        조선시대 형법·형사소송법 연구성과의 검토와 활용

        본 연구에서는 조선시대의 형법 및 형사소송법에 관한 그간의 연구성과를 현대 형사법의 구분에 맞추어 정리하고 검토해 보았다. 법학적 개념 구분을 기준으로 한 것으로 그 이유는, 법제사가 법학과 사학의 방법론을 공유하는 만큼 사료를 바탕으로 한 분석을 법학적 개념의 프리즘에 투영시킬 경우 법학과 사학의 학제 간 융합적 분석이 더욱 활성화될 것을 기대할 수 있기 때문이다. 또한 법학적 개념 구분에 따를 경우 데이터베이스의 구축과 접근이 보다 체계적이고 용이하다고 할 수 있다. 형사법의 개념 자체가 범죄의 성립과 처벌에 대한 일관되면서도 포괄적인 설명을 위한 것이기 때문이다. 조선시대 형법 및 형사소송법의 연구성과를 데이터베이스로 구축할 때는 대법원 ‘종합법률정보’(glaw.scourt.go.kr) 시스템을 참고해 볼 수 있다. 대법원 ‘종합법률정보’ 시스템은 ‘통합검색’ 및 ‘판례’, ‘법령’, ‘문헌’ 등의 탭으로 구성되어 있는데, 이를 조선시대 형법 및 형사소송법의 연구성과에 적용해 보면 관련 조선시대의 사례와 대명률 및 국전의 조문, 그리고 관련 연구문헌을 동시에 검색하는 것이 가능해지기 때문에 기존의 법제사 데이터베이스와는 다른 차원의 접근을 제공한다고 할 수 있다. 이외에 이러한 시스템이 완성될 경우 연구자는 물론 일반인도 연구성과에 대한 접근과 활용이 보다 용이해질 것을 기대할 수 있다. In this study, the results of research on criminal law and criminal procedure law in the Joseon Dynasty were organized and reviewed in accordance with the modern theory of criminology. It is based on the classification of legal concepts because it can be expected that the interdisciplinary study between law and history will be more convergent when the analysis based on historical data is projected into a prism of legal concepts. Furthermore, the construction and access of the database will be more systematic and easy when the legal conceptual classification is followed. This is because the concept of criminology itself is for a consistent and comprehensive explanation of the establishment and punishment of crime. The Supreme Court's web service, "Comprehensive Legal Information" can be referred to when constructing a database of research results of the criminal law and criminal procedure law in the Joseon Dynasty. The system of the Supreme Court's web service consists of tabs such as "integrated search", "judgment", "legislation", and "literature", which provide a different level of access from the existing database. Thus applying the system would make it possible to simultaneously search criminal cases and criminal codes in the Joseon Dynasty with the related study literature. In addition, the completion of this sort of system would make it easier for the general public as well as researchers to access and utilize research performance.

        Verification of the 3D dose distribution in spinal radiosurgery by using a BANG3^®^ polymer gel dosimeter

        In intensity-modulated radiosurgery (IMRS) treatment, radiation delivery techniques require the ability to accurately verify complex three-dimensional (3D) dose distributions. This study was designed to evaluate and verify dosimetry generated from gels, films, and treatment planning systems. In this study, commercially available BANG3r polymer gel was used to confirm the accuracy of the treatment plan and to assess the dosimetric uncertainty of the radiosurgery procedure. BANG3r gels that are read with R2 magnetic resonance (MR) imaging mapping are useful options. The gel is a tissue equivalent, and the relaxation ratio measured using MR imaging is proportional to the dose absorbed in the gel. A cylindrical container (500 deep, 700 high) filled with BANG3r gel was mounted in a cubic phantom (The EASY CUBEr, Euromechanics, Schwarzenbruck, Germany). We then carried out the same process using the gel and gafchromic film as would be used for a patient with metastatic T-spine cancer by using a Novalis Radiosurgery system (Brain LAB Inc.,Germany). Our experimental results provided the dose distribution and the radiation delivery precision. Comparisons of the measured and the calculated relative dose distributions showed good agreement in the high-dose region with differences of 2 mm. BANG3r polymer gel dosimetry can be useful for the verification of clinical treatment radiosurgery plans.         Estimates of the Image Quality and the Radiation Dose for Head and Abdomen Phantom Image Acquisition by Using Dual-energy CT

        Using dual-energy computed tomography (CT) scans, we obtained images from a raw data set by using low- and high-energy scans (usually 80 and 140 kV, respectively). Generally, the head and the abdomen examinations were performed using single-energy (120 kV) scanning with a routine exposure protocol, and the images were used for diagnostic interpretation. The dual-energy CT scans can also be used for diagnosis by using the linearly-mixed method with low- and high-energy images. In the current study, we evaluated mixed images in dual-energy and single-energy scans for image quality and radiation dose. The CT scan protocol for single energy was adopted from IEC protocols, and the recommended dose from the EC. The dual-energy scan protocol was based on the Siemens dual-energy CT scan protocol. The CT scan protocols were extended further in the mA range for both scans to estimate the image quality corresponding to these dose alternations. The results demonstrate that the Contrast-to-noise ratio (CNR) value of a dual-energy mixed image is higher than that of a single-energy image in similar dose regions for both the head and the abdomen phantoms. We observed that the dual-energy images could reduce the dose compared to single-energy images. In the abdomen phantom study, the CNR of dual-energy images was even higher than that of single-energy images with half the radiation dose of the single-energy scan.

        배출권거래제 하에서 단일 제조업자-다소매업자의 공급사슬에서 다품목의 재고모형

        In pursuing carbon emission reduction efforts, companies have focused for the most part on reducing emissions due to the more efficient equipment and facilities. However they overlook a significant source of carbon emissions, one that is driven by operational policies. Currently companies are looking for solutions to reduce carbon emissions associated with their operations. Operational adjustments, such as modifications in order quantities could an effective way in reducing carbon emissions in the supply chain. Also, Cap-and-Trade mechanism is generally accepted as on of the most effective market-based mechanism to reduce carbon emissions. In this paper, we investigate a supply chain with single manufacturer and multiple retailers multi-product inventory model under the cap-and-trade system incorporating the carbon emissions caused by transportation and warehousing activities. Also, we provide an iterative solution algorithm and derive the common order interval and the number of intervals for each product. We show by numerical example that the inventory model incorporating cap & trade mechanism can reduce total cost and carbon emissions compared to the classical inventory model. Using the numerical examples, we also investigates different carbon price on the performance of the inventory model.

        The Case Study for the Legislation of Criminal Laws in the Early Joseon Dynasty

        In this paper, I discuss the legislation of criminal laws in the early Joseon dynasty through a case study. It was the homicide case between two brothers in 1478(the 9th year of King Seongjong’s reign). Despite the simplicity of the case, almost 40 higher officials in the royal court participated in the discussion of the case. The reason why the higher officials took the case seriously was that the older brother was a son by a concubine and the younger was a son by the legal wife. There was a deep and rigorous distinction between sons by the legal wife and sons by concubines in the Joseon dynasty. The higher officials thought that the social status order by birth legitimacy was not reflected adequately in The Great Ming Code, the basic criminal code in the Joseon dynasty. They reinterpreted the case from various perspectives in order to establish the firm social status order between sons by the legal wife and sons by concubines. Not only the number of higher officials participating in the discussion, but also the different legal opinions presented in the royal presence exemplify the process and the reasoning of making new criminal laws in the early Joseon dynasty.
