일반국도 도로포장공사에 성능보증계약제도 도입을 위한 기초 연구

해외에서는 1960년이후부터 유럽에서 성능보증제도가 운영되기 시작하였다. 도로 및 교량공사에 관하 여 최대 5년의 성능보증제도를 도입하는 방안이 적용되었으며, 1990년대 이후 미국 교통국에서도 성능보증제도를 도입하여 운영하기 시작을 하였으며, 미국내에서는 미시간주에서는 성능보증제도 운영이 가장 활발하게 진행되고 있다. 도로포장 성능보증계약제도(Performance Warranty Contract)는 공사 대상에 대하여 준공이후 일정기간동안 성능기준 이상으로 유지를 시공사에서 진행을 하고 성능보증제도 기간 이 후에 발주청에 유지관리 책임을 이관하는 계약제도이다. 성능보증계약제도는 도로포장을 하는 시공사가 재료, 배합설계, 품질관리 계획, 공법 등을 자율적으로 선택 할 수 있는 자율권을 보장해 준다. 하지만, 도로포장이 시공사에서 관리하는 기간중에 조기파손 또는 긴급보수가 필요한 경우에는 시공사에서 유지 관리비용을 부담하여 보수를 해야 한다. 이처럼, 시공사가 공사관리 및 품질관리를 미흡하게 할 경우, 본인 부담으로 보수해야 한다는 리스크가 계약 상대자인 시공사에게 부담이 된다. 유럽과 미국에서 운영되고 있는 성능보증제도 운영의 장점으로는 시공사에서 자체적으로 시공시 품질 관리 및 장비개선을 통하여 시공 품질 개선을 위하여 공용수명 증가와 함께 유지관리비 절감 효과가 널리 보고되고 있다. 이러한 성능보증계약제도가 국내에 도입이 된다면, 시공사 자체의 기술개발을 유도함으로써, 업체들의 기술력 향상을 통하여, 해외 건설시장에서의 국제 경쟁력을 확보 할 수 있을 것으로 판단된다. 또한, 시공사의 기술 및 품질관리 철저를 통하여 유지관리비용의 절감과 발주처에서 부담하였던 유지 관리 등에 대한 비용 절감을 통하여 국가 예산 효율성을 극대화 할 수 있을 것으로 판단된다. 성능보증계약제도 도입으로 인하여 다양한 효과가 기대됨으로써, 본 연구에서는 국내일반국도 포장공사에 성능보증 계약제도 도입을 위한 시범사업을 준비하고 있다. 성능보증계약제도를 수행하기 위해서는 우선적으로 현 행 2년의 하자보수기간을 5~7년으로 연장에 필요한 하자보수보증증권이 필요하다. 또한, 기존 2년의 하 자보수기간뒤에 발생될 도로파손 위험을 알아보기 위하여 공용년수별 조기파손현황을 조사하였다. 아래 그림과 같이 공용년수 4년차에서부터 파손연장이 증가함을 나타내고 있다. 이 경향을 바탕으로 리스트 분석을 현재 연구중에 있으며, 향후 분석결과를 제시하고자 한다.

공공건설공사 성능보증계약제도 적용방안에 관한 기초 연구

According to introduction of the construction market's opening and new technical development, the construction market has gradually become complexity, variety and specialization, and then owner's requirements about quality has become higher.The objectives of this study is to suggest the introduction plans of performance warranty contracting that has benefits such as improvement of the quality awareness and responsibility of construction companies as well as extension of product life, reduction of life cycle cost and motivation of contractor's innovative technology development. The methods of this study suggested the fundamental direction and a phase stage in of the construction activity to introduce performance warranty contracting through foreign literature research, and then brought up improvement direction of general conditions of contract which suitable for domestic construction industry environment through interview to the professional.

도로포장 성능보증(Warranty) 계약제도 도입방안에 관한 기초연구

도로포장분야의 성능보증(warranty)계약제도는 유럽, 미국, 일본에서 오랫동안 시행되어 왔거나 시행되기 시작한 제도로서 그 효과가 입증되었거나 입증되고 있다. 본 연구에서는 유럽, 미국, 일본의 성능보증계약제도의 도입 및 운영 현황을 조사하였고, 성능보증계약제도의 장단점과 국내 적용가능성 분석을 통해 성능보증계약제도의 국내 도입방안을 제시하였다. 본 연구의 주요 결론으로 성능보증계약제도를 국내에 적용하기 위한 성능기준 개발의 필요성과, 보증보험 수수료 및 보증기간 등을 고려한 적정공사비 산정방안 마련, 국내에 적합한 성능보증방식 개발 등의 필요성을 제시하였고, 국내에 성능보증계약 제도의 도입을 위한 장단기적 적용방안을 제시하였다. Warranty contracting for pavements construction has been widely used in Europeans countries, Japan, and the U.S. and the benefits of warranty contract has been proven. This research investigated the European, U.S., and Japanese warranty contract policies and compared pros and cons. The most appropriate warranty contract policy solution is developed to fit in the Korean construction industry culture. Three main conclusions have been developed in this study: (1) performance specifications should be developed; (2) the systematic method is required to estimate the appropriate costs of performance bond and warranty period, etc.; and (3) short and long term plans for adopting performance warranty contract in Korea are suggested.

Warranty contracting has been widely used in European Countries from decades ago whereas its effectiveness is being verified in the us at present. In Korea, as the concept is still in its infancy, a research into how to adapt the concept in the Korea construction environment to lift up the overall competitiveness of Korea construction industry is needed. In this regards, this study extensively conducts literature review centered on the EU countries and the us experience, on the basis of which a direction to introduce the warranty contracting in the area of pavement construction in Korea reducing the negative impacts on the market is illustrated. It is suggested that the development of performance-related specification (PRS) and QC/QA specification are a priori of introducing long-term warranty contracting as they provide an environment where the knowledge on pavement performance can be accumulated leading into the technology improvement of construction company.

As the technology of construction industry has improved and the quality requirements of owner and user has increased, the construction industry has concentrated efforts on improvement of product quality. In this sense, the agency in Europe, U.S. and Japan has recognized that the quality is the most important criterion and established performance-based construction environment. This paper suggests introduction of performance warranty contracting to improve product quality and technical competitiveness using in highway construction of Europe and U.S. Performance warranty, a type of performance-based contracts, is the contract that contractor assumes the responsibility for maintaining actual performance of product to meet threshold values of pavement distress indicator during warranty period. It is important that the contractor has the right to decide the selection of materials and mix design. In other words, the contractor has more responsibility for quality of product in lieu of freedom for design. It is expected that performance warranty would be possible to bring on integrity of product. This paper presents plan for establishing performance warranty suitable for domestic environment of construction industry.

Recently, the Ministry of Finance and the Economy of Korea launched two new project delivery system that is Best Value Contract(Design-Bid-Build) and Bridging Contract(Design-Build), by revising enforcement ordinances of Act on Contracts to which the State is a Party to provoke the tendering system. In order to solve the problem such as stated above, advanced constructions in United Kingdom, Japan and United States have introduced warranty contract which is warranted to quality and performance for need of owner in determined term to ensure the quality of construction since 1960s. The purpose of this study is to suggest directions of the Performance Warranty Contracting in order to solve the problem such as stated above.
