兒童虐待に對する民事法的對應 - 兒童虐待犯罪處罰に關する特例法を中心に -

우리나라의 공적인 학대 피해아동 보호체계가 마련된 지 십여 년이 지났음에도 그간의 법?제고의 보안 노력은 매우 미흡하였으며, 법·제도의 미비는 많은 아동들을 학대 속에 방치하는 결과를 초래하였다는 점에서 적극적인 개선 노력이 요망되어 왔다. 현행 한국의 아동학대와 관련한 법·제도의 가장 큰 문제점으로는 피해아동 보호조치가 긴급하게 행해지고 있지 못하고, 보호 조치가 학대행위자의 친권과 충돌하는 문제가 법률적으로 해결되지 못하고 있다는 점을 들 수 있다. 이러한 문제를 해결하기 위하여 2014년 1월 28일 아동학대범죄의 처벌 등에 관한 특례법이 제정되었다. 특례법은 아동학대범죄의 처벌 및 그 절차에 관한 특례와 피해아동에 대한 보호절차 및 아동학대행위 자에 대한 보호처분을 규정함으로써 아동이 건강한 사회 구성원으로 성장하도록 함을 목적으로 한다. 특례법의 가장 큰 특징은 기존의 행정처분이 아닌 사법체계(법원) 내에서 신속한 판결을 통해 피해아동 보호에 만전을 기하고 있다는 점이다. 한편, 이와 별개로 부모의 부당한 친권행사로부터 아동을 보호하기 위하여, 2년 이내 시간 동안 친권을 ``정지``하거나 구체적 사안에 대하여 친권을 일부 ``제한``하는 것을 주된 내용으로 하는 「민법」 일부 개정법률안이 법무부 주도로 마련되어 조만간 국회에 제출될 예정이다. 위와 같은 법제도적 개선이 설효를 거두기 위해서는 근본적으로 우리 사회 에 여전히 잔존하는 가부장적 의식("내 子女는 내 마음대로 할 수 있다")과 고정관념("법은 가정 내에 들어가지 않는다")이 반드시 타파되어야 한다. 친 권은 자녀의 복리를 위하여 부모에게 인정되는 의무권에 다름 아니며, 가정은 법이 개입할 수 없는 성역이 결코 아니라는 인식이 사회 저변에 강고하게 뿌리내리기를 바라는 바이다. The biggest problem with the current law related to child abuse in Korea is that the protective measure of victim children is not enforced urgently and the confliction between the protective measure and the parental authority is not solved legally. То solve the problem, the Special Act оn the Punishment оn Child Abuse Crimes was legislated оn Jаnuаrу 28, 2014. This Special Act will be enforced оn September 29, 2014. The рurроsе of this special act is to stipulate the special provisions for the punishment and procedures for child abuse crimes, the protection procedures for victim children, and the protection provision for child abusers so that children саn grow as members of а wholesome society. The special act is fully enforced to protect victim children through the rapid judical decision in the judicial system. Оn the other hand, to protect children from the nnргорег exercise of parental authority, а revision of the related civil law to limit part of parental authority about certain matters ог to suspend the parental authority for up to two years is soon to be submitted to the national assembly. То make the revision of the legal system effective, the family head`s consciousness, "I саn do оn my own for my children" and the conventional соnсерt, "the law does not work in the family", that аге still remaining, should be broken. The recognition that the parental authority is the duty given to the parents for the sake of children`s welfare and that the family is not а sanctuary that cannot be penetrated by law should be deeply rooted in реорle`s minds and the society.

Noncontact Sleep Study Based on an Ensemble of Deep Neural Network and Random Forests

<P>Sleep quality, which is an undervalued health issue that affects well-being and daily lives, is checked through the polysomnography (PSG), considered as the gold standard for determining sleep stages. Due to the obtrusiveness of its sensor attachments, recent sleep stage classification algorithms using noninvasive sensors have been developed and commercialized. However, the newly developed devices and algorithms used in the previous studies have lacked the detection of non-rapid eye movement and rapid eye movement sleep, which are known to be correlated with the development of sleep disorders, cardiovascular disease, metabolic disease, and neurodegeneration. We devise a novel approach to employ ensemble of deep neural network and random forest for the performance of noncontact sleep stage classification. Notably, this paper is designed based on the PSG data of sleep-disordered patients, which were received and certified by professionals at Hanyang University Hospital. The efficiency of the proposed algorithm is highlighted by contrasting sleep stage classification performance with previously proposed methods and a commercialized sleep monitoring device called ResMed S+. The proposed algorithm was assessed with random patients following gold-standard measurement schemes (PSG examination), and results show a promising novel approach for determining sleep stages in an economical and unobtrusive manner.</P>

Association of ${\beta}$-Lactoglobulin Variants with Milk Yield and Composition in Dairy Cattle

Major milk proteins have considerable variane which comes from substitution and deletions in their amino arid sequences. Variants in genes that code for milk proteins, such as ${\beta}$-lactoglobulin (${\beta}-LG$) have been established as genetic markers for milk production and milk protein composition in dairy cattle. The effect of ${\beta}-LG$ variant on milk production traits, such as milk yield. fat yield, protein yield, fat percentage and protein percentage, was estimated for 482 Holstein cows in the first lactation. The ${\beta}-LG$ variants were determined by PCR-RFLP technique at the DNA level. Single trait linear model was used for the statistical analysis of the data. Results of this study indicated that ${\beta}-LG$ variants affected significantly protein yield (p<0.05) and fat percentage (p<0.05). Animals with the AA variant produced 31kg of milk protein more than animals with the BB variant. On the contrary, cows with the BB variant had fat percentage higher by 0.35 and 0.32% compared with cows with the AA and AB variants, respectively. No associations between the ${\beta}-LG$ variants and milk yield, protein percentage and fat yield were found Therefore, milk production traits could be improved through ${\beta}-LG$ typing by increasing the frequency of A variant for protein yield or the frequency of B variant for fat content in Holstein dairy cattle population.

Media Selectivity and U.S. Humanitarian Intervention: Reflection on the 1991 Crises in Iraq

This study examines a selective policy-forcing role of media on U.S. foreign policymaking and presents how the interaction among media coverage, media framing and policy certainty provided a permissive condition for the United States to selectively undertake humanitarian intervention. It focuses on two humanitarian crises that occurred in northern and southern Iraq after the Persian Gulf War in 1991 and investigates how disproportionate media coverage and empathy media framing, combined with the policy uncertainty over the Iraqi crises drove the United States to implement selective humanitarian intervention in northern Iraq. Meanwhile, the southern crisis was left untended, which ultimately degenerated into an orphan conflict that remained protracted for years without any international recognition of the suffering of millions. This result implies that in the absence of the policy certainty of the United States, the policy-forcing role of the media becomes far more compelling in making a crisis visible to the public and prioritizing it over policymaking.
