1215년 6월 15일 잉글랜드 템스강 유역의 러니미드라는 초원에서는 영국 왕 존과 반란을 일으켰던 귀족들(barons) 사이에 63개 조항의 규약을 정하고 왕이 이를 의리로써 지킬 것을 맹세하는 의식이 이루어졌다. 이 때 서명된 라틴어로 쓰여진 문서가 세계사에서 가장 중요한 문서 중의 하나인 마그나 카르타(Magna Carta, 영어로는 The great Charter of Freedoms)이다. 마그나 카르타는 법의 지배(rule of law)를 천명한 최초의 문서라는 점에서 중요한 의미를 가지며, 특히 39조는 배심재판과 영장주의 등 법의 적정절차(due process of law)의 근거조항으로, 12조 및 14조는 의회주의와 조세법률주의의 원천조항으로 주장되어 왔다. 마그나 카르타는 권리청원(1628), 권리장전(1689)으로 이어져 영국 헌법의 기초가 되었고, 뉴잉글랜드 식민지 개척자들이 제정한 최초의 법인 매사추세츠 자유법(1641), 버지니아 권리장전(1776), 미국 독립선언문(1776), 미국 수정헌법(1789)의 근간으로 인정되며, 세계인권선언(1948), 유럽인권협약(1950)에도 큰 영향을 끼쳤다. 또한 캐나다, 오스트레일리아를 비롯한 영연방 국가와 세계 제2차 대전 후 독립한 아시아와 아프리카의 여러 국가들의 헌법도 직접 혹은 간접적으로 마그나 카르타의 영향을 받은 것으로 알려져 있다. 그 결과 마그나 카르타라는 단어는 오늘날 자유와 권리를 상징하는 용어로도 사용되고 있다. 마그나 카르타가 탄생하고 위와 같이 중요한 영향을 가지된 데에는 세명의 법률가들의 노력이 숨어 있다. 존왕 당시 영국 캔터배리 대주교이자 추기경이었던 스티븐 랭턴(Stephen Langton)은 왕과 반란 귀족들을 중재하면서 존왕 이전의 왕인 헨리1세의 헌장을 선례로 하여 마그나 카르타를 기초하고 왕과 귀족들의 동의를 얻음으로써 마그나 카르타를 탄생하게 하였다. 에드워드 코크(Edward Coke)는 절대왕정을 추구하는 스튜어트 왕가의 제임스 1세와 찰스 1세에게 대항하는 과정에서 마그나 카르타를 찾아 내고 이를 표본으로 하여 1628년 권리청원의 작성을 주도하였다. 잉글랜드법 주석서를 저술한 윌리엄 블랙스톤(William Blackstone)은 1759년 대헌장과 삼림헌장이라는 저서를 출판하였는데, 그는 이 책에서 마그나 카르타의 1215년 존왕판과 1216년 헨리3세의 첫 번째 판, 1217년 헨리3세의 두 번째 판 및 1225년의 헨리3세의 세 번째 판을 각각 비교하고 조항별로 분석하였다. 이로써 그는 마그나 카르타의 판본을 둘러싼 혼란을 정리하였다고 평가된다. Magna Carta(The Great Charter of Freedoms) is one of the most famous documents in the world. It is agreed to by King John of England at Runnymede on 15 June 1215, and drafted by the Archbishop of Canterbury Stephen Langton to make peace between the King and a group of rebel barons. It promised the protection of church rights, protection for the barons from illegal imprisonment, access to swift justice, and limitations on feudal payments to the Crown, to be implemented through a council of 25 barons. Neither side stood behind their commitments, and the charter was annulled by Pope Innocent III, leading to the First Barons' War. After John's death, the regency government of his young son, Henry III, reissued the document in 1216, stripped of some of its more radical content, in an unsuccessful bid to build political support for their cause. At the end of the war in 1217, it formed part of the peace treaty agreed at Lambeth, where the document acquired the name Magna Carta, to distinguish it from the smaller Charter of the Forest which was issued at the same time. Short of funds, Henry reissued the charter again in 1225 in exchange for a grant of new taxes. His son, Edward I, repeated the exercise in 1297, this time confirming it as part of England's statute law. In Magna Carta's 63 clauses, there are a number of fundamental values that challenged the autocracy of the king and proved highly adaptable in future centuries. Most famously, the 39th clause gave all ‘free men’ the right to justice and a fair trial. Magna Carta established for the first time the principle that everybody, including the king, was subject to the law. Although nearly a third of the text was deleted or substantially rewritten within ten years, and almost all the clauses have been repealed in modern times, Magna Carta remains a cornerstone of the British constitution with Petition of Rights(1628) and Bill of Rights(1689). Some of Magna Carta’s core principles are adopted in the Virginia Declaration of Rights(1776), the Declaration of Independence(1776), the United States Bill of Rights (1791) and in many other constitutional documents around the world, as well as in the Universal Declaration of Human Rights (1948) and the European Convention on Human Rights (1950).
