Notary Act in 2009 accepted the electronic notary system and the amendment has been in full effect since Aug. 7, 2010, however, the electronic notary has not been popular in practice. This article deals with the current status of electronic notary. Notary under the electronic system is not entirely carried out in virtual space. As a regard, first, possibility of partial waiver to require applicant’s presence before a notary public in electronic notary and second, solution to adopt electronic notary to other area such as granting fixed date(officially-stamped date) will be discussed.

정보기기 및 통신수단의 급속한 발전 및 보급에 따라 매매계약의 청약, 승인의 의사표시 등 거래에 관한 정보를 전자적으로 교환하는 전자거래나 공적기관 등에 대한 청약이나 신고를 전자적으로 행하는 전자청약과 전자승인이 이미 실시되고 있고 앞으로 더욱 활발히 실시될 전망이다. 인터넷은 통신당사자가 1대1의 통신경로가 확보되지 않은 오픈네트워크이기 때문에, 오픈네트워크를 이용한 거래 환경에 있어서는 보안확보가 중요하고 송신하는 데이터의 비밀유지 문제 이외에 제3자에 의한 정보의 변조를 방지하고 상대방을 확인하는 일이 안전한 전자거래를 위한 중요한 과제가 되고 있다. 인터넷을 통한 무역거래를 안정적으로 발전시키기 위해서는 첫째, 전자인증ㆍ공증, 기업의 신용등급장치 등의 법ㆍ실무적 장치, 둘째, 분쟁발생에 대비하기 위한 법ㆍ제도 장치, 셋째, 네트워크 및 거래감시제도, 인정제도 등의 환경구축이 필요할 것이다. 따라서 본 연구는 전자무역 기반 하에서의 전자인증절차 및 국내외 서비스 현황을 분석함으로써 전자인증제도의 문제점을 도출하고, 전자무역을 활용하고 있는 기업 및 공공기관에 대해 전반적인 고려사항을 제시하고자 한다. Though rapidly growth and spreads of information and communication media, digital business systems to electronically exchange information about transactions subscriptions of sales contracts and declarations of intention for approval, and digital subscription and approval to electronically perform subscriptions and reports to public institutions have put in effort and would be more actively. Because of internet which is open network not to ensure communicative ways by a person and a person for communicating people, ensuring securityis very important in the transaction environmentusing open network, and it has become to be an important subjectfor safe transactions that prevent falsifying in?formation by others and to make sure the other party expect on a matter to maintain secrets of transmitted data. To stably develop trade businesses through internet, it must be needed they are, first of all, legal and practical devices such as electronic authentication, digital notary and credit rating devices for enterprises, second of all, legal and institutional devices to prepare happening troubles, and finally building environments such as watching and recognizing systems for network and transactions. Therefore, this research is to derive problems of the digital notary system and to show the whole points to be considered for enterprises and public institutions using digital trades by analyzing digital notary process and the present status of internal and external services under the basis of electronic trades.

본 논문은 보안적으로 안전하며, 타임스탬프 관련 국제 표준 규격을 만족하며, 사용자 접근성이 높은 웹 기반 시스템 형태를 갖는 전자 공증 시스템(digital notary system)을 개발하였다. 타임스탬프 관련 기술 및 응용 시스템들은 아직 대중화되어 있지 않지만 전자상거래, 디지털 저작권 관리, 인터넷 메일 등의 다양한 분야에서 잠재적으로 매우 중요한 의미를 갖는다. 개발된 전자 공증 시스템은 rfc3l6l을 준수하는 타임스탬프 요청(timestamp request) 및 타임스탬프 응답(timestamp response}을 사용한다. 또한 서버와 클라이언트 통신에 SSL(Secure Socket Layer)을 사용하여 통신 보안을 보장하며, 재사용 공격 (replay attack)을 방지하기 위하여 논스(nonce)를 사용한다. This paper developed a secure web-based digital notary system. The system conforms to international standards, and gives users very good accessibility to it. The technologies and the application systems for timestamprelated services are not yet popularized, but they are potentially meaningful to many kinds of areas such as ecommerces, digital right managements, and internet mail systems. The digital notary system uses the timestamp requests and responses which conforms to rfc 3161. The system supports secure communication between web-based notary server and its clients by using SSL(Secure Socket Layer), and use nonces for prevention of replay attacks.

인터넷을 통한 루머나 악성 댓글이 사회적인 문제로 대두되고 있다. 이를 고발하기 위하여 해당 웹 게시물을 캡처한 이미지나 출력물이 증거로 활용될 수 있으나, 이는 포토샵 등의 도구를 이용한 위·변조에 취약하다. 악의적인 목적으로 타인이 작성한 정상적인 글을 캡처한 화면에 비방하는 내용이 포함되도록 위조한다면 무고한 자가 처벌을 받게 될 수도 있다. 이처럼 웹 게시물의 캡처 화면은 정확한 사실 관계를 반영하기에는 증거로서의 진정성과 무결성에 흠결이 있다. 웹 게시물의 증거화를 위한 인증 시스템이 제공되면 진정성이 입증된 증거의 제시가 가능하고 효율적인 수사에도 도움이 되므로 관련 기술과 정책의 빠른 정착이 요구된다. 이에 본 논문에서는 웹 게시물 증거화의 중요성을 역설하고, 웹 게시물 공증 시스템에 요구되는 법률적, 기술적 요구 사항 및 설계 방안을 제안한다. Rumor or abusive web postings in internet has become a social issue. Web postings may be proposed on evidence in form of a screenshot in libel suit, but a screenshot can be easily modified by computer programs. A person can make ill use of the screenshot which is modified deliberately original contents to opposite meaning in a lawsuit. That makes an innocent person to be punished because it can have difficulties to verify despite analyzing the server data. A screenshot of web postings is likely to fail to prove its authenticity and it is not able to reflect the fact. If notarization for web postings is offered, clear and convincing evidence can be submitted in a court. So, related techniques and policies should be established. In this paper, we propose some technical and legal conditions and design for notarization and archive system of web postings for litigation.

전자문서 이용확산을 위한 공인 전자문서보관소의 도입 필요성과 입법내용

There are increasing needs for an individual or enterprise to interchange documents electronically through communication network to enhance the efficiency of business, owing to rapid process of transactions. But e-commerce encounters the problems regarding the handling the electronic documents, that is to say, deposit and proof of the electronic documents. This paper deals with Authorized Electronic Data Depot as an integrated system for processing, relaying and proving documents that. Authorized Electronic Data Depot operates as e-enabler in exchanging documents in trust among administrative agencies and a comprehensive government directory, digital government seal certification system and DNS system. Authorized Electronic Data Depot leads public and private sectors to save the paper-related costs. But the regulations concerning an authorized electronic data depot is introduced in the course of revision of Electronic Transactions Act. The purpose of this paper is to suggest some guidelines in legalizing the authorized electronic data depot.
