 이에 경찰노조가 전국적으로 활동하고 있는 미국의 경찰노조 활동의 분석을 통해 현재 한국에서 추진하고 있는 경찰 직장협의회의 향후 방향과 현재 활동상황을 재조명하고자 한다. In US, Germany and France, Police officers can make the Police Union for their working condition and right. There is the police Labor management in UK, so they can negotiate their working place problems. In 2006 and 2007, ILO recommended the Korea government that fire fighters, the educational public service, a prison officers could make union regardless of their job character. However, Korea Police Agency denied the Police union because of their special rank system and the obligation of police officers for the civilians. Korea Police Agency insists that police officers can protect their right without the police union. Low rank police officers have made the association, Polnetian and Mugungwha club, for the police union promote. There can be excessive expectation and antipathy for the police union and the police Labor management in the police system. The civil servant union is different from the police union because of the character of law enforcement, so this study will show the current situation of US police union and the analysis on Korea police labor management promote on the base of Korea Police Agency report for the police union. This comparition analysis between US police union and Korea police Labor management will introduce the new direction to the police system.

우리나라 경찰제도의 뿌리에 관한 고찰

본 연구는 우리나라의 경찰제도가 어떻게 변천되어 발전해 나왔는가를 심층적으로 짚어보고 오늘날의 현주소는 어디인가를 고찰해 보는데 연구의 목적을 두고 있다. 1894년 갑오개혁 때 경찰제도가 처음 도입되면서 포도청이 폐지되고 한성부에 경찰이 창설되어 우리나라 최초의 근대적 경찰개념이 도입되긴 하였으나, 한국에 식민지 개척에 도구로서 역할을 다하며 한국에 프랑스, 독일 등 대륙법계 경찰체제를 이식 시키게 되었다. 그러다가 1910년 6․24 한․일합방과 더불어 「한국경찰사수 위탁에 관한 각서」의 체결을 통해 한국의 경찰사무가 완전히 일본식으로 위탁되게 되었다. 일본 식민지 통치시대, 해방 후 미군정(1945~1948년)기를 거치면서 민주 경찰체제 도입, 1946년 5월 15일 여경창설, 경찰 경무부장으로 장관 승격, 경찰위원회임명, 대륙법계 경찰제도에서 영미법계 도입 등 눈부신 발전을 거듭하다가 1948년 대한민국 정부수립 이후 경찰기구는 내무부의 치안국으로 개편되었다. 그리고 한국전쟁(1950~1953년)을 계기로 기구와 인력을 개편․확대하여 좌․우익의 소용돌이 속에 구국, 호국경찰로서 역할을 다하다 이승만․박정희․전두환․노태우 김영삼․김대중․노무현 대통령을 거치면서 경찰제도가 발전하여 오는 동안 경찰의 수사권 확보, 지방분권화에 따른 자치경찰제도 도입 등 국민을 위한 새로운 제도를 생각하는 시점에서 고뇌하고 있다. Diese Arbeit beschaeft sich mit dem koreanischen Polizeisystem in Suedkorea. Besonders umfasst diese Abhandlung folgende Fragen: wie wurde koreanische Polizeisystem im historischen Rahmen entwickelt? Welche Probleme haben das koreanische Polizeisystem im Bereich der historischen Situation und eigenen Rolle? Wieso braucht man heute Local Police in Korea? Der Autor analysiert solche Reformmassnahmen in dieser Abhandlung durch Comparative Methode.

한국경찰사 연구를 통한 민족의식 고취 사례 분석

경찰은 건국 이후부터 현재까지 국가와 국민 안전을 위해 수많은 희생을 감내해 왔으 나, 그간 지속적인 한국경찰사 연구를 통한 경찰의 역할 모델을 만드는 작업은 매우 부족 했다. 이러한 점에서 경찰의 뿌리를 찾아 경찰의 자긍심을 드높일 수 있는 사례의 발굴을 통한 의식의 고취는 매우 중요한 일이다. 따라서 본 연구에서는 한국경찰사 중 민족의식 고취를 위한 경찰 사례 분석을 위해 시기를 임시정부․전쟁혼란․민주화운동․현대 등 4단계 로 나누고, 각 시기에 희생을 치르며 책임을 다한 대표적인 인물을 분석하였다. 연구결과, 먼저 임시정부 시기에 김구 선생은 초대 경무국장에 취임하여 경찰의 기틀 을 잡고 해방 이후 경찰이 나아가야 할 방향을 제시했으며, 나석주․유상근 의사 등 많은 독립운동가들은 경찰에 투신하여 민주경찰의 역사를 이루었다. 그리고 전쟁과 혼란의 시 기에 차일혁 경무관은 첨예한 이데올로기적 갈등에도 빨치산들을 따듯한 인류애로 대했 고, 수많은 국보급 보호하는 등 문화경찰의 모습을 보였다. 또한 최규식 경무관과 정종수 경사는 무장공비의 청와대 진격을 온몸으로 사수하며 책임구역을 희생으로 막아냈다. 나아가 민주화운동 시기에 안병하 치안감은 ‘시민들을 진압하라’는 상부의 부당한 지휘에 정당히 맞서다가 파면과 고문을 당하는 등 모진 고초를 겪었다. 또한 현대 시기에도 정옥 성․이기태․김창호․김선현 경감 및 유재국 경위 등은 자살기도자와 정신장애인 등 약자 구 조에 나섰다가 현장에서 의롭게 순직하였다. 한국경찰사 연구는 외부적으로는 경찰의 역사적 정통성 인식과 함께 경찰활동에 민주 성과 권위성을 부여한다는 측면에서, 내부적으로는 경찰 역사의 시작점에 자랑스러운 선 조가 있음을 알려 구성원의 자긍심을 고취하여 책임있는 경찰작용을 이끌어낸다는 데 큰 중요성이 있다고 하겠다. 따라서 한국 경찰의 역사를 기록하고 고증하는 것은 경찰의 미 래 역할에도 기여하는 바가 매우 크다고 할 것이다. The police have endured numerous sacrifices for the safety of the country and the people since the founding of the country until now, but the work of creating a role model for the police through continuous research on the Korean police history has been very insufficient. In this respect, it is very important to find the roots of the police and raise awareness by discovering cases that can raise the pride of the police. Therefore, in this study, in order to analyze the case of the police to raise national consciousness among Korean police history, the period was divided into four stages: the provisional government, war chaos, democratization movement, and modern times, and analyzed representative figures who fulfilled their responsibilities at each period. As a result of the study, first, during the provisional government period, Kim Koo took office as the first head of the Police Department and suggested the direction the police should go after liberation, and independence activists, such as Na Seok-ju and Yoo Sang-geun, committed to the police and made the history of the democratic police. In a time of war and chaos, Superintendent General Cha Il-hyuk treated the Partisans with warm human love despite the sharp ideological conflict, and showed the appearance of cultural police by protecting numerous national treasure-level cultural properties. In addition, Superintendent General Choi Gyu-sik and Assistant Inspector Jeong Jong-soo defended the armed Spies advance to the Blue House with all their bodies and blocked the area of r e sponsibility with sacrifice. Furthermore, during the period of the democratization movement, Ahn Byung-ha suffered severe hardships, such as being dismissed and tortured while justly confronting the unreasonable command of the upper part of ‘Suppress the citizens’. Also, even in the modern era, Senior Inspector Jeong Ok-seong, Lee Ki-tae, Kim Chang-ho, Kim Sun-hyun, and Inspector Yoo Jae-guk, etc., tried to rescue the weak, such as suicide attempters and mentally handicapped persons, and died righteously in the field. The study of the Korean police history externally recognizes the historical legitimacy of the police and gives democracy and authority to police activities. It can be said that it is of great importance to elicit a police action that exists. Therefore, it can be said that recording and proving the history of the Korean police contributes greatly to the future role of the police.

바람직한 한국적 자치경찰제도의 방향

본 논문에서는「자치경찰법안」에 대해 구체적으로 몇 가지 쟁점별 도입방향을 논하면서 한국적 자치경찰제의 방향을 제시하는데 목적을 두고 수행되었다. 첫째, 자치경찰제 모형과 관련해서는 한국적 현실을 감안할 때 경찰의 민주성과 합법성, 봉사성과 전문성 등을 동시에 지향할 수 있는 모델이 되어야 한다. 그것은 미국식의 순수 자치경찰제나, 대륙식 국가경찰제가 아니라, 그들 국가들도 오늘날에 와서는 혼합형태로 발전시키고 있듯이, 양자의 장점들을 극대화할 수 있는 모형이 한국적 미래의 자치경찰유형으로 바람직하다는 것이다. 왜 우리가 스페인식의 경찰제도를 도입해 가는 것은 그리 좋은 방법이 아닐 것이다.둘째, 자치경찰제 실시 단위와 관련해서는, 기본적으로 주민근접행정의 구현이라는 차원에서 기초자치단체의 경찰지방자치가 중요하다는 점을 전제하는 것은 바람직하다. 다만 전체 제도운영 차원에서 사무는 광역자치단체에 이양하면서 즉 지방경찰 사무의 소속을 관역으로 하면서 실제집행은 기초자치단체에서 이루어지는 형식이 발람직할 것이다. 국가경찰과는 별개로 기초단체에 존재하는 또 다른 조직으로는 제대로 된 경찰기능을 발휘하기 힘들 기 때문이다.셋째, 지방경찰의 관리형태는 정치적 간섭을 배제하고 민생치안을 위하여 위원회나 절충형의 합의제가 바람직하다고 하겠다. 위원회 형태가 될 경우 지방경찰위원회와 지방경찰청, 위원회와 지방의회간의 관계설정이 중요하다. 다섯째, 기능배분과 관련하여 이 법안이 의회를 통과하여 시행되게 된다면 시범 실시 후 단계별로 시행하는 것이 바람직하다고 하겠다. 즉 우선 특별사법업무부터 자치단체가 시행해보고, 그 효과나 능력이 입증되고 난 후 민생치안업무나 교통업무로 확장해 나가는 것이 바람직하다고 할 것이다. 자치경찰제도는 시민 또는 지역주민 중심으로 자치경찰제의 모든 사항들이 논의될 때 본질적으로 큰 무리 없이 도입에 성공할 수 있을 것으로 판단된다. 즉 관련 주체들이 배타적이고도 이기주의적인 주장들을 고집하지 않고, 그리고 자치경찰제를 시행하는 근본이유가 궁극적으로 주민안전을 위한 시민을 위하여 존재해야함을 인정하고 제도화를 고민한다면 한국적인 경찰지방자치의 성공적 도입정착이 보다 쉽게 가능할 것이다. The Presidential Committee of Government Innovation and Decentraliza tion held the state affairs task meeting on the Autonomous Police System and announced the outset of the autonomous police system focusing resident's life under Mr. Noh MooHyun's presidency on September 16th, 2004. Therefore, the main propulsion task of the decentralization special law gets secured by introducing the Autonomous police system and the connections between the local administration and the police administration are maintained.By offering a public security service that is suitable to its regional special character, the institutional foundation that strengthen the public security ability of whole nation is prepared, and in support of the enactment of legislation, the Autonomous police law proposition was previously announced on August 4th, 2005.Based on the outset of the basis of a Korean Autonomous Police System model, the autonomous police law proposition of previous announcement of legislation is analyzed. By enforcing this law proposition, potential drawbacks are deduced and outcome of the practicing enforcement model are prepared.

한국·영국·일본의 자치경찰제에 대한 비교연구와 정책적 함의

자치경찰제는 지방분권의 이념에 따라 지방자치단체에 경찰권을 부여하고 경찰의 설치, 유지, 운영에 대한 책임을 지방자치단체가 담당하는 제도이다. 자치경찰과 국가경찰은 담당 사무에 차이가 있으며, 자치경찰은 생활안전, 교통, 지역경비 임무, 기초질서위반 단속, 교통관리 등 주민밀착형 사무 및 민생치안 밀접수사를 담당한다. 한국은 2021년 7월 자치경찰제가 전면 시행되어 자치경찰위원회의 출범을 통해 다양한 민생치 안업무를 수행하고 있다. 그러나 자치경찰제에 대한 낮은 인지도와 예산 편성 권한이나 인사권의 제한, 자치경찰사무의 실효성 확보를 위한 제도적 미비점 등 해결되어야 할 문제점이 지적되고 있다. 따라서 이 연구는 우리나라의 자치경찰제 실시 이후의 운영 현황을 파악하고 영국과 일본의 자치경찰제를 비교 분석하여 현재 운영되고 있는 한국의 자치경찰제의 정책적 함의에 대해 논의 하였다. 영국과 일본의 자치경찰제 도입과 변천과정, 관리기구 등을 분석하고 한국의 자치경찰 제와 비교하였다. 이를 통해 우리나라 자치경찰제의 문제점 해결을 위한 전략적 방안을 제시하고자 했다.
