Impasse or Gateway to Innovation? Legal Reflections on Public-Private Partnership in Germany

Since mid-2017, Germany has been holding the dubious record of being probably the first country to make Public-Private Partnership (PPP) a constitutional notion. At the same time, the long-standing controversy on the meaning and scope of PPP as well as on its usefulness, especially in highway construction and maintenance, has not come to an end. As will be shown in this article, the amendment of Article 90 of the Basic Law, dealing with federal highways, their construction and administration, opens a door to PPP but by no means very wide, considering the territorial and functional limits imposed by the provision. Moreover, the constitutional amendment was overshadowed by the impending failure of what until then had been considered a showcase PPP project: the Bremen-Hamburg strand of the A 1 Motorway, whose private concessionaire declared that due to shortcomings of the underlying contract model, it was close to facing bankruptcy. At the same time, the Federal Court of Auditors has repeatedly opposed PPP as uneconomic, an assertion that is refuted by its proponents. While at first glance, Article 90 (2) of the Basic Law seems to accommodate the objections, it also involves a constitutional recognition of the concept and underpins its inherent lawfulness. The forthcoming entrustment of a private infrastructure company in public ownership of the planning, construction and administration of all federal motorways will probably alter the nature of PPP where it is applied, insofar as the private entrepreneur will henceforth cooperate not with a public law entity but a body that is, like himself, governed by private law. If the European Court of Justice will allow Germany to extend, as envisaged, its tolling legislation, now confined to heavy vehicles, to all automobiles, the influx of toll revenues, which may be used to compensate the private partner, could provide PPP new momentum. What remains objectionable in the constitutional amendment is that the use of PPP as a term does not seem to reflect a specific understanding of that highly disputed concept, nor does it lay the ground for it; it thus raises expectations that can only be belied.
A Study on the Confidence Region of the Stationary Point in a second Order Response Surface

When a response surface by a seconde order polynomial regression model, the stationary point is obtained by solving simultaneous linear equations. But the point is a function of random variables. We can find a confidence region for this point as Box and Hunter provided. However, the confidence region is often too large to be useful for the experiments, and it is necessary to augment additional design points in order to obtain a satisfactory confidence region for the stationary point. In this note, the author suggests a method how to augment design points "eficiently", and shows the change of the confidence region of the estimated stationary point in a response surface.e surface.

Optimal stopping problem without recall from a multivariate distribution is solved by using the concept of an equilibrium point which was introduced by J. Nash. The solution is derived for the two cases: 1. The case where the observation cost C is positive and the given upper bound K on the number of observations is infinite. 2. The case where the observation cost C is zero and the given upper bound K on the number of observations is finite.

독일은 2017년 중반 이후 민관협력(PPP)을 헌법적 개념으로 도입한 최초의 국가라는 불확실한 기록을 보유해 왔다. 그와 동시에, 특히 고속도로 건설과 유지관리에 있어 민관협력의 유용성뿐만 아니라 그 의미와 범위에 대한 오랜 논란은 아직도 끝나지 않았다. 본 논문에서 밝히는 바와 같이, 연방고속도로와 그 건설 및 관리를 다루는 독일 기본법 제90조의 개정으로 민관협력의 길이 열렸으나 해당 조항이 갖는 지리적, 기능적 제약을 고려할 때 허용된 민관협력의 범위가 그다지 넓지는 않다. 게다가 당시 민관협력사업이 어떤 것인지 선보이기 위한 것으로 여겨졌던 A1도로의 브레멘-함부르크 구간의 실패가 임박하자 헌법의 개정에 그늘이 드리워졌다. 해당 구간의 민간 영업권 보유자가 기본 계약모델의 단점으로 인해 파산지경에 이르렀음을 선언하고 나섰고, 연방감사원(Federal Court of Auditors)은 민관협력의 비경제성을 들어 계속해서 이에 반대해 왔으며, 민관협력의 지지자들은 이를 부인해 왔다. 일견 기본법 제90조(2)항은 민관협력을 반대하는 주장을 수용하는 것으로 보이지만 이 조항은 민관협력의 개념을 헌법적으로 인정하고, 민관협력의 합법성을 뒷받침하고 있다. 곧 모든 연방 도로의 계획, 시공, 관리에 대한 공적 소유를 민간인프라기업에게 위임하게 되면, 향후 민간사업가가 공법인이 아닌 본인과 마찬가지로 민법의 적용을 받는 법인과 협력하는 측면에서는 민관협력의 성격이 바뀔 수 있다. 독일이 계획대로 현재 중차량에 한정된 통행료법 적용 범위를 모든 차량으로 확대하는 것을 유럽재판소(European Court of Justice)가 허용한다면 통행료 매출의 유입으로 민간협력자에게 보상이 이루어질 수 있어 민관협력이 새로운 전기를 맞이할 수 있다. 헌법 개정에서 여전히 이의를 제기할 만한 부분은, 민관협력이라는 용어의 사용에 논란의 여지가 많은 개념에 대한 구체적 이해가 반영된 것으로 보이지 않고 또한 이 개념을 정립시키고 있지도 않은바, 이에 대한 기대를 저버릴 수밖에 없다는 점이다.
