        국제상사분쟁해결을 위한 조정제도 활용에 관한 고찰- 조정과 중재제도의 비교를 중심으로 -

        The Mediation as an alternative resolution system is highlighting on ICT global commerce with easy to access and effectiveness. Recently UNCITRAL model law on international commercial mediation has been amended in 2018 to encourage the use of mediation on adding and improving ensuring certainty for international settlement agreements and its enforcement. It is undeniable that the international commercial arbitration has been a significant effects for the international commercial resolutions to ensure the justice according to laws of arbitration. Arbitration has the quasi judicial characteristics. However, we also are expected to be cost, time and relationship on the commercial fields as well as the simple and settlement agreement of small or simple disputes with voluntarily amicable process in international commercial disputes. Mediation service for settlement of commercial disputes should be followed by the operation rules of law based on the improving value in accordance with the national and international supporting measures with laws and practices. It will be good conditions for making the international convention on settlement agreements resulting form mediation as a draft as finalized by the UN commission. In this paper it is consider the problems and alternatives on related applicable mediation system as an parties' own initiative resolution and recognize the commercial conditions of mediation for preparing the new changable commercial disputes world.

        베트남의 국제상사중재제도에 관한 고찰

        Vietnam has been attracting attention as a country that connects post China which is replacing the business environment. Vietnam could be expected to attract factors of various incentives for FDI due to China’s reorganization of alternative markets and changing the global supply chains due to reflective profits cause by national security and economic conflict between USA and China. Vietnam is a central ASEAN country which is located in economic hub connecting China and India, raising important status in international trade environment. Despite the global economic recession, the manufacturing and processing industry in Vietnam continues to expand, export and FDI, increase productivity, and develop the service industry. Commercial Arbitration Act in Vietnam was enacted only in 2010 could be meaningful as an institutional overhaul. However, it remains regrettable that it still does not include the standard recommended regulations of the international commercial arbitration system and the characteristics of universal arbitration sufficiently. nevertheless, it could be expected that Vietnam’s legislation is trying to release a favorable tendency for commercial arbitration. In the reality that Korea and Vietnam are increasing the quantitative scale of investment and trade transaction in disputes in proportion to the size of commercial disputes is expected. Currently, Korea and Vietnam are processing toward an comprehensive and strategic partnership agreement. Considering trade and economic relations between Korea and Vietnam, we should be able to develop and glow by trying to understanding on changes in Vietnam’s arbitration system and the regional study of political economy.

        침수 홍수사상의 강우자료를 활용한 설계강우 요소의 적정성 분석

        The purpose of this study is to analyze whether design rainfall and hyetograph, which are the main elements of design rainfall, can properly reflect the those of observed rainfalls through inundated rainfall events. The target areas were selected at seven large cities with high damages regarding to the flooding. Comparative analysis between probability and observed rainfall shows that 57% of the cases, in which rainfall amount through the IDF curve is estimated lower than the observed rainfall, do not properly reflect the observed rainfalls. In particular, this trend is exacerbated by the cases in low return period and the rain type of typhoon or frontal rain. The comparative results of rainfall intensity formula showed that the Talbot and Japanese formula were stable in the short- and long-term return periods, respectively. The comparison of hyetograph results also showed that the Mononobe method properly reflects the maximum rainfall intensity and the Huff method properly reflects the shape of rainfall pattern.

        MIMO 기술은 데이터 전송률을 증대시키고 수신 성능을 향상시킬 수 있는 다중 안테나 기술로써 각광받아왔다. 그러나 단말 크기의 제한으로 인하여 구현에 큰 어려움이 따르게 되었고 이를 해결하기 위해서 하나의 안테나를 갖고 있는 단말간 서로 협력(cooperation) 하여 데이터 전송률을 높이고 수신 성능을 향상시키기 위한 연구가 논의되고 있다. 특히 ad-hoc 이나 mesh 네트워크에서의 다중 홉 기술을 기반으로 단말간 서로 협력하여 채널 용량을 늘리고 수신 성능을 향상시키기 위한 다양한 연구가 진행 중이다. 본 고에서는 다중 홉 중계 기술에 대한 기본적인 개념과 협력 통신 기술, 그리고 IEEE 802.16j 표준화 동향에 대해 살펴본다. 이론적인 채널 용량 분석과 중계(relay)의 목적에 대해 알아보고 중계 기법에 따른 채널 용량을 분석한다. 더 나아가 다중 홉 중계 전송 기법의 성능을 분석하고 다중 홉 지원을 위한 표준화 동향 및 프레임 구조를 알아본다. 마지막으로 다이버시티 이득과 다중화 이득을 얻을 수 있는 협력통신 기술에 대해 살펴본다.

        This paper was constructed to investigate strange attractor in considering speech which is regarded as chaos in that the random signal appears in the deterministic raising system. This paper searches for the delay time from AR model power spectrum for constructing fit attractor for speech signal. As a result of applying Taken's embedding theory to the delay tiem, an exact correlation dimension solution is obtained. As a result of this consideration of speech, it is found that it has more speaker recognition characteristic parameter, an gains a large speaker discrimination recognition rate.

        한ㆍ중ㆍ일 해사중재제도에 관한 비교연구

        본 연구는 해양산업에서 분쟁해결을 위한 분쟁해결서비스로서 중재제도의 한 유형인 해사중재제도에 관하여 동북아시아 3국인 한국과 중국 그리고 일본의 해사중재법제에 관한 비교를 통하여 우리나라의 해사중재제도의 문제점과 발전방안을 고찰하고자 하는 연구이다. 작금의 우리나라는 세계경제의 침체에 따른 해양산업의 위기를 맞고 있는 실정이다. 해운업을 비롯하여 조선과 해양플랜트산업 그리고 전후방산업이 위축되는 모습을 지켜보고 있다. 그럼에도 우리나라는 지정학적으로나 경제적으로 해양산업의 중요성을 도외시할 수 없는 환경에 있기 때문에 해양산업의 성장과 발전을 위한 탐색이 요구된다. 이에 해양사업 분야에서 복잡하고 고도하게 발생하는 분쟁의 해결방법으로서 해사중재제도에 대한 잠재적 경쟁력 향상을 위하여 동북아시아 3국의 권역 내에서의 협력과 경쟁력 증대를 위한 해사중재의 협의체 구성과 활성화 방안에 대한 동북아 3국의 상호 협력적 논의를 기대한다. There are the main countries of Northeast Asia in the world trade and sea industries. Korea, China and Japan have the leading competitive powers of the ship building, sea transport and container port throughout the world. However, in the arbitration as the dispute resolution service in the maritime industries, three countries have not enough to their handling disputes and its confidence in maritime arbitration area compared with its volumes and cases of the LMAA in United Kingdom. Maritime arbitration offers the benefit of expertise and technical qualities that are especially important in the traditional practices and customs in the field of shipping industries and sea transport. According to the volumes and scales of maritime industries of 3 main countries in Northeast Asia, they should promote to the maritime arbitration and provide the confidential and creditable maritime arbitration service throughout the shipping disputes. It need to be considered how to expand maritime dispute resolution service in the Asia-Pacific economic stage. China has the independent maritime arbitration institute, which was established in 1959, CMAC began comparatively late compared with European countries. there still exist defects which are not matched with the world arbitration trend, such as the requirement of the selecting the arbitration institute in the case of arbitration agreement. TOMAC of the Japan Shipping Exchange is the leading and independent maritime arbitration committee, which was founded in 1926. TOMAC has been the historical experience of maritime arbitration in several decades. Even though, TOMAC has the lack of the power and handled only a few maritime disputes because of the traditional characteristics and practices of the maritime industries. Recently, there are discussing the meet the need to establish specializing independent institute for maritime arbitration in Korea. The KCAB has not enough to providing the maritime dispute resolution service in maritime arbitration that is because of the weak experience and uncovered specializing requirements of speed and economic needs with experts and specializing arbitration body in the maritime disputes. In this article, it suggest and more desirable for corporation and communication within 3 countries geographically and economic relationally in the area of dispute resolution service for increasing the potential power and development of maritime arbitration in Northeast Asia.

      • 垂直과 水平平板이 結合된 直角모서리에서의 自然對流

        A Study has been conducted experimentally on natural convection heat transfer charact-eristics for various Rayleigh numbers at vertical and horizontal plates with the rectangular corner. The results are as follows: 1) While temperature field is formed by the interaction of the heated fluid between verti-cal and horizontal plate, thermal boundary layer is pulled to the vertical plate near co-rner. 2) In case of constant Rayleigh number, the mean Nusselt number of the vertical plate is 28.8% more than that of the horizontal plate at ??. 3) Local Nusselt number increases at the trailing edge of the vertical plate and the lea-ding edge of the horizontal plate but decreases at the corner combined in vertical and horizontal plates. 4) In the vertical plate, the mean Nusselt number has a similar tendancy, but has 38.5% less than by the results of Schmidt and Beckman's study at ??. 5) In the horizontal plate, the mean Nusselt number has a similar tendancy, but has 38.4%iess than by the results of Rotem and Classen's study at ??.
