키워드 네트워크 분석을 통해 살펴본 최근 10년 법학연구 동향

최근 타 학문분야에서는 논문 연구의 지식생산구조와 그 특징을 분석하여 동향을 파악하는 다양한 시도가 이루어지고 있다. 계량서지학적 분석방법은 시간의 흐름에 따른문헌연구의 동향을 예측할 수 있게 하고, 네트워크 분석은 문헌 등에서 추출한 서지정보들 간의 관계를 분석하여 연구동향 분석을 가능하게 한다. 본 연구에서는 최근 10년법학분야 논문 데이터를 기반으로 기술통계 분석, 키워드 분석 및 네트워크 분석 기법을활용하여 법학분야 연구동향을 분석하였다. 위의 세 가지 방법에 따라 최근 10년 법학분야 논문을 분석해본 결과, 특징적인 이슈를 도출해 낼 수 있었다. 첫 번째, 기술통계 분석 결과에 의하면 법학분야 논문은 2004년부터 2009년까지 지속적으로 증가추세이며, 법학 관련 학술지 또한 이와 같은 추세를 보였다. 이는 2009년법학전문대학원(로스쿨)의 출범과 2012~2013년 로스쿨 인증평가가 주 원인으로, 전국각 대학은 로스쿨 인가를 받기위해 인가기준인 전임교원 연구성과와 연구지 발간 실적을 증대시켰을 것으로 분석된다. 성공적인 로스쿨 제도의 국내 정착을 위하여, 향후 로스쿨이 법조계에 미치는 영향, 출신 법조인들의 활동 현황 분석, 로스쿨 제도의 평가 및향후 전망 등의 연구가 지속적으로 필요할 것으로 예측된다. 두 번째, 최근 10년간 법학 논문의 서지사항에서 키워드를 추출하여 분석해 본 결과,총 81,892개의 단어 중 ‘저작권’ 단어가 가장 많이 사용되었고, 다음으로 ‘손해배상’, ‘표현의 자유’, ‘불법행위’ 등의 순으로 분석되었다. 이는 2006년 저작권법의 전부개정 이후로 저작권 분쟁이 증가함에 따라 법 관련 연구가 활발히 이루어진 것으로 보인다. 세 번째, 키워드를 기초로 한 네트워크 분석의 결과, 최근 들어서 ‘표현의 자유’ 및 ‘개인정보’가 키워드들 사이의 연결중심성이 높은 것으로 나타났다. 이는 말, 정신, 인격 등이 인터넷이라는 기술을 만나면서 새로운 법적 이슈가 되었음을 알 수 있었고, 향후 개인정보와 표현의 자유에 기초한 국민의 정신적 자유와 법의 충돌을 통해 정신적 자유의범위에 관한 연구가 활발하게 진행될 것으로 예상된다. 위 분석들을 통해 최근 10년의 법학연구 트렌드를 전반적으로 정리해 보면, ‘소비자 보호’, ‘채무불이행’ 단어 같은 실체가 있고(concrete) 가시적인(visible) 이슈에서, ‘표현의자유’, ‘인권’ 키워드와 같은 관념적(abstract)이면서 무형의(invisible) 것으로 변화하고있음을 알 수 있었다. 이러한 추세에 따라 향후 법학연구는 국민의 권리, 특히 정신적 자유에 관한 새로운 판례와 그에 따른 연구가 증가할 것으로 예측해 본다. Recently, a number of researches have been carried out in order to understand the research trends in academic disciplines by analyzing the structure of knowledge production and its characteristics. This study analyzes a research trend in the field of legal research using descriptive statistics data analysis as well as network analysis based on bibliometric data from Korea Citation Index during the past 10 years. As a result, we have put forward several remarkable findings as follows. First, according to descriptive statistics, both the research papers in the field of legal research and the legal journals show a steady increasing trend from 2004 to 2009. Possibly, most of this is attributable to the establishment of Korean law schools in 2009 and the 2012-2013 law school accreditation, and it might be worth performing the further research topics; the effect of law school on legal profession, analysis of activities for judicial officers from law school, and the evaluation and prospect of law school system for the successful settlement of law Second, as a result of analyzing the keywords extracted from bibliographic information of the articles in law, “copyright” has emerged most frequently, followed by “damages”, “freedom of expression”, and “illegal activities” among a total of 81,892 words. This seems to happen because the research on copyright act has been actively conducted with increase of copyright dispute since the revision of the Korean Copyright Act in 2006. Third, by the keyword network analysis, “freedom of expression” and “personal information” are found to be high in degree centrality between keywords over time. This explains new legal issues encountered by means of internet accessing with word, mind, personality and so on. Researches on the scope of freedom of expression is expected to be progressed actively in the future through the conflict between law and mental freedom of people based on personal information and freedom of expression. To sum up, this paper shows that the focus of legal research has been shifted from the issues on the concrete and the visible (e.g. consumer protection) to those on the abstract and the invisible (e.g. freedom of expression). Regarding these trends, we expect that investigations on personality and mental freedom based on the rights of the people will be increased in the field of legal studies.

实践性法学教育原理探究

본문은 중국 법학교육이 존재하는 문제점으로 출발하여 실천성(실무형) 법학교육의 원리를 검토하고 법학교육의 질을 향상시키는 필요한 전제는 실천성 법학교육을 강화하는 것이라고 지적하였다. 아울러 본문은 실천성 법학교육의 기본방법은 체험식 교육방식이고 실천성 법학교육의 유형에는 로클리닉과목, 모의과목 및 교외수습을 포함하며, 실천성 법학교육의 이론적 기초는 문제식 교육이념이라고 지적하였다. 이를 기초로 본문은 실천성 법학교육의 목표를 검토함으로써 실천성 법학교육의 목표는 학생들의 직업기능 및 가치관을 양성하는 것이라고 지적하였고 실천성 법학교육의 질을 향상할 데 관한 구체적인 구상을 제시하였다.

국제태권도사관학교의 설립·운영을 위한 법제도적 방안에 관한 연구

태권도에 관한 체계적인 교육과정을 통하여 세계 수준의 우수한 태권도 전문인력을 양성하기 위해 대학원대학으로서 국제태권도사관학교의 설립이 논의되고 있다. 대학원대학은 고등교육기관 중 학부 과정 없이 석사·박사 학위과정의 대학원 과정만 둔 대학교를 의미하며 특정 분야의 전문인력 양성을 목적으로 설립된다. 다만, 대학원대학의 설립 요건이나 기준이 일반대학에 비해 낮기 때문에 설립 이후 부실 운영의 문제가 제기되고 있으며, 특히 외국 유학생의 선발 및 관리기준의 미비를 비롯하여 학사·학위 운영, 교원 인사 등 대학운영 전반에 대한 위법 사항이 지속적으로 지적되고 있다. 국제태권도사관학교가 대학원대학의 형태로 설립되기 위해서는 「고등교육법」, 「대학설립·운영 규정」에 따른 설립 근거, 요건 및 기준 등과 관련 특별법 등 유사 입법례의 비교·분석을 통해 국제태권도사관학교의 설립 시 고려 사항들이 면밀히 검토되어야 한다. 국제태권도사관학교의 설치 시 그 설립 및 운영에 관한 사항은 문화체육관광부장관에게 위탁하는 것이 적절하며, 취업 및 해외 유학과 관련한 학생의 불이익 문제를 해소하기 위해 석사·박사학위과정이 설치되어야 한다. 재정지원과 관련해서는 「국가재정법」 제12조 및 출연금 지급에 관한 입법례를 고려했을 때 국제태권도사관학교의 설립·운영에 드는 경비를 정부의 출연금으로 충당할 수 있을 것이나, 이는 같은 법에서 정하고 있는 출연 사유를 고려하여 신중한 검토가 필요할 것이다. 또한 대학원대학은 「고등교육법」 및 같은 법 시행령에 따라 학칙을 제정할 수 있을 것이며, 대학원대학에서 부정 학위 수여, 교수의 부당 임용, 부실 수업 운영 등의 문제가 발생하고 있는 점을 고려할 때, 학사 및 학위 운영과정에 있어 철저한 점검과 관리 체계가 구축되어야 한다. 그 밖에 전임교원의 연구 여건을 마련하고 연구실적을 체계적으로 관리할 수 있는 시스템이 갖춰져야 하고, 행정직원의 업무역량 강화 등 인력의 전문성이 제고되어야 한다. 국제태권도사관학교의 설립을 위해 해결해야 할 과제들은 매우 다양한데, 특히 기존의 대학원대학이 안고 있는 문제점과 한계를 적시하여 이를 사전에 예방하는 것이 중요하다. The establishment of an International Taekwondo Academy is under discussion to cultivate globally competitive taekwondo professionals through a systematic curriculum. A graduate school university refers to an institution that offers only master's and doctoral degree programs without undergraduate courses and is established with the aim of fostering specialized professionals in specific fields. However, due to the lower requirements and standards for establishing graduate school universities compared to general universities, concerns have been raised about issues of poor management after establishment. In particular, issues such as insufficient standards for the selection and management of foreign exchange students, illegal practices in academic and degree operations, and faculty appointments in various aspects of university operations continue to be pointed out. In order for the International Taekwondo Academy to be established in the form of a graduate school university, a thorough review of the basis, requirements, and standards for establishment in accordance with the "Higher Education Act" and "University Establishment and Operation Regulations," as well as comparative analysis with similar special laws and legislative precedents, should be carefully considered. Delegating matters related to the establishment and operation of the International Taekwondo Academy to the Minister of Culture, Sports, and Tourism would be appropriate, and in order to resolve issues related to employment and overseas study, it is necessary to establish master's and doctoral degree programs. With regard to financial support, considering Article 12 of the "National Finance Act" and legislative examples related to government funding, it may be possible to cover the expenses for the establishment and operation of the International Taekwondo Academy with government contributions. However, this requires careful consideration in light of the reasons for contributions stipulated in the same law. Moreover, the graduate school university may establish regulations in accordance with the "Higher Education Act" and its enforcement decree. Given the occurrence of issues such as illegitimate degree conferral, improper faculty appointments, and inadequate course management in graduate school universities, a thorough inspection and management system should be established in the process of academic and degree operations. Furthermore, it is essential to provide research conditions for full-time faculty and establish a system for the systematic management of research achievements, as well as to enhance the professionalism of administrative staff through the reinforcement of their job capabilities. The establishment of the International Taekwondo Academy requires addressing a wide range of tasks, and it is particularly important to anticipate and prevent existing problems and limitations of the current graduate school universities in advance.
